and_o so_o can_v a_o constabe_v or_o justice_n of_o the_o peace_n do_v and_o by_o the_o statute_n 5._o h._n 4._o ca._n 10._o the_o justice_n of_o peace_n must_v send_v his_o prisoner_n to_o the_o that_o book_n that_o in_o this_o case_n also_o they_o may_v break_v open_a the_o door_n to_o apprehend_v he_o because_o the_o prince_n have_v a_o interest_n in_o the_o matter_n and_o then_o a_o man_n house_n shall_v be_v no_o refuge_n for_o he_o as_o it_o shall_v be_v in_o debt_n or_o trespass_n where_o the_o interest_n be_v but_o only_o to_o some_o particular_a party_n now_o if_o the_o disorder_n after_o that_o they_o have_v in_o 13._o of_o that_o king_n c._n 7._o stat._n 1._o take_v order_n that_o justice_n of_o peace_n shall_v be_v make_v of_o new_a in_o all_o the_o county_n of_o england_n of_o the_o most_o sufficient_a knight_n esquier_n &_o man_n of_o law_n of_o the_o same_o county_n and_o that_o they_o shall_v be_v swear_v to_o keep_v &_o put_v in_o execution_n all_o party_n greeve_v that_o the_o justice_n so_o warn_v shall_v in_o convenient_a time_n cause_v the_o last_o say_v statute_n due_o to_o be_v execute_v at_o the_o cost_n of_o the_o say_a party_n and_o whether_o the_o perfon_n make_v such_o entry_n be_v present_a or_o avoid_v before_o the_o justice_n come_v the_o same_o justice_n or_o justice_n in_o some_o good_a town_n next_o to_o the_o say_a tenement_n whereof_o they_o or_o their_o ancestor_n or_o they_o who_o estate_n they_o have_v therein_o have_v continue_v their_o possession_n in_o the_o same_o by_o three_o year_n or_o more_o shall_v not_o be_v endamage_v by_o this_o statute_n this_o last_o statute_n i_o have_v the_o rather_o exemplify_v at_o large_a because_o it_o contain_v a_o full_a direction_n in_o this_o business_n yet_o because_o i_o have_v see_v some_o other_o thing_n that_o â—ende_v to_o some_o little_a explanation_n of_o some_o of_o the_o point_n of_o the_o same_o which_o be_v good_a to_o be_v consider_v of_o i_o think_v that_o they_o also_o may_v be_v well_o bestow_v here_o this_o statute_n therefore_o enable_v any_o one_o justice_n of_o the_o peace_n to_o deal_v in_o this_o matter_n upon_o occasion_n give_v and_o be_v make_v as_o well_o against_o such_o as_o enter_v with_o force_n as_o against_o those_o that_o enter_v peaceable_o and_o then_o hold_v in_o with_o force_n but_o whether_o the_o justice_n be_v bind_v to_o ermine_v the_o goodness_n of_o his_o title_n that_o enter_v and_o accordind_v to_o the_o same_o to_o make_v or_o deny_v restitution_n it_o have_v be_v oft_o time_n make_v a_o question_n which_o sure_o in_o my_o opinion_n shall_v carry_v no_o great_a doubt_n with_o it_o for_o see_v that_o the_o statute_n 5._o r._n 2._o cap._n 7._o prohibit_v all_o entry_n with_o force_n although_o they_o be_v otherwise_o lawful_a and_o the_o statute_n 15._o r._n 2._o ca._n 2._o rehearse_v the_o same_o geve_v authority_n to_o every_o justice_n of_o peace_n upon_o any_o such_o forcible_a entry_n present_o to_o commit_v the_o offender_n there_o find_v to_o the_o caole_n and_o this_o statute_n meaning_n to_o supply_v some_o other_o defect_n in_o the_o former_a geve_v special_a remedy_n to_o the_o party_n grieve_v by_o the_o aid_n of_o the_o same_o justice_n by_o restore_v of_o he_o to_o his_o possession_n again_o i_o see_v not_o why_o the_o justice_n of_o peace_n who_o perhaps_o shall_v have_v but_o little_a skill_n in_o law_n to_o discern_v and_o judge_v of_o the_o little_o and_o yet_o be_v a_o fit_n man_n to_o suppress_v all_o force_n and_o able_a enough_o to_o restore_v a_o possession_n shall_v be_v tie_v to_o the_o discuss_n of_o the_o right_n or_o title_n of_o either_o of_o the_o party_n and_o therefore_o 22._o h._n 6._o 18._o admit_v this_o case_n that_o if_o a._n shall_v disseyse_v b._n and_o b._n shall_v enter_v again_o and_o put_v out_o a._n by_o force_n and_o strong_a hand_n yet_o shall_v a._n be_v restore_v to_o his_o possession_n at_o the_o hand_n of_o the_o justice_n of_o peace_n although_o his_o first_o entire_a be_v very_o unlawful_a and_o that_o thereupon_o notwithstanding_o the_o restitution_n make_v b._n may_v have_v a_o assize_n or_o else_o may_v enter_v upon_o he_o again_o so_o as_o he_o do_v it_o in_o peaceable_a manner_n and_o i_o do_v little_a doubt_n but_o that_o a_o lessée_fw-fr for_o year_n or_o a_o copieholder_n be_v put_v out_o with_o force_n and_o the_o lessor_n or_o lord_n disseise_v thereby_o the_o lessée_fw-fr or_o copieholder_n ought_v to_o have_v restitution_n by_o the_o help_n of_o a_o justice_n of_o peace_n upon_o this_o statute_n now_o whereas_o the_o word_n be_v after_o complaint_n etc._n etc._n that_o do_v not_o always_o enforce_v a_o necessity_n of_o complaint_n by_o the_o party_n grieve_v for_o if_o a_o forcible_a entry_n be_v commit_v the_o justice_n may_v inquire_v of_o it_o and_o also_o make_v restitution_n upon_o any_o information_n or_o other_o knowledge_n thereof_o though_o no_o complaint_n be_v make_v unto_o he_o by_o the_o party_n grieve_v as_o it_o be_v hold_v 7._o e._n 4._o 18._o complaint_n complaint_n it_o seem_v further_a that_o it_o shall_v not_o be_v altogether_o requisite_a to_o the_o punish_v of_o the_o offender_n by_o imprisonment_n and_o fine_a that_o the_o party_n grieve_v shall_v be_v actual_o put_v out_o of_o possession_n for_o and_o therefore_o if_o the_o case_n be_v that_o after_o the_o death_n of_o a._n a_o stranger_n enter_v into_o his_o land_n and_o hold_v the_o same_o by_o force_n against_o his_o heir_n before_o be_v have_v get_v any_o possession_n in_o deed_n the_o heir_n of_o a._n in_o this_o case_n say_v marr._n shall_v never_o have_v restitution_n because_o he_o never_o have_v any_o other_o possession_n than_o a_o possession_n in_o law_n but_o no_o actual_a possession_n and_o by_o his_o opinion_n also_o if_o a_o man_n claim_v a_o rent_n or_o common_a in_o land_n that_o be_v so_o hold_v with_o such_o force_n that_o he_o can_v not_o distrain_v for_o the_o one_o nor_o use_v the_o other_o this_o a_o force_n removable_a by_o this_o statute_n but_o the_o party_n can_v have_v no_o restitution_n here_o make_v unto_o he_o one_o person_n alone_o may_v commit_v this_o forcible_a entry_n so_o also_o may_v he_o be_v punishable_a for_o detain_v of_o the_o possession_n by_o force_n force_n enter_v or_o hold_v be_v of_o opinion_n that_o if_o the_o justice_n of_o peace_n come_v and_o find_v the_o door_n shut_v and_o they_o within_o deny_v he_o to_o enter_v this_o be_v a_o detain_v with_o force_n and_o he_o may_v thereupon_o commit_v they_o if_o it_o be_v find_v that_o diverse_a person_n have_v make_v a_o forcible_a entry_n to_o the_o use_n and_o behouse_n of_o a_o strange_a that_o be_v absent_a
