41._o bring_v he_o in_o speak_v in_o another_o language_n and_o more_o consonant_a to_o law_n viz._n that_o the_o conviction_n here_o mention_v be_v intend_v of_o conviction_n upon_o indictment_n only_o and_o that_o no_o other_o sort_n of_o conviction_n or_o proceed_n upon_o the_o statute_n of_o 23_o eliz._n be_v mention_v or_o intend_v throughout_o this_o whole_a act_n of_o 29._o and_o if_o information_n as_o be_v resolve_v by_o the_o judge_n mich._n 4_o car._n 1._o jones_n 193._o and_o yet_o this_o statute_n do_v not_o whole_o abrogate_v the_o power_n of_o the_o justice_n of_o peace_n case_n cite_v in_o dr._n foster_n case_n co._n 11._o 63._o and_o now_o by_o the_o statute_n of_o 3_o jac._n cap._n 4._o 4._o and_o hear_v and_o determine_v the_o offence_n of_o not_o come_v to_o church_n stat._n 3_o jac._n 4._o the_o power_n of_o justice_n of_o peace_n to_o hear_v and_o determine_v the_o offence_n of_o not_o come_v to_o church_n be_v again_o restore_v to_o they_o vide_fw-la that_o statute_n sect._n 5._o and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a pay_v stat._n sect._n 3_o at_o what_o time_n the_o money_n forfeit_v for_o not_o go_v to_o the_o can_v be_v no_o distinction_n make_v between_o the_o two_o part_n and_o the_o recusant_n three_o part_n so_o that_o in_o this_o case_n the_o recusant_n must_v either_o be_v enable_v to_o sue_v and_o marry_v nor_o their_o child_n christen_v nor_o themselves_o bury_v according_a to_o the_o law_n of_o the_o church_n of_o england_n but_o the_o same_o be_v do_v superstitious_o by_o popish_a person_n in_o secret_a whereby_o the_o day_n of_o their_o marriage_n birth_n and_o burial_n can_v be_v certain_o know_v recusant_n stat._n sect._n 15._o marriage_n of_o popish_a recusant_n be_v it_o further_o enact_v by_o authority_n of_o this_o present_a parliament_n that_o every_o man_n be_v or_o which_o shall_v be_v a_o popish_a recusant_n convict_v and_o who_o shall_v be_v hereafter_o marry_v otherwise_o then_o in_o some_o open_a church_n or_o chappel_n and_o otherwise_o then_o according_a to_o the_o order_n of_o the_o church_n of_o england_n by_o a_o minister_n lawful_o authorize_v shall_v be_v utter_o disable_v and_o exclude_v to_o have_v any_o estate_n of_o fréehold_n into_o any_o the_o land_n tenement_n and_o hereditament_n of_o his_o wife_n as_o tenant_n by_o the_o whereof_o her_o husband_n die_v seize_v and_o likewise_o be_v disable_v and_o exclude_v to_o have_v or_o enjoy_v any_o part_n or_o portion_n of_o the_o good_n of_o her_o say_a husband_n by_o virtue_n which_o shall_v be_v a_o popish_a recusant_n convict_v a_o woman_n who_o be_v no_o popish_a recusant_n convict_v offender_n where_o the_o wife_n be_v no_o offender_n marry_v a_o man_n who_o be_v a_o popish_a recusant_n convict_v in_o other_o form_n than_o be_v here_o appoint_v she_o shall_v not_o be_v disable_v by_o this_o branch_n of_o the_o act_n for_o the_o forfeiture_n or_o disability_n extend_v only_o to_o the_o popish_a recusant_n convict_v and_o as_o in_o the_o case_n before_o recite_v the_o woman_n only_o shall_v be_v disable_v so_o in_o this_o case_n the_o man_n only_o shall_v forfeit_v or_o be_v disable_v or_o any_o jointure_n of_o the_o land_n and_o hereditament_n of_o her_o husband_n or_o any_o of_o his_o ancestor_n jointure_n jointure_n a_o feme_fw-fr who_o be_v a_o popish_a recusant_n convict_v and_o marry_v otherwise_o then_o be_v appoint_v by_o this_o act_n be_v not_o therefore_o disable_v to_o have_v any_o sort_n of_o jointure_n as_o wingate_n tit_n crown_n imprisonment_n without_o bail_n or_o mainprize_n for_o one_o year_n any_o schoolmaster_n a_o usher_n usher_n usher_n or_o assistant_n in_o teach_v be_v a_o master_n in_o the_o school_n and_o seem_v to_o be_v include_v within_o the_o word_n schoolmaster_n and_o the_o follow_a word_n here_o or_o teacher_n explain_v who_o be_v intend_v viz._n every_o teacher_n of_o youth_n 2._o a_o schoolmaster_n conform_v or_o be_v license_v either_o of_o they_o sufficient_a stat._n 1_o jac._n 4._o 14_o car._n 2._o what_o he_o must_v do_v by_o stat._n 14_o car._n 2._o repair_v to_o church_n as_o be_v aforesaid_a or_o be_v allow_v this_o clause_n be_v in_o the_o dis-junctive_a it_o seem_v that_o although_o a_o schoolmaster_n do_v not_o come_v to_o church_n yet_o if_o he_o be_v license_v by_o the_o parliament_n assemble_v tend_v to_o the_o utter_a subversion_n of_o the_o whole_a state_n late_o undertake_v by_o the_o instigation_n of_o jesuit_n and_o seminary_n and_o in_o advancement_n of_o their_o religion_n by_o their_o scholar_n teach_v and_o instruct_v by_o they_o to_o that_o purpose_n which_o attempt_n by_o the_o only_a goodness_n of_o almighty_a god_n be_v discover_v and_o defeat_v and_o where_o divers_a person_n popish_o affect_v do_v nevertheless_o the_o better_a to_o cover_v and_o hide_v their_o false_a heart_n and_o with_o the_o more_o safety_n to_o attend_v the_o opportunity_n to_o execute_v their_o mischievous_a design_n repair_v sometime_o to_o church_n to_o escape_v the_o penalty_n of_o the_o law_n in_o that_o behalf_n provide_v for_o the_o better_a discovery_n therefore_o of_o such_o person_n and_o their_o evil_a affection_n to_o the_o king_n majesty_n and_o the_o state_n of_o this_o his_o realm_n 2._o stat._n sect._n 2._o to_o the_o end_n that_o be_v know_v their_o evil_a purpose_n may_v be_v the_o better_o prevent_v be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o every_o popish_a recusant_n convict_v or_o hereafter_o to_o be_v convict_v which_o parliament_n if_o he_o or_o she_o be_v conform_v as_o aforesaid_a before_o the_o end_n of_o this_o session_n of_o parliament_n or_o within_o the_o first_o year_n next_o after_o that_o he_o or_o she_o shall_v after_o this_o session_n of_o parliament_n so_o conform_v he_o or_o herself_o and_o repair_v to_o church_n as_o aforesaid_a and_o after_o the_o say_v first_o year_n shall_v once_o in_o every_o year_n follow_v at_o the_o least_o receive_v the_o bless_a sacrament_n of_o the_o lord_n supper_n in_o the_o church_n of_o that_o parish_n where_o he_o or_o she_o shall_v most_o usual_o abide_v or_o be_v within_o the_o say_a year_n wherein_o by_o the_o true_a meaning_n of_o this_o statute_n he_o or_o she_o ought_v so_o to_o receive_v yearly_o the_o forfeiture_n of_o a_o conform_a recusant_n which_o do_v not_o receive_v the_o sacrament_n of_o the_o lord_n supper_n yearly_o and_o if_o there_o be_v no_o such_o parish_n church_n then_o in_o the_o church_n next_o adjoin_v to_o the_o place_n of_o he_o or_o her_o such_o most_o usual_a abode_n and_o if_o any_o recusant_n so_o conform_v shall_v not_o receive_v the_o say_a sacrament_n of_o the_o lord_n supper_n according_o he_o or_o she_o shall_v for_o such_o not_o receive_v lose_v and_o forfeit_v for_o the_o first_o year_n twenty_o pound_n and_o for_o the_o second_o year_n for_o such_o not_o receive_v forty_o pound_n and_o for_o every_o year_n after_o for_o such_o not_o receive_v threescore_o pound_n until_o he_o or_o she_o shall_v have_v receive_v the_o say_a sacrament_n as_o be_v aforesaid_a and_o if_o after_o he_o or_o she_o shall_v have_v receive_v the_o say_a sacrament_n as_o be_v aforesaid_a and_o after_o shall_v eftsoons_o at_o any_o time_n offend_v in_o not_o receive_v the_o say_a sacrament_n as_o be_v recusant_n whatsoever_o which_o be_v contrary_a to_o the_o express_a word_n of_o the_o statute_n certain_a conviction_n must_v be_v show_v in_o certain_a in_o a_o information_n upon_o this_o statute_n information_n that_o the_o defendant_n be_v convict_v in_o due_a form_n of_o law_n and_o the_o defendant_n do_v not_o demur_v thereto_o but_o plead_v not_o guilty_a and_o it_o be_v find_v against_o he_o there_o judgement_n shall_v not_o be_v stay_v for_o this_o defect_n for_o he_o have_v lose_v his_o advantage_n and_o by_o his_o plea_n have_v admit_v the_o point_n of_o conviction_n and_o at_o receive_v threescore_o pound_n note_v the_o statute_n say_v not_o that_o the_o offender_n shall_v forfeit_v for_o the_o first_o second_o and_o three_o offence_n but_o for_o the_o first_o and_o
