of_o late_o resolve_v by_o the_o judge_n that_o if_o a_o man_n have_v make_v himself_o one_o of_o the_o king_n servant_n extraordinary_a that_o this_o will_v not_o exempt_v he_o from_o the_o body_n but_o in_o one_o place_n at_o one_o time_n and_o yet_o if_o the_o case_n be_v so_o that_o a_o man_n have_v two_o several_a house_n in_o two_o several_a precinct_n and_o within_o several_a leet_n and_o he_o do_v live_v sometime_o at_o the_o one_o house_n and_o sometime_o at_o the_o other_o house_n in_o this_o case_n he_o may_v perhaps_o be_v make_v a_o officer_n at_o either_o of_o the_o leet_n within_o either_o of_o the_o place_n if_o he_o be_v there_o dwell_v at_o the_o time_n when_o the_o leet_n be_v keep_v for_o a_o man_n may_v do_v corporal_a service_n at_o two_o place_n at_o several_a time_n but_o if_o two_o tything_n be_v within_o one_o leet_n and_o one_o man_n have_v house_n in_o both_o the_o tything_n in_o this_o case_n it_o seem_v doubtful_a whether_o albeit_o he_o do_v live_v in_o the_o one_o tything_n he_o may_v not_o be_v compel_v to_o serve_v in_o this_o office_n for_o his_o house_n in_o the_o other_o tything_n especial_o if_o the_o tything_n be_v near_o and_o he_o keep_v no_o tenant_n in_o his_o house_n fit_a to_o undergo_v the_o office_n when_o it_o shall_v come_v to_o his_o turn_n wherein_o as_o in_o all_o other_o such_o like_a case_n a_o due_a consideration_n must_v be_v have_v of_o all_o circumstance_n 3._o by_o that_o which_o have_v be_v say_v it_o may_v appear_v then_o how_o unreasonable_a a_o thing_n it_o be_v that_o these_o office_n the_o particular_n aforesaid_a may_v set_v rate_n and_o tax_n upon_o the_o parishioner_n for_o the_o payment_n of_o money_n and_o as_o touch_v this_o point_n and_o to_o show_v how_o the_o law_n be_v at_o this_o day_n upon_o the_o new_a ordinance_n these_o thing_n be_v to_o be_v know_v 1._o these_o officer_n with_o the_o overseer_n of_o the_o poor_a of_o the_o parish_n or_o the_o great_a part_n of_o they_o together_o must_v now_o make_v these_o rate_n for_o if_o they_o be_v otherwise_o make_v there_o be_v no_o mean_n to_o recover_v they_o 2._o these_o rate_n may_v be_v make_v before_o there_o be_v present_a need_n as_o before_o the_o church_n fall_v or_o be_v in_o danger_n of_o ruin_n or_o the_o like_a 3._o these_o officer_n may_v by_o these_o rate_n raise_v money_n for_o the_o buy_n of_o book_n provide_v of_o bread_n and_o wine_n repair_v of_o the_o churchyard_n or_o burying_n place_n for_o the_o king_n bench_n and_o marshalsey_n and_o other_o payment_n and_o so_o also_o as_o it_o seem_v for_o the_o repair_n of_o the_o church_n the_o tower_n and_o the_o bell_n 4._o for_o this_o they_o may_v rate_v rate_n in_o make_v rate_n every_o inhabitant_n and_o occupier_n of_o land_n tithe_n impropriate_a wood_n or_o other_o hereditament_n within_o the_o parish_n 5._o the_o churchwarden_n must_v give_v public_a notice_n in_o the_o church_n when_o and_o where_o the_o rate_n be_v to_o be_v make_v howbeit_o if_o the_o parishioner_n after_o such_o notice_n give_v will_v not_o come_v or_o come_v will_v not_o agree_v to_o the_o rate_n in_o this_o case_n the_o churchwarden_n and_o overseer_n of_o the_o poor_a alone_o or_o the_o major_a part_n of_o they_o may_v make_v the_o rate_n but_o a_o rate_v make_v now_o without_o give_v notice_n thereof_o before_o hand_n to_o the_o parish_n be_v not_o good_a 6._o this_o rate_n must_v be_v equal_a and_o for_o this_o cause_n it_o must_v be_v upon_o every_o parishioner_n and_o not_o upon_o some_o of_o the_o parishioner_n only_o and_o it_o must_v be_v set_v upon_o every_o one_o of_o they_o equal_o viz._n according_a to_o the_o quantity_n and_o quality_n of_o his_o estate_n and_o land_n within_o the_o parish_n wherein_o they_o may_v rate_v by_o the_o yard_n acre_n or_o otherwise_o as_o they_o think_v fit_a so_o as_o it_o be_v equal_a and_o according_a to_o the_o true_a value_n by_o a_o equal_a proportion_n and_o if_o one_o of_o another_o parish_n have_v land_n in_o the_o parish_n where_o the_o rate_n be_v make_v in_o his_o own_o occupation_n in_o this_o case_n they_o may_v rate_v he_o to_o church_n payment_n according_a to_o the_o value_n of_o his_o land_n and_o this_o albeit_o there_o be_v no_o house_n upon_o it_o and_o albeit_o the_o owner_n and_o occupier_n dwell_v in_o another_o parish_n for_o as_o to_o this_o purpose_n he_o shall_v be_v call_v a_o parishioner_n and_o therefore_o he_o may_v parishioner_n parishioner_n if_o he_o please_v come_v unto_o and_o frequent_v the_o church_n of_o that_o parish_n as_o he_o do_v the_o church_n of_o the_o parish_n wherein_o he_o live_v and_o where_o the_o landlord_n and_o tenant_n both_o do_v live_v out_o of_o the_o parish_n it_o seem_v the_o curchwarden_n may_v rate_v either_o of_o they_o at_o their_o election_n and_o yet_o some_o hold_n that_o in_o these_o and_o such_o like_a case_n the_o rate_n must_v be_v always_o set_v upon_o the_o occupier_n of_o the_o
