be_v by_o some_o remark_v that_o when_o the_o lord_n of_o justiciary_a after_o the_o end_n of_o the_o first_o day_n debate_v resolve_v that_o same_o night_n to_o give_v judgement_n upon_o it_o they_o outlaw_n and_o fugitive_n and_o that_o albeit_o it_o be_v singular_a in_o the_o case_n of_o treason_n that_o the_o trial_n may_v go_v on_o even_o to_o a_o final_a sentence_n though_o the_o party_n be_v absent_a yet_o such_o trial_n be_v only_o proper_a to_o and_o always_o reserve_v for_o parliament_n and_o that_o so_o it_o have_v be_v constant_o observe_v until_o after_o the_o rebellion_n in_o the_o year_n 1666_o but_o there_o be_v several_a person_n notour_o engage_v in_o that_o rebellion_n who_o have_v escape_v and_o thereby_o withdraw_v themselves_o from_o justice_n it_o be_v think_v that_o the_o want_n of_o a_o parliament_n for_o the_o time_n ought_v not_o to_o afford_v they_o any_o immunity_n and_o therefore_o it_o be_v resolve_v by_o the_o council_n with_o advice_n of_o the_o absurd_a to_o think_v that_o it_o shall_v be_v in_o the_o power_n of_o the_o party_n thus_o accuse_v and_o find_v guilty_a by_o his_o escape_n to_o frustrate_v justice_n and_o withdraw_v himself_o from_o the_o punishment_n he_o deserve_v but_o on_o the_o other_o hand_n it_o be_v plead_v for_o the_o earl_n that_o first_o it_o be_v a_o fundamental_a rule_n that_o until_o once_o the_o cause_n be_v conclude_v no_o sentence_n can_v be_v pronounce_v next_o that_o it_o be_v a_o sure_a maxim_n in_o law_n that_o in_o criminal_a action_n there_o neither_o be_v or_o can_v be_v any_o other_o
