and_o give_v bond_n as_o aforesaid_a shall_v afterward_o upon_o sail_n of_o all_o or_o any_o part_n of_o the_o same_o under_o his_o own_o hand_n or_o the_o hand_n of_o his_o servant_n for_o who_o he_o certificate_n and_o payment_n of_o the_o excize_n as_o aforesaid_a shall_v deliver_v or_o cause_v to_o be_v deliver_v nor_o any_o buyer_n or_o other_o person_n receive_v all_o or_o any_o such_o good_n ale-maker_n and_o distiller_n of_o aquavitae_n and_o strong-water_n to_o sell_v again_o in_o their_o shop_n who_o by_o this_o present_a act_n be_v charge_v with_o excize_n and_o liable_a to_o payment_n thereof_o upon_o the_o brew_n or_o make_v of_o their_o beer_n and_o ale_n aquavitae_a and_o strong-water_n shall_v under_o their_o own_o hand_n or_o the_o hand_n of_o such_o for_o who_o they_o shall_v be_v responsible_a weekly_a that_o be_v to_o say_v on_o the_o monday_n of_o every_o week_n make_v true_a entry_n at_o the_o office_n of_o excize_n under_o which_o they_o live_v of_o the_o quality_n and_o quantity_n of_o all_o beer_n and_o ale_n aquavitae_a and_o strong-water_n by_o they_o brew_v make_v and_o distil_v the_o week_n forego_v and_o at_o the_o same_o time_n pay_v and_o clear_v the_o excize_n upon_o pain_n of_o forfeit_v twenty_o pound_n for_o the_o first_o forty_o pound_n for_o the_o second_o and_o sixty_o pound_n for_o the_o three_o week_n they_o or_o any_o of_o they_o or_o any_o other_o for_o they_o as_o aforesaid_a shall_v neglect_v refuse_v or_o omit_v to_o make_v such_o entry_n and_o payment_n as_o aforesaid_a and_o further_o to_o forfeit_v double_a the_o value_n of_o the_o beer_n ale_n aquavitae_a and_o strong-water_n by_o they_o make_v and_o brew_v in_o those_o or_o any_o of_o those_o week_n and_o before_o such_o entry_n and_o payment_n of_o excize_a as_o aforesaid_a the_o same_o to_o be_v levy_v by_o distress_n and_o in_o default_n thereof_o the_o party_n offend_v to_o be_v proceed_v against_o as_o be_v hereafter_o mention_v and_o express_v and_o in_o case_n any_o common_a brewer_n of_o beer_n and_o ale-maker_n or_o distiller_n of_o aquavitae_a or_o strong-water_n shall_v for_o more_o than_o three_o several_a week_n neglect_v or_o refuse_v to_o enter_v and_o pay_v weekly_a his_o excize_n as_o aforesaid_a every_o such_o brewer_n maker_n or_o distiller_n of_o aquavitae_a or_o strong-water_n i_o shall_v for_o ever_o after_o be_v disable_v and_o make_v uncapable_a of_o exercise_v the_o trade_n of_o a_o common_a brewer_n maker_n or_o distiller_n of_o aquavitae_a or_o strong-water_n unless_o and_z until_o he_o shall_v pay_v one_o hundred_o pound_n and_o give_v bond_n unto_o our_o sovereign_a lord_n the_o king_n with_o sufficient_a surety_n for_o his_o due_a and_o constant_a enter_v and_o pay_v weekly_o in_o the_o future_a as_o aforesaid_a that_o all_o common_a brewer_n in_o pay_v and_o clear_v their_o excize_n shall_v from_o time_n to_o time_n and_o at_o all_o time_n be_v allow_v sixty_o four_o gallon_n in_o every_o seven_o hundred_o and_o four_o gallon_n of_o beer_n and_o thirty_o two_o gallon_n in_o every_o six_o hundred_o seventy_o two_o gallon_n of_o ale_n and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n by_o they_o brew_v free_a of_o duty_n to_o be_v deduct_v and_o defaulk_v from_o their_o payment_n to_o be_v for_o and_o in_o respect_n of_o fill_v waste_v leakage_n return_v or_o at_o any_o other_o accident_n or_o consideration_n whatsoever_o that_o no_o vintner_n innkeeper_n victualler_n alehouse-keeper_n or_o other_o person_n whatsoever_o that_o use_v common_a sell_v of_o beer_n ale_n aquavitae_a or_o strong-water_n shall_v be_v permit_v to_o brew_v make_v or_o distil_v he_o or_o their_o own_o beer_n ale_n aquavitae_a or_o strong-water_n unless_o such_o vintner_n innkeeper_n victualler_n alehouse-keeper_n and_o other_o person_n whatsoever_o brew_v make_v and_o vend_v by_o retail_n in_o their_o house_n as_o aforesaid_a do_v forthwith_o enter_v into_o bond_n to_o our_o sovereign_a lord_n the_o king_n with_o sufficient_a surety_n in_o such_o sum_n or_o sum_n of_o money_n as_o the_o commissioner_n or_o sub-commissioner_n of_o excize_n shall_v judge_v reasonable_a for_o the_o true_a enter_v and_o pay_v weekly_o at_o the_o office_n of_o excize_n under_o which_o he_o or_o they_o live_v of_o the_o excize_n of_o all_o their_o beer_n ale_n aquavitae_a or_o strong-water_n in_o case_n he_o or_o they_o live_v not_o above_o three_o mile_n from_o the_o say_a office_n or_o else_o every_o fourteen_o day_n in_o case_n they_o live_v further_o off_o from_o the_o same_o upon_o pain_n that_o every_o vintner_n alehousekeeper_n or_o other_o person_n brew_v make_v or_o distil_v his_o or_o their_o beer_n ale_n aquavitae_a or_o strongwater_n without_o bond_n give_v as_o aforesaid_a shall_v upon_o due_a proof_n thereof_o make_v before_o the_o commissioner_n of_o excize_n or_o their_o sub-commissioner_n respective_o forfeit_v for_o every_o such_o offence_n the_o sum_n of_o twenty_o shilling_n and_o if_o the_o say_a person_n shall_v offend_v the_o second_o time_n then_o to_o forfeit_v the_o sum_n of_o forty_o shilling_n to_o be_v levy_v by_o distress_n or_o otherwise_o as_o hereafter_o by_o this_o act_n be_v appoint_v and_o if_o the_o say_a person_n shall_v notwithstanding_o commit_v the_o like_a offence_n the_o three_o time_n than_o such_o person_n or_o person_n so_o offend_v shall_v not_o only_o forfeit_v three_o pound_n to_o be_v levy_v as_o aforesaid_a but_o shall_v and_o may_v be_v commit_v to_o some_o common_a gaol_n by_o the_o say_a commissioner_n or_o sub-commissioner_n till_o he_o or_o they_o do_v enter_v into_o bond_n with_o a_o good_a surety_n to_o his_o majesty_n use_n in_o the_o penal_a sum_n of_o twenty_o pound_n sterling_a that_o he_o shall_v not_o and_o will_v not_o brew_v make_v distil_v and_o vend_fw-mi by_o retail_n or_o otherwise_o beer_n ale_n aquavitae_a or_o strongwater_n any_o more_o or_o at_o any_o from_o time_n to_o time_n and_o to_o make_v his_o or_o their_o return_n or_o report_n sign_v under_o his_o or_o theâ—_n hand_n to_o the_o say_a commissioner_n their_o sub-commissioner_n or_o deputy_n shall_v upon_o their_o entry_n charge_v themselves_o with_o and_o not_o otherwise_o that_o if_o any_o common_a brewer_n distiller_n or_o â—aker_n of_o aquavitae_a or_o strong-water_n or_o 〈◊〉_d any_o vintner_n innkeeper_n victualer_n ale-â—ouse-keeper_n or_o other_o person_n brew_v and_o â—â—lling_v beer_n ale_n aquavitae_a or_o strong-water_n shall_v refuse_v or_o deny_v any_o gager_n or_o â—â—archer_n as_o aforesaid_a to_o enter_v into_o he_o or_o â—heir_a house_n brew-house_n stilling-house_n outhouse_n store_n or_o other_o place_n whatsoever_o of_o or_o belong_v unto_o they_o or_o ale_n aquavitae_a or_o strongwater_n from_o the_o gagâ—_n view_n or_o sight_n of_o the_o gager_n or_o gagers_n searcher_n or_o searcher_n or_o else_o make_v use_n of_o anâ—_n private_a tun_n copper_n fat_a keeve_v stilâ—_n alimbick_n or_o other_o vessel_n for_o the_o make_n brew_v or_o distil_v of_o his_o or_o their_o beeâ—_n ale_n aquavitae_a or_o strongwater_n without_o acquaint_v or_o give_v notice_n thereof_o untâ—_n such_o gager_n or_o gagers_n searcher_n or_o searcher_n every_o such_o common_a brewer_n or_o distiller_n anâ—_n maker_n of_o aquavitae_a or_o strongwater_n shall_v for_o every_o copper_n fat_a keeve_v still_o alimbeck_n or_o other_o vessel_n so_o make_v use_v â—â—_o without_o acquaint_v or_o give_v notice_n as_o aforesaid_a forfeit_v the_o sum_n of_o twenty_o â—_z and_o every_o vintner_n innkeeper_n victualer_n or_o alehousekeeper_n five_o pound_n and_o sâ—_n deny_v entrance_n and_o liberty_n of_o gage_v â—â—_o conceal_n any_o beer_n ale_n aquavitae_a oâ—_n strongwater_n as_o aforesaid_a shall_v be_v presentiâ—â—_n forbid_v by_o such_o gager_n or_o searcher_n tâ—_n carry_v or_o deliver_v any_o beer_n or_o ale_n or_o retaiâ—_n any_o more_o beer_n ale_n aquavitae_a or_o strong-water_n which_o if_o he_o shall_v nevertheless_o do_v he_o or_o they_o respective_o shall_v besides_o the_o forfeiture_n of_o double_a the_o value_n of_o all_o such_o beer_n and_o ale_n aquavitae_a and_o strongwater_n forfeit_v more_o to_o be_v pay_v by_o every_o such_o commoâ—_n brewer_n fifty_o pound_n and_o by_o every_o vintner_n innkeeper_n alehousekeeper_n distiller_n or_o other_o the_o sum_n of_o five_o pound_n to_o be_v levy_v by_o distress_n or_o otherwise_o the_o party_n offend_v to_o be_v proceed_v against_o as_o hereafter_o be_v appoint_v provide_v always_o that_o if_o any_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o maker_n or_o distiller_n of_o aquavitae_a or_o strong_a water_n use_v common_a sell_v and_o retail_v of_o beer_n ale_n aquavitae_a or_o strong_a water_n shall_v think_v fit_a to_o compound_v for_o the_o excize_n of_o all_o beer_n ale_n aquavitae_a or_o strong_a water_n which_o he_o or_o they_o shall_v brew_v make_v distil_v draw_v retail_n or_o bend_v in_o he_o or_o their_o house_n that_o they_o the_o say_v commissioner_n of_o excize_n or_o sub-commissioner_n respective_o be_v hereby_o authorize_v and_o empower_v to_o agree_v and_o compound_v with_o such_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o as_o aforesaid_a according_o for_o any_o time_n not_o exceed_v twelve_o month_n and_o at_o such_o rate_n to_o be_v pay_v monthly_a as_o they_o the_o say_v commissioner_n or_o sub-commissioner_n respective_o shall_v judge_v meet_a and_o reasonable_a in_o which_o regard_n be_v to_o be_v have_v to_o the_o number_n of_o gallon_n of_o beer_n ale_n aquavitae_a or_o strong_a water_n likely_a to_o be_v make_v draw_v or_o sell_v by_o every_o such_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o as_o aforesaid_a in_o or_o at_o their_o house_n respective_o and_o not_o elsewhere_o and_o which_o be_v not_o to_o be_v compute_v and_o compound_v for_o at_o less_o than_o such_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o person_n his_o or_o their_o excize_n for_o beer_n ale_n aquavitae_a or_o strong-water_n respective_o amount_v unto_o at_o any_o time_n for_o twelve_o month_n before_o go_v and_o upon_o composition_n and_o agreement_n make_v such_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o person_n as_o aforesaid_a shall_v with_o able_a surety_n enter_v into_o sufficient_a obligation_n to_o our_o sovereign_a lord_n the_o king_n as_o shall_v be_v appoint_v and_o conclude_v on_o for_o his_o or_o their_o perform_n and_o pay_v according_a to_o such_o composition_n and_o agreement_n as_o shall_v be_v make_v betwixt_o they_o and_o thereupon_o such_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o so_o compound_v shall_v be_v discharge_v and_o acquit_v from_o make_v entry_n weekly_o or_o every_o fourteen_o day_n or_o have_v any_o gage_n or_o search_v make_v of_o what_o beer_n ale_n aquavitae_a or_o strong-water_n shall_v be_v by_o they_o make_v or_o brew_v during_o the_o time_n and_o term_n of_o their_o composition_n and_o of_o and_o from_o all_o penalty_n and_o forfeiture_n for_o or_o concern_v all_o or_o any_o of_o the_o same_o any_o thing_n before_o in_o this_o present_a act_n to_o the_o contrary_a notwithstanding_o that_o all_o person_n sell_v and_o retail_v beer_n ale_n aquavitae_a or_o strong-water_n only_o in_o place_n where_o the_o general_n assizes_n or_o quarter-session_n shall_v be_v keep_v during_o the_o time_n of_o the_o assize_n or_o session_n or_o at_o any_o fair_a or_o fair_n during_o the_o time_n of_o fair_a or_o fair_n shall_v upon_o the_o place_n pay_v the_o excize_n of_o such_o beer_n ale_n aquavitae_a or_o strong-water_n except_o the_o same_o be_v brew_v by_o any_o common_a brewer_n before_o they_o draw_v or_o tap_v the_o same_o unto_o such_o sub-commissioner_n or_o other_o officer_n for_o excize_n as_o shall_v be_v appoint_v then_o and_o there_o to_o receive_v and_o demand_v the_o same_o and_o if_o any_o person_n shall_v neglect_v or_o refuse_v do_v thereof_o such_o sub-commissioner_n or_o other_o officer_n shall_v and_o may_v seize_v and_o detain_v in_o his_o or_o their_o custody_n such_o beer_n ale_n aquavitae_a or_o strong-water_n until_o such_o person_n pay_v and_o clear_v the_o excize_n of_o the_o same_o that_o no_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o person_n as_o aforesaid_a have_v compound_v or_o give_v bond_n for_o entry_n or_o payment_n of_o he_o or_o their_o excize_n shall_v vend_n or_o dispose_n of_o any_o their_o beer_n or_o ale_n to_o any_o other_o housekeeper_n victualer_n or_o other_o person_n by_o the_o barrel_n half_a barrel_n kilderkin_n ferkin_n or_o gallon_n for_o his_o or_o their_o private_a expense_n or_o consumption_n or_o otherwise_o to_o be_v by_o they_o retail_v upon_o pain_n that_o every_o such_o housekeeper_n victualer_n or_o other_o person_n buy_v or_o receive_v such_o beer_n or_o ale_n from_o such_o vintner_n innkeeper_n alehousekeeper_n or_o other_o person_n shall_v pay_v double_a the_o excize_n for_o all_o such_o beer_n or_o ale_n so_o by_o he_o or_o they_o buy_v and_o receive_v and_o in_o default_n of_o such_o payment_n both_o vintner_n innkeeper_n victualer_n alehousekeeper_n and_o other_o person_n sell_v as_o also_o every_o housekeeper_n or_o other_o person_n buy_v and_o receive_v such_o beer_n or_o ale_n shall_v be_v equal_o liable_a to_o the_o forfeiture_n of_o forty_o shilling_n a_o piece_n to_o be_v levy_v by_o distress_n as_o hereafter_o
be_v mention_v that_o all_o vintner_n innkeeper_n victualler_n alehouse-keeper_n or_o other_o person_n sell_v beer_n or_o ale_n by_o retail_n shall_v either_o whole_o brew_v and_o make_v their_o own_o beer_n and_o ale_n or_o take_v the_o same_o from_o some_o common_a brewer_n and_o that_o every_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o as_o aforesaid_a do_v otherwise_o by_o brew_v part_n of_o he_o or_o their_o beer_n and_o ale_n and_o take_v other_o part_n from_o a_o common_a brew_v shall_v be_v liable_a and_o pay_v excize_a nevertheless_o as_o if_o he_o or_o they_o have_v themselves_o brew_v all_o and_o every_o part_n thereof_o upon_o pain_n of_o forfeit_v all_o such_o beer_n or_o ale_n which_o he_o or_o they_o shall_v take_v from_o such_o common_a brewer_n or_o else_o the_o value_n thereof_o to_o be_v leviad_v by_o distress_n â—s_v hereafter_o be_v direct_v provide_v always_o and_o be_v it_o enact_v that_o no_o distress_n make_v or_o take_v by_o virtue_n of_o this_o present_a act_n of_o the_o good_n and_o chattel_n of_o any_o vintner_n innkeeper_n victualer_n alehouse-â—eeper_a or_o other_o brew_v make_v and_o selâ—ing_v by_o retail_v any_o beer_n ale_n aquavitae_n or_o strongwater_n shall_v be_v sell_v or_o dispose_v of_o until_o fourteen_o day_n after_o any_o such_o good_n or_o chattel_n shall_v be_v distrain_v and_o within_o 〈◊〉_d at_o time_n any_o such_o vintner_n innkeeper_n victualer_n alehousekeeper_n or_o other_o person_n as_o aforesaid_a find_v he_o or_o themselves_o grieve_v shall_v or_o may_v make_v he_o or_o their_o complaint_n unto_o one_o or_o more_o of_o the_o next_o justice_n of_o the_o peace_n who_o upon_o such_o complaint_n to_o he_o or_o they_o make_v by_o such_o party_n or_o party_n be_v hereby_o authorize_v and_o require_v to_o hear_v and_o examine_v the_o same_o upon_o oath_n which_o oath_n any_o one_o or_o more_o of_o the_o say_a justice_n be_v hereby_o authorize_v to_o administer_v and_o final_o â—o_o determine_v the_o matter_n of_o complaint_n and_o to_o â—mitigate_v any_o fine_a penalty_n forfeiture_n inflict_v or_o impose_v upon_o any_o such_o person_n by_o this_o present_a act_n by_o the_o lord_n lieutenant_n lord_n deputy_n or_o other_o chief_a governor_n or_o governor_n of_o ireland_n for_o the_o time_n be_v and_o to_o be_v commission_v under_o the_o great_a seal_n of_o this_o your_o majesty_n realm_n to_o have_v and_o to_o hold_v to_o they_o respective_o during_o their_o good_a behaviour_n respective_o which_o say_v commissioner_n or_o any_o three_o or_o more_o of_o they_o shall_v have_v power_n and_o be_v hereby_o authorize_v from_o time_n to_o time_n with_o the_o approbation_n of_o the_o lord_n lieutenant_n lord_n deputy_n or_o other_o chief_a governor_n or_o governor_n of_o ireland_n for_o the_o time_n be_v to_o choose_v and_o appoint_v such_o fit_a clerk_n searcher_n waiter_n messenger_n and_o all_o other_o officer_n for_o the_o city_n suburb_n and_o liberty_n of_o dublin_n and_o the_o port_n of_o dublin_n and_o the_o several_a creek_n and_o member_n thereof_o as_o they_o may_v necessary_o have_v occasion_n to_o employ_v for_o the_o advantage_n
