appoint_v she_o 300_o l._n per_fw-la annnm_fw-la out_o of_o her_o father_n estate_n until_o further_a order_n and_o the_o say_a defendant_n be_v daily_o arrest_v and_o trouble_v for_o the_o say_a unto_o your_o honour_n by_o the_o counsel_n of_o the_o plaintiff_n and_o mr._n zanchie_n her_o solicitor_n not_o enter_v into_o the_o register_n book_n or_o draw_v up_o by_o he_o from_o any_o note_n take_v in_o court_n or_o be_v ever_o peruse_v by_o the_o defendant_n counsel_n before_o it_o be_v sign_v according_a to_o the_o rule_n of_o the_o court_n in_o which_o order_n it_o be_v mention_v and_o become_v very_o weak_a and_o for_o peril_n of_o receive_v from_o he_o disease_n of_o dangerous_a conseqnence_n she_o can_v cohabit_v with_o he_o

natural_o intend_v relief_n where_o the_o husband_n do_v repudiate_v and_o not_o the_o wife_n the_o word_n be_v upon_o consideration_n aswell_o of_o the_o portion_n or_o estate_n that_o have_v be_v pay_v or_o come_v to_o the_o husband_n by_o such_o wife_n as_o shall_v pray_v relief_n and_o therefore_o in_o this_o particular_a case_n it_o may_v be_v very_o just_o insist_v even_o from_o the_o sense_n and_o letter_n of_o the_o act_n as_o also_o that_o it_o be_v mrs._n ivy_n separate_v herself_o from_o her_o husband_n it_o be_v not_o her_o husband_n leave_v she_o nay_o after_o she_o be_v go_v he_o use_v all_o affectionate_a and_o prudential_a mean_n to_o bring_v she_o home_o to_o cohabit_v with_o he_o neither_o do_v he_o desist_v in_o the_o prosecution_n of_o it_o but_o have_v several_a way_n attempt_v it_o even_o until_o this_o day_n and_o do_v still_o declare_v and_o protest_v his_o willingness_n to_o receive_v she_o whensoever_o she_o will_v return_v and_o give_v gentleman_n under_o feign_a name_n her_o frequent_v and_o meet_v they_o in_o scandalous_a house_n in_o long-acre_n and_o other_o place_n at_o unseasonable_a time_n of_o the_o night_n under_o the_o pretence_n of_o withdraw_v from_o her_o husbaud_n be_v a_o bed_n to_o her_o devotion_n those_o horrrid_a and_o detestable_a plot_n upon_o jane_n gilbert_n even_o to_o the_o lose_n of_o her_o life_n her_o charge_v her_o husband_n with_o foul_a disease_n of_o which_o he_o be_v clear_v upon_o oath_n by_o the_o precedent_n of_o the_o college_n and_o other_o learned_a physician_n and_o also_o her_o contrivancy_n and_o solicitation_n to_o her_o brother_n john_n stepkins_n to_o murder_v her_o husband_n which_o appear_v by_o the_o oath_n of_o the_o say_a stepkin_n moreover_o see_v that_o there_o be_v a_o caution_n in_o the_o act_n that_o the_o allowance_n to_o the_o repudiate_a wife_n ought_v to_o be_v proportionable_a to_o the_o fortune_n she_o bring_v her_o husband_n may_v it_o therefore_o please_v your_o honour_n to_o understand_v 1._o that_o he_o never_o receive_v any_o penny_n portion_n as_o yet_o and_o have_v great_a reason_n to_o doubt_v whether_o ever_o he_o shall_v 2._o because_o the_o estate_n of_o her_o father_n be_v at_o present_a in_o the_o aforesaid_a trustee_n and_o not_o in_o the_o defendant_n nay_o it_o be_v so_o settle_v on_o they_o that_o unless_o i_o can_v raise_v and_o secure_v 4000_o l._n more_o beside_o 7000_o l._n already_o lay_v out_o they_o be_v not_o obligh_v neither_o will_v they_o nor_o can_v they_o convey_v it_o to_o the_o defendant_n as_o appear_v by_o the_o indenture_n of_o settlement_n 3._o in_o case_n they_o shall_v convey_v and_o settle_v on_o the_o defendant_n the_o say_a estate_n it_o be_v only_o for_o his_o life_n and_o no_o long_o for_o which_o estate_n be_v only_o 240_o l._n per_fw-la annum_fw-la he_o have_v disburse_v and_o lay_v out_o far_o more_o money_n than_o it_o be_v worth_a this_o appear_v from_o the_o indenture_n viz._n a_o 1000_o l._n to_o mr._n stepkin_n in_o ready_a money_n to_o free_v the_o estate_n from_o encumbrance_n three_o year_n since_o the_o interest_n whereof_o come_v to_o 200_o l._n in_o jewel_n pearl_n ambergreeze_v bezoar_n etc._n etc._n to_o the_o value_n of_o 1200_o l._n there_o be_v also_o spend_v in_o law_n to_o enforce_v the_o trustee_n who_o be_v keep_v back_o and_o hinder_v by_o mr._n stepkin_n her_o father_n to_o settle_v the_o estate_n according_a to_o the_o covenant_n and_o for_o the_o fine_a and_o recovery_n 200_o l._n more_o at_o least_o which_o make_v 2600_o l._n that_o notwithstanding_o all_o the_o aforesaid_a sum_n of_o money_n have_v be_v lay_v out_o by_o the_o defendant_n the_o trustee_n do_v still_o refuse_v to_o convey_v the_o estate_n to_o the_o defendant_n and_o the_o plaintiff_n brother_n as_o heir_n at_o law_n have_v since_o the_o death_n of_o his_o father_n get_v the_o possession_n of_o the_o estate_n and_o receive_v the_o rent_n issue_n and_o profit_n thereof_o insomuch_o that_o the_o defendant_n have_v be_v necessitate_v to_o expend_v great_a sum_n of_o money_n to_o maintain_v several_a suit_n at_o law_n both_o against_o the_o trustee_n and_o waste_v of_o his_o estate_n 4000_o l._n viz_o 3000_o l._n since_o marriage_n spend_v on_o she_o 500_o l._n give_v in_o money_n 100_o l._n give_v to_o gentleman_n of_o her_o familiar_a acquaintance_n to_o persuade_v she_o to_o go_v into_o the_o country_n 300_o l._n take_v in_o silk_n and_o plate_n from_o the_o defendant_n whilst_o that_o he_o be_v at_o the_o court_n of_o alderman_n he_o have_v also_o contract_v several_a great_a debt_n to_o the_o value_n of_o 3000_o l._n beside_o 1000_o l._n spend_v in_o this_o unhappy_a suit_n and_o must_v therefore_o necessary_o in_o case_n 3000_o l._n per_fw-la annum_fw-la be_v take_v from_o he_o be_v cast_v into_o prison_n the_o most_o part_n of_o his_o life_n he_o have_v but_o 632_o l._n per_fw-la annum_fw-la of_o his_o own_o estate_n and_o that_o for_o his_o life_n only_o both_o to_o pay_v all_o his_o debt_n aforesaid_a and_o to_o live_v on_o beside_o except_v the_o 240_o l._n per_fw-la annum_fw-la which_o if_o it_o be_v recover_v from_o the_o heir_n of_o stepkins_n and_o recover_v by_o the_o trustee_n all_o which_o will_v yield_v but_o a_o scant_a and_o bare_a maintenance_n for_o himself_o wife_n and_o family_n to_o raise_v out_o of_o it_o 3000_o l._n for_o the_o creditor_n and_o 4000_o l._n more_o according_a to_o the_o indenture_n of_o settlement_n unless_o the_o defendant_n be_v acquit_v and_o discharge_v of_o the_o say_a 4000_o l._n by_o the_o last_o will_n and_o testament_n of_o the_o plaintiff_n father_n in_o who_o the_o remainder_n of_o the_o estate_n be_v in_o case_n the_o defendant_n shall_v have_v no_o issue_n or_o not_o perform_v the_o covenant_n which_o he_o stand_v oblige_v to_o perform_v in_o the_o say_a deed_n and_o though_o the_o defendant_n be_v credible_o inform_v that_o the_o say_a ivy_n have_v be_v guilty_a of_o the_o complaint_n contrary_a to_o the_o act_n of_o parliament_n have_v thus_o affliction_n add_v to_o affliction_n and_o be_v in_o debt_n by_o the_o mean_n of_o his_o say_a wife_n above_o 3000_o l._n and_o have_v not_o wherewithal_o to_o sell_v to_o pay_v his_o creditor_n and_o in_o regard_n the_o reversion_n of_o his_o estate_n be_v settle_v on_o his_o say_a wife_n he_o attend_v almost_o a_o year_n upon_o the_o lord_n commissioner_n for_o his_o relief_n that_o they_o will_v be_v please_v but_o to_o grant_v he_o a_o fair_a hear_n upon_o the_o merit_n of_o the_o cause_n in_o presence_n of_o both_o party_n with_o their_o counsel_n which_o be_v by_o their_o order_n according_o grant_v and_o a_o day_n by_o they_o appoint_v but_o when_o the_o day_n come_v and_o mr._n ivy_n have_v retain_v to_o his_o great_a charge_n many_o great_a counsel_n the_o lord_n commissioner_n absolute_o refuse_v to_o hear_v the_o say_a cause_n which_o have_v expose_v the_o say_a mr._n ivy_n and_o his_o wife_n to_o all_o manner_n of_o temptation_n and_o their_o person_n and_o estate_n to_o utter_a ruin_n and_o although_o at_o the_o same_o time_n mr._n ivy_n do_v request_n the_o say_a lord_n commissioner_n to_o recommend_v any_o godly_a minister_n who_o they_o themselves_o shall_v choose_v to_o live_v in_o house_n with_o he_o and_o his_o wife_n as_o a_o expedient_a to_o a_o peace_n and_o reconciliation_n between_o they_o for_o which_o he_o oblige_v himself_o to_o allow_v any_o such_o minister_n 50_o l._n per_fw-la annum_fw-la beside_o all_o other_o
