by_o the_o constable_n or_o townsman_n upon_o their_o watch_n by_o night_n or_o by_o day_n and_o shall_v be_v deliver_v to_o the_o sheriff_n he_o be_v to_o enrol_v the_o same_o and_o to_o commit_v they_o until_o the_o come_n of_o the_o justice_n of_o gaol_n delivery_n and_o in_o the_o mean_a time_n the_o sheriff_n be_v to_o inquire_v of_o the_o offendor_n by_o a_o jury_n who_o presentment_n therein_o he_o must_v return_v before_o the_o say_a justice_n with_o the_o body_n of_o the_o offender_n but_o now_o these_o offender_n be_v deal_v withal_o by_o the_o justice_n of_o peace_n at_o the_o session_n and_o therefore_o the_o sheriff_n not_o trouble_v with_o they_o as_o it_o seem_v otherwise_o than_o by_o enquiry_n in_o their_o tear_v which_o see_v hic_fw-la postea_fw-la cap._n 107._o but_o concern_v the_o statute_n of_o vagabond_n i_o see_v not_o what_o the_o sheriff_n be_v to_o do_v by_o virtue_n of_o his_o oath_n or_o office_n by_o any_o statute_n now_o in_o force_n in_o that_o behalf_n save_v only_o to_o arrest_v &_o commit_v they_o as_o suspect_v person_n hic_fw-la cap._n 4._o the_o sheriff_n also_o be_v to_o take_v the_o oath_n of_o allegiance_n whensoever_o it_o shall_v be_v lawful_o tender_v to_o he_o the_o new_a sheriff_n at_o or_o before_o his_o first_o county_n court_n writ_n 4_o must_v take_v all_o prisoner_n and_o writ_n or_o upon_o the_o writ_n of_o discharge_v deliver_v to_o his_o predecessor_n must_v take_v over_o from_o the_o old_a sheriff_n all_o his_o prisoner_n which_o be_v in_o the_o gaol_n by_o their_o name_n and_o all_o his_o writ_n precise_o by_o view_n and_o by_o indenture_n to_o be_v make_v between_o the_o old_a sheriff_n and_o the_o new_a these_o indenture_n must_v contain_v and_o express_v 1_o all_o the_o cause_n which_o the_o old_a sheriff_n have_v against_o every_o prisoner_n at_o the_o peril_n of_o the_o old_a sheriff_n with_o the_o prisoner_n name_n 2_o all_o writ_n with_o the_o name_n of_o the_o plaintiff_n and_o of_o the_o defendant_n and_o the_o day_n of_o the_o return_n for_o the_o new_a sheriff_n shall_v be_v charge_v only_o with_o such_o prisoner_n and_o with_o such_o cause_n or_o execution_n whereof_o he_o shall_v have_v notice_n give_v he_o from_o the_o old_a sheriff_n the_o new_a sheriff_n be_v not_o bind_v to_o receive_v any_o prisoner_n from_o the_o old_a sheriff_n but_o only_o at_o the_o gaol_n and_o yet_o if_o the_o new_a sheriff_n shall_v receive_v the_o prisoner_n out_o of_o the_o gaol_n the_o old_a sheriff_n be_v discharge_v by_o such_o delivery_n and_o receive_v of_o the_o prisoner_n also_o the_o new_a sheriff_n may_v compel_v the_o old_a sheriff_n to_o make_v delivery_n by_o indenture_n of_o all_o prisoner_n and_o of_o all_o execution_n against_o they_o and_o yet_o if_o the_o new_a sheriff_n will_v receive_v they_o otherwise_o it_o suffice_v but_o where_o the_o old_a sheriff_n shall_v happen_v to_o die_v during_o the_o time_n of_o his_o office_n there_o without_o delivery_n or_o notice_n the_o new_a sheriff_n be_v chargeable_a present_o with_o all_o prisoner_n &_o be_v also_o to_o take_v notice_n of_o all_o writ_n in_o the_o hand_n of_o his_o predecessor_n etc._n etc._n and_o of_o the_o content_n thereof_o and_o of_o all_o prisoner_n and_o the_o cause_n of_o their_o commitment_n as_o it_o seem_v the_o form_n of_o the_o indenture_n for_o set_v over_o prisoner_n and_o writ_n between_o two_o sheriff_n see_v in_o my_o book_n at_o large_a note_v that_o by_o the_o death_n of_o the_o king_n or_o
