gentleman_n you_o be_v judge_n of_o law_n as_o well_o as_o of_o fact_n this_o aught_o to_o be_v consider_v by_o you_o and_o then_o as_o touch_v adultery_n the_o act_n of_o parliament_n of_o june_n 24._o 1650_o say_v the_o word_n be_v these_o provide_v always_o that_o no_o person_n or_o person_n shall_v incur_v any_o of_o the_o penalty_n in_o this_o act_n mention_v unless_o the_o say_a person_n or_o person_n be_v therefore_o indict_v within_o twelve_o month_n after_o the_o offence_n commit_v and_o evidence_n must_v be_v swear_v for_o the_o prisoner_n the_o word_n be_v these_o provide_v also_o that_o it_o shall_v be_v lawful_a for_o any_o person_n or_o person_n who_o shall_v be_v indict_v for_o any_o of_o the_o offence_n aforesaid_a to_o produce_v at_o their_o respective_a trial_n any_o witness_n or_o witness_n for_o the_o clear_n of_o themselves_o from_o the_o say_a offence_n whereof_o they_o shall_v be_v so_o indict_v and_o the_o justice_n before_o who_o such_o trial_n shall_v be_v have_v shall_v have_v power_n and_o be_v hereby_o authorize_v to_o examine_v those_o witness_n upon_o oath_n so_o that_o both_o the_o fact_n and_o the_o time_n must_v be_v clear_a and_o certain_a both_o in_o the_o indictment_n and_o evidence_n and_o the_o reason_n be_v this_o that_o the_o prisoner_n may_v if_o he_o have_v any_o produce_v his_o witness_n which_o that_o he_o can_v do_v if_o the_o time_n be_v not_o certain_a it_o be_v the_o company_n the_o prisoner_n be_v in_o at_o such_o a_o time_n that_o must_v either_o clear_v he_o or_o lay_v he_o open_v to_o your_o verdict_n and_o therefore_o gentleman_n indictment_n and_o evidence_n must_v both_o agree_v in_o fact_n and_o time_n if_o not_o they_o be_v both_o invalid_n and_o aught_o to_o be_v reject_v and_o no_o proceed_n can_v or_o aught_o to_o be_v upon_o the_o same_o and_o further_o the_o prisoner_n ought_v to_o have_v notice_n of_o both_o fact_n and_o time_n before_o he_o be_v call_v to_o a_o trial_n that_o so_o he_o may_v provide_v his_o witness_n since_o the_o act_n require_v they_o to_o be_v hear_v and_o swear_v and_o not_o so_o sudden_o surprise_v by_o a_o indictment_n as_o mr._n webbe_n i_o perceive_v be_v who_o be_v commit_v for_o coin_v be_v unexpected_o arraign_v for_o another_o thing_n not_o have_v any_o time_n to_o provide_v for_o his_o defence_n quite_o contrary_a to_o the_o act_n which_o allow_v witness_n to_o be_v hear_v and_o swear_v which_o can_v be_v without_o notice_n and_o time_n give_v and_o gentleman_n the_o law_n have_v put_v you_o into_o a_o place_n of_o great_a trust_n and_o in_o case_n the_o court_n shall_v have_v such_o prejudice_n against_o any_o prisoner_n as_o thus_o to_o surprise_v he_o and_o to_o lay_v he_o open_v to_o the_o mercy_n of_o death_n it_o be_v your_o care_n to_o prevent_v it_o and_o do_v the_o prisoner_n right_o therein_o and_o indeed_o so_o much_o the_o more_o for_o that_o your_o verdict_n be_v to_o be_v ground_v on_o clear_a and_o plain_a proof_n which_o can_v be_v where_o the_o prisoner_n be_v call_v to_o a_o trial_n for_o a_o fact_n which_o he_o dream_v not_o of_o especial_o in_o the_o case_n of_o adultery_n where_o the_o negative_a be_v as_o good_a as_o the_o affirmative_a gentleman_n life_n and_o death_n be_v in_o your_o hand_n the_o weal_n and_o woe_n of_o many_o a_o poor_a family_n your_o place_n be_v of_o great_a weight_n the_o high_a and_o great_a in_o the_o court_n the_o court_n move_v as_o you_o move_v if_o you_o move_v amiss_o the_o court_n must_v move_v so_o also_o the_o thing_n that_o i_o have_v take_v liberty_n to_o offer_v you_o be_v necessary_a such_o cause_n may_v come_v before_o you_o the_o court_n may_v have_v that_o prejudice_n against_o the_o prisoner_n as_o to_o throw_v they_o in_o many_o disadvantage_n and_o may_v so_o much_o undervalue_v you_o who_o indeed_o be_v the_o life_n of_o the_o court_n as_o will_v not_o allow_v you_o the_o law_n to_o read_v and_o examine_v as_o they_o do_v by_o mr._n web_n jury._n therefore_o gentleman_n as_o you_o be_v english_a man_n and_o profess_v the_o lord_n christ_n and_o be_v now_o call_v to_o so_o great_a a_o employment_n wherein_o you_o have_v a_o very_a large_a opportunity_n of_o imitate_v our_o bless_a saviour_n and_o follow_v his_o golden_a rule_n do_v to_o all_o man_n as_o yourselves_o will_v be_v do_v unto_o rouse_v up_o your_o spirit_n claim_v your_o right_n let_v not_o might_n and_o greatness_n sway_v you_o but_o in_o all_o thing_n clear_a and_o plain_a evidence_n and_o a_o good_a conscience_n so_o will_v you_o purchase_v praise_n both_o of_o god_n and_o man_n and_o be_v example_n of_o great_a good_a to_o your_o countryman_n for_o which_o the_o lord_n in_o his_o infinite_a mercy_n go_v along_o with_o you_o according_a to_o the_o weight_n of_o your_o employment_n finis_fw-la
