be_v please_v to_o answer_v the_o instance_n of_o one_o of_o his_o lordship_n council_n that_o if_o a_o great_a minister_n shall_v be_v commit_v he_o have_v the_o cure_n of_o a_o pardon_n a_o prorogation_n or_o a_o dissolution_n but_o say_v the_o earl_n if_o the_o case_n shall_v be_v put_v why_o forty_o member_n or_o a_o great_a number_n may_v not_o as_o well_o be_v take_v without_o any_o remedy_n of_o any_o of_o the_o king_n court_n his_o lordship_n say_v that_o mr._n attorney-could_a not_o very_o easy_o answer_v and_o if_o in_o this_o case_n say_v he_o there_o can_v be_v no_o relief_n no_o man_n can_v foresee_v what_o may_v be_v hereafter_o and_o in_o another_o place_n of_o the_o same_o speech_n he_o say_v he_o do_v not_o think_v it_o a_o kindness_n to_o the_o lord_n to_o take_v these_o man_n who_o he_o have_v name_v for_o no_o small_a authority_n in_o this_o age_n and_o the_o earl_n of_o shaftsbury_n he_o say_v be_v a_o man_n still_o as_o much_o for_o the_o maintain_n of_o this_o order_n as_o ever_o but_o that_o his_o lordship_n do_v show_v himself_o at_o the_o same_o time_n to_o be_v for_o english_a liberty_n and_o he_o plain_o show_v his_o own_o sense_n both_o of_o this_o and_o of_o all_o order_n whatever_o which_o concern_v the_o liberty_n of_o the_o subject_a and_o declare_v that_o he_o take_v that_o court_n to_o be_v the_o proper_a judge_n of_o all_o such_o order_n he_o say_v it_o thereby_o appear_v how_o sensible_a that_o lord_n be_v that_o such_o case_n may_v concern_v forty_o as_o well_o as_o one_o and_o member_n of_o either_o house_n as_o well_o as_o other_o man_n and_o without_o relief_n if_o it_o shall_v be_v admit_v that_o ordinart_n court_n can_v not_o relieve_v and_o the_o earl_n of_o danby_n say_v that_o there_o be_v no_o answer_v of_o these_o argument_n of_o the_o earl_n of_o shaftsbury_n unless_o it_o can_v be_v deny_v that_o the_o king_n can_v impeach_v as_o well_o as_o the_o commons_o or_o that_o the_o king_n can_v construe_v to_o extend_v to_o indefinite_a imprisonment_n he_o then_o repeat_v sir_n william_n jones_n his_o declaration_n in_o that_o court_n that_o either_o a_o pardon_n a_o prorogation_n or_o a_o dissolution_n be_v a_o cure_n against_o such_o imprisonment_n and_o he_o observe_v thereupon_o that_o if_o that_o doctrine_n be_v true_a that_o any_o one_o of_o those_o be_v a_o cure_n against_o such_o imprisonment_n and_o he_o can_v not_o doubt_v of_o its_o be_v good_a law_n then_o certain_o he_o ought_v to_o find_v relief_n from_o his_o imprisonment_n who_o have_v every_o one_o of_o those_o cure_n on_o his_o side_n he_o then_o desire_v to_o put_v the_o court_n in_o mind_n how_o in_o the_o worst_a of_o time_n justice_n have_v take_v place_n so_o far_o as_o to_o lay_v aside_o the_o force_n of_o order_n make_v in_o parliament_n after_o the_o dissolution_n of_o those_o parliament_n which_o make_v they_o although_o it_o be_v to_o the_o prejudice_n of_o the_o interest_n of_o those_o precarious_a than_o it_o be_v in_o those_o day_n he_o add_v that_o if_o upon_o such_o order_n man_n can_v not_o be_v bail_v in_o the_o interval_n of_o parliament_n they_o will_v become_v grievance_n equal_a to_o the_o multiplication_n of_o treason_n in_o former_a day_n which_o have_v some_o time_n be_v greedy_o make_v heretofore_o by_o parliament_n in_o distemper_a time_n but_o the_o commons_o have_v never_o be_v quiet_a till_o they_o can_v get_v their_o bear_n chain_v up_o and_o their_o law_n reduce_v to_o the_o old_a standard_n of_o treason_n again_o but_o yet_o those_o thing_n have_v betwixt_o the_o king_n and_o his_o parliament_n in_o which_o so_o much_o blood_n have_v be_v shed_v that_o a_o ordinance_n of_o parliament_n shall_v not_o be_v hold_v equal_a to_o a_o act_n of_o parliament_n and_o yet_o those_o be_v order_n of_o both_o house_n and_o now_o say_v he_o shall_v we_o be_v defend_v that_o a_o order_n of_o one_o house_n only_o shall_v be_v equivalent_a to_o a_o law_n and_o shall_v be_v in_o force_n against_o our_o great_a and_o most_o sacred_a law_n of_o liberty_n which_o have_v be_v so_o confirm_v to_o we_o this_o say_v he_o i_o be_o not_o able_a to_o understand_v the_o reason_n of_o nor_o will_v any_o man_n who_o shall_v give_v himself_o the_o least_o leisure_n to_o think_v upon_o it_o he_o then_o say_v he_o desire_v to_o ask_v any_o man_n that_o in_o the_o exchequer_n and_o recognizance_n enter_v into_o by_o the_o say_a fountain_n to_o abide_v the_o order_n of_o the_o house_n of_o lord_n and_o after_o the_o parliament_n be_v dissolve_v the_o council_n of_o the_o say_a fountain_n do_v insist_v on_o the_o say_a order_n before_o the_o baron_n that_o the_o house_n be_v possess_v of_o mr._n fountain_n cause_n and_o security_n have_v be_v give_v by_o he_o to_o abide_v the_o order_n of_o the_o house_n that_o no_o proceed_n ought_v to_o be_v have_v in_o the_o exchequer_n upon_o the_o say_a decree_n until_o the_o matter_n on_o the_o those_o act_n of_o the_o inferior_a court_n do_v so_o hinder_v the_o proceed_n of_o the_o superior_a but_o that_o the_o plaintiff_n in_o parliament_n may_v revive_v the_o same_o matter_n there_o again_o by_o scire_fw-la facias_fw-la or_o by_o re-summons_n etc._n etc._n but_o he_o say_v it_o be_v never_o hear_v of_o that_o the_o lord_n themselves_o do_v proceed_v again_o exit_fw-la exit_fw-la officio_fw-la upon_o that_o neither_o unless_o they_o be_v call_v upon_o by_o the_o prosecutor_n and_o then_o their_o lordship_n proceed_n upon_o the_o impeachment_n will_v be_v no_o more_o hinder_v by_o the_o bail_n of_o he_o in_o the_o inferior_a court_n than_o they_o be_v in_o the_o other_o case_n by_o the_o execution_n and_o sequestration_n which_o be_v grant_v in_o the_o interval_n of_o parliament_n which_o be_v for_o the_o the_o prevention_n both_o of_o delay_n and_o of_o failure_n of_o justice_n beside_o he_o say_v if_o this_o shall_v not_o be_v do_v how_o can_v it_o be_v know_v whether_o the_o prosecutor_n of_o a_o impeachment_n from_o the_o house_n of_o commons_o who_o be_v never_o the_o same_o man_n in_o a_o new_a parliament_n will_v proceed_v any_o more_o upon_o a_o former_a impeachment_n for_o he_o say_v it_o have_v many_o time_n fall_v out_o otherwise_o and_o he_o cite_v a_o late_a case_n of_o the_o lord_n mordant_n who_o be_v impeach_v upon_o article_n in_o one_o session_n and_o have_v take_v out_o a_o pardon_n during_o the_o prorogation_n be_v never_o more_o call_v upon_o nor_o never_o question_v upon_o the_o former_a impeachment_n although_o the_o very_a same_o parliament_n sit_v again_o which_o have_v impeach_v he_o and_o therefore_o he_o say_v that_o the_o case_n may_v more_o probable_o happen_v to_o fall_v out_o so_o when_o a_o new_a parliament_n shall_v meet_v again_o which_o will_v consist_v of_o new_a men._n he_o say_v it_o be_v likewise_o to_o be_v observe_v that_o although_o the_o transcript_n of_o the_o record_n in_o a_o writ_n of_o error_n may_v have_v day_n of_o continuance_n yet_o no_o supersedeas_fw-la be_v grantable_a and_o he_o say_v that_o if_o the_o lord_n order_v be_v no_o ground_n for_o a_o supersedeas_fw-la on_o a_o writ_n of_o error_n why_o the_o lie_a of_o a_o impeachment_n shall_v be_v a_o ground_n for_o confine_v a_o man_n within_o four_o wall_n all_o his_o life_n he_o be_v sure_o must_v be_v both_o less_o reasonable_a and_o less_o just_a as_o liberty_n be_v more_o valluable_a than_o property_n and_o without_o which_o property_n can_v be_v of_o no_o comfort_n in_o the_o next_o place_n he_o observe_v that_o if_o the_o order_n shall_v be_v continue_v literal_o to_o mean_v that_o the_o impeachment_n as_o well_o as_o the_o appeal_v and_o writ_n of_o error_n and_o the_o incident_n relate_v to_o all_o of_o they_o shall_v remain_v in_o the_o same_o state_n they_o be_v at_o the_o dissolution_n of_o that_o parliament_n mention_v in_o the_o say_a order_n his_o case_n thereupon_o he_o say_v will_v be_v quite_o different_a from_o any_o other_o for_o that_o he_o be_v not_o under_o any_o commitment_n at_o the_o dissolution_n of_o that_o parliament_n nor_o at_o the_o time_n when_o that_o order_n be_v make_v but_o be_v then_o at_o liberty_n to_o be_v a_o sit_v member_n of_o that_o house_n and_o by_o a_o vote_n of_o the_o house_n have_v leave_v to_o continue_v so_o for_o that_o as_o he_o have_v already_o observe_v the_o date_n of_o the_o order_n be_v the_o 19_o of_o march_n 1678._o and_o the_o warrant_n of_o his_o commitment_n do_v appear_v by_o the_o return_n before_o the_o court_n to_o be_v the_o 16_o of_o april_n follow_v insomuch_o that_o he_o desire_v the_o court_n to_o take_v notice_n that_o the_o strict_a letter_n of_o the_o word_n statu_fw-la quo_fw-la in_o the_o statv_n qvo_fw-la so_o that_o as_o it_o already_o observe_v the_o status_n qvo_n as_o to_o he_o he_o again_o say_v be_v to_o put_v he_o into_o a_o state_n of_o liberty_n last_o he_o say_v that_o he_o have_v no_o prospect_n now_o when_o any_o parliament_n will_v sit_v and_o by_o the_o example_n of_o past_a parliament_n he_o may_v reasonable_o fear_v whether_o when_o they_o do_v meet_v they_o may_v sit_v so_o long_o as_o to_o give_v he_o relief_n for_o that_o his_o petition_n have_v be_v read_v the_o first_o day_n that_o the_o last_o parliament_n enter_v upon_o any_o public_a business_n or_o whether_o great_a business_n of_o the_o kingdom_n may_v not_o as_o it_o have_v do_v already_o so_o take_v up_o their_o time_n as_o not_o to_o give_v they_o leisure_n to_o consider_v the_o case_n of_o a_o single_a person_n and_o since_o this_o have_v already_o fall_v out_o to_o be_v his_o misfortune_n in_o three_o parliament_n successive_o he_o take_v it_o to_o be_v but_o too_o plain_a a_o demonstration_n of_o his_o lie_v under_o a_o indefinite_a imprisonment_n unless_o he_o shall_v find_v relief_n in_o that_o court_n for_o that_o there_o be_v no_o other_o to_o appeal_v unto_o he_o say_v that_o in_o those_o great_a and_o eminent_a case_n which_o fall_v out_o 3_o &_o 5_o car._n about_o the_o bayl_n of_o person_n commit_v to_o indefinite_a imprisonment_n the_o judge_n be_v then_o very_o positive_a against_o their_o bail_n and_o yet_o change_v those_o opinion_n afterward_o and_o so_o he_o hope_v that_o court_n may_v do_v upon_o a_o due_a consideration_n of_o his_o case_n and_o circumstance_n or_o else_o he_o hope_v that_o his_o lordship_n will_v convince_v he_o that_o his_o imprisonment_n be_v not_o indefinite_a by_o let_v he_o know_v at_o what_o prefix_a time_n and_o where_o he_o may_v resort_v for_o remedy_n which_o the_o law_n do_v without_o question_n allow_v to_o all_o man_n and_o at_o all_o time_n he_o say_v he_o be_v a_o very_a reasonable_a man_n and_o when_o he_o be_v convince_v by_o reason_n upon_o which_o he_o be_v sure_o all_o law_n be_v found_v he_o can_v be_v content_a to_o suffer_v still_o though_o his_o imprisonment_n have_v be_v so_o long_o already_o for_o that_o however_o he_o may_v have_v be_v misrepresent_v for_o a_o arbitrary_a man_n he_o will_v rather_o perish_v in_o his_o prison_n than_o have_v any_o thing_n do_v for_o he_o which_o say_v in_o the_o behalf_n of_o all_o english_a man_n liberty_n as_o well_o as_o of_o his_o own_o case_n that_o it_o be_v a_o case_n which_o do_v concern_v every_o man_n to_o take_v care_n of_o in_o the_o consequence_n of_o it_o and_o which_o do_v cry_v loud_o for_o relief_n he_o then_o tell_v the_o court_n that_o he_o have_v trouble_v they_o long_o but_o that_o he_o hope_v it_o will_v be_v excuse_v in_o a_o case_n of_o that_o moment_n and_o in_o the_o first_o place_n he_o say_v he_o hope_v it_o be_v plain_a that_o that_o court_n have_v it_o in_o their_o power_n to_o grant_v he_o relief_n if_o they_o please_v that_o it_o be_v as_o plain_a that_o there_o be_v nothing_o in_o the_o lord_n order_n against_o it_o and_o that_o the_o practice_n of_o the_o lord_n have_v be_v otherways_o even_o in_o the_o behalf_n of_o commoner_n that_o it_o be_v apparent_a that_o both_o that_o court_n and_o the_o court_n of_o chancery_n and_o exchequer_n do_v relieve_v upon_o appeal_n and_o writ_n of_o error_n which_o be_v in_o the_o same_o order_n with_o the_o impeachment_n and_o yet_o do_v in_o no_o sort_n meddle_v with_o the_o judicature_n or_o proceed_n of_o the_o house_n of_o lord_n that_o it_o be_v manifest_a that_o let_v the_o order_n be_v construe_v as_o any_o man_n please_v yet_o that_o bail_a can_v be_v no_o sort_n of_o judge_v of_o any_o proceed_n in_o the_o superior_a court_n but_o will_v leave_v the_o judgement_n entire_o to_o the_o parliament_n and_o will_v continue_v he_o a_o prisoner_n in_o law_n bind_v to_o appear_v before_o that_o extraordinary_a court_n whenever_o his_o majesty_n shall_v be_v please_v to_o call_v it_o and_o he_o say_v it_o be_v more_o evident_a that_o otherwise_o he_o be_v a_o indefinite_a prisoner_n and_o at_o the_o king_n will_n only_o for_o his_o liberty_n the_o consequence_n of_o which_o every_o man_n ought_v to_o lay_v to_o his_o heart_n with_o a_o dread_n of_o it_o whenever_o they_o shall_v live_v under_o a_o of_o man_n under_o long_a imprisonment_n ought_v either_o to_o have_v express_a law_n for_o it_o or_o a_o good_a number_n of_o precedent_n and_o in_o good_a time_n to_o justify_v it_o and_o not_o any_o single_a instance_n or_o two_o if_o they_o can_v be_v produce_v which_o he_o think_v they_o can_v not_o and_o he_o hope_v that_o precedent_n which_o he_o have_v already_o mention_v on_o his_o majesty_n behalf_n will_v be_v very_o well_o consider_v which_o be_v how_o the_o king_n court_n shall_v keep_v the_o king_n prisoner_n and_o at_o the_o king_n suit_n in_o the_o king_n prison_n with_o the_o king_n pardon_n and_o against_o the_o king_n will_n twice_o declare_v in_o that_o court_n by_o his_o attorney_n general_n he_o say_v he_o shall_v conclude_v with_o let_v his_o lordship_n know_v that_o as_o the_o king_n himself_o have_v sufficient_o declare_v that_o there_o be_v no_o danger_n in_o the_o let_v he_o have_v his_o liberty_n so_o he_o have_v such_o bail_n to_o offer_v to_o his_o lordship_n as_o will_v sufficient_o satisfy_v the_o world_n that_o he_o shall_v be_v forthcoming_a to_o answer_v when_o and_o where_o that_o court_n shall_v appoint_v and_o then_o he_o hope_v the_o
