to_o the_o honourable_a the_o commons_o in_o parliament_n assemble_v the_o humble_a petition_n and_o remonstrance_n of_o edmond_n rolph_n prisoner_n in_o the_o gatehouse_n westminster_n show_v that_o in_o judgement_n and_o conscience_n he_o have_v adventure_v his_o life_n for_o the_o preservation_n of_o the_o honour_n and_o just_a power_n of_o parliament_n with_o the_o freedom_n liberty_n and_o property_n of_o the_o freeborn_a people_n of_o this_o nation_n that_o as_o heretofore_o so_o at_o present_a all_o the_o endeavour_n of_o wicked_a and_o malicious_a man_n be_v bend_v and_o employ_v to_o wound_n and_o destroy_v both_o the_o parliament_n honour_n and_o the_o people_n liberty_n by_o subtle_a designment_n and_o scandalous_a aspersion_n thereby_o to_o render_v both_o the_o parliament_n army_n and_o all_o godly_a people_n adhere_v to_o they_o odious_a in_o the_o eye_n of_o the_o nation_n that_o in_o order_n to_o the_o end_n aforesaid_a one_o osbourn_n and_o dowcet_n have_v late_o make_v a_o false_a and_o scandalous_a suggestion_n bruit_n it_o abroad_o that_o there_o be_v a_o design_n to_o poison_v the_o king_n and_o because_o it_o be_v necessary_a that_o they_o shall_v father_n the_o design_n upon_o some_o body_n they_o have_v lay_v it_o upon_o the_o whole_a army_n in_o general_a and_o upon_o your_o petitioner_n in_o particular_a use_v all_o mean_n by_o colour_n of_o the_o say_a suggestion_n to_o exasperate_v the_o people_n to_o resist_v the_o authority_n of_o parliament_n and_o to_o weaken_v their_o power_n by_o the_o destruction_n of_o that_o army_n which_o by_o the_o blessing_n of_o god_n have_v be_v your_o protection_n to_o this_o day_n maugre_o the_o malice_n of_o your_o adversary_n that_o by_o mean_n of_o the_o say_a suggestion_n your_o petitioner_n have_v be_v by_o a_o party_n of_o the_o lord_n imprison_v and_o sentence_v contrary_a to_o law_n without_o hear_v yea_o without_o legal_a crime_n or_o legal_a accuser_n have_v not_o only_o his_o life_n end_v anger_v by_o his_o cruel_a usage_n in_o the_o time_n of_o his_o bodily_a distemper_n but_o also_o his_o name_n and_o credit_v destroy_v by_o have_v that_o scandalous_a imputation_n of_o a_o traitor_n cast_v upon_o he_o that_o this_o house_n have_v declare_v it_o to_o be_v a_o heinous_a crime_n against_o the_o law_n of_o nature_n against_o the_o rule_n of_o justice_n that_o innocent_a man_n shall_v be_v charge_v with_o so_o high_a a_o offence_n as_o treason_n in_o the_o face_n of_o the_o high_a judicatory_n of_o the_o kingdom_n without_o witness_n without_o evidence_n without_o all_o possibility_n of_o legal_a reparation_n 1_o part_n book_n decl._n pag._n 201._o that_o by_o the_o law_n of_o the_o kingdom_n no_o person_n ought_v to_o be_v imprison_v indict_v arraign_v or_o condemn_v for_o any_o treason_n or_o treason_n without_o the_o testimony_n of_o two_o lawful_a accuser_n as_o appear_v by_o the_o statute_n of_o 5_o and_o 6_o of_o edw._n 6._o chap._n 11._o as_o be_v large_o prove_v at_o the_o open_a bar_n at_o the_o assize_n and_o general_a goal-delivery_n hold_v at_o winchester_n for_o the_o county_n of_o southampton_n by_o mr_n maynard_n counsellor_n at_o law_n and_o a_o member_n of_o this_o honourable_a house_n that_o contrary_a to_o this_o and_o many_o other_o good_a law_n provide_v against_o this_o evil_n your_o petitioner_n have_v not_o only_o be_v detain_v in_o prison_n without_o any_o legal_a warrant_n but_o have_v also_o be_v indict_v contrary_a to_o law_n the_o say_a indictment_n be_v draw_v up_o here_o by_o the_o king_n council_n and_o by_o the_o say_a lord_n transmit_v to_o be_v find_v at_o winchester_n by_o the_o grand-jury_n and_o yet_o your_o petitioner_n keep_v prisoner_n in_o the_o gatehouse_n that_o in_o order_n thereunto_o osbourn_n and_o dowcet_n be_v by_o the_o lord_n send_v to_o winchester_n to_o give_v evidence_n to_o the_o grand-jury_n upon_o the_o say_a indictment_n which_o they_o according_o do_v on_o the_o 28_o of_o august_n 1648._o that_o notwithstanding_o the_o say_a indictment_n do_v consist_v of_o four_o several_a head_n of_o treason_n wherein_o the_o whole_a army_n as_o well_o as_o your_o petitioner_n be_v accuse_v yet_o the_o say_a osbourn_n and_o dowcet_n give_v nothing_o material_a in_o evidence_n whereon_o a_o indictment_n can_v be_v ground_v so_o that_o upon_o the_o examination_n of_o the_o whole_a matter_n the_o grand_a jury_n return_v a_o ignoramus_n upon_o the_o say_a bill_n of_o indictment_n as_o by_o a_o certificate_n from_o the_o clerk_n of_o the_o assize_n more_o plain_o appear_v that_o your_o petitioner_n notwithstanding_o he_o be_v clear_a in_o the_o eye_n of_o the_o law_n and_o in_o the_o conscience_n of_o all_o honest_a man_n yet_o he_o be_v still_o a_o prisoner_n to_o the_o will_n of_o the_o lord_n and_o leave_v without_o a_o possibility_n of_o legal_a reparation_n both_o for_o his_o illegal_a imprisonment_n beside_o his_o great_a charge_n and_o damage_n in_o his_o estate_n and_o credit_n sustain_v be_v leave_v without_o all_o possibility_n of_o vindication_n or_o reparation_n unless_o this_o honourable_a house_n be_v please_v as_o in_o like_o case_n heretofore_o to_o take_v he_o into_o consideration_n and_o as_o a_o manifestation_n of_o their_o just_a sense_n of_o their_o own_o and_o the_o army_n honour_n and_o your_o petitioner_n unparalleled_a suffering_n find_v some_o expedient_a both_o for_o the_o enlargement_n vindication_n and_o reparation_n of_o your_o petitioner_n the_o judge_n be_v both_o corrupt_a and_o so_o near_o concern_v the_o lord_n so_o powerful_a and_o osbourn_n and_o dowcet_n so_o beggarly_a that_o it_o be_v impossible_a your_o petitioner_n shall_v ever_o be_v repair_v in_o his_o estate_n or_o credit_n without_o your_o justice_n be_v exercise_v in_o the_o obtain_n thereof_o the_o premise_n consider_v may_v it_o please_v your_o honour_n see_v that_o both_o your_o own_o and_o the_o army_n honour_n have_v be_v blemish_v by_o the_o say_a scandalous_a information_n that_o therefore_o some_o publication_n may_v be_v make_v by_o the_o authority_n and_o approbation_n of_o this_o house_n of_o the_o proceed_n in_o relation_n to_o this_o business_n to_o the_o end_n that_o your_o and_o the_o army_n honour_n may_v be_v vindicate_v and_o your_o petitioner_n name_n and_o credit_n so_o far_o as_o may_v be_v repair_v and_o that_o some_o legal_a way_n may_v be_v take_v for_o the_o freedom_n and_o reparation_n of_o your_o petitioner_n who_o be_v great_o impoverish_v by_o the_o say_a imprisonment_n it_o have_v cost_v he_o nigh_o 120_o l._n of_o his_o estate_n since_o the_o time_n of_o his_o restraint_n beside_o the_o great_a damage_n receive_v in_o his_o name_n and_o credit_n which_o be_v altogether_o unrepairable_a and_o forasmuch_o as_o the_o judge_n be_v appoint_v to_o sit_v with_o the_o lord_n as_o their_o assistant_n in_o point_n of_o law_n and_o aught_o to_o inform_v they_o by_o what_o rule_n they_o be_v to_o proceed_v be_v swear_v thereunto_o and_o yet_o have_v contrary_a to_o law_n and_o their_o oath_n connive_v at_o the_o apparent_a subversion_n of_o the_o fundamental_a law_n of_o this_o nation_n by_o suffer_v such_o illegal_a warrant_n to_o pass_v from_o time_n to_o time_n from_o the_o lord_n upon_o such_o illegal_a accusation_n that_o therefore_o this_o house_n will_v be_v please_v to_o call_v the_o say_a judge_n to_o a_o account_n for_o these_o their_o undue_a proceed_n and_o out_o of_o their_o estate_n who_o ought_v to_o have_v prevent_v your_o petitioner_n suffering_n and_o damage_n to_o allow_v he_o such_o legal_a repairation_n as_o to_o your_o honour_n shall_v seem_v meet_a and_o couvenient_a and_o he_o shall_v pray_v etc._n etc._n
