extraordinary_a spirit_n to_o fight_v their_o battle_n for_o they_o and_o subdue_v their_o enemy_n and_o to_o judge_n israel_n and_o these_o man_n do_v every_o thing_n by_o a_o divine_a impulse_n and_o inspiration_n as_o moses_n and_o joshua_n do_v so_o that_o they_o be_v as_o immediate_o govern_v by_o god_n as_o any_o man_n govern_v his_o own_o house_n and_o family_n but_o when_o the_o government_n be_v put_v into_o the_o hand_n of_o king_n god_n in_o a_o great_a measure_n leave_v the_o administration_n of_o it_o to_o the_o will_n and_o pleasure_n of_o prince_n and_o to_o the_o method_n of_o humane_a government_n and_o policy_n though_o god_n do_v immediate_o appoint_v saul_n and_o afterward_o david_n to_o be_v king_n yet_o ordinary_o the_o government_n descend_v not_o by_o god_n immediate_a choice_n but_o by_o the_o right_n of_o succession_n and_o though_o some_o king_n be_v prophet_n too_o yet_o it_o be_v not_o often_o so_o they_o be_v not_o so_o immediate_o direct_v by_o god_n as_o the_o judge_n of_o old_a be_v but_o have_v their_o counsel_n of_o state_n for_o advice_n in_o peace_n and_o war_n and_o their_o stand_a army_n and_o guard_n for_o the_o defence_n of_o their_o person_n and_o government_n they_o be_v indeed_o command_v to_o govern_v by_o the_o law_n of_o moses_n to_o consult_v the_o oracle_n of_o god_n in_o difficult_a case_n and_o god_n raise_v up_o extraordinary_a prophet_n to_o direct_v they_o but_o still_o it_o be_v in_o their_o own_o power_n whether_o they_o will_v obey_v the_o law_n of_o god_n or_o hearken_v to_o his_o prophet_n good_a king_n do_v and_o bad_a king_n do_v not_o and_o therefore_o the_o government_n of_o israel_n by_o king_n be_v like_o other_o humane_a government_n liable_a to_o all_o the_o defect_n and_o miscarriage_n which_o other_o government_n be_v whereas_o while_o the_o government_n be_v immediate_o in_o god_n hand_n they_o do_v not_o only_o receive_v their_o law_n and_o external_a polity_n from_o he_o but_o the_o very_a executive_a power_n be_v in_o god_n for_o though_o it_o be_v administer_v by_o man_n yet_o it_o be_v administer_v by_o god_n immediate_a direction_n with_o the_o most_o exact_a wisdom_n justice_n and_o goodness_n this_o be_v the_o sin_n of_o the_o jew_n that_o they_o prefer_v the_o government_n of_o a_o earthly_a king_n before_o have_v god_n for_o their_o king_n and_o this_o must_v be_v acknowledge_v to_o be_v a_o great_a fault_n but_o it_o be_v such_o a_o fault_n as_o no_o other_o nation_n be_v ever_o capable_a of_o but_o only_o the_o jew_n because_o god_n never_o vouchsafe_v to_o be_v king_n of_o any_o other_o nation_n in_o such_o a_o manner_n and_o therefore_o we_o must_v not_o compare_v kingly_a government_n for_o there_o be_v no_o competition_n between_o they_o with_o the_o government_n of_o god_n but_o we_o must_v compare_v kingly_a government_n with_o any_o other_o form_n of_o humane_a government_n and_o then_o we_o have_v reason_n to_o believe_v that_o notwithstanding_o god_n be_v angry_a with_o the_o jew_n and_o this_o be_v a_o case_n peculiar_a to_o the_o jew_n for_o desire_v a_o king_n that_o yet_o he_o prefer_v kingly_a government_n before_o any_o other_o because_o when_o he_o foresee_v that_o the_o jew_n will_v in_o time_n grow_v weary_a of_o his_o government_n he_o make_v provision_n in_o their_o law_n for_o set_v up_o a_o king_n not_o for_o set_v up_o a_o aristocratical_a or_o democratical_a power_n which_o their_o law_n make_v no_o allowance_n for_o as_o you_o may_v see_v 17_o deuter._n 14._o 2._o another_o objection_n against_o kingly_a power_n and_o government_n be_v that_o samuel_n in_o this_o place_n represent_v it_o as_o very_o oppressive_a and_o burdensome_a to_o the_o subject_a for_o what_o some_o man_n answer_v that_o samuel_n speak_v here_o only_o of_o the_o abuse_n of_o regal_a power_n i_o think_v be_v not_o true_a for_o the_o mere_a abuse_n of_o power_n be_v no_o argument_n against_o it_o because_o all_o kind_n and_o form_n of_o power_n be_v liable_a to_o be_v abuse_v and_o by_o this_o reason_n we_o shall_v have_v no_o government_n at_o all_o and_o it_o be_v evident_a that_o samuel_n do_v not_o mention_v any_o one_o thing_n here_o that_o can_v be_v call_v a_o abuse_n of_o power_n nothing_o but_o what_o be_v absolute_o necessary_a to_o maintain_v the_o state_n and_o magnificence_n of_o a_o imperial_a crown_n for_o how_o can_v a_o prince_n subsist_v without_o officer_n and_o servant_n of_o all_o sort_n both_o man_n and_o woman_n both_o for_o the_o use_n of_o his_o family_n and_o the_o service_n of_o his_o government_n both_o in_o peace_n and_o war_n and_o how_o can_v this_o be_v maintain_v but_o by_o a_o revenue_n proportionable_a to_o the_o expense_n and_o since_o none_o of_o they_o have_v such_o a_o estate_n as_o to_o defray_v this_o charge_n themselves_o whoever_o be_v to_o be_v choose_v king_n must_v have_v it_o from_o other_o by_o public_a grant_n and_o public_a tax_n which_o he_o here_o express_v by_o take_v their_o field_n and_o their_o vineyard_n and_o their_o olive-yard_n the_o ten_o of_o their_o field_n and_o their_o vineyard_n and_o the_o ten_o of_o their_o sheep_n for_o himself_o and_o his_o servant_n the_o ten_o ●●●ng_v the_o usual_a tribute_n pay_v to_o the_o eastern_a king_n this_o be_v not_o a_o abuse_n of_o power_n though_o some_o prince_n may_v be_v excessive_a in_o all_o this_o but_o it_o be_v the_o manner_n of_o the_o king_n that_o which_o be_v necessary_a to_o his_o royal_a state_n there_o be_v nothing_o of_o all_o this_o forbid_v in_o 17_o deuter._n where_o god_n give_v law_n to_o the_o king_n and_o indeed_o to_o forbid_v this_o will_v be_v to_o forbid_v kingly_a power_n which_o can_v subsist_v without_o it_o indeed_o i_o find_v some_o learned_a man_n mistake_v in_o this_o matter_n for_o they_o take_v it_o for_o grant_v that_o what_o samuel_n here_o call_v the_o manner_n of_o the_o king_n be_v such_o a_o abuse_n of_o power_n as_o god_n have_v express_o forbid_v to_o king_n in_o the_o 17_o of_o deuter._n 16_o 17._o but_o why_o the_o abuse_n of_o regal_a power_n shall_v be_v call_v the_o manner_n or_o the_o right_n of_o the_o king_n be_v past_o my_o understanding_n mishpat_o however_o you_o translate_v it_o must_v signify_v something_o which_o be_v essential_a to_o kingly_a government_n otherwise_o samuel_n argument_n against_o choose_v a_o king_n have_v be_v sophistical_a and_o fallacious_a for_o there_o be_v no_o form_n of_o government_n but_o be_v liable_a to_o great_a abuse_n when_o it_o fall_v into_o ill_a hand_n and_o this_o they_o have_v experience_n of_o at_o this_o very_a time_n for_o the_o miscarriage_n of_o samuel_n son_n be_v the_o great_a reason_n why_o the_o people_n at_o this_o time_n desire_v a_o king_n 1_o sam._n 8._o 3_o 4_o 5._o and_o if_o we_o compare_v these_o two_o place_n together_o what_o god_n forbid_v the_o king_n with_o what_o samuel_n call_v the_o manner_n of_o the_o king_n we_o shall_v find_v nothing_o alike_o in_o the_o 17_o of_o deut._n 16_o 17._o v_o god_n tell_v they_o that_o their_o king_n shall_v not_o multiply_v horse_n to_o himself_o nor_o cause_v the_o people_n to_o return_v into_o egypt_n to_o the_o end_n that_o he_o shall_v multiply_v horse_n for_o as_o much_o as_o the_o lord_n have_v say_v unto_o you_o you_o shall_v henceforth_o return_v no_o more_o that_o way_n god_n will_v not_o allow_v they_o to_o have_v any_o commerce_n or_o intercourse_n with_o egypt_n and_o therefore_o forbid_v their_o king_n to_o multiply_v horse_n with_o which_o egypt_n do_v abound_v that_o there_o may_v be_v no_o new_a familiarity_n contract_v with_o that_o idolatrous_a nation_n neither_o shall_v he_o multiply_v wife_n to_o himself_o that_o his_o heart_n turn_v not_o away_o where_o multiply_a wife_n seem_v plain_o to_o refer_v to_o his_o take_a wife_n of_o other_o nation_n and_o other_o religion_n as_o appear_v from_o what_o be_v add_v that_o his_o heart_n turn_v not_o away_o that_o be_v lest_o they_o shall_v seduce_v he_o to_o idolatry_n as_o we_o know_v solomon_n wife_n do_v he_o who_o be_v therefore_o say_v to_o turn_v away_o his_o whatsoever_o be_v resist_v the_o first_o governor_n god_n set_v over_o the_o child_n of_o israel_n when_o he_o bring_v they_o out_o of_o the_o land_n of_o egypt_n be_v moses_n and_o i_o think_v i_o need_v not_o prove_v how_o sacred_a and_o irresistible_a his_o authority_n be_v this_o be_v sufficient_o evident_a in_o the_o rebellion_n of_o korah_n dathan_n and_o abiram_n against_o moses_n and_o aaron_n when_o god_n cause_v the_o earth_n to_o open_v her_o mouth_n and_o swallow_v they_o up_o 16_o number_n and_o lest_o this_o shall_v be_v think_v a_o extraordinary_a case_n moses_n and_o aaron_n against_o all_o those_o who_o oppose_v themselves_o against_o the_o sovereign_a power_n but_o moses_n be_v not_o always_o to_o rule_v over_o they_o and_o therefore_o god_n express_o provide_v for_o a_o succession_n of_o sovereign_a power_n to_o which_o they_o must_v all_o submit_v the_o ordinary_a sovereign_a power_n of_o the_o jewish_a nation_n after_o moses_n his_o death_n be_v devolve_v settle_v in_o their_o king_n for_o as_o for_o the_o jewish_a sanhedrim_n who_o power_n be_v so_o much_o extol_v by_o the_o jewish_a writer_n who_o be_v all_o of_o a_o late_a date_n many_o year_n since_o the_o destruction_n of_o jerusalem_n and_o therefore_o no_o competent_a witness_n of_o what_o be_v do_v so_o many_o age_n before_o it_o do_v not_o appear_v from_o any_o testimony_n of_o scripture_n that_o there_o be_v any_o such_o court_n of_o judicature_n till_o after_o their_o return_n from_o the_o babylonish_n captivity_n but_o yet_o god_n take_v care_n to_o secure_v the_o peace_n and_o good_a government_n of_o the_o nation_n by_o appoint_v such_o a_o power_n as_o shall_v receive_v the_o last_o appeal_n and_o who_o sentence_n in_o all_o controversy_n shall_v be_v final_a and_o uncontrollable_a as_o you_o may_v see_v in_o the_o 17_o deut._n 8_o 9_o 10_o 11_o 12_o v._n there_o be_v inferior_a magistrate_n and_o judge_n appoint_v in_o their_o several_a tribe_n and_o city_n the_o hand_n of_o moses_n while_o he_o live_v so_o it_o be_v here_o secure_v to_o the_o high_a priest_n or_o judge_n after_o his_o death_n for_o it_o be_v express_o appoint_v that_o if_o those_o 12_o ver_fw-la appear_v only_o to_o be_v the_o high_a priest_n and_o to_o the_o judge_n that_o shall_v be_v in_o those_o day_n that_o be_v if_o it_o shall_v be_v at_o such_o a_o time_n when_o there_o be_v a_o extraordinary_a judge_n raise_v by_o god_n for_o there_o be_v not_o always_o such_o judge_n in_o israel_n as_o be_v evident_a to_o any_o one_o who_o read_v the_o book_n of_o judge_n and_o of_o they_o they_o shall_v inquire_v and_o they_o shall_v show_v the_o sentence_n of_o judgement_n and_o thou_o shall_v do_v according_a to_o the_o sentence_n which_o they_o of_o that_o place_n which_o the_o lord_n shall_v choose_v shall_v show_v thou_o and_o thou_o shall_v observe_v to_o do_v according_a to_o all_o they_o shall_v inform_v thou_o where_o the_o place_n which_o god_n shall_v shall_v die_v and_o thou_o shall_v put_v away_o the_o evil_a from_o israel_n this_o be_v as_o absolute_a authority_n as_o the_o most_o absolute_a monarch_n in_o the_o world_n can_v challenge_v that_o disobedience_n to_o their_o last_o and_o final_a determination_n what_o ever_o the_o cause_n be_v shall_v be_v punish_v with_o death_n and_o what_o place_n can_v there_o be_v for_o resistance_n in_o such_o a_o constitution_n of_o government_n as_o this_o it_o be_v say_v indeed_o in_o v_o 11._o according_a to_o the_o sentence_n of_o the_o law_n which_o they_o shall_v teach_v thou_o and_o according_a to_o the_o judgement_n that_o they_o shall_v tell_v thou_o thou_o shall_v do_v and_o hence_o some_o conclude_v that_o they_o be_v not_o bind_v to_o abide_v by_o their_o sentence_n nor_o be_v punishable_a if_o they_o do_v not_o but_o only_o in_o such_o case_n when_o they_o give_v sentence_n according_a to_o the_o law_n of_o god_n but_o these_o man_n do_v not_o consider_v that_o the_o matter_n in_o controversy_n be_v suppose_v to_o be_v doubtful_a and_o such_o as_o can_v not_o be_v determine_v by_o the_o inferior_a court_n and_o therefore_o be_v submit_v to_o the_o decision_n of_o the_o supreme_a judge_n and_o as_o he_o determine_v so_o they_o must_v do_v and_o no_o man_n under_o the_o penalty_n of_o death_n must_v presume_v to_o do_v otherwise_o which_o take_v away_o all_o liberty_n of_o judge_v from_o private_a person_n though_o this_o supreme_a judge_n may_v possible_o mistake_v in_o his_o judgement_n as_o all_o humane_a judicature_n be_v liable_a to_o mistake_n but_o it_o seem_v god_n almighty_n think_v it_o necessary_a that_o there_o shall_v be_v some_o final_a judgement_n from_o whence_o there_o shall_v be_v no_o appeal_n notwithstanding_o the_o possibility_n of_o a_o mistake_n in_o it_o so_o that_o there_o be_v a_o supreme_a and_o sovereign_a that_o be_v unaccountable_a and_o irresistible_a power_n in_o the_o jewish_a nation_n appoint_v by_o god_n that_o when_o the_o jew_n will_v have_v a_o king_n their_o king_n be_v invest_v with_o this_o supreme_a and_o irresistible_a power_n for_o when_o they_o desire_v a_o king_n they_o do_v not_o desire_v our_o country_n command_v we_o not_o to_o resist_v and_o if_o death_n a_o illegal_a unjust_a death_n follow_v upon_o that_o i_o can_v help_v it_o god_n and_o our_o country_n must_v answer_v for_o it_o it_o be_v a_o wonderful_a discovery_n which_o this_o author_n have_v make_v that_o when_o we_o suffer_v against_o law_n we_o be_v condemn_v by_o no_o law_n to_o die●_n for_o if_o we_o be_v we_o can_v not_o suffer_v against_o law_n and_o it_o be_v as_o wonderful_a a_o argument_n he_o use_v to_o prove_v that_o we_o may_v resist_v when_o we_o be_v persecute_v against_o law_n because_o we_o be_v condemn_v by_o no_o law_n to_o die_v which_o be_v suppose_v in_o the_o very_a question_n and_o be_v neither_o more_o nor_o less_o than_o to_o affirm_v the_o thing_n which_o he_o be_v to_o prove_v we_o may_v resist_v a_o prince_n who_o persecute_v against_o law_n because_o we_o be_v condemn_v by_o no_o law_n that_o be_v because_o he_o persecute_v against_o law_n this_o prove_v indeed_o that_o we_o ought_v not_o to_o die_v when_o we_o be_v condemn_v by_o no_o law_n to_o die_v but_o whether_o we_o may_v preserve_v ourselves_o from_o a_o unjust_a and_o violent_a death_n by_o resist_v a_o persecute_v prince_n be_v another_o question_n 2._o it_o be_v urge_v that_o a_o prince_n have_v no_o authority_n against_o law_n there_o be_v no_o authority_n on_o earth_n above_o the_o law_n much_o less_o against_o it_o it_o be_v murder_n to_o put_v a_o man_n to_o death_n against_o law_n and_o if_o they_o know_v who_o have_v authority_n to_o commit_v open_a bare-faced_n and_o downright_a murder_n this_o will_v direct_v they_o where_o to_o pay_v their_o passive_a obedience_n but_o it_o will_v be_v the_o horride_v slander_n in_o the_o world_n to_o say_v that_o any_o such_o power_n be_v lodge_v in_o the_o prerogative_n as_o to_o destroy_v man_n contrary_a to_o law_n now_o i_o perfect_o agree_v with_o they_o in_o this_o also_o that_o a_o prince_n have_v no_o just_a and_o legal_a authority_n to_o act_v against_o law_n that_o if_o he_o know_o persecure_v any_o subject_n to_o death_n contrary_a to_o law_n he_o be_v a_o murderer_n and_o that_o no_o prince_n have_v any_o such_o prerogative_n to_o commit_v open_a bare-faced_n and_o downright_a murder_n but_o what_o follow_v from_o hence_o do_v it_o hence_o follow_v therefore_o we_o may_v resist_v and_o oppose_v they_o if_o they_o do_v this_o i_o absolute_o deny_v because_o god_n have_v express_o command_v we_o not_o to_o resist_v and_o i_o see_v no_o inconsistencie_n between_o these_o two_o proposition_n that_o a_o prince_n have_v no_o legal_a authority_n to_o persecute_v against_o law_n and_o yet_o that_o he_o must_v not_o be_v resist_v when_o he_o do_v both_o the_o law_n of_o god_n and_o the_o law_n of_o our_o country_n suppose_v these_o two_o to_o be_v very_o consistent_a for_o notwithstanding_o the_o possibility_n that_o prince_n may_v abuse_v their_o power_n and_o transgress_v the_o law_n whereby_o they_o ought_v to_o govern_v yet_o they_o command_v subject_n in_o no_o case_n to_o resist_v and_o it_o be_v not_o sufficient_a to_o justify_v resistance_n if_o prince_n do_v what_o they_o have_v no_o just_a authority_n to_o do_v unless_o we_o have_v also_o a_o just_a authority_n to_o resist_v he_o who_o exceed_v the_o just_a bound_n of_o his_o authority_n be_v liable_a to_o be_v call_v to_o a_o account_n for_o it_o but_o he_o be_v accountable_a only_o to_o those_o who_o have_v a_o superior_a authority_n to_o call_v he_o to_o a_o account_n no_o power_n whatever_o be_v accountable_a to_o a_o inferior_a for_o this_o be_v a_o contradiction_n to_o the_o very_a notion_n of_o power_n and_o destructive_a of_o all_o order_n and_o government_n inferior_a magistrate_n be_v on_o all_o hand_n acknowledge_v to_o be_v liable_a to_o give_v a_o account_n of_o the_o abuse_n of_o their_o power_n but_o to_o who_o must_v they_o give_v a_o account_n not_o to_o their_o inferior_n not_o to_o the_o people_n who_o they_o be_v to_o govern_v but_o to_o superior_a magistrate_n or_o to_o the_o sovereign_a prince_n who_o govern_v all_o thus_o the_o sovereign_a prince_n may_v exceed_v his_o authority_n and_o be_v accountable_a for_o it_o to_o a_o superior_a power_n but_o because_o he_o have_v no_o superior_a power_n on_o earth_n he_o can_v be_v resist_v by_o his_o own_o subject_n but_o must_v be_v reserve_v to_o the_o judgement_n of_o god_n who_o alone_o be_v the_o king_n of_o king_n to_o justify_v our_o resistance_n of_o any_o power_n there_o be_v two_o thing_n to_o be_v prove_v 1._o that_o this_o power_n have_v exceed_v its_o just_a authority_n 2._o that_o we_o have_v authority_n to_o resist_v now_o these_o man_n indeed_o prove_v the_o first_o very_o well_o that_o prince_n who_o be_v to_o govern_v by_o law_n exceed_v their_o legal_a authority_n when_o they_o persecute_v against_o law_n but_o they_o say_v not_o one_o word_n of_o the_o second_o that_o subject_n have_v authority_n to_o resist_v their_o prince_n who_o persecute_v against_o law_n which_o be_v the_o only_a thing_n that_o need_v proof_n but_o this_o be_v a_o hard_a task_n and_o therefore_o they_o think_v it_o more_o adviseable_a to_o take_v it_o for_o grant_v than_o to_o attempt_v to_o prove_v it_o they_o say_v indeed_o that_o a_o inauthoritative_a act_n which_o carry_v no_o obligation_n at_o all_o can_v oblige_v subject_n to_o obedience_n now_o this_o be_v manifest_o true_a if_o by_o obedience_n they_o mean_v a_o active_a obedience_n for_o i_o be_o not_o bind_v to_o do_v a_o ill_a thing_n or_o a_o illegal_a action_n because_o my_o prince_n command_v i_o but_o if_o they_o mean_v passive_a obedience_n it_o be_v as_o manifest_o false_a for_o i_o be_o bind_v to_o obey_v that_o be_v not_o to_o resist_v my_o prince_n when_o he_o offer_v the_o most_o unjust_a and_o illegal_a violence_n nay_o it_o be_v very_o false_a and_o absurd_a to_o say_v that_o every_o illegal_a be_v a_o inauthoritative_a act_n which_o carry_v no_o obligation_n with_o it_o this_o be_v contrary_a to_o the_o practice_n of_o all_o humane_a judicature_n and_o the_o daily_a experience_n of_o man_n who_o suffer_v in_o their_o life_n body_n or_o estate_n by_o a_o unjust_a and_o illegal_a sentence_n every_o judgement_n contrary_a to_o the_o true_a meaning_n of_o the_o law_n be_v in_o that_o sense_n illegal_a and_o yet_o such_o illegal_a judgement_n have_v their_o authority_n and_o obligation_n till_o they_o be_v rescind_v by_o some_o high_a authority_n this_o be_v the_o true_a reason_n of_o appeal_n from_o inferior_a to_o superior_a court_n to_o rectify_v illegal_a proceed_n and_o reverse_v illegal_a judgement_n which_o suppose_v that_o such_o illegal_a act_n have_v authority_n till_o they_o be_v make_v null_n and_o void_a by_o a_o high_a power_n and_o if_o the_o high_a power_n from_o whence_o lie_v no_o appeal_n confirm_v and_o ratify_v a_o unjust_a and_o illegal_a sentence_n it_o carry_v so_o much_o authority_n and_o obligation_n with_o it_o that_o the_o injure_a person_n have_v no_o redress_n but_o must_v patient_o submit_v and_o thus_o it_o must_v necessary_o be_v or_o there_o can_v be_v no_o end_n of_o dispute_n nor_o any_o order_n and_o government_n in_o humane_a society_n and_o this_o be_v a_o plain_a demonstration_n that_o though_o the_o law_n be_v the_o rule_n according_a to_o which_o prince_n ought_v to_o exercise_v their_o authority_n and_o power_n yet_o the_o authority_n be_v not_o in_o law_n but_o in_o person_n for_o otherwise_o why_o be_v not_o a_o sentence_n pronounce_v according_a to_o law_n by_o a_o private_a person_n of_o as_o much_o authority_n as_o a_o sentence_n
pronounce_v by_o a_o judge_n how_o do_v a_o illegal_a sentence_n pronounce_v by_o a_o judge_n come_v to_o have_v any_o authority_n for_o a_o sentence_n contrary_a to_o law_n can_v have_v the_o authority_n of_o the_o law_n why_o be_v a_o legal_a or_o illegal_a sentence_n reversible_a and_o alterable_a when_o pronounce_v by_o one_o judge_n and_o irreversible_a and_o unalterable_a when_o pronounce_v by_o another_o for_o the_o law_n be_v the_o same_o and_o the_o sentence_n be_v the_o same_o either_o according_a to_o law_n or_o against_o it_o whoever_o the_o judge_n be_v but_o it_o seem_v the_o authority_n of_o the_o person_n be_v not_o the_o same_o and_o that_o make_v the_o difference_n so_o that_o there_o be_v a_o authority_n in_o person_n in_o some_o sense_n distinct_a from_o the_o authority_n of_o law_n nay_o superior_a to_o it_o for_o there_o be_v such_o a_o authority_n as_o though_o it_o can_v make_v a_o illegal_a act_n legal_a yet_o can_v and_o often_o do_v make_v a_o illegal_a act_n bind_v and_o obligatorie_n to_o the_o subject_n when_o pronounce_v by_o a_o competent_a judge_n if_o it_o be_v say_v that_o this_o very_a authority_n be_v owe_v to_o the_o law_n which_o appoint_v judge_n and_o magistrate_n to_o decide_v controversy_n and_o order_n appeal_n from_o inferior_a to_o superior_a court_n i_o will_v only_o ask_v one_o short_a question_n whether_o the_o law_n give_v authority_n to_o any_o person_n to_o judge_v contrary_a to_o law_n if_o it_o do_v not_o than_o all_o illegal_a act_n be_v null_n and_o void_a and_o lay_v no_o obligation_n on_o the_o subject_a and_o yet_o this_o be_v manifest_o false_a according_a to_o the_o know_a practice_n of_o all_o the_o know_a government_n in_o the_o world_n the_o most_o illegal_a judgement_n be_v valid_a till_o it_o be_v reverse_v by_o some_o superior_a power_n and_o the_o judgement_n of_o the_o supreme_a power_n though_o never_o so_o illegal_a can_v be_v repeal_v by_o no_o authority_n but_o its_o own_o and_o yet_o it_o be_v absurd_a to_o say_v that_o the_o law_n give_v any_o man_n authority_n to_o judge_n contrary_a to_o law_n for_o to_o be_v sure_a this_o be_v beside_o the_o end_n and_o intention_n of_o the_o law_n whence_o then_o do_v a_o illegal_a act_n or_o judgement_n derive_v its_o authority_n and_o obligation_n the_o answer_n be_v plain_a it_o be_v from_o the_o authority_n of_o the_o person_n who_o act_n or_o judgement_n it_o be_v it_o will_v be_v of_o great_a use_n to_o this_o controversy_n to_o make_v this_o plain_a and_o obvious_a to_o every_o understanding_n which_o therefore_o i_o shall_v endeavour_v to_o do_v as_o brief_o as_o may_v be_v 1._o then_o i_o observe_v that_o there_o must_v be_v a_o personal_a power_n and_o authority_n antecedent_n to_o all_o civil_a law_n for_o there_o can_v be_v no_o law_n without_o a_o lawmaker_n and_o there_o can_v be_v no_o lawmaker_n unless_o there_o be_v one_o or_o more_o person_n invest_v with_o the_o power_n of_o government_n of_o which_o make_v law_n be_v one_o branch_n for_o a_o law_n be_v nothing_o else_o but_o the_o public_a and_o declare_a will_n and_o command_v of_o the_o lawmaker_n whether_o he_o be_v the_o sovereign_a prince_n or_o the_o people_n 2._o and_o hence_o it_o necessary_o follow_v that_o a_o sovereign_a prince_n do_v not_o receive_v his_o authority_n from_o the_o law_n but_o law_n receive_v their_o authority_n from_o he_o we_o be_v often_o indeed_o mind_v of_o what_o bracton_n say_v lex_fw-la facit_fw-la regem_fw-la that_o the_o law_n make_v the_o king_n by_o which_o that_o great_a lawyer_n be_v far_o enough_o from_o understanding_n that_o the_o king_n receive_v his_o sovereign_a power_n from_o the_o law_n for_o the_o law_n have_v no_o authority_n nor_o can_v give_v any_o but_o what_o it_o receive_v from_o the_o king_n and_o than_o it_o be_v a_o wonderful_a riddle_n how_o the_o king_n shall_v receive_v his_o authority_n from_o the_o law_n but_o when_o he_o say_v the_o law_n make_v the_o king_n he_o distinguish_v a_o king_n from_o a_o tyrant_n and_o his_o meaning_n be_v that_o to_o govern_v by_o law_n make_v a_o sovereign_a prince_n a_o king_n as_o king_n signify_v a_o just_a and_o equal_a and_o beneficial_a power_n and_o authority_n as_o appear_v from_o the_o reason_n he_o give_v for_o it_o non_fw-la est_fw-la enim_fw-la rex_fw-la ubi_fw-la dominatur_fw-la voluntas_fw-la &_o non_fw-la lex_fw-la he_o be_v no_o king_n who_o govern_v by_o arbitrarie_a will_n and_o not_o by_o law_n not_o that_o he_o be_v no_o sovereign_a prince_n but_o he_o be_v a_o tyrant_n and_o not_o a_o king_n 3._o and_o hence_o it_o evident_o follow_v that_o the_o be_v of_o sovereign_a power_n be_v independent_a on_o law_n that_o be_v as_o a_o sovereign_a prince_n do_v not_o receive_v his_o power_n from_o the_o law_n so_o shall_v he_o violate_v the_o law_n by_o which_o he_o be_v bind_v to_o govern_v yet_o he_o do_v not_o forfeit_v his_o power_n he_o break_v his_o faith_n to_o god_n and_o to_o his_o country_n but_o he_o be_v a_o sovereign_a prince_n still_o and_o this_o be_v in_o effect_n acknowledge_v by_o these_o man_n who_o so_o free_o confess_v that_o let_v a_o prince_n be_v what_o he_o will_v though_o he_o trample_v upon_o all_o law_n and_o exercise_v a_o arbitrarie_a and_o illegal_a authority_n yet_o his_o person_n be_v sacred_a and_o inviolable_a and_o irresistible_a he_o must_v not_o be_v touch_v nor_o oppose_v and_o allow_v that_o say_n of_o david_n to_o be_v scripture_n still_o who_o can_v stretch_v forth_o his_o hand_n against_o the_o lord_n be_v anoint_v and_o be_v guiltless_a now_o what_o be_v it_o that_o make_v the_o person_n of_o a_o king_n more_o inviolable_a and_o unaccountable_a than_o other_o man_n nothing_o that_o i_o know_v of_o but_o his_o sacred_a and_o inviolable_a authority_n and_o therefore_o it_o seem_v though_o he_o act_v against_o law_n yet_o he_o be_v a_o sovereign_a prince_n and_o the_o lord_n be_v anoint_v still_o or_o else_o i_o see_v no_o reason_n why_o they_o may_v not_o destroy_v his_o person_n also_o and_o yet_o if_o nothing_o but_o a_o inviolable_a and_o unaccountable_a authority_n can_v make_v the_o person_n of_o the_o king_n inviolable_a and_o unaccountable_a i_o will_v glad_o know_v how_o it_o become_v lawful_a to_o resist_v his_o authority_n and_o unlawful_a to_o resist_v his_o person_n i_o will_v desire_v these_o man_n to_o tell_v i_o whether_o a_o sovereign_a prince_n signify_v the_o natural_a person_n or_o the_o authority_n of_o a_o king_n and_o if_o to_o divest_v he_o of_o his_o authority_n be_v to_o kill_v the_o king_n why_o they_o may_v not_o kill_v the_o man_n too_o when_o they_o have_v kill_v the_o king_n thus_o when_o man_n be_v force_v to_o mince_v treason_n and_o rebellion_n they_o always_o speak_v nonsense_n those_o indeed_o who_o resist_v the_o authority_n of_o their_o prince_n but_o spare_v his_o person_n do_v better_a than_o those_o who_o kill_v he_o but_o those_o who_o affirm_v that_o his_o person_n be_v as_o resistible_a and_o accountable_a as_o his_o authority_n speak_v more_o consistent_o with_o themselves_o and_o the_o principle_n of_o rebellion_n 4._o and_o hence_o i_o suppose_v it_o plain_o appear_v that_o every_o illegal_a act_n the_o king_n do_v be_v not_o a_o inauthoritative_a act_n but_o lay_v a_o obligation_n on_o subject_n to_o yield_v if_o not_o a_o active_a yet_o a_o passive_a obedience_n for_o the_o king_n receive_v not_o his_o sovereign_a authority_n from_o the_o law_n nor_o do_v he_o forfeit_v his_o authority_n by_o break_v the_o law_n and_o therefore_o he_o be_v a_o sovereign_a prince_n still_o and_o his_o most_o illegal_a act_n though_o they_o have_v not_o the_o authority_n of_o the_o law_n yet_o they_o have_v the_o authority_n of_o sovereign_a power_n which_o be_v irresistible_a and_o unaccountable_a in_o a_o word_n it_o do_v not_o become_v any_o man_n who_o can_v think_v three_o consequence_n off_o to_o talk_v of_o the_o authority_n of_o law_n in_o derogation_n to_o the_o authority_n of_o the_o sovereign_a power_n the_o sovereign_a power_n make_v the_o law_n and_o can_v repeal_v they_o and_o dispense_v with_o they_o and_o make_v new_a law_n the_o only_a power_n and_o authority_n of_o the_o law_n be_v in_o the_o power_n which_o can_v make_v and_o execute_v law_n sovereign_a power_n be_v inseparable_a from_o the_o person_n of_o a_o sovereign_a prince_n and_o though_o the_o exercise_n of_o it_o may_v be_v regulate_v by_o law_n and_o that_o prince_n do_v very_o ill_a who_o have_v consent_v to_o such_o a_o regulation_n break_v the_o law_n yet_o when_o he_o act_v contrary_a to_o law_n such_o act_n carry_v sovereign_a and_o irresistible_a authority_n with_o they_o while_o he_o continue_v a_o sovereign_a prince_n but_o if_o it_o be_v possible_a to_o convince_v all_o man_n how_o vain_a this_o pretence_n of_o law_n be_v to_o justify_v
of_o king_n be_v like_a to_o be_v very_o chargeable_a and_o oppressive_a to_o they_o he_o will_v take_v your_o son_n and_o appoint_v they_o for_o himself_o for_o his_o chariot_n and_o to_o be_v his_o horseman_n and_o some_o shall_v run_v before_o his_o chariot_n and_o he_o will_v appoint_v he_o captain_n over_o thousand_o and_o captain_n over_o fifty_n and_o will_v set_v they_o to_o ear_n his_o ground_n and_o to_o reap_v his_o harvest_n and_o thus_o in_o several_a particular_n he_o acquaint_v they_o what_o burden_n and_o exaction_n they_o will_v bring_v upon_o themselves_o by_o set_v up_o a_o king_n which_o they_o be_v then_o free_a from_o and_o if_o any_o prince_n shall_v be_v excessive_a in_o such_o exaction_n yet_o they_o have_v no_o way_n to_o help_v themselves_o they_o must_v not_o resist_v nor_o rebel_v against_o he_o nor_o expect_v that_o what_o inconvenience_n they_o may_v find_v in_o kingly_a government_n god_n will_v relieve_v and_o deliver_v they_o from_o it_o when_o once_o they_o have_v choose_v a_o king_n you_o shall_v cry_v out_o in_o that_o day_n because_o of_o your_o king_n which_o you_o have_v choose_v you_o and_o the_o lord_n will_v not_o hear_v you_o in_o that_o day_n v_o 18._o that_o be_v god_n will_v not_o alter_v the_o government_n for_o you_o again_o how_o much_o soever_o you_o may_v complain_v of_o it_o this_o i_o say_v be_v a_o plain_a proof_n that_o their_o king_n be_v invest_v with_o that_o sovereign_a power_n which_o must_v not_o be_v resist_v though_o they_o oppress_v their_o subject_n to_o maintain_v their_o own_o state_n and_o the_o grandeur_n and_o magnificence_n of_o their_o kingdom_n but_o i_o can_v think_v that_o these_o word_n contain_v the_o original_a grant_n and_o charter_n of_o regal_a power_n but_o only_o the_o translation_n of_o that_o power_n which_o be_v former_o in_o their_o high-priest_n or_o judge_n to_o king_n king_n have_v no_o more_o power_n than_o their_o other_o governor_n have_v for_o there_o can_v be_v no_o power_n great_a than_o that_o which_o be_v irresistible_a but_o this_o power_n in_o the_o hand_n of_o king_n be_v likely_a to_o be_v more_o burdensome_a and_o oppressive_a to_o they_o than_o it_o be_v in_o the_o hand_n of_o their_o priest_n and_o judge_n by_o reason_n of_o their_o different_a way_n of_o live_v which_o be_v the_o only_a argument_n samuel_n use_v to_o dissuade_v they_o from_o transfer_v the_o supreme_a and_o sovereign_a power_n to_o prince_n and_o therefore_o i_o rather_o choose_v to_o translate_v mishpat_o as_o our_o translator_n do_v by_o the_o manner_n of_o the_o king_n than_o as_o other_o learned_a man_n do_v by_o the_o right_n of_o the_o king_n thereby_o understand_v the_o original_a charter_n of_o kingly_a power_n for_o it_o be_v not_o the_o regal_a power_n which_o samuel_n here_o blame_v which_o be_v no_o other_o but_o the_o very_a same_o power_n which_o he_o himself_o have_v while_o he_o be_v supreme_a judge_n of_o israel_n but_o their_o pompous_a way_n of_o live_v which_o will_v prove_v very_o oppressive_a and_o burdensome_a to_o they_o and_o be_v apt_a to_o make_v they_o complain_v who_o have_v not_o be_v use_v to_o such_o exaction_n and_o here_o before_o i_o proceed_v give_v i_o leave_v to_o make_v a_o short_a digression_n in_o vindication_n of_o kingly_a government_n which_o some_o man_n think_v be_v great_o disparage_v by_o this_o story_n for_o 1._o it_o be_v evident_a that_o god_n be_v angry_a with_o the_o jew_n for_o desire_v a_o king_n and_o declare_v his_o anger_n against_o they_o by_o send_v a_o violent_a tempest_n of_o thunder_n and_o rain_n in_o wheat-harvest_n which_o make_v they_o confess_v that_o they_o have_v add_v to_o all_o their_o sin_n this_o evil_a to_o ask_v a_o king_n 1_o sam._n 12._o 16_o 17._o etc._n etc._n from_o whence_o some_o conclude_v that_o kingly_a power_n and_o authority_n be_v so_o far_o from_o be_v the_o original_a appointment_n and_o constitution_n of_o god_n that_o it_o be_v displease_v to_o he_o and_o 2._o that_o samuel_n in_o describe_v the_o manner_n of_o the_o king_n represent_v it_o as_o oppressive_a and_o uneasy_a to_o subject_n and_o much_o more_o burdensome_a and_o less_o desirable_a than_o other_o form_n of_o government_n 1._o as_o for_o the_o first_o it_o must_v be_v acknowledge_v that_o god_n be_v angry_a with_o the_o child_n of_o israel_n for_o ask_v a_o king_n but_o then_o these_o man_n mistake_v the_o reason_n which_o be_v not_o because_o god_n be_v a_o enemy_n to_o kingly_a government_n but_o because_o he_o himself_o be_v the_o king_n of_o israel_n and_o by_o ask_v a_o king_n to_o go_v in_o and_o out_o before_o they_o they_o express_v a_o dislike_n of_o god_n government_n of_o they_o thus_o god_n tell_v samuel_n they_o have_v not_o reject_v thou_o but_o they_o have_v reject_v i_o that_o i_o shall_v not_o reign_v over_o they_o 1_o sam._n 8._o 7._o and_o thus_o samuel_n aggravate_v their_o sin_n that_o they_o say_v nay_o but_o a_o king_n shall_v reign_v over_o we_o when_o the_o lord_n your_o god_n be_v your_o king_n 12_o chap._n 12._o v._n now_o the_o crime_n have_v be_v the_o same_o have_v they_o set_v up_o a_o aristocratical_a or_o democratical_a government_n as_o well_o as_o regal_a power_n in_o derogation_n of_o god_n government_n of_o they_o their_o fault_n be_v not_o in_o choose_v to_o be_v govern_v by_o a_o single_a person_n for_o so_o they_o have_v be_v govern_v all_o along_o by_o moses_n and_o joshua_n by_o their_o high_a priest_n or_o those_o other_o extraordinary_a judge_n who_o god_n have_v raise_v up_o and_o at_o this_o very_a time_n by_o samuel_n himself_o for_o it_o be_v a_o great_a mistake_n to_o think_v that_o the_o jew_n before_o they_o choose_v a_o king_n be_v govern_v by_o a_o synedrial_a power_n like_o a_o aristocracy_n or_o democracy_n which_o there_o be_v not_o the_o least_o appearance_n of_o in_o all_o the_o sacred_a history_n for_o as_o for_o those_o person_n who_o moses_n by_o the_o advice_n of_o jethro_n set_v over_o the_o people_n they_o be_v not_o a_o supreme_a or_o sovereign_a tribunal_n but_o such_o subordinate_a magistrate_n as_o every_o prince_n make_v use_v of_o for_o administer_a justice_n to_o the_o people_n they_o be_v ruler_n of_o thousand_o ruler_n of_o hundred_o ruler_n of_o fifty_n ruler_n of_o ten_o 18_o exod._n 21._o and_o be_v so_o far_o from_o be_v one_o stand_v judicature_n that_o they_o be_v divide_v among_o their_o several_a tribe_n and_o family_n and_o be_v so_o far_o from_o be_v supreme_a that_o moses_n still_o reserve_v all_o difficult_a case_n and_o last_o appeal_v that_o be_v the_o true_a sovereign_a power_n to_o himself_o as_o it_o be_v afterward_o by_o a_o express_a law_n reserve_v to_o the_o high_a priest_n and_o judge_n extraordinary_o appoint_v and_o there_o be_v so_o little_a appearance_n of_o this_o sovereign_a tribunal_n in_o samuel_n day_n that_o he_o himself_o go_v in_o circuit_n every_o year_n as_o our_o judge_n now_o do_v to_o bethel_n and_o gilgal_n and_o mizpeh_n and_o judge_v israel_n 1_o sam._n 7._o 16._o but_o the_o fault_n of_o israel_n in_o ask_v a_o king_n be_v this_o that_o they_o prefer_v the_o government_n of_o a_o king_n before_o the_o immediate_a government_n of_o god_n for_o the_o understanding_n of_o which_o it_o will_v be_v necessary_a to_o consider_v brief_o how_o god_n government_n of_o israel_n differ_v from_o their_o government_n by_o king_n for_o when_o they_o have_v choose_v a_o king_n do_v god_n cease_v to_o be_v the_o king_n of_o israel_n be_v not_o their_o king_n god_n minister_n and_o vicegerent_n as_o their_o ruler_n and_o judge_n be_v before_o be_v not_o the_o king_n god_n be_v anoint_v and_o do_v he_o not_o receive_v the_o law_n and_o rule_n of_o government_n from_o he_o yes_o this_o be_v in_o some_o measure_n true_a and_o yet_o the_o difference_n be_v very_o great_a while_o god_n be_v the_o king_n of_o israel_n though_o he_o appoint_v a_o supreme_a visible_a authority_n in_o the_o nation_n yet_o the_o exercise_n of_o this_o authority_n be_v under_o the_o immediate_a direction_n and_o government_n of_o god_n moses_n and_o joshua_n do_v not_o stir_v a_o step_n nor_o attempt_v any_o thing_n without_o god_n order_n no_o more_o than_o a_o menial_a servant_n do_v without_o the_o direction_n of_o his_o master_n in_o time_n of_o peace_n they_o be_v under_o the_o ordinary_a government_n of_o the_o high_a priest_n who_o be_v god_n immediate_a servant_n who_o declare_v the_o law_n to_o they_o and_o in_o difficult_a case_n refer_v the_o cause_n to_o god_n who_o give_v forth_o his_o answer_n by_o he_o when_o they_o be_v oppress_v by_o their_o enemy_n which_o god_n never_o permit_v but_o for_o their_o sin_n when_o they_o repent_v and_o beg_v god_n pardon_v and_o deliverance_n god_n raise_v up_o some_o extraordinary_a person_n endue_v with_o a_o

shall_v distinct_o consider_v the_o doctrine_n of_o christ_n while_o he_o live_v on_o earth_n and_o here_o be_v several_a thing_n very_o fit_a to_o be_v observe_v 1._o we_o have_v no_o reason_n to_o suspect_v that_o christ_n will_v alter_v the_o right_n of_o sovereign_a power_n and_o the_o measure_n of_o obedience_n and_o subjection_n which_o be_v fix_v and_o determine_v by_o god_n himself_o this_o be_v no_o part_n of_o his_o commission_n to_o change_v the_o external_a form_n and_o polity_n of_o civil_a government_n which_o be_v a_o act_n of_o secular_a power_n and_o authority_n and_o do_v not_o belong_v to_o a_o spiritual_a prince_n he_o who_o will_v not_o undertake_v to_o decide_v a_o petty_a controversy_n or_o to_o divide_v a_o inheritance_n between_o two_o contend_a brethren_n 12_o luke_n 13_o 14._o can_v we_o think_v that_o he_o will_v attempt_v any_o thing_n of_o that_o vast_a consequence_n as_o the_o change_n and_o alteration_n of_o civil_a power_n which_o will_v have_v unsettle_a the_o fundamental_a constitution_n of_o all_o the_o government_n of_o the_o world_n at_o that_o time_n our_o saviour_n tell_v we_o that_o he_o come_v not_o to_o destroy_v the_o law_n and_o the_o prophet_n but_o to_o fulfil_v it_o 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d to_o fill_v it_o up_o to_o complete_a and_o perfect_a it_o 5_o matth._n 17._o that_o be_v to_o fulfil_v the_o ancient_a type_n instance_n and_o degree_n of_o virtue_n but_o he_o abrogate_a no_n moral_a law_n and_o therefore_o not_o the_o law_n of_o obedience_n and_o subjection_n to_o prince_n which_o have_v always_o be_v reduce_v to_o the_o five_o commandment_n nay_o he_o abrogate_a no_o law_n but_o by_o perfect_v and_o fulfil_v they_o and_o therefore_o he_o can_v make_v no_o alteration_n in_o the_o doctrine_n of_o nonresistance_n which_o be_v as_o perfect_a subjection_n as_o can_v or_o aught_o to_o be_v pay_v to_o sovereign_a prince_n his_o kingdom_n be_v not_o of_o this_o world_n as_o he_o tell_v pilate_n though_o he_o be_v a_o king_n he_o neither_o be_v a_o enemy_n nor_o rival_n to_o caesar_n but_o have_v he_o absolve_v his_o disciple_n from_o their_o obedience_n to_o prince_n have_v he_o make_v it_o in_o any_o case_n lawful_a to_o resist_v which_o be_v so_o express_o forbid_v the_o jew_n by_o god_n himself_o and_o which_o be_v such_o a_o contradiction_n to_o the_o very_a notion_n of_o sovereign_a power_n he_o have_v be_v somewhat_o worse_o than_o a_o rival_n to_o all_o the_o prince_n of_o the_o earth_n for_o though_o he_o have_v set_v up_o no_o kingdom_n of_o his_o own_o yet_o he_o have_v pull_v down_o they_o whereas_o he_o take_v great_a care_n that_o his_o religion_n shall_v give_v no_o disturbance_n to_o the_o world_n nor_o create_v any_o reasonable_a jealousy_n and_o suspicion_n to_o prince_n who_o have_v be_v very_o excusable_a for_o their_o aversion_n to_o christianity_n have_v it_o invade_v the_o right_n and_o royalty_n of_o their_o crown_n this_o make_v it_o very_o improbable_a that_o our_o saviour_n shall_v make_v any_o alteration_n in_o civil_a power_n or_o abridge_v the_o right_n of_o sovereignty_n which_o be_v so_o foreign_a to_o his_o design_n of_o come_v into_o the_o world_n and_o so_o incongruous_a to_o the_o person_n which_o he_o sustain_v and_o yet_o he_o can_v not_o alter_v the_o duty_n of_o subject_n but_o he_o must_v alter_v the_o right_n of_o prince_n too_o he_o must_v take_v away_o the_o sovereign_a power_n of_o prince_n at_o the_o same_o time_n that_o he_o make_v it_o lawful_a for_o subject_n in_o any_o case_n whatsoever_o to_o resist_v we_o may_v safe_o then_o conclude_v that_o our_o saviour_n have_v leave_v the_o government_n of_o the_o world_n as_o he_o find_v it_o he_o have_v indeed_o give_v such_o admirable_a law_n as_o will_v teach_v prince_n to_o govern_v and_o subject_n to_o obey_v better_a which_o be_v the_o most_o effectual_a way_n to_o secure_v the_o public_a peace_n and_o happiness_n to_o prevent_v the_o oppression_n of_o subject_n and_o rebellion_n against_o prince_n but_o he_o have_v not_o interpose_v in_o new_a model_v the_o government_n of_o the_o world_n which_o be_v not_o of_o such_o consequence_n as_o some_o man_n imagine_v it_o be_v not_o the_o external_a form_n of_o government_n but_o the_o fatherly_a care_n and_o prudence_n and_o justice_n of_o governor_n and_o the_o dutiful_a obedience_n of_o subject_n which_o can_v make_v any_o people_n happy_a if_o prince_n and_o subject_n be_v good_a christian_n they_o may_v be_v happy_a under_o most_o form_n of_o government_n if_o they_o be_v not_o they_o can_v be_v happy_a under_o none_o have_v our_o saviour_n give_v subject_n liberty_n to_o resist_v to_o depose_v to_o murder_v tyrannical_a prince_n he_o have_v do_v they_o no_o kindness_n at_o all_o for_o to_o give_v liberty_n to_o subject_n to_o resist_v be_v only_o to_o proclaim_v a_o universal_a licence_n to_o faction_n and_o sedition_n and_o civil_a war_n and_o if_o any_o man_n can_v think_v this_o such_o a_o mighty_a blessing_n to_o the_o world_n yet_o i_o think_v it_o be_v not_o a_o blessing_n proper_a for_o the_o prince_n of_o peace_n to_o give_v but_o he_o who_o instruct_v prince_n to_o rule_v as_o god_n minister_n and_o vicegerent_n and_o to_o express_v a_o fatherly_a care_n and_o concernment_n for_o the_o happiness_n of_o their_o subject_n and_o that_o teach_v subject_n to_o reverence_n and_o obey_v their_o prince_n as_o the_o image_n of_o god_n and_o quiet_o to_o submit_v and_o yield_v to_o his_o authority_n and_o that_o enforce_v th●se_a law_n both_o on_o prince_n and_o subject_n in_o the_o name_n and_o authority_n of_o god_n and_o from_o the_o consideration_n of_o the_o future_a judgement_n when_o prince_n who_o abuse_v their_o power_n shall_v give_v a_o account_n of_o it_o to_o their_o great_a master_n when_o subject_n who_o resist_v shall_v receive_v to_o themselves_o damnation_n and_o those_o who_o patient_o and_o quiet_o suffer_v for_o god_n sake_n shall_v have_v their_o injury_n redress_v and_o their_o obedience_n reward_v i_o say_v such_o a_o person_n as_o this_o take_v a_o more_o effectual_a course_n to_o reform_v the_o abuse_n of_o civil_a power_n and_o to_o preserve_v good_a government_n in_o the_o world_n than_o all_o our_o wise_a politician_n and_o state-mender_n who_o think_v to_o reform_v the_o government_n of_o the_o that_o can_v be_v do_v nay_o this_o be_v all_o that_o he_o can_v do_v in_o this_o matter_n he_o never_o usurp_v any_o civil_a power_n and_o authority_n and_o therefore_o can_v not_o new_a model_n the_o government_n of_o the_o world_n he_o never_o offer_v any_o external_a force_n and_o compulsion_n to_o make_v man_n obey_v his_o law_n and_o therefore_o neither_o force_n prince_n to_o rule_v well_o nor_o subject_n to_o obey_v but_o he_o have_v take_v the_o same_o care_n of_o the_o government_n of_o the_o world_n as_o he_o have_v do_v of_o all_o the_o other_o duty_n of_o piety_n and_o prevail_v so_o will_v the_o government_n of_o the_o world_n mend_v without_o alter_v the_o model_n and_o constitution_n of_o they_o 2._o but_o yet_o we_o have_v some_o positive_a evidence_n what_o our_o saviour_n teach_v about_o obedience_n to_o the_o high_a power_n i_o shall_v give_v you_o two_o instance_n of_o it_o which_o be_v as_o plain_a and_o express_v as_o can_v be_v desire_v 1._o the_o they_o come_v to_o he_o with_o great_a ceremony_n and_o address_n as_o to_o a_o infallible_a oracle_n to_o consult_v he_o in_o a_o very_a weighty_a case_n of_o conscience_n they_o express_v a_o great_a esteem_n and_o assurance_n of_o his_o sincerity_n and_o faithfulness_n and_o courage_n as_o well_o as_o of_o his_o unerring_a judgement_n in_o declare_v the_o will_n of_o god_n to_o they_o of_o man_n that_o be_v thou_o will_v not_o conceal_v nor_o pervert_v the_o truth_n for_o fear_n nor_o favour_n and_o then_o they_o propose_v a_o ensnare_a question_n to_o he_o tell_v we_o therefore_o what_o think_v thou_o be_v it_o lawful_a to_o give_v tribute_n to_o caesar_n or_o not_o they_o think_v it_o impossible_a that_o he_o shall_v give_v any_o answer_n to_o this_o which_o will_v not_o affirm_v that_o they_o may_v for_o there_o be_v a_o very_a potent_a faction_n among_o they_o who_o think_v it_o unlawful_a for_o the_o jew_n to_o own_o the_o authority_n or_o usurpation_n of_o any_o who_o custom_n fear_v to_o who_o fear_n honour_n to_o who_o honour_n 13_o rom._n 7._o whatever_o be_v due_a to_o sovereign_a prince_n and_o do_v not_o interfere_v with_o their_o duty_n to_o god_n that_o they_o must_v give_v to_o caesar_n who_o at_o this_o time_n be_v their_o sovereign_n in_o which_o answer_n there_o be_v several_a thing_n observable_a 1._o that_o our_o saviour_n do_v not_o examine_v into_o coesar_n right_a nor_o how_o he_o come_v by_o this_o sovereign_a power_n but_o as_o he_o find_v he_o in_o possession_n of_o it_o so_o he_o leave_v he_o and_o require_v they_o to_o render_v to_o he_o all_o the_o right_n of_o sovereignty_n 2._o that_o he_o do_v not_o particular_o determine_v what_o the_o thing_n of_o caesar_n be_v that_o be_v what_o his_o right_n be_v as_o a_o sovereign_a prince_n hence_o some_o man_n conclude_v that_o this_o text_n can_v prove_v nothing_o that_o we_o can_v learn_v from_o it_o what_o our_o saviour_n judgement_n be_v in_o this_o point_n that_o it_o be_v only_o a_o subtle_a answer_n which_o those_o who_o ask_v the_o question_n can_v make_v nothing_o of_o which_o be_v a_o proper_a return_n to_o their_o ensnare_a question_n this_o i_o think_v be_v as_o great_a a_o reproach_n to_o our_o saviour_n as_o they_o can_v well_o cast_v upon_o he_o that_o he_o who_o be_v the_o wisdom_n of_o god_n the_o great_a prophet_n and_o teacher_n of_o mankind_n shall_v return_v as_o sophistical_a and_o doubtful_a answer_n as_o the_o heathen_a oracle_n and_o that_o in_o a_o case_n which_o require_v and_o will_v admit_v a_o very_a plain_a answer_n it_o be_v true_a many_o time_n our_o saviour_n when_o he_o discourse_v of_o what_o concern_v his_o own_o person_n or_o the_o mystery_n of_o his_o kingdom_n which_o be_v not_o fit_a at_o that_o time_n to_o be_v publish_v in_o plain_a term_n use_v a_o mystical_a language_n as_o when_o he_o call_v his_o body_n the_o temple_n or_o he_o teach_v they_o by_o parable_n which_o be_v not_o obvious_a at_o the_o first_o hear_n but_o still_o what_o he_o say_v have_v a_o certain_a and_o determine_a sense_n and_o what_o be_v obscure_a and_o difficult_a he_o explain_v private_o to_o his_o apostle_n that_o in_o due_a time_n they_o may_v explain_v it_o to_o other_o but_o to_o assert_v as_o these_o man_n must_v do_v that_o christ_n give_v they_o such_o a_o answer_n as_o signify_v nothing_o and_o which_o he_o intend_v they_o shall_v understand_v nothing_o by_o show_v that_o they_o be_v not_o so_o civil_a to_o our_o saviour_n as_o these_o pharisee_n and_o herodian_o be_v who_o at_o least_o own_a in_o compliment_n master_n we_o know_v that_o thou_o be_v true_a and_o teach_v the_o way_n of_o god_n in_o truth_n neither_o care_v thou_o for_o any_o man_n for_o thou_o regard_v not_o the_o person_n of_o man_n but_o certain_o the_o pharisees_n do_v believe_v that_o there_o be_v something_o in_o our_o saviour_n answer_n for_o they_o marvel_v and_o leave_v he_o and_o go_v their_o way_n and_o yet_o those_o who_o have_v wit_n enough_o to_o ask_v such_o ensnare_a question_n can_v not_o be_v so_o dull_a as_o to_o be_v put_v off_o with_o a_o sophistical_a answer_n a_o art_n below_o the_o gravity_n of_o our_o saviour_n person_n and_o office_n but_o will_v have_v urge_v it_o a_o little_a further_o have_v they_o not_o be_v sensible_a that_o they_o be_v sufficient_o answer_v and_o have_v nothing_o to_o reply_v for_o indeed_o can_v any_o thing_n be_v plain_a than_o our_o saviour_n answer_n they_o ask_v he_o whether_o it_o be_v lawful_a to_o pay_v tribute_n to_o caesar_n he_o do_v not_o indeed_o in_o express_a word_n say_v that_o they_o shall_v pay_v tribute_n to_o caesar_n but_o he_o give_v they_o such_o a_o answer_n as_o withal_o convince_v they_o of_o the_o reason_n and_o necessity_n of_o it_o he_o ask_v who_o image_n and_o superscription_n be_v on_o the_o tribute-money_n they_o tell_v he_o coesar_n from_o whence_o he_o infer_v render_v therefore_o unto_o caesar_n the_o thing_n that_o be_v coesar_n therefore_o wherefore_o because_o the_o tribute-money_n have_v coesar_n image_n on_o it_o therefore_o they_o must_v render_v to_o caesar_n the_o thing_n that_o be_v coesar_n which_o certain_o signify_v that_o tribute_n be_v one_o of_o those_o thing_n which_o belong_v to_o caesar_n and_o must_v be_v render_v to_o he_o as_o appear_v by_o its_o have_v coesar_n image_n not_o as_o if_o every_o thing_n that_o have_v coesar_n mark_n and_o stamp_n on_o it_o do_v belong_v to_o caesar_n and_o must_v be_v give_v to_o he_o as_o some_o man_n profane_o enough_o how_o witty_o soever_o they_o imagine_v burlesque_fw-la and_o ridicule_fw-la our_o saviour_n answer_n for_o at_o this_o rate_n all_o the_o money_n of_o the_o empire_n which_o bear_v his_o image_n be_v coesar_n but_o the_o money_n which_o be_v stamp_v with_o coesar_n image_n and_o be_v the_o currant_n money_n of_o the_o nation_n be_v a_o plain_a sign_n as_o i_o observe_v before_o that_o he_o be_v their_o sovereign_n and_o pay_v tribute_n be_v a_o know_v right_o due_a to_o sovereign_a prince_n and_o therefore_o the_o very_a money_n which_o they_o use_v with_o coesar_n image_n on_o it_o resolve_v that_o question_n not_o only_o of_o the_o lawfulness_n but_o the_o necessity_n of_o pay_v tribute_n and_o this_o be_v so_o plain_a a_o answer_n that_o the_o pharisee_n be_v ashamed_a of_o their_o question_n and_o go_v away_o without_o make_v any_o reply_n for_o they_o no_o more_o dare_v to_o deny_v that_o caesar_n be_v their_o king_n than_o they_o think_v he_o dare_v either_o to_o own_o or_o deny_v the_o lawfulness_n of_o pay_v tribute_n to_o caesar_n and_o this_o be_v all_o the_o subtlety_n of_o our_o saviour_n answer_n but_o then_o our_o saviour_n not_o confine_v his_o answer_n mere_o to_o the_o case_n of_o pay_v tribute_n but_o answer_v in_o general_a that_o we_o must_v render_v to_o caesar_n the_o thing_n that_o be_v coesar_n extend_v this_o to_o all_o the_o right_n of_o sovereign_a prince_n and_o so_o become_v a_o stand_a rule_n in_o
as_o be_v absolute_a and_o unaccountable_a if_o there_o be_v no_o supreme_a power_n in_o any_o society_n when_o ever_o there_o happen_v any_o difference_n among_o the_o member_n of_o such_o a_o society_n nothing_o can_v be_v do_v and_o such_o a_o society_n be_v a_o arbitrary_a and_o voluntary_a not_o a_o govern_a society_n because_o there_o be_v no_o body_n to_o govern_v and_o no_o body_n to_o be_v govern_v they_o may_v govern_v themselves_o by_o mutual_a consent_n but_o if_o they_o can_v agree_v there_o be_v a_o end_n of_o their_o government_n where_o there_o be_v any_o government_n there_o must_v be_v somebody_o to_o govern_v and_o whoever_o have_v the_o power_n of_o government_n must_v not_o be_v contradict_v or_o resist_v for_o than_o he_o can_v govern_v for_o a_o power_n to_o govern_v man_n only_o when_o and_o in_o what_o case_n they_o please_v to_o be_v govern_v be_v no_o power_n now_o place_v this_o power_n where_o you_o will_v in_o a_o single_a person_n or_o in_o the_o hand_n of_o some_o select_a person_n or_o in_o the_o people_n and_o the_o case_n be_v the_o same_o where_o ever_o the_o power_n rest_v there_o it_o be_v absolute_a and_o unaccountable_a wherever_o there_o be_v any_o government_n there_o must_v be_v a_o last_o appeal_n and_o where_o the_o last_o appeal_n be_v whether_o to_o a_o prince_n to_o a_o parliament_n or_o to_o the_o people_n there_o be_v sovereign_a and_o absolute_a power_n which_o can_v be_v resist_v without_o a_o dissolution_n of_o government_n and_o return_v to_o a_o state_n of_o war_n which_o be_v a_o direct_a contradiction_n to_o the_o first_o institution_n of_o humane_a society_n and_o therefore_o that_o which_o can_v be_v allow_v by_o the_o fundamental_a constitution_n of_o any_o society_n the_o result_n of_o all_o in_o short_a be_v this_o 1._o that_o in_o all_o civil_a government_n there_o must_v be_v some_o supreme_a and_o sovereign_a power_n 2._o that_o the_o very_a notion_n of_o supreme_a power_n be_v that_o it_o be_v unaccountable_a and_o irresistible_a and_o therefore_o 3._o whatever_o power_n in_o any_o nation_n according_a to_o the_o fundamental_a law_n of_o its_o government_n can_v and_o ought_v not_o to_o be_v resist_v that_o be_v the_o supreme_a power_n of_o that_o nation_n the_o high_a power_n to_o which_o the_o apostle_n require_v we_o to_o be_v subject_a and_o from_o hence_o it_o be_v evident_a that_o the_o crown_n of_o england_n be_v a_o imperial_a crown_n and_o have_v all_o the_o right_n of_o sovereignty_n belong_v to_o it_o since_o according_a to_o the_o fundamental_a law_n of_o the_o realm_n the_o person_n and_o authority_n of_o the_o king_n be_v sacred_a and_o irresistible_a the_o oath_n of_o allegiance_n and_o supremacy_n those_o law_n which_o declare_v and_o acknowledge_v the_o king_n to_o be_v supreme_a in_o his_o dominion_n under_o god_n to_o have_v the_o sole_a power_n of_o the_o sword_n that_o it_o be_v treason_n to_o levy_v war_n against_o the_o king_n within_o the_o realm_n and_o without_o that_o both_o or_o either_o house_n of_o parliament_n can_v nor_o lawful_o may_v raise_v or_o levy_v war_n offensive_a or_o defensive_a against_o his_o majesty_n his_o heir_n or_o lawful_a successor_n that_o it_o be_v not_o lawful_a upon_o any_o pretence_n whatsoever_o to_o take_v arm_n against_o the_o king_n and_o that_o we_o must_v abhor_v that_o traitorous_a position_n of_o take_v arm_n by_o his_o authority_n against_o his_o person_n or_o against_o those_o who_o be_v commissionated_a by_o he_o these_o i_o say_v and_o such_o like_a declaration_n as_o these_o both_o former_o and_o of_o late_a make_v by_o both_o house_n of_o parliament_n and_o enact_v into_o public_a law_n be_v a_o sufficient_a proof_n that_o the_o supreme_a power_n of_o these_o realm_n be_v lodge_v in_o the_o prince_n for_o he_o who_o be_v unaccountable_a and_o irresistible_a be_v supreme_a but_o to_o avoid_v all_o this_o there_o be_v some_o who_o tell_v we_o that_o by_o the_o high_a power_n in_o the_o text_n the_o apostle_n mean_v the_o law_n for_o law_n be_v the_o high_a and_o most_o venerable_a authority_n in_o any_o nation_n and_o we_o ought_v indeed_o to_o be_v the_o law_n be_v as_o much_o superior_a to_o they_o as_o they_o be_v to_o their_o own_o subject_n and_o therefore_o when_o prince_n violate_v public_a law_n they_o be_v no_o long_o to_o own_v they_o for_o the_o high_a power_n but_o may_v vindicate_v the_o law_n against_o they_o may_v defend_v the_o legal_a authority_n of_o their_o prince_n against_o his_o personal_a usurpation_n may_v fight_v for_o the_o authority_n of_o the_o king_n against_o his_o person_n but_o in_o answer_n to_o this_o we_o may_v consider_v 1._o that_o it_o be_v evident_a from_o the_o whole_a context_n and_o manner_n of_o speak_v that_o the_o apostle_n do_v not_o here_o speak_v of_o law_n but_o person_n not_o of_o imperial_a law_n but_o sovereign_a prince_n law_n be_v never_o before_o call_v the_o high_a power_n the_o ignorance_n of_o foolish_a man_n by_o their_o peaceable_a and_o obedient_a behaviour_n to_o their_o governor_n they_o shame_v those_o man_n who_o ignorant_o reproach_v the_o christian_a religion_n now_o hence_o there_o be_v two_o plain_a consequent_n 1._o that_o subjection_n to_o government_n be_v a_o thing_n of_o very_o good_a repute_n in_o the_o world_n or_o else_o it_o can_v be_v no_o credit_n to_o christianity_n and_o this_o be_v a_o good_a argument_n that_o subjection_n to_o government_n be_v a_o great_a virtue_n because_o all_o man_n speak_v well_o of_o it_o it_o be_v a_o thing_n of_o good_a report_n and_o therefore_o become_v christian_n 4_o phil._n 8._o 2._o it_o hence_o follow_v also_o that_o subjection_n to_o government_n be_v a_o stand_a doctrine_n of_o the_o christian_a religion_n because_o it_o be_v the_o will_n of_o god_n that_o they_o shall_v recommend_v christianity_n to_o the_o world_n by_o subjection_n to_o prince_n but_o certain_o god_n never_o intend_v they_o shall_v put_v a_o cheat_n upon_o the_o world_n and_o recommend_v christianity_n to_o they_o by_o that_o which_o be_v no_o part_n nor_o duty_n of_o christianity_n this_o be_v abundant_o sufficient_a to_o confute_v that_o vain_a pretence_n that_o the_o doctrine_n of_o subjection_n and_o nonresistance_n oblige_v christian_n only_o while_o they_o be_v unable_a to_o resist_v and_o defend_v themselves_o and_o this_o be_v enough_o to_o satisfy_v we_o what_o the_o doctrine_n of_o the_o apostle_n be_v about_o subjection_n to_o prince_n as_o for_o their_o example_n i_o think_v there_o be_v never_o any_o dispute_n about_o that_o it_o be_v sufficient_o know_v that_o they_o suffer_v martyrdom_n as_o a_o vast_a number_n of_o christian_n in_o that_o and_o some_o follow_a age_n do_v without_o either_o reproach_v their_o governor_n or_o rebel_a against_o they_o and_o this_o they_o do_v as_o they_o teach_v other_o to_o do_v not_o mere_o because_o they_o can_v not_o resist_v but_o out_o of_o duty_n and_o reverence_n to_o god_n who_o set_v prince_n on_o throne_n and_o have_v give_v they_o a_o sacred_a and_o inviolable_a authority_n and_o in_o imitation_n of_o their_o great_a lord_n and_o master_n who_o go_v as_o a_o lamb_n to_o the_o slaughter_n and_o as_o a_o sheep_n before_o the_o shearer_n be_v dumb_a so_o he_o open_v not_o his_o mouth_n chap._n vi_o a_o answer_n to_o the_o most_o popular_a objection_n against_o nonresistance_n i_o proceed_v now_o to_o consider_v those_o objection_n which_o be_v make_v against_o the_o doctrine_n of_o nonresistance_n though_o methinks_v after_o such_o plain_a and_o convince_a proof_n that_o nonresistance_n be_v the_o doctrine_n both_o of_o the_o old_a and_o new_a testament_n though_o witty_a man_n may_v be_v able_a to_o start_v some_o objection_n yet_o wise_a and_o good_a man_n shall_v not_o regard_v they_o for_o no_o objection_n be_v of_o any_o force_n against_o a_o plain_a and_o express_a law_n of_o god_n indeed_o when_o we_o have_v no_o evidence_n for_o a_o thing_n but_o only_o natural_a reason_n and_o the_o reason_n seem_v to_o be_v equal_o strong_a and_o cogent_a on_o both_o side_n it_o render_v the_o matter_n very_o doubtful_a on_o which_o side_n the_o truth_n lie_v but_o when_o on_o one_o side_n there_o be_v a_o plain_a and_o express_a revelation_n of_o the_o will_n of_o god_n and_o on_o the_o other_o side_n some_o show_n and_o appearance_n of_o reason_n i_o think_v there_o can_v be_v no_o dispute_n which_o side_n we_o choose_v unless_o any_o man_n think_v it_o doubtful_a which_o be_v the_o most_o certain_a and_o infallible_a rule_n scripture_n or_o mere_a natural_a reason_n and_o therefore_o till_o man_n can_v answer_v that_o scripture-evidence_n which_o i_o have_v produce_v which_o i_o be_o not_o much_o concern_v about_o for_o i_o guess_v it_o will_v take_v they_o up_o some_o time_n to_o do_v it_o all_o their_o other_o objection_n whether_o i_o can_v answer_v they_o or_o not_o signify_v nothing_o at_o all_o to_o i_o and_o aught_o to_o signify_v as_o little_a to_o any_o man_n who_o reverence_v the_o scripture_n but_o let_v we_o consider_v their_o objection_n for_o they_o be_v not_o so_o formidable_a that_o we_o need_v be_v afraid_a of_o they_o now_o i_o know_v no_o body_n but_o will_v acknowledge_v that_o in_o most_o case_n it_o be_v the_o duty_n of_o subject_n not_o to_o resist_v their_o prince_n but_o they_o only_o pretend_v that_o this_o be_v not_o their_o duty_n when_o their_o prince_n oppress_v and_o persecute_v they_o contrary_a to_o law_n when_o their_o life_n and_o liberty_n and_o property_n and_o religion_n be_v all_o secure_v by_o the_o law_n of_o the_o land_n they_o see_v no_o reason_n why_o they_o shall_v tame_o suffer_v a_o prince_n to_o usurp_v upon_o they_o why_o they_o shall_v not_o defend_v themselves_o against_o all_o unjust_a and_o illegal_a violence_n and_o they_o urge_v several_a argument_n to_o prove_v that_o they_o may_v do_v so_o which_o may_v be_v reduce_v to_o these_o five_o 1._o that_o they_o be_v bind_v by_o no_o law_n to_o suffer_v against_o law_n 2._o that_o the_o prince_n have_v no_o authority_n against_o law_n 3._o that_o they_o have_v a_o natural_a right_n of_o self-defence_n against_o unjust_a violence_n 4._o that_o otherwise_o we_o destroy_v the_o distinction_n between_o a_o absolute_a and_o limit_a monarch_n between_o a_o prince_n who_o will_n be_v his_o law_n and_o a_o prince_n who_o be_v bind_v to_o govern_v by_o law_n which_o undermine_v the_o fundamental_a constitution_n of_o the_o english_a government_n 5._o that_o if_o resistance_n in_o no_o case_n be_v allow_v the_o mischief_n and_o inconvenience_n to_o mankind_n may_v be_v intolerable_a i_o suppose_v it_o will_v be_v
