the_o intent_n for_o the_o intent_n itself_o be_v not_o traversable_a traversable_a what_o traversable_a but_o that_o by_o which_o it_o be_v make_v manifest_a as_o be_v adjudge_v in_o booth_n case_n co._n 5._o 77._o and_o it_o be_v also_o enact_v by_o the_o authority_n aforesaid_a stat._n stat._n that_o as_o well_o justice_n of_o assize_n in_o their_o circuit_n as_o justice_n of_o peace_n within_o sect._n 3_o the_o limit_n of_o their_o commission_n and_o authority_n aforesaid_a what_o justice_n may_v inquire_v of_o and_o certify_v the_o offence_n aforesaid_a or_o two_o of_o every_o or_o stand_v with_o to_o extol_v etc._n etc._n the_o jurisdiction_n of_o the_o see_v or_o bishop_n of_o rome_n or_o attribute_v such_o jurisdiction_n etc._n etc._n or_o procure_v counsel_v etc._n etc._n which_o be_v here_o for_o the_o first_o offence_n make_v a_o praemunire_n for_o these_o be_v the_o only_a premise_n in_o the_o act_n and_o this_o clause_n extend_v not_o to_o the_o oath_n of_o supremacy_n or_o any_o offence_n in_o refuse_v of_o it_o much_o less_o to_o all_o offence_n against_o this_o act_n as_o it_o be_v mistake_v in_o the_o late_a addition_n to_o dalton_n cap._n 140._o tit_n high_a treason_n sect._n 11._o nor_o do_v it_o seem_v to_o be_v the_o intent_n of_o the_o statute_n to_o give_v the_o justice_n of_o peace_n any_o power_n to_o inquire_v of_o any_o offence_n make_v high_a treason_n thereby_o herein_o the_o power_n of_o justice_n of_o peace_n herein_o for_o the_o power_n here_o give_v to_o the_o justice_n of_o peace_n be_v only_o to_o inquire_v of_o offence_n contrary_a to_o the_o true_a meaning_n of_o the_o premise_n and_o the_o premise_n extend_v only_o to_o those_o offence_n make_v a_o praemunire_n and_o this_o clear_o appear_v by_o the_o subsequent_a word_n viz._n that_o the_o presentment_n thereof_o shall_v be_v certify_v into_o the_o king_n bench_n who_o shall_v hear_v and_o determine_v every_o such_o offence_n as_o if_o the_o offender_n have_v be_v present_v upon_o any_o matter_n in_o the_o statute_n of_o 16_o r._n 2._o now_o that_o can_v be_v intend_v of_o high_a treason_n assize_n and_o of_o justice_n of_o assize_n the_o like_a may_v be_v say_v of_o justice_n of_o assize_n for_o as_o they_o be_v mere_o justice_n of_o assize_n they_o can_v by_o force_v of_o this_o act_n inquire_v of_o either_o the_o first_o or_o second_o offence_n in_o refuse_v the_o oath_n of_o supremacy_n nor_o of_o the_o second_o offence_n in_o extol_v the_o bishop_n of_o rome_n authority_n only_o for_o the_o first_o offence_n of_o this_o last_o kind_n they_o may_v inquire_v and_o take_v indictment_n thereof_o and_o certify_v they_o into_o the_o king_n bench_n but_o then_o by_o their_o commission_n of_o oyer_n and_o terminer_n they_o may_v not_o only_o inquire_v of_o the_o first_o or_o second_o offence_n in_o extol_v the_o bishop_n of_o rome_n authority_n or_o refuse_v the_o oath_n of_o supremacy_n but_o may_v hear_v and_o determine_v they_o and_o according_o be_v slade_n and_o body_n indict_v arraign_v and_o try_v in_o the_o county_n of_o southampton_n of_o a_o praemunire_n for_o the_o first_o offence_n in_o extol_v the_o bishop_n of_o rome_n authority_n upon_o which_o they_o be_v attaint_v and_o afterward_o of_o treason_n for_o the_o second_o offence_n before_o sir_n roger_n manwood_n and_o justice_n
common_a law_n prefer_v or_o other_o law_n or_o law_n use_v or_o allow_v within_o this_o realm_n etc._n etc._n this_o take_v in_o so_o much_o of_o the_o canon_n and_o civil_a law_n as_o be_v allow_v here_o but_o the_o common_a law_n as_o the_o peculiar_a law_n of_o this_o kingdom_n be_v here_o prefer_v and_o particular_o mention_v and_o not_o the_o canon_n law_n as_o be_v erroneous_o say_v in_o the_o late_a addition_n to_o dalton_n cap._n 81._o tit_n recusant_n sect._n 11._o as_o have_v or_o shall_v have_v authority_n by_o common_a use_n etc._n etc._n oath_n who_o be_v to_o administer_v the_o oath_n the_o statute_n say_v not_o that_o those_o who_o belong_v not_o to_o any_o court_n shall_v take_v the_o oath_n before_o those_o who_o be_v authorize_v by_o common_a use_n to_o give_v it_o as_o wingate_n tit_n crown_n numb_a 20._o mistake_v the_o meaning_n of_o this_o clause_n for_o this_o be_v then_o a_o new_a oath_n devise_v by_o the_o maker_n of_o the_o act_n of_o 1_o eliz._n no_o person_n can_v have_v authority_n by_o common_a use_n to_o administer_v it_o and_o the_o act_n plain_o enough_o speak_v of_o those_o who_o have_v authority_n by_o common_a use_n to_o admit_v the_o party_n to_o the_o office_n and_o not_o authority_n by_o common_a use_n to_o give_v the_o oath_n and_o also_o person_n stat._n sect._n 5._o the_o bishop_n may_v tender_v the_o oath_n to_o any_o spiritual_a person_n be_v it_o enact_v by_o the_o authority_n of_o this_o present_a parliament_n that_o every_o archbishop_n and_o bishop_n within_o this_o realm_n and_o dominion_n of_o the_o same_o shall_v have_v full_a power_n and_o authority_n by_o virtue_n of_o this_o act_n to_o tender_a or_o minister_v the_o oath_n aforesaid_a to_o every_o or_o any_o spiritual_a or_o ecclesiastical_a person_n within_o their_o proper_a diocese_n as_o well_o in_o place_n and_o jurisdiction_n exempt_v as_o elsewhere_o if_o a_o man_n be_v indict_v for_o refuse_v this_o oath_n before_o he_o who_o be_v
