witness_n in_o order_n to_o the_o examination_n or_o trial_n of_o the_o offence_n aforesaid_a provide_v always_o exempt_v ordinary_a process_n of_o law_n not_o exempt_v that_o nothing_o in_o this_o act_n contain_v shall_v extend_v or_o be_v construe_v to_o exempt_a any_o officer_n or_o soldier_n whatsoever_o from_o the_o ordinary_a process_n of_o law_n provide_v also_o that_o this_o act_n shall_v continue_v and_o be_v in_o force_n until_o the_o first_o day_n of_o july_n act._n time_n of_o the_o continuance_n of_o this_o act._n in_o the_o year_n of_o our_o lord_n one_o thousand_o seven_o hundred_o and_o one_o and_o no_o long_o provide_v always_o and_o be_v it_o enact_v that_o in_o all_o trial_n of_o offender_n by_o court_n martial_a to_o be_v hold_v by_o virtue_n of_o this_o act_n swear_v officer_n on_o trial_n before_o a_o court_n martial_a to_o be_v swear_v where_o the_o offence_n may_v be_v punish_v by_o death_n every_o officer_n present_a at_o such_o trial_n before_o any_o proceed_n be_v have_v thereupon_o shall_v take_v a_o oath_n before_o the_o court_n and_o a_o justice_n of_o peace_n if_o any_o such_o be_v there_o present_a otherwise_o the_o president_n of_o such_o court_n be_v first_o swear_v by_o two_o of_o the_o member_n thereof_o shall_v administer_v the_o oath_n unto_o the_o other_o and_o the_o president_n of_o such_o court_n and_o any_o two_o other_o member_n thereof_o be_v hereby_o respective_o authorize_v to_o administer_v the_o same_o in_o these_o word_n that_o be_v to_o say_v oath_n form_n of_o the_o oath_n you_o shall_v well_o and_o true_o try_v and_o determine_v according_a to_o your_o evidence_n the_o matter_n now_o before_o you_o between_o our_o sovereign_a lord_n the_o king_n and_o the_o prisoner_n to_o be_v try_v so_o help_v you_o god_n agree_v no_o sentence_n of_o death_n to_o pass_v on_o offender_n unless_o nine_o of_o eleven_o agree_v and_o no_o sentence_n of_o death_n shall_v be_v give_v against_o any_o offender_n in_o such_o case_n by_o any_o court_n martial_a unless_o nine_o of_o the_o eleven_o officer_n present_a shall_v concur_v therein_o and_o if_o there_o be_v a_o great_a number_n of_o officer_n present_a than_o the_o judgement_n shall_v pass_v by_o the_o concurrence_n of_o the_o great_a part_n of_o they_o so_o swear_v which_o major_a part_n shall_v not_o be_v less_o than_o nine_o and_o not_o otherwise_o nor_o shall_v any_o sentence_n of_o death_n pass_v by_o any_o court_n martial_a upon_o any_o offender_n be_v put_v in_o execution_n therein_o no_o sentence_n of_o death_n to_o be_v execute_v until_o the_o captain_n general_n etc._n etc._n give_v direction_n therein_o until_o report_n be_v make_v of_o the_o whole_a matter_n by_o the_o president_n of_o such_o court_n unto_o the_o according_a to_o sentence_n before_o the_o same_o be_v execute_v a_o act_n to_o prevent_v the_o desert_v of_o the_o frontier_n of_o this_o province_n forasmuch_o as_o the_o maintain_n and_o defend_v of_o the_o frontier_n in_o time_n of_o war_n be_v of_o very_o great_a import_n and_o in_o regard_n it_o will_v great_o prejudice_v his_o majesty_n interest_n and_o encourage_v a_o enemy_n if_o any_o of_o the_o out_o post_n shall_v be_v quit_v or_o expose_v by_o lessen_v the_o strength_n thereof_o be_v it_o therefore_o enact_v by_o his_o excellency_n the_o governor_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o no_o town_n or_o precinct_n be_v a_o frontier_n of_o this_o province_n which_o the_o town_n hereafter_o name_v be_v to_o be_v so_o account_v that_o be_v to_o say_v well_n york_n kittery_n etc._n frontier_n town_n etc._n etc._n aimsbury_n haverhill_n dunstable_n chelmsford_n groton_n lancaster_n marlborough_n brookfield_n deerfield_n mendon_n and_o woodstock_n nor_o any_o of_o the_o town_n follow_v to_o wit_n salisbury_n andover_n billerica_n hatfield_n hadley_n westfield_n and_o northhampton_n which_o though_o they_o be_v not_o frontier_n as_o those_o town_n first_o name_v leave_n not_o to_o be_v break_v up_o or_o desert_v without_o leave_n yet_o lie_v more_o open_a than_o many_o other_o to_o a_o attack_z of_o a_o enemy_n shall_v be_v break_v up_o or_o voluntary_o desert_v without_o application_n first_o make_v by_o the_o inhabitant_n and_o allowance_n have_v and_o obtain_v from_o the_o governor_n or_o commander_n in_o chief_a and_o council_n for_o their_o draw_v off_o if_o it_o appear_v to_o they_o that_o it_o may_v be_v of_o public_a advantage_n desert_n penalty_n on_o particular_a person_n that_o shall_v desert_n or_o that_o the_o place_n be_v not_o tenable_a nor_o shall_v any_o inhabitant_n of_o the_o frontier_n and_o other_o town_n or_o precinct_n beforenamed_n or_o of_o any_o of_o they_o have_v a_o estate_n of_o freehold_n in_o land_n or_o tenement_n within_o the_o same_o at_o the_o time_n of_o any_o insurrection_n or_o break_v forth_o of_o any_o war_n remove_v from_o thence_o with_o intent_n to_o sojourn_v or_o inhabit_v elsewhere_o without_o special_a licence_n first_o have_v and_o obtain_v as_o aforesaid_a on_o pain_n of_o forfeit_v all_o his_o estate_n in_o land_n and_o tenement_n lie_v within_o the_o bound_n or_o limit_n of_o such_o town_n or_o precinct_n unto_o his_o conveyance_n thereof_o or_o any_o part_n thereof_o make_v between_o the_o break_n out_o of_o a_o war_n insurrection_n or_o rebellion_n and_o such_o judgement_n enter_v up_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o male_a person_n of_o sixteen_o year_n of_o age_n or_o upward_o that_o shall_v be_v a_o inhabitant_n of_o or_o belong_v to_o any_o of_o the_o say_a town_n or_o precinct_n herein_o before_o name_v land_n penalty_n on_o person_n remove_v that_o have_v no_o estate_n in_o land_n at_o the_o time_n of_o any_o insurrection_n or_o break_v forth_o of_o any_o war_n as_o aforesaid_a and_o not_o have_v any_o land_n or_o tenement_n in_o such_o town_n or_o precinct_n shall_v presume_v to_o remove_v from_o the_o same_o to_o sojourn_v or_o remain_v elsewhere_o during_o the_o time_n of_o such_o insurrection_n or_o war_n without_o special_a licence_n first_o
the_o same_o to_o distrein_o the_o say_a person_n or_o person_n by_o his_o or_o their_o good_n or_o chattel_n as_o aforesaid_a and_o for_o want_v of_o such_o distress_n to_o commit_v the_o party_n to_o the_o common_a goal_n there_o to_o remain_v until_o payment_n be_v make_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o where_o the_o owner_n or_o tenant_n of_o any_o land_n liable_a to_o public_a tax_n shall_v not_o reside_v or_o be_v a_o inhabitant_n of_o the_o town_n or_o precinct_n in_o which_o such_o land_n lie_v dwell_v provision_n in_o case_n of_o land_n be_v rate_v in_o any_o town_n in_o which_o the_o owner_n or_o tenant_n thereof_o do_v not_o dwell_v and_o no_o stock_n corn_n or_o hay_n can_v be_v find_v upon_o the_o say_a land_n whereof_o the_o constable_n or_o collector_n may_v make_v distress_n to_o satisfy_v such_o sum_n or_o sum_n as_o from_o time_n to_o time_n such_o land_n shall_v be_v assess_v at_o either_o to_o the_o province_n county_n or_o town_n charge_n in_o such_o case_n any_o justice_n of_o the_o peace_n in_o the_o county_n where_o the_o occupant_a of_o any_o such_o land_n dwell_v or_o reside_v upon_o application_n to_o he_o make_v by_o the_o constable_n or_o collector_n to_o who_o the_o listen_v wherein_o such_o land_n shall_v be_v assess_v shall_v be_v commit_v and_o upon_o sight_n of_o the_o same_o or_o authentic_a copy_n thereof_o may_v and_o hereby_o be_v empower_v and_o require_v to_o grant_v a_o warrant_n unto_o the_o constable_n of_o the_o town_n or_o precinct_n where_o such_o occupant_a dwell_v or_o reside_v to_o distrein_o such_o occupant_a by_o his_o good_n or_o chattel_n the_o full_a sum_n at_o which_o say_v land_n be_v set_v in_o such_o list_n of_o assessment_n with_o the_o charge_n occasion_v for_o make_v such_o distress_n and_o to_o satisfy_v the_o same_o by_o sale_n thereof_o return_v the_o over_o plus_fw-la if_o any_o be_v to_o the_o owner_n and_o in_o case_n no_o good_n or_o chattel_n can_v be_v find_v whereon_o to_o distrein_o to_o commit_v the_o party_n to_o the_o common_a goal_n of_o the_o county_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o he_o pay_v and_o satisfy_v the_o sum_n or_o sum_n so_o assess_v with_o the_o charge_n tax_n provision_n in_o case_n of_o person_n be_v about_o to_o remove_v before_o the_o time_n for_o payment_n of_o the_o second_o part_n of_o any_o tax_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o when_o at_o any_o time_n the_o general_n assembly_n shall_v order_v any_o public_a rate_n or_o tax_n by_o they_o grant_v to_o be_v pay_v into_o the_o treasury_n at_o two_o or_o more_o several_a time_n or_o day_n of_o payment_n and_o any_o person_n or_o person_n be_v inhabitant_n or_o dweller_n in_o any_o town_n or_o precinct_n within_o this_o province_n at_o the_o time_n of_o make_v such_o rate_n or_o tax_n and_o be_v assess_v thereunto_o shall_v be_v about_o to_o remove_v he_o or_o themselves_o from_o thence_o before_o the_o time_n that_o shall_v be_v prefix_v for_o payment_n of_o the_o same_o it_o shall_v and_o may_v be_v lawful_a in_o such_o case_n to_o and_o for_o the_o constable_n or_o collector_n of_o the_o same_o town_n or_o precinct_n to_o demand_v and_o levy_v the_o whole_a sum_n and_o sum_n which_o such_o person_n or_o person_n shall_v be_v assess_v at_o in_o the_o list_n or_o list_n to_o such_o constable_n or_o collector_n commit_v notwithstanding_o the_o time_n for_o collect_v the_o second_o part_n of_o such_o rate_n or_o tax_n may_v not_o then_o be_v come_v and_o in_o default_n of_o payment_n to_o distrein_o for_o the_o same_o or_o to_o take_v any_o other_o way_n or_o course_n for_o the_o obtain_n thereof_o according_a to_o the_o rule_n and_o direction_n herein_o before_o provide_v and_o when_o and_o so_o often_o as_o it_o happen_v that_o constable_n be_v a_o new_a choose_a and_o swear_v for_o any_o town_n before_o the_o former_a constable_n have_v perfect_v their_o collection_n of_o any_o tax_n or_o assessment_n to_o they_o commit_v to_o gather_v choose_v constable_n to_o who_o any_o tax_n shall_v be_v commit_v to_o perfect_v their_o collection_n although_o other_o constable_n be_v choose_v such_o former_a constable_n be_v notwithstanding_o hereby_o full_o empower_v and_o require_v to_o perfect_a all_o such_o collection_n and_o may_v exercise_v the_o same_o power_n and_o authority_n for_o the_o gather_n and_o enforce_v the_o payment_n thereof_o as_o by_o this_o act_n they_o may_v have_v do_v before_o other_o constable_n be_v choose_v and_o swear_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n or_o collector_n to_o who_o any_o public_a tax_n or_o assessment_n shall_v be_v commit_v to_o collect_v collector_n penalty_n on_o defective_a constable_n or_o collector_n shall_v be_v remiss_a and_o negligent_a of_o his_o duty_n in_o not_o levy_v and_o pay_v unto_o the_o treasurer_n his_o deputy_n or_o deputy_n such_o sum_n and_o sum_n of_o money_n as_o from_o time_n to_o time_n he_o shall_v have_v receive_v and_o as_o aught_o by_o he_o to_o have_v be_v pay_v within_o the_o respective_a time_n set_v and_o limit_v by_o the_o treasurer_n warrant_n according_a to_o the_o direction_n therein_o pursuant_n to_o law_n the_o treasurer_n be_v hereby_o empower_v after_o the_o expiration_n of_o the_o time_n so_o set_v by_o warrant_n under_o his_o hand_n and_o seal_v direct_v to_o the_o sheriff_n or_o marshal_n to_o cause_v such_o sum_n and_o sum_n of_o money_n to_o be_v levy_v by_o distress_n and_o sale_n of_o such_o defective_a constable_n or_o collector_n estate_n real_a or_o personal_a return_v the_o overplus_a if_o any_o be_v and_o for_o want_v of_o such_o estate_n to_o take_v the_o body_n of_o such_o constable_n or_o collector_n and_o to_o imprison_v they_o until_o they_o pay_v the_o same_o which_o warrant_v the_o sheriff_n or_o marshal_n be_v hereby_o empower_v and_o require_v to_o execute_v according_o and_o be_v it_o further_o enact_v that_o if_o any_o constable_n or_o collector_n so_o fail_v as_o aforesaid_a have_v no_o estate_n to_o be_v find_v whereon_o to_o make_v distress_n collect_v the_o town_n or_o precinct_n in_o which_o any_o defective_a constable_n or_o collector_n live_v to_o be_v answerable_a for_o his_o payment_n in_o to_o the_o treasury_n the_o sum_v commit_v to_o he_o to_o collect_v and_o his_o person_n can_v be_v take_v within_o the_o space_n of_o two_o month_n from_o the_o time_n which_o be_v set_v for_o his_o pay_v the_o same_o into_o the_o treasury_n in_o such_o case_n the_o town_n or_o precinct_n whereof_o the_o constable_n or_o collector_n so_o fail_v of_o his_o duty_n shall_v within_o three_o month_n from_o the_o expiration_n of_o say_a two_o month_n make_v good_a to_o the_o treasury_n the_o sum_n or_o sum_n due_a and_o owe_v to_o the_o same_o from_o such_o defective_a constable_n or_o collector_n which_o the_o assessor_n of_o such_o town_n have_v notice_n from_o the_o treasurer_n of_o the_o failure_n of_o any_o constable_n or_o collector_n as_o afore_o say_v shall_v forthwith_o thereupon_o without_o any_o other_o or_o further_a warrant_n assess_v upon_o the_o inhabitant_n and_o estate_n of_o such_o town_n in_o manner_n as_o the_o sum_n so_o commit_v to_o such_o defective_a constable_n or_o collector_n be_v assess_v and_o commit_v the_o same_o to_o some_o other_o constable_n or_o collector_n to_o collect_v who_o be_v to_o be_v empower_v thereunto_o by_o warrant_n from_o the_o treasurer_n provide_v always_o that_o such_o constable_n or_o collector_n fail_v of_o his_o duty_n as_o aforesaid_a for_o who_o default_n the_o town_n be_v answerable_a as_o before_o express_v shall_v at_o all_o time_n after_o ward_n be_v liable_a to_o the_o action_n or_o suit_n of_o the_o treasurer_n of_o such_o town_n for_o all_o such_o sum_n and_o sum_n as_o be_v assess_v upon_o the_o same_o through_o his_o default_n and_o for_o other_o damage_n accrue_v unto_o the_o say_a town_n thereby_o and_o in_o case_n of_o the_o decease_n of_o any_o constable_n or_o collector_n in_o any_o town_n before_o his_o have_v adjust_v the_o account_n of_o the_o assessment_n to_o he_o commit_v etc._n executor_n or_o administrator_n of_o constable_n decease_v to_o make_v up_o their_o account_n etc._n etc._n the_o executor_n or_o administrator_n of_o such_o constable_n or_o collector_n shall_v within_o two_o month_n after_o his_o decease_n settle_v and_o make_v up_o account_n with_o the_o assessor_n of_o the_o same_o town_n of_o such_o part_n of_o the_o say_a assessment_n as_o be_v receive_v and_o collect_v by_o the_o decease_a constable_n or_o collector_n in_o his_o life_n time_n with_o which_o such_o executor_n or_o administrator_n shall_v be_v chargeable_a in_o like_a manner_n as_o the_o decease_a constable_n or_o collector_n shall_v be_v if_o live_a
and_o such_o assessor_n shall_v thereupon_o procure_v and_o appoint_v other_o fit_a person_n or_o person_n to_o perfect_a such_o collection_n as_o be_v before_o provide_v and_o if_o the_o executor_n or_o administrator_n of_o any_o constable_n or_o collector_n so_o decease_a not_o have_v full_o collect_v the_o assessment_n commit_v to_o he_o shall_v sail_v of_o make_v up_o and_o settle_v the_o account_n of_o what_o be_v receive_v by_o the_o decease_a as_o aforesaid_a before_o the_o expiration_n of_o the_o time_n aforesaid_a such_o executor_n or_o administrator_n shall_v be_v chargeable_a with_o the_o whole_a sum_n commit_v to_o be_v collect_v by_o the_o constable_n or_o collector_n unto_o who_o they_o be_v executor_n or_o administrator_n in_o manner_n as_o the_o decease_a constable_n or_o collector_n shall_v be_v if_o live_v in_o case_n there_o be_v sufficient_a asset_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a marshal_n penalty_n on_o defective_a sheriff_n or_o marshal_n that_o where_o any_o sheriff_n or_o marshal_n shall_v make_v default_n in_o account_v for_o or_o return_v into_o the_o treasury_n the_o sum_n and_o sum_v mention_v in_o any_o warrant_n or_o warrant_n of_o distress_n by_o he_o to_o be_v receive_v from_o the_o treasurer_n the_o treasurer_n in_o such_o case_n be_v hereby_o authorize_v and_o empower_v to_o make_v out_o his_o warrant_n direct_v unto_o the_o coroner_n of_o such_o county_n where_o any_o sheriff_n be_v defective_a or_o to_o the_o constable_n of_o the_o town_n in_o which_o a_o defective_a marshal_n live_v require_v they_o respective_o to_o distrain_v the_o same_o upon_o the_o estate_n real_a or_o personal_a of_o such_o defective_a sheriff_n or_o marshal_n as_o be_v before_o herein_o direct_v refer_v to_o the_o sheriff_n or_o marshal_n make_v distress_n upon_o the_o estate_n of_o defective_a constable_n or_o collector_n which_o warrant_v the_o coroner_n of_o any_o county_n or_o constable_n of_o satisfy_v the_o sum_n or_o sum_n for_o which_o such_o estate_n shall_v be_v levy_v with_o all_o charge_n arise_v thereon_o and_o to_o return_v the_o overplus_n upon_o such_o sale_n if_o any_o be_v
