this_o day_n and_o who_o by_o threat_n promise_n and_o persuasion_n and_o all_o other_o undue_a mean_n have_v endeavour_v to_o divert_v her_o affection_n from_o her_o say_a husband_n mr._n emmerton_n that_o the_o lord_n chief_a justice_n hale_v upon_o the_o examination_n of_o the_o evil_a practice_n aforesaid_a witness_n the_o record_n and_o 4_o witness_n do_v think_v fit_a to_o order_v a_o hyde_n or_o not_o and_o the_o jury_n be_v so_o well_o satisfy_v of_o the_o strength_n and_o validity_n of_o the_o proof_n and_o evidence_n that_o they_o give_v a_o verdict_n for_o the_o marriage_n without_o go_v from_o the_o bar_n with_o the_o approbation_n of_o the_o say_v court_n court._n prove_v by_o the_o act_n of_o that_o court._n that_o mr._n emmerton_n have_v exhibit_v a_o libel_n in_o the_o archy_n court_n of_o canterbury_n the_o second_o of_o march_n 1674._o for_o the_o recover_v of_o his_o say_a wife_n the_o judge_n of_o the_o say_a court_n do_v declare_v by_o colour_n of_o a_o obsolete_a canon_n that_o his_o witness_n that_o be_v at_o the_o marriage_n be_v excommunicate_v ipso_fw-la facto_fw-la for_o be_v at_o a_o clandestine_v marriage_n and_o so_o put_v mr._n emmerton_n to_o many_o long_a debate_n to_o great_a charge_n and_o trouble_n before_o they_o can_v be_v restore_v and_o absolve_v ad_fw-la testificandum_fw-la only_o but_o as_o for_o mr._n emmerton_n father_n and_o mother_n after_o four_o term_n debate_v the_o say_a judge_n do_v utter_o refuse_v to_o absolve_v or_o admit_v they_o to_o be_v witness_n at_o all_o in_o the_o say_a cause_n against_o which_o unjust_a and_o unlawful_a sentence_n mr._n emmerton_n appeal_v to_o the_o delegate_n but_o they_o unjust_o and_z illegaly_n do_v confirm_v the_o aforesaid_a sentence_n though_o mr._n emmerton_n council_n do_v pray_v that_o his_o father_n and_o mother_n may_v be_v only_o examine_v de_fw-la bene_fw-la esse_fw-la and_o to_o be_v believe_v as_o they_o shall_v see_v cause_n and_o as_o they_o agree_v or_o contest_v with_o other_o witness_n when_o the_o examination_n shall_v be_v publish_v that_o since_o the_o say_a sentence_n the_o say_a mr._n emmerton_n father_n be_v dead_a and_o his_o mother_n be_v very_o sickly_a and_o ancient_a witnessess_n prove_v by_o 4_o witnessess_n so_o that_o by_o the_o say_a sentence_n he_o have_v utter_o lose_v the_o testimony_n of_o his_o father_n and_o will_v in_o all_o probability_n lose_v the_o testimony_n of_o his_o mother_n if_o he_o shall_v have_v further_a occasion_n to_o use_v she_o who_o both_o of_o they_o be_v the_o most_o material_a witness_n not_o only_o to_o prove_v the_o say_a marriage_n but_o also_o the_o lady_n vyner_n desire_n and_o consent_n to_o and_o for_o the_o say_a marriage_n that_o the_o say_a judge_n delegate_n do_v retain_v the_o say_a cause_n before_o they_o till_o the_o 12_o day_n of_o july_n 1680._o at_o which_o time_n it_o be_v final_o hear_v court_n prove_v by_o the_o act_n of_o court_n and_o although_o mr._n emmerton_n lose_v the_o testimony_n of_o his_o father_n and_o mother_n and_o many_o of_o the_o most_o material_a article_n of_o his_o allegation_n be_v reject_v and_o all_o his_o kindred_n admit_v to_o testify_v only_a sub_fw-la omnibus_fw-la limitationibus_fw-la and_o the_o many_o other_o hardship_n be_v put_v upon_o he_o yet_o he_o make_v so_o clear_a a_o proof_n of_o his_o say_a marriage_n that_o the_o say_v judge_n delegate_n do_v give_v a_o sentence_n for_o the_o same_o that_o notwithstanding_o the_o verdict_n at_o law_n and_o judgement_n execution_n and_o possession_n thereupon_o have_v yet_o the_o lord_n high_a chancellor_n of_o england_n upon_o a_o bill_n file_v in_o that_o court_n by_o the_o say_a mrs._n bridget_n without_o overrule_a mr._n emmerton_n plea_n thereunto_o which_o he_o do_v still_o refuse_v to_o hear_v do_v order_v the_o rent_n of_o the_o estate_n in_o question_n in_o the_o say_a suit_n court._n prove_v by_o the_o order_n of_o that_o court._n to_o remain_v in_o the_o tenant_n hand_n till_o a_o sentence_n shall_v be_v give_v before_o the_o delegate_n and_o since_o the_o say_a sentence_n his_o lordship_n have_v order_v the_o say_a rent_n in_o arrear_n to_o be_v bring_v into_o court_n declare_v that_o he_o will_v allow_v the_o say_a mrs._n bridget_n 1000_o l._n per_fw-la anum_fw-la which_o be_v half_a the_o yearly_a revenue_n during_o the_o dependence_n of_o a_o commission_n of_o review_n which_o have_v be_v grant_v she_o after_o almost_o six_o about_o 6000_o l._n so_o that_o mr._n emmerton_n can_v have_v no_o fruit_n of_o his_o say_a verdict_n at_o law_n or_o say_v sentence_n that_o although_o she_o be_v oblige_v to_o plead_v all_o new_a matter_n upon_o her_o commission_n of_o review_n court_n prove_v by_o the_o act_n of_o the_o say_v court_n and_o prove_v all_o by_o the_o 26_o of_o october_n 1680._o yet_o she_o do_v not_o exhibit_v any_o allegation_n till_o the_o 9_o of_o this_o instant_a november_n and_o although_o the_o allegation_n consist_v of_o such_o matter_n as_o ought_v not_o to_o be_v admit_v by_o law_n yet_o the_o bishop_n and_o civilian_n empower_v by_o the_o say_a commission_n of_o review_n then_o present_a do_v admit_v it_o all_o and_o give_v she_o further_a time_n to_o prove_v viz._n to_o the_o first_o day_n of_o next_o term._n so_o that_o by_o these_o tedious_a delay_n not_o know_v but_o this_o suit_n may_v last_v some_o year_n long_a and_o by_o these_o vast_a expense_n mr._n emmerton_n be_v put_v to_o have_v spend_v about_o 6000_o l._n in_o this_o suit_n and_o be_v debar_v from_o receive_v any_o rent_n and_o profit_n of_o the_o premise_n by_o the_o lord_n chancellor_n order_n as_o aforesaid_a by_o such_o like_a unjust_a and_o unreasonable_a do_n mr._n emmerton_n be_v like_a to_o be_v utter_o undo_v and_o ruin_v
