bar_n of_o the_o lord_n house_n the_o 10_o the_o instant_a that_o your_o petitioner_n be_v at_o a_o vast_a charge_n in_o keep_v his_o witness_n in_o town_n wait_v for_o a_o order_n and_o a_o day_n appoint_v according_a to_o the_o prayer_n of_o the_o say_a petition_n he_o therefore_o pray_v that_o your_o majesty_n will_v be_v gracious_o please_v to_o call_v for_o the_o say_a petition_n and_o cause_v it_o to_o be_v read_v and_o that_o a_o short_a day_n may_v be_v appoint_v that_o a_o fair_a hear_v may_v be_v have_v to_o find_v out_o the_o truth_n and_o that_o justice_n may_v be_v do_v according_o and_o let_v it_o not_o be_v say_v in_o england_n that_o the_o innocent_a be_v punish_v and_o the_o guilty_a go_v free_a but_o call_v to_o mind_v how_o merciful_a god_n have_v be_v in_o restr_v your_o majesty_n even_o so_o in_o pity_n restore_v your_o poor_a distress_a subject_n and_o he_o shall_v ever_o pray_v etc._n etc._n james_n percy_z this_o petition_n be_v present_v into_o his_o majesty_n sacred_a hand_n the_o 15_o the_o of_o december_n 1680._o to_o lose_v such_o a_o opportunity_n as_o offer_v on_o thursday_n last_o and_o now_o to_o trouble_v so_o good_a a_o king_n so_o oft_o double_v your_o petitioner_n sorrow_n and_o that_o which_o add_v to_o your_o petitioner_n misery_n be_v that_o he_o can_v dispose_v of_o his_o witness_n till_o a_o positive_a order_n be_v have_v for_o which_o he_o humble_o pray_v note_v these_o three_o follow_a precedent_n 1._o the_o lord_n of_o newport_n beg_v the_o percy_n land_n of_o the_o king_n for_o the_o duke_n of_o monmouth_n when_o the_o duke_n be_v in_o france_n but_o at_o the_o duke_n return_n percy_n the_o claimant_n wait_v upon_o the_o duke_n to_o know_v his_o pleasure_n and_o tell_v he_o that_o my_o solicitor_n have_v betray_v i_o for_o the_o percy_n land_n be_v beg_v without_o the_o claimant_n consent_n or_o knowledge_n then_o the_o duke_n reply_v mr._n percy_n you_o shall_v have_v a_o fair_a trial_n at_o law_n and_o moreover_o he_o do_v promise_v he_o will_v not_o stand_v upon_o privilege_n but_o when_o percy_n be_v ready_a for_o a_o trial_n then_o trumpt_v up_o privilege_n and_o mr._n ross_n the_o duke_n agent_n say_v the_o duke_n can_v not_o set_v aside_o his_o privilege_n but_o the_o duke_n say_v if_o percy_n prove_v himself_o heir_n i_o have_v no_o right_n and_o forthwith_o sell_v his_o interest_n for_o a_o inconsiderable_a sum_n of_o money_n 2._o the_o lord_n ogle_n that_o marry_v the_o lady_n elizabeth_n percy_n will_v have_v assume_v the_o name_n of_o percy_n and_o put_v in_o a_o bill_n to_o be_v make_v a_o act_n to_o settle_v the_o land_n upon_o he_o by_o act_n of_o parliament_n 3._o and_o it_o be_v report_v that_o the_o lord_n of_o essex_n desire_v that_o some_o of_o those_o land_n may_v be_v settle_v upon_o he_o by_o act_n of_o parliament_n by_o this_o account_n the_o land_n be_v yet_o unsettled_a ergo_fw-la then_o great_a reason_n it_o be_v that_o the_o true_a heir-male_a of_o the_o percy_n bill_n shall_v be_v make_v a_o act_n of_o parliament_n to_o settle_v the_o name_n title_n and_o estate_n together_o again_o according_a to_o the_o first_o settlement_n confirm_v by_o his_o ancestor_n now_o your_o poor_a distress_a and_o oppress_a petitioner_n humble_o and_o free_o offer_v for_o the_o obtain_n of_o justice_n and_o for_o the_o full_a satisfaction_n to_o the_o king_n most_o excellent_a majesty_n and_o the_o right_n honourable_a lord_n spiritual_a and_o temporal_a and_o those_o honourable_a and_o worthy_a member_n of_o the_o house_n of_o commons_o in_o parliament_n assemble_v if_o it_o be_v require_v and_o think_v convenient_a he_o be_v very_o unwilling_a to_o offer_v any_o thing_n that_o may_v give_v the_o least_o offence_n but_o rather_o submit_v to_o their_o grave_n and_o mature_a wisdom_n these_o proposal_n follow_v james_n percy_n the_o claimant_n and_o plaintiff_n will_v pay_v into_o the_o hand_n of_o any_o trustee_n that_o shall_v be_v appoint_v to_o receive_v the_o money_n in_o trust_n for_o mr._n john_n blakeston_n cost_v provide_v he_o likewise_o lie_v down_o the_o 90_o l._n take_v by_o surprise_n out_o of_o court_n before_o the_o trial_n be_v end_v and_o mr._n vtting_n cost_n likewise_o shall_v be_v pay_v for_o what_o sir_n john_n coppleston_n claim_v provide_v likewise_o that_o sir_n john_n coppleston_n pay_v the_o 10_o l._n down_o which_o he_o get_v when_o he_o venture_v the_o breach_n of_o privilege_n of_o parliament_n provide_v the_o whole_a merit_n of_o the_o cause_n may_v have_v a_o fair_a hearing_n and_o determination_n before_o the_o lord_n and_o if_o the_o plaintiff_n and_o claimant_n james_n percy_n do_v not_o prove_v himself_o to_o be_v the_o right_n true_a and_o next_o heir-male_a in_o blond_n of_o the_o percy_n of_o northumberland_n then_o let_v they_o take_v all_o the_o money_n and_o the_o plaintiff_n will_v free_o acquit_v his_o claim_n for_o ever_o and_o remain_v till_o death_n a_o loyal_a subject_n and_o james_n percy_n although_o his_o witness_n be_v disperse_v a_o week_n time_n will_v bring_v they_o to_o town_n again_o upon_o the_o sight_n of_o a_o order_n for_o the_o claimant_n james_n percy_n by_o birth_n ought_v to_o enjoy_v the_o place_n seat_n and_o privilege_n of_o his_o ancestor_n earl_n of_o northumberland_n but_o now_o he_o dare_v not_o appear_v till_o a_o order_n be_v have_v therefore_o he_o most_o humble_o pray_v that_o a_o fair_a hear_v may_v be_v have_v and_o that_o a_o true_a decision_n of_o his_o just_a cause_n and_o claim_n may_v be_v make_v according_a to_o justice_n so_o that_o the_o innocent_a may_v be_v preserve_v and_o that_o the_o fraudulent_a practice_n not_o just_a may_v march_v off_o with_o shame_n for_o heroic_a action_n glorify_v god_n honour_n the_o king_n
