how_o say_v he_o can_v any_o thing_n be_v more_o dangerous_a to_o the_o subject_a or_o be_v a_o plain_a failure_n of_o justice_n whatever_o may_v be_v pretend_v to_o the_o contrary_a than_o to_o say_v that_o there_o can_v be_v any_o such_o restraint_n of_o english_a liberty_n as_o can_v obtain_v so_o much_o as_o bail_v but_o by_o the_o leave_n of_o the_o house_n of_o lord_n when_o that_o house_n can_v neither_o meet_v but_o when_o the_o king_n please_v nor_o can_v never_o sit_v long_o than_o he_o please_v so_o that_o to_o say_v a_o man_n shall_v be_v a_o close_a prisoner_n i_o mean_v by_o their_o liberty_n this_o doctrine_n shall_v now_o be_v admit_v for_o law_n we_o will_v seem_v to_o endeavour_v as_o much_o as_o in_o we_o lie_v to_o bring_v it_o to_o this_o conclusion_n and_o be_v our_o own_a felo_n de_n se_fw-es that_o the_o king_n shall_v have_v a_o way_n find_v out_o by_o ourselves_o and_o without_o his_o seek_v how_o he_o may_v imprison_v any_o man_n or_o number_n of_o man_n when_o he_o please_v in_o a_o parliamentary_a way_n and_o by_o dissolve_v that_o parliament_n he_o may_v keep_v they_o as_o long_o as_o he_o please_v in_o a_o prison_n without_o remedy_n but_o that_o he_o shall_v neither_o have_v power_n to_o relieve_v we_o himself_o by_o his_o own_o authority_n nor_o by_o his_o court_n of_o justice_n so_o as_o in_o short_a by_o this_o doctrine_n the_o king_n shall_v only_o have_v power_n to_o hurt_v his_o subject_n as_o much_o and_o as_o long_o as_o he_o please_v but_o shall_v not_o be_v able_a to_o do_v they_o any_o right_n if_o he_o will_v and_o reason_n often_o to_o suspect_v to_o be_v knight_n of_o the_o post_n among_o who_o the_o story_n of_o one_o magrath_n another_o irish_a man_n he_o say_v be_v notable_o remarkable_a in_o his_o but_o by_o that_o court_n where_o the_o law_n direct_v every_o english_a man_n to_o come_v for_o justice_n that_o be_v oppress_v in_o his_o liberty_n he_o say_v he_o hope_v his_o lordship_n will_v forgive_v he_o for_o have_v be_v a_o little_a tedious_a on_o that_o subject_a of_o sir_n edmundbury_a godfrey_n because_o his_o reputation_n have_v be_v so_o much_o expose_v in_o that_o particular_a and_o before_o that_o court._n after_o his_o discharge_n from_o that_o indictment_n he_o say_v there_o seem_v to_o be_v a_o probability_n of_o the_o call_v of_o a_o parliament_n in_o some_o short_a offer_v to_o be_v of_o council_n with_o he_o though_o in_o matter_n of_o law_n which_o he_o believe_v have_v never_o be_v hear_v of_o but_o in_o his_o case_n and_o he_o hope_v that_o when_o all_o liberty_n he_o say_v he_o be_v inform_v that_o his_o majesty_n have_v be_v again_o please_v to_o give_v his_o direction_n to_o mr._n attorney_n to_o give_v his_o consent_n a_o second_o time_n to_o that_o on_o the_o contrary_a the_o reason_n be_v much_o strong_a for_o the_o do_v of_o that_o as_o it_o relate_v not_o only_o to_o he_o but_o to_o the_o liberty_n of_o the_o subject_a in_o general_n then_o for_o the_o proceed_n which_o the_o inferior_a court_n do_v daily_a practice_n upon_o appeal_n and_o writ_n of_o error_n which_o be_v but_o for_o property_n and_o be_v comprise_v in_o the_o same_o order_n and_o therefore_o he_o say_v that_o he_o hope_v he_o shall_v at_o least_o find_v the_o same_o favour_n in_o a_o case_n of_o liberty_n which_o be_v allow_v every_o day_n in_o case_n of_o lesser_a moment_n he_o then_o say_v that_o although_o it_o do_v not_o concern_v his_o particular_a case_n yet_o for_o the_o sake_n of_o english_a liberty_n itself_o he_o can_v not_o but_o say_v something_o further_o upon_o this_o point_n for_o he_o can_v not_o but_o be_v of_o opinion_n that_o if_o the_o order_n have_v direct_o forbid_v bail_n which_o it_o be_v far_o from_o do_v and_o beside_o the_o lord_n own_o practice_n have_v show_v their_o meaning_n to_o the_o contrary_a by_o the_o bail_n of_o a_o commonnor_n who_o crime_n be_v declare_v to_o be_v great_a than_o he_o and_o in_o which_o case_n they_o make_v not_o non_fw-la obstante_fw-la to_o their_o order_n but_o take_v that_o to_o be_v still_o in_o the_o same_o force_n towards_o he_o as_o towards_o any_o other_o who_o be_v in_o custody_n yet_o he_o say_v in_o that_o case_n if_o such_o a_o order_n shall_v be_v find_v to_o be_v against_o magna_fw-la charta_fw-la and_o the_o fundamental_a right_n of_o the_o liberty_n of_o the_o subject_a as_o any_o thing_n must_v be_v which_o do_v subject_a any_o man_n to_o a_o indefinite_a imprisonment_n he_o conceive_v that_o of_o right_o that_o court_n ought_v to_o free_v any_o and_o he_o say_v that_o the_o house_n of_o commons_o desire_v that_o such_o a_o power_n may_v have_v be_v enact_v into_o a_o law_n though_o themselves_o will_v have_v be_v the_o first_o who_o will_v have_v repent_v such_o a_o law_n do_v sufficient_o denote_v that_o the_o commons_o do_v not_o think_v the_o order_n will_v be_v bind_v in_o law_n after_o their_o dissolution_n for_o otherwise_o what_o show_v any_o thing_n to_o the_o contrary_a nor_o do_v he_o know_v what_o temporary_a indefinite_a do_v mean_v the_o lord_n chief_a justice_n then_o say_v that_o he_o be_v not_o a_o judge_n at_o that_o time_n when_o the_o judge_n opinion_n be_v ask_v but_o desire_v his_o br._n jones_n to_o relate_v how_o it_o be_v mr._n justice_n jones_n then_o say_v that_o he_o remember_v the_o case_n have_v be_v all_o his_o life-time_n if_o the_o king_n please_v which_o confirm's_n what_o he_o have_v be_v a_o great_a part_n of_o this_o time_n labour_v to_o prove_v and_o he_o say_v he_o must_v confess_v he_o do_v expect_v to_o have_v hear_v strong_a and_o more_o powerful_a argument_n to_o have_v convince_v he_o that_o he_o be_v in_o the_o wrong_n in_o what_o he_o have_v say_v but_o that_o now_o he_o be_v more_o encourage_v than_o before_o not_o to_o give_v over_o a_o cause_n which_o do_v so_o much_o concern_v every_o man_n in_o england_n the_o lord_n chief_a justice_n then_o say_v that_o his_o lordship_n be_v mistake_v in_o believe_v that_o that_o court_n do_v keep_v he_o in_o prison_n for_o that_o he_o be_v not_o keptin_a prison_n by_o they_o but_o by_o a_o superior_a court_n which_o be_v too_o big_a for_o they_o to_o meddle_v with_o or_o to_o examine_v what_o they_o do_v to_o this_o his_o lordship_n answer_v that_o he_o have_v wrong_o do_v he_o which_o must_v be_v do_v by_o some_o not_o ready_a to_o give_v any_o present_a opinion_n there_o have_v be_v so_o much_o and_o some_o thing_n so_o material_o say_v by_o his_o lordship_n but_o that_o for_o his_o better_a satisfaction_n by_o a_o impeachment_n and_o have_v plead_v a_o pardon_n to_o the_o impeachment_n before_o the_o lord_n he_o say_v he_o take_v that_o plea_n to_o be_v a_o tacite_fw-la confession_n of_o guilt_n in_o law_n though_o the_o party_n be_v never_o so_o innocent_a and_o then_o it_o have_v be_v a_o tacite_fw-la plead_v of_o guilty_a insomuch_o that_o he_o do_v believe_v there_o can_v be_v no_o
