money_n whether_o he_o be_v convict_v or_o not_o because_o rookwood_n name_n be_v in_o the_o proclamation_n though_o his_o be_v not_o mr._n phipps_n then_o my_o lord_n with_o humble_a submission_n here_o be_v another_o proclamation_n wherein_o he_o be_v name_v we_o desire_v that_o may_v be_v read_v mr._n sol._n gen._n and_o when_o it_o be_v read_v it_o will_v be_v as_o little_a to_o your_o purpose_n as_o the_o other_o mr._n att._n gen._n let_v they_o read_v what_o they_o please_v we_o need_v say_v nothing_o at_o all_o to_o it_o l._n c._n j._n holt._n certain_o upon_o this_o proclamation_n there_o be_v no_o objection_n for_o he_o be_v entitle_v to_o his_o one_o thousand_o pound_n already_o though_o rookwood_n be_v never_o convict_v mr._n phipps_n but_o be_v he_o not_o by_o this_o proclamation_n which_o mention_n his_o accomplice_n entitle_v to_o his_o pardon_n if_o so_o he_o swear_v to_o secure_v himself_o l._n c._n j._n holt._n by_o the_o apprehend_n and_o discover_v he_o be_v entitle_v to_o his_o pardon_n mr._n phipps_n but_o not_o without_o he_o be_v bring_v to_o justice_n that_o be_v to_o say_v till_o he_o be_v convict_v therefore_o he_o can_v be_v a_o evidence_n to_o convict_v he_o l._n c._n j._n holt._n that_o be_v as_o to_o any_o that_o be_v there_o name_v if_o any_o of_o they_o discover_v and_o apprehend_v one_o another_o it_o must_v be_v so_o as_o that_o they_o be_v bring_v to_o justice_n but_o if_o any_o person_n that_o be_v not_o name_v there_o do_v apprehend_v any_o that_o be_v he_o be_v entitle_v to_o the_o one_o thousand_o pound_n bare_o by_o the_o apprehension_n mr._n phipps_n then_o there_o be_v another_o proclamation_n where_o they_o be_v both_o name_v as_o mr._n rookwood_n tell_v i_o sir_n b._n shewer_n my_o lord_n we_o will_v set_v this_o matter_n right_a we_o will_v show_v the_o other_o proclamation_n in_o which_o if_o i_o be_o right_o inform_v for_o i_o have_v not_o read_v it_o mr._n harris_n be_v name_v mr._n att._n gen._n if_o you_o have_v not_o read_v it_o i_o will_v advise_v you_o not_o to_o trouble_v the_o court_n with_o it_o for_o you_o will_v find_v the_o latter_a part_n be_v restrain_v to_o three_o or_o four_o particular_a person_n of_o which_o he_o be_v none_o rookwood_n i_o be_o name_v in_o the_o proclamation_n mr._n att._n gen._n ay_o but_o read_v the_o latter_a part_n of_o it_o and_o you_o will_v find_v you_o be_v not_o name_v in_o that_o clause_n that_o they_o refer_v to_o you_o need_v not_o read_v the_o former_a part_n of_o the_o proclamation_n we_o agree_v the_o prisoner_n be_v name_v there_o but_o only_o look_v towards_o the_o bottom_n which_o be_v the_o clause_n that_o they_o refer_v to_o cl._n of_o arr._n reads_z and_o we_o do_v hereby_o further_o declare_v etc._n etc._n mr._n att._n gen._n they_o have_v not_o consider_v the_o proclamation_n and_o therefore_o make_v a_o objection_n of_o they_o do_v know_v wat_fw-mi sir_n b._n shewer_n we_o be_v in_o your_o lordship_n judgement_n l._n c._n j._n holt._n for_o what_o see_v if_o you_o can_v make_v or_o state_n a_o case_n for_o our_o judgement_n sir_n b._n shewer_n mr._n rookwood_n be_v mention_v in_o the_o first_o proclamation_n and_o harris_n be_v not_o but_o there_o be_v the_o word_n accomplice_n he_o be_v likewise_o mention_v in_o the_o last_o proclamation_n but_o not_o in_o the_o last_o clause_n of_o it_o i_o confess_v if_o he_o have_v it_o have_v be_v plain_a it_o will_v have_v take_v off_o his_o testimony_n but_o now_o we_o must_v submit_v it_o to_o you_o whether_o he_o be_v not_o a_o interest_v person_n and_o consequent_o no_o good_a witness_n l._n c._n j._n holt._n true_o i_o do_v not_o see_v any_o colour_n for_o the_o objection_n be_v he_o not_o as_o well_o entitle_v to_o his_o one_o thousand_o pound_n though_o mr._n rookwood_n have_v never_o be_v try_v by_o the_o bare_a apprehend_v of_o mr._n rookwood_n as_o if_o he_o be_v convict_v sir_n b._n shower_n no_o my_o lord_n because_o the_o word_n be_v so_o as_o he_o may_v be_v bring_v to_o justice_n l._n c._n j._n holt._n that_o be_v not_o so_o as_o to_o any_o person_n that_o apprehend_v one_o mention_v in_o the_o proclamation_n if_o the_o person_n that_o apprehend_v be_v not_o mention_v in_o it_o and_o name_v himself_o if_o any_o one_o that_o be_v not_o mention_v apprehend_v one_o that_o be_v mention_v he_o be_v entitle_v by_o the_o apprehension_n to_o the_o one_o thousand_o pound_n if_o any_o one_o that_o be_v mention_v apprehend_v another_o than_o he_o be_v to_o bring_v he_o to_o justice_n now_o mr._n harris_n be_v not_o name_v in_o this_o proclamation_n and_o so_o as_o to_o the_o one_o thousand_o pound_n he_o stand_v in_o the_o same_o condition_n as_o any_o other_o person_n that_o discover_v or_o apprehend_v one_o of_o the_o person_n there_o name_v sir_n b._n shower_n but_o it_o seem_v he_o be_v one_o of_o the_o conspirator_n because_o he_o be_v himself_o describe_v in_o another_o proclamation_n mr._n att._n gen._n if_o it_o be_v so_o it_o will_v not_o be_v material_a nor_o any_o manner_n of_o objection_n but_o as_o they_o have_v make_v their_o objection_n upon_o these_o proclamation_n we_o think_v there_o be_v nothing_o for_o we_o to_o give_v a_o answer_n to_o mr._n cowper_n nay_o my_o lord_n if_o it_o be_v so_o will_v sir_n bartholomew_n shower_v say_v his_o client_n be_v not_o bring_v to_o justice_n unless_o he_o be_v convict_v i_o be_o sure_a the_o word_n convict_v or_o attaint_v be_v not_o in_o the_o proclamation_n l._n c._n j._n holt_n there_o be_v nothing_o in_o it_o you_o must_v swear_v mr._n harris_n which_o be_v do_v according_o mr._n sol._n gen._n will_v you_o give_v
