from_o august_n till_o the_o beginning_n of_o december_n follow_v by_o which_o time_n they_o have_v receive_v hear_v and_o consider_v all_o accusation_n and_o complaint_n which_o malicious_a enemy_n or_o suborn_v suggestor_n can_v bring_v or_o procure_v and_o the_o committee_n be_v ready_a to_o draw_v up_o their_o report_n and_o to_o make_v it_o to_o the_o house_n of_o all_o their_o proceed_n herein_o with_o all_o possible_a speed_n but_o the_o parliament_n resign_v their_o power_n the_o 12._o day_n of_o december_n into_o the_o hand_n of_o his_o highness_n the_o lord_n protector_n i_o be_v plunge_v into_o a_o gulf_n of_o misery_n as_o never_o any_o distress_a person_n be_v the_o power_n that_o lay_v i_o in_o prison_n and_o sequester_v my_o estate_n they_o be_v dissolve_v those_o that_o have_v i_o in_o custody_n neither_o will_v nor_o can_v release_v i_o i_o be_v at_o a_o stand_n and_o amaze_v remedy_n and_o relief_n i_o know_v of_o none_o yet_o notwithstanding_o some_o worthy_a and_o conscientious_a man_n of_o the_o committee_n take_v my_o sad_a condition_n into_o their_o pious_a consideration_n whereof_o the_o chayrman_n be_v one_o though_o they_o have_v resign_v their_o power_n yet_o be_v please_v for_o conscience_n and_o truth_n sake_n to_o declare_v their_o judgement_n and_o opinion_n by_o a_o certificate_n under_o their_o hand_n bearing_z date_n the_o 6._o of_o january_n 1653._o wherein_o they_o do_v certify_v that_o the_o charge_n against_o sir_n john_n lenthall_n in_o parliament_n consist_v of_o three_o several_a head_n the_o first_o for_o escape_n of_o prisoner_n the_o second_o for_o delinquency_n the_o three_o for_o murder_n for_o the_o escape_n they_o certify_v to_o have_v be_v very_o few_o in_o respect_n of_o the_o great_a clamour_n make_v against_o he_o and_o that_o those_o be_v mere_a matter_n of_o law_n and_o proper_o triable_a and_o determinable_a there_o for_o the_o cause_n of_o delinquency_n they_o certify_v that_o by_o the_o judgement_n of_o the_o former_a parliament_n 15._o september_n 1645._o the_o same_o be_v resolve_v scandalous_a and_o the_o prosecutor_n in_o that_o cause_n to_o deserve_v exemplary_a punishment_n which_o vote_n of_o parliament_n be_v after_o confitm_v by_o the_o vote_n of_o the_o council_n of_o the_o army_n 1649._o upon_o the_o prosecution_n of_o the_o person_n and_o witness_n in_o the_o former_a complaint_n and_o we_o find_v nothing_o in_o proof_n to_o the_o contrary_n for_o the_o murder_n we_o judge_v that_o charge_n to_o be_v most_o malicious_a against_o sir_n john_n lenthall_n and_o that_o he_o be_v innocent_a of_o any_o such_o crime_n and_o we_o do_v conceive_v the_o say_a charge_n to_o have_v be_v prosecute_v with_o much_o malice_n against_o he_o and_o the_o testimony_n of_o the_o witness_n to_o be_v altogether_o invalid_a to_o which_o certificate_n they_o subscribe_v their_o name_n i_o be_v leave_v thus_o destiture_n and_o disconsolate_a without_o my_o liberty_n restrain_v in_o prison_n and_o deprive_v of_o my_o estate_n and_o consequent_o of_o all_o subsistence_n it_o please_v god_n to_o prepare_v mean_n to_o turn_v my_o mourning_n into_o joy_n by_o put_v the_o civil_a sword_n into_o my_o lord_n protector_n hand_n i_o address_v myself_o unto_o his_o highness_n by_o my_o petition_n and_o have_v the_o happiness_n to_o be_v one_o of_o the_o first_o fruit_n of_o his_o justice_n who_o immediate_o refer_v it_o to_o his_o honourable_a council_n they_o with_o the_o like_a dispatch_n appoint_v four_o of_o themselves_o a_o committee_n to_o hear_v and_o examine_v my_o cause_n by_o who_o command_n i_o attend_v on_o monday_n the_o 16_o of_o january_n where_o they_o take_v the_o business_n into_o consideration_n and_o with_o much_o integrity_n justice_n and_o prudence_n examine_v the_o state_n of_o my_o accusation_n as_o it_o stand_v before_o the_o late_a parliament_n so_o conscientious_a and_o scrupulous_a they_o be_v that_o they_o not_o only_o deliberate_o peruse_v all_o the_o paper_n that_o i_o produce_v but_o most_o judicious_o as_o intend_v to_o hear_v at_o both_o ear_n send_v for_o all_o the_o note_n and_o examination_n which_o remain_v in_o the_o hand_n of_o the_o clerk_n of_o the_o committee_n of_o parliament_n by_o which_o they_o may_v be_v true_o instruct_v of_o all_o accusation_n and_o information_n against_o i_o which_o the_o clerk_n according_o bring_v in_o and_o upon_o a_o through_o and_o mature_a consideration_n thereof_o those_o honourable_a person_n be_v please_v after_o they_o have_v with_o great_a diligence_n and_o patience_n peruse_v and_o examine_v all_o that_o can_v be_v say_v for_o or_o against_o i_o to_o make_v their_o report_n to_o the_o council_n the_o 24._o of_o january_n how_o they_o find_v the_o state_n of_o the_o business_n the_o lord_n of_o the_o counsel_n debate_v the_o business_n upon_o the_o report_n order_v the_o 27._o of_o the_o say_v january_n that_o it_o shall_v be_v refer_v to_o the_o lord_n chief_a justice_n roll_n and_o to_o other_o justice_n or_o justice_n of_o the_o upper_a bench_n to_o examine_v all_o complaint_n against_o sir_n john_n lenthall_n so_o as_o the_o same_o may_v be_v determine_v in_o a_o legal_a way_n &_o thereby_o they_o be_v require_v to_o take_v such_o course_n for_o dispose_v the_o custody_n of_o the_o prison_n and_o prisoner_n as_o may_v be_v most_o secure_a and_o advantageous_a for_o the_o creditor_n and_o be_v agreeable_a to_o law_n and_o justice_n and_o certain_o if_o that_o way_n have_v be_v think_v of_o before_o sergeant_n dendy_n have_v not_o now_o have_v so_o many_o escape_n bring_v against_o he_o nor_o so_o many_o man_n in_o all_o probability_n endanger_v of_o so_o many_o considerable_a debt_n nor_o myself_o have_v have_v several_a declaration_n bring_v against_o i_o for_o escapes_n make_v and_o suffer_v in_o sergeant_n dendy_n time_n when_o he_o be_v possess_v of_o the_o prison_n by_o virtue_n of_o the_o order_n of_o the_o counsel_n the_o lord_n chief_a justice_n and_o mr._n justice_n ask_v summon_v sergeant_n dendy_n and_o myself_o to_o appear_v before_o they_o on_o monday_n the_o 30_o of_o january_n where_o we_o both_o attend_v with_o out_o counsel_n and_o after_o a_o full_a debate_n and_o examination_n of_o our_o respective_a interest_n and_o title_n in_o the_o say_a office_n his_o lordship_n and_o mr._n justice_n ask_v be_v both_o please_v to_o declare_v that_o sir_n john_n lenthall_n have_v a_o good_a title_n in_o law_n which_o neither_o sergeant_n dendy_n nor_o his_o counsel_n either_o do_v or_o can_v deny_v thereupon_o the_o lord_n chief_a justice_n and_o mr._n justice_n ask_v do_v make_v their_o certificate_n to_o the_o lord_n of_o the_o counsel_n dat._v the_o 13_o of_o febru_n 1653._o that_o upon_o hear_v counsel_n of_o both_o side_n they_o find_v that_o sir_n john_n lenthall_n have_v a_o good_a title_n which_o sergeant_n dendy_n do_v not_o deny_v and_o that_o they_o be_v inform_v and_o it_o be_v confess_v by_o both_o party_n that_o divers_a prisoner_n who_o be_v in_o prison_n when_o sergeant_n dendy_n first_o enter_v into_o the_o custody_n of_o the_o prison_n be_v now_o absent_v to_o the_o great_a prejudice_n of_o their_o creditor_n and_o dishonour_n of_o the_o law_n and_o of_o the_o upper_a bench_n in_o particular_a we_o have_v think_v fit_a to_o settle_v sir_n john_n lenthall_n in_o the_o office_n of_o the_o custody_n of_o the_o prison_n and_o prisoner_n which_o course_n we_o conceive_v to_o be_v most_o secure_a and_o advantageous_a for_o creditor_n and_o most_o agreeable_a to_o law_n and_o justice_n the_o judge_n do_v also_o declare_v in_o open_a court_n the_o 11_o of_o february_n that_o the_o lord_n protector_n and_o his_o counsel_n have_v appoint_v they_o by_o their_o order_n to_o hear_v any_o complaint_n against_o sir_n john_n lenthall_n so_o that_o they_o may_v be_v determine_v in_o a_o legal_a way_n and_o that_o they_o also_o require_v they_o to_o settle_v the_o custody_n of_o the_o prison_n and_o prisoner_n according_a to_o law_n and_o justice_n and_o therefore_o they_o do_v declare_v sir_n john_n lenthall_n to_o be_v marshal_n and_o admit_v he_o to_o sit_v in_o court_n and_o to_o take_v the_o custody_n of_o the_o prison_n and_o prisoner_n upon_o he_o and_o order_v a_o rule_n of_o court_n to_o be_v enter_v to_o that_o purpose_n which_o be_v do_v according_o by_o virtue_n whereof_o i_o be_v possess_v of_o my_o office_n and_o livelihood_n and_o after_o some_o struggle_v with_o sergeant_n dendy_n be_v suffer_v quiet_o to_o enjoy_v it_o and_o i_o can_v but_o here_o acknowledge_v and_o extol_v god_n wonderful_a and_o abundant_a goodness_n who_o out_o of_o the_o depth_n of_o his_o mercy_n look_v upon_o i_o in_o the_o depth_n of_o my_o misery_n and_o out_o of_o the_o strength_n of_o his_o power_n deliver_v i_o from_o the_o malice_n of_o my_o potent_a enemy_n who_o be_v ready_a to_o devour_v i_o and_o swallow_v i_o up_o rational_a and_o
disposable_a by_o he_o and_o such_o other_o particular_a person_n to_o who_o they_o in_o right_a and_o equity_n do_v belong_v as_o any_o other_o personal_a security_n to_o any_o other_o particular_a person_n that_o this_o present_a parliament_n by_o their_o most_o pious_a and_o religious_a declaration_n late_o set_v forth_o to_o the_o contentment_n of_o many_o thousand_o of_o this_o nation_n encourage_v he_o with_o all_o thankful_a acknowledgement_n to_o assure_v himself_o that_o as_o the_o parliament_n the_o high_a and_o supreme_a power_n of_o the_o nation_n have_v declare_v that_o they_o will_v be_v as_o tender_v of_o life_n estate_n liberty_n just_a right_n and_o property_n of_o all_o other_o as_o they_o be_v of_o themselves_o and_o their_o posterity_n so_o this_o honourable_a committee_n who_o be_v a_o part_n of_o that_o honourable_a body_n will_v not_o be_v offend_v if_o that_o he_o the_o say_v sir_n john_n lenthall_n shall_v on_o his_o and_o the_o other_o behalf_n presume_v upon_o that_o honourable_a favour_n and_o grace_n which_o the_o say_a parliament_n have_v with_o such_o abundant_a care_n offer_v to_o the_o people_n and_o therefore_o can_v in_o justice_n or_o equity_n deliver_v up_o such_o security_n which_o can_v be_v useful_a or_o advantageous_a unto_o he_o by_o the_o law_n as_o appear_v by_o his_o former_a reason_n humble_o offer_v to_o the_o committee_n and_o other_o ground_n if_o take_v from_o he_o without_o a_o particular_a act_n of_o parliament_n therein_o to_o relieve_v he_o this_o be_v thus_o humble_o offer_v without_o the_o least_o disregard_n to_o the_o power_n of_o this_o committee_n or_o disrespect_n to_o any_o of_o their_o person_n who_o as_o become_v he_o in_o the_o place_n wherein_o god_n have_v place_v you_o he_o shall_v ever_o honour_v this_o in_o all_o humility_n assure_v himself_o of_o justice_n and_o equity_n according_a to_o the_o know_a right_n of_o law_n and_o property_n john_n lenthall_n july_n 29._o 1653._o reason_n humble_o offer_v and_o present_v to_o the_o honourable_a committee_n for_o prison_n and_o prisoner_n wherefore_o the_o bond_n and_o security_n take_v for_o the_o true_a imprisonment_n of_o prisoner_n by_o sir_n john_n lenthall_n knight_n martial_n of_o the_o upper_a bench_n prison_n can_v safe_o be_v deliver_v out_o of_o sir_n john_n lenthall_n hand_n i._o for_o that_o many_o of_o the_o say_a bond_n and_o security_n upon_o escape_n make_v be_v already_o deliver_v to_o creditor_n thereby_o to_o recover_v their_o debt_n due_a from_o the_o prisoner_n and_o sir_n john_n stand_v engage_v by_o his_o promise_n to_o deliver_v divers_a more_o ii_o for_o that_o as_o scone_fw-mi as_o the_o prisoner_n shall_v take_v notice_n their_o seourity_n be_v out_o of_o sir_n john_n lenthal_n power_n they_o will_v and_o may_v make_v escape_n and_o sir_n john_n have_v no_o other_o way_n to_o restrain_v they_o or_o to_o secure_v himself_o other_o then_o by_o his_o bond_n and_o security_n shall_v be_v leave_v without_o remedy_n iii_o for_o that_o there_o now_o be_v several_a action_n of_o escape_n depend_v against_o sir_n john_n lenthall_n amount_v to_o 100●0_n l._n and_o several_a recovery_n have_v sir_n john_n have_v no_o other_o mean_n to_o secure_v his_o person_n and_o estate_n from_o the_o say_a action_n and_o recovery_n but_o by_o the_o say_a bond_n and_o security_n many_o of_o which_o he_o have_v deliver_v to_o his_o attorney_n to_o put_v in_o suit_n to_o be_v indemnify_v from_o the_o say_a action_n and_o recovery_n iv_o for_o that_o the_o say_v bond_n and_o security_n be_v make_v to_o he_o in_o his_o name_n for_o his_o indemnity_n and_o suable_a only_o by_o he_o and_o in_o his_o name_n and_o can_v only_o be_v release_v by_o he_o v._o for_o that_o the_o say_v bond_n etc._n etc._n be_v not_o forfeit_v or_o to_o be_v sue_v until_o after_o escape_n bring_v against_o sir_n john_n lenthall_n so_o that_o if_o the_o same_o shall_v be_v deliver_v out_o of_o his_o hand_n the_o prisoner_n creditor_n surety_n and_o sir_n john_n lenthall_n may_v be_v much_o damnify_v vi_o for_o that_o upon_o the_o discharge_n of_o prisoner_n which_o be_v daily_o the_o say_a bond_n and_o surety_n be_v to_o be_v deliver_v up_o otherwise_o the_o surety_n may_v be_v endanger_v and_o the_o prisoner_n damnify_v upon_o his_o counter-security_n give_v by_o he_o to_o his_o surety_n vii_o for_o that_o every_o defendant_n have_v liverty_n to_o crave_v oyer_n of_o the_o condition_n of_o the_o bond_n upon_o which_o he_o be_v sue_v before_o he_o plead_v which_o sir_n john_n not_o have_v in_o his_o hand_n to_o produce_v will_v be_v delay_v in_o his_o suit_n or_o lose_v the_o benefit_n of_o his_o action_n viii_o for_o that_o the_o bond_n and_o security_n take_v for_o true_a imprisonment_n be_v sir_n john_n lenthall_n undoubted_a right_n and_o property_n which_o he_o hope_v this_o honourable_a committee_n will_v inviolable_o defend_v ix_o for_o that_o the_o surety_n who_o be_v most_o of_o they_o tradesman_n in_o this_o city_n and_o live_v by_o their_o credit_n and_o will_v be_v bind_v for_o a_o prisoner_n true_a imprisonment_n when_o they_o will_v not_o be_v bind_v with_o he_o for_o any_o money_n when_o they_o shall_v perceive_v their_o name_n be_v publish_v and_o their_o bond_n put_v to_o other_o use_n than_o they_o intend_v they_o will_v present_o call_v in_o their_o bond_n and_o that_o will_v be_v a_o mean_n to_o deter_v all_o other_o from_o be_v bind_v which_o will_v prove_v a_o very_a great_a prejudice_n to_o the_o creditor_n x._o for_o that_o such_o bond_n and_o security_n as_o be_v in_o sir_n johns_n hand_n be_v give_v to_o he_o by_o the_o prisoner_n and_o his_o surety_n by_o way_n of_o trust_n and_o upon_o condition_n that_o no_o use_n shall_v be_v make_v thereof_o but_o in_o case_n of_o escape_n and_o therefore_o the_o prisoner_n have_v make_v no_o escape_n sir_n john_n can_v without_o breach_n of_o trust_n part_n with_o their_o security_n the_o morrow_n after_o which_o be_v saturday_n the_o thirty_o of_o july_n the_o house_n be_v make_v acquaint_v with_o this_o my_o answer_n who_o thereupon_o make_v a_o order_n for_o my_o commitment_n to_o the_o sergeant_n at_o arm_n to_o answer_v to_o such_o matter_n as_o shall_v be_v object_v against_o i_o and_o another_o order_n that_o sergeant_n dendy_n shall_v take_v the_o care_n and_o humble_o beseech_v they_o in_o regard_n of_o the_o multiplicity_n of_o the_o troublesome_a and_o entangle_a business_n that_o lie_v upon_o i_o and_o for_o that_o i_o know_v not_o what_o may_v be_v bring_v out_o against_o i_o have_v have_v so_o many_o year_n to_o do_v in_o a_o troublesome_a office_n to_o be_v please_v for_o to_o take_v off_o this_o restraint_n from_o i_o which_o certain_o as_o i_o do_v not_o see_v what_o prejudice_n can_v arise_v from_o it_o all_o my_o estate_n and_o livelihood_n lie_v at_o the_o stake_n and_o it_o concern_v i_o so_o near_o to_o make_v out_o my_o interest_n so_o have_v it_o be_v to_o i_o a_o deed_n of_o very_a great_a mercy_n and_o compassion_n for_o as_o it_o will_v have_v be_v a_o mean_n to_o save_v i_o from_o a_o great_a charge_n which_o in_o the_o miserable_a condition_n i_o be_v in_o lie_z heavy_a upon_o i_o so_o will_v it_o have_v enable_v i_o to_o go_v about_o to_o make_v such_o defence_n against_o what_o may_v have_v be_v bring_v against_o i_o in_o behalf_n of_o the_o common_a wealth_n as_o that_o i_o may_v thereby_o enjoy_v the_o benefit_n of_o the_o law_n and_o the_o freedom_n of_o a_o native_a english_a man_n the_o great_a offence_n which_o they_o allege_v against_o i_o as_o be_v before_o set_v down_o be_v only_o broach_v but_o nothing_o prove_v i_o do_v little_o expect_v such_o a_o restraint_n shall_v have_v be_v put_v upon_o i_o as_o to_o imprison_v my_o body_n and_o to_o put_v sergeant_n dendy_n into_o the_o possession_n of_o my_o office_n before_o i_o be_v hear_v or_o have_v leave_v to_o make_v my_o defence_n and_o i_o can_v but_o say_v this_o by_o the_o way_n that_o it_o be_v my_o mishap_n to_o be_v the_o miserable_a precedent_n in_o this_o case_n in_o what_o doubt_n may_v it_o leave_v all_o other_o officer_n who_o have_v act_v according_a to_o the_o know_a law_n of_o the_o nation_n as_o i_o ever_o do_v and_o what_o security_n can_v they_o imagine_v to_o themselves_o if_o upon_o every_o alteration_n they_o shall_v be_v call_v in_o question_n for_o action_n do_v by_o virtue_n of_o law_n in_o force_n for_o my_o part_n i_o do_v aver_v that_o what_o i_o do_v in_o the_o execution_n of_o my_o office_n be_v nothing_o but_o what_o the_o rule_n of_o the_o court_n to_o which_o
