A62698 Tam quam, or, A attaint brought in the supream court of the King of kings, upon the statutes, Exod. 20. 7, 16 and Levit. 19. 12 against those modern jurors, who have found any indictments upon the statutes of 23 Eliz., 29 Eliz., or 3 Jacobi, against Protestants, for monthly absence from church, without any confession of the parties, or oath of witness against them, or made any presentments of them : contrary to the express letter of their oaths taken in a Court of Judgment, the course of the law of England, or any right reason : wherein is discoursed, whether any Protetant be concerned in that part of those laws? : the contrary is proved : as also whether a grand-jury's finding and indictment, be any evidence to a petit-jury? : the absurdness, and most pernicious consequents of which are detected, and the vengeance of God agaisnt false-swearing is declared / by one who prosecutes, as well for his sovereign lord the King of kings, as for the lives, liberties, and properties of all the subjects of England. One who persecutes as well for his sovereign lord the King of kings as for the lives, liberties, and properties of all the subjects of England. 1683 (1683) Wing T133; ESTC R17 24,452 40

statute-law_n unless_o it_o be_v malicious_a and_o in_o a_o case_n betwixt_o party_n and_o party_n the_o law_n of_o god_n make_v no_o such_o distinction_n false-swearing_a be_v the_o crime_n which_o the_o divine_a law_n denounce_v the_o judgement_n of_o god_n against_o and_o he_o that_o read_v my_o lord_n cook_n be_v chapter_n of_o perjury_n in_o his_o plea_n of_o the_o crown_n will_v find_v that_o according_a to_o the_o old_a law_n of_o england_n though_o one_o swear_v what_o be_v truth_n but_o not_o what_o he_o can_v know_v to_o be_v true_a be_v not_o punishable_a in_o other_o court_n yet_o he_o be_v punishable_a in_o the_o star-chamber_n of_o which_o he_o give_v we_o a_o instance_n in_o that_o chapter_n and_o without_o doubt_n so_o it_o ought_v to_o be_v for_o i_o can_v true_o swear_v that_o thing_n to_o be_v or_o to_o have_v be_v do_v which_o i_o do_v not_o know_v be_v or_o have_v be_v do_v in_o palmer_n report_n be_v a_o instance_n of_o one_o indict_v and_o punish_v for_o swear_v a_o thing_n so_o and_o so_o which_o indeed_o be_v so_o because_o he_o do_v not_o know_v it_o to_o be_v so_o guide_v to_o juries_n p._n 33._o 7._o it_o be_v not_o my_o design_n to_o discourse_v this_o theme_n in_o the_o latitude_n but_o only_o so_o far_o as_o concern_v juror_n in_o the_o court_n of_o assize_n and_o session_n and_o that_o only_a with_o respect_n to_o criminal_a case_n our_o law_n be_v not_o so_o confident_a of_o twelve_o or_o 24_o man_n in_o a_o grand_a jury_n or_o a_o petit-jury_n but_o that_o it_o have_v provide_v against_o false-swearing_a in_o they_o by_o two_o act_n of_o attaint_n by_o the_o one_o 11_o hen._n 7.21_o provision_n be_v only_o make_v for_o the_o city_n of_o london_n by_o the_o other_o for_o the_o whole_a nation_n 23_o hen._n 8._o 3._o which_o statute_n allow_v the_o person_n wrong_v by_o a_o untrue_a verdict_n to_o bring_v a_o attaint_n against_o the_o person_n give_v such_o verdict_n if_o it_o amount_v to_o the_o value_n of_o forty_o pound_n and_o recover_v of_o every_o one_o of_o they_o twenty_o pound_n ten_o for_o the_o king_n ten_o for_o himself_o but_o this_o must_v be_v only_o in_o case_n betwixt_o party_n and_o party_n it_o seem_v a_o defect_n in_o our_o law_n that_o if_o the_o king_n be_v a_o party_n the_o jury_n shall_v not_o be_v attaint_v for_o every_o one_o will_v apprehend_v it_o very_o unreasonable_a that_o juror_n shall_v be_v attaint_v and_o their_o verdict_n again_o be_v examine_v by_o 24_o man_n in_o a_o attaint_n where_o the_o subject_n be_v a_o loser_n forty_o pound_n or_o upward_o and_o that_o they_o shall_v be_v liable_a to_o no_o punishment_n for_o a_o untrue_a verdict_n where_o the_o damage_n amount_v to_o much_o more_o i_o remember_v in_o a_o parallel_n case_n of_o perjury_n in_o a_o witness_n where_o the_o law_n determine_v no_o indictment_n on_o the_o statute_n shall_v lie_v because_o the_o statute_n be_v restrain_v to_o oath_n between_o party_n and_o party_n my_o lord_n cook_n determine_v that_o though_o no_o indictment_n upon_o the_o stat._n 5_o eliz._n will_v lie_v in_o the_o case_n yet_o a_o indictment_n shall_v lie_v at_o common_a law_n and_o that_o have_v be_v often_o experience_v and_o that_o great_a oracle_n of_o the_o law_n give_v a_o unanswerable_a reason_n for_o it_o because_o it_o be_v not_o reasonable_a that_o the_o king_n name_n who_o be_v the_o fountain_n of_o justice_n shall_v patronize_v injustice_n whether_o a_o attaint_n at_o the_o common_a law_n do_v not_o lie_v against_o juror_n bring_v in_o false_a verdict_n which_o indeed_o be_v nonsense_n though_o they_o find_v for_o the_o king_n deserve_v the_o study_n of_o lawyer_n sure_o i_o be_o my_o lord_n cook_n in_o his_o chapter_n of_o perjury_n give_v we_o a_o account_n that_o by_o the_o old_a law_n of_o england_n juror_n bring_v in_o untrue_a verdict_n be_v most_o severe_o punish_v by_o imprisonment_n seizure_n of_o all_o their_o estate_n turn_v out_o their_o wife_n and_o child_n pull_v down_o their_o house_n and_o be_v make_v infamous_a their_o oath_n never_o more_o to_o be_v admit_v in_o any_o court_n this_o law_n be_v sure_o not_o so_o extinguish_v but_o some_o punishment_n yet_o remain_v for_o all_o such_o person_n if_o once_o we_o can_v hit_v upon_o the_o method_n that_o shall_v bring_v they_o to_o it_o 8._o but_o my_o business_n be_v only_o to_o show_v they_o that_o there_o lie_v a_o attaint_n against_o they_o in_o the_o court_n of_o heaven_n the_o punishment_n of_o which_o be_v not_o only_o the_o eternal_a damnation_n of_o their_o soul_n according_a to_o their_o own_o desire_n in_o the_o oath_n they_o take_v but_o the_o curse_n of_o god_n enter_v into_o their_o house_n and_o abide_v in_o they_o until_o it_o have_v consume_v the_o timber_n thereof_o and_o the_o 29_o eliz._n and_o 3_o jacobi_n this_o be_v the_o only_a point_n i_o design_n to_o put_v in_o issue_n be_v assure_v that_o if_o the_o conviction_n of_o these_o man_n upon_o those_o statute_n prove_v act_n abrogate_v it_o further_o than_o concern_v the_o lord_n day_n the_o better_a sanctification_n of_o which_o be_v the_o design_n of_o the_o act_n beside_o be_v not_o the_o former_a law_n which_o give_v liberty_n to_o arrest_v man_n on_o any_o day_n abrogate_a by_o this_o act_n so_o far_o forth_o as_o concern_v that_o point_n yet_o multitude_n of_o justice_n have_v so_o interpret_v these_o
