remain_v in_o his_o majesty_n hand_n behind_o and_o unpaid_a shall_v be_v accept_v by_o his_o majesty_n his_o heir_n and_o successor_n for_o and_o towards_o the_o satisfaction_n of_o such_o arrear_n of_o rent_n as_o shall_v be_v then_o owe_v and_o unpaid_a and_o the_o residue_n thereof_o if_o any_o such_o be_v together_o with_o the_o interest_n thereof_o then_o due_a the_o say_a arrear_n be_v first_o deduct_v shall_v be_v repay_v and_o satisfy_v out_o of_o such_o part_n of_o his_o majesty_n revenue_n as_o shall_v grow_v due_a and_o payable_a after_o such_o avoidance_n or_o determination_n as_o aforesaid_a and_o the_o lord_n treasurer_n vice-treasurer_n chancellor_n and_o baron_n of_o the_o exchequer_n and_o all_o and_o every_o the_o farmer_n according_o and_o the_o lord_n treasurer_n etc._n etc._n on_o sight_n hereof_o to_o pay_v the_o same_o according_o commissioner_n collector_n and_o receiver_n thereof_o or_o any_o part_n thereof_o be_v hereby_o empower_v and_o require_v to_o pay_v the_o same_o according_o upon_o the_o sight_n of_o this_o present_a grant_n or_o the_o inrolment_n thereof_o without_o any_o other_o or_o further_a warrant_n provide_v always_o nevertheless_o continue_v the_o power_n of_o grant_v licence_n to_o transport_v wool-flock_n to_o continue_v and_o it_o be_v hereby_o declare_v to_o be_v the_o true_a intent_n and_o meaning_n of_o all_o party_n to_o these_o present_n that_o nothing_o herein_o contain_v shall_v extend_v or_o be_v construe_v to_o extend_v to_o lessen_v abate_v interrupt_v make_v void_a or_o give_v any_o disturbance_n to_o the_o out_o of_o his_o majesty_n dominion_n eliz._n and_o to_o grant_v pardon_n of_o the_o offence_n commit_v against_o the_o statute_n of_o the_o 11._o and_o 13._o eliz._n and_o to_o grant_v pardon_n of_o the_o offence_n commit_v against_o the_o statute_n of_o the_o eleven_o and_o thirteen_o of_o queen_n elizabeth_n in_o that_o case_n make_v and_o provide_v and_o of_o the_o forfeiture_n and_o penalty_n forfeit_v to_o his_o majesty_n by_o the_o say_a act_n or_o either_o of_o they_o nor_o to_o give_v any_o disturbance_n to_o the_o execution_n of_o the_o like_a authority_n grant_v or_o to_o be_v grant_v by_o his_o majesty_n his_o heir_n or_o successor_n at_o any_o time_n during_o the_o continuance_n of_o the_o say_v several_a and_o respective_a lease_n unto_o any_o other_o lieutenant_n deputy_n chief_a governor_n or_o governor_n of_o ireland_n for_o the_o time_n be_v nor_o to_o lessen_v or_o make_v void_a any_o power_n or_o authority_n give_v or_o grant_v to_o the_o commissioner_n of_o appeal_n appeal_n and_o the_o power_n grant_v the_o commissioner_n of_o appeal_n or_o to_o his_o majesty_n court_n of_o exchequer_n but_o that_o they_o and_o every_o of_o they_o shall_v and_o may_v at_o all_o time_n during_o the_o continuance_n of_o the_o say_v several_a lease_n lessen_v abate_v mitigate_v compound_v for_o or_o discharge_v such_o fine_n penalty_n and_o forfeiture_n as_o by_o law_n they_o be_v authorize_v to_o do_v any_o thing_n herein_o contain_v to_o the_o contrary_a thereof_o notwithstanding_o and_o because_o in_o this_o present_a indenture_n several_a demise_n be_v contain_v wherein_o several_a duty_n and_o revenue_n of_o a_o different_a kind_n and_o nature_n be_v demise_v for_o several_a and_o different_a term_n of_o year_n and_o provision_n be_v likewise_o make_v that_o defalcation_n of_o rent_n shall_v be_v allow_v in_o several_a case_n in_o such_o manner_n and_o form_n as_o herein_o before_o be_v express_v notwithstanding_o which_o provision_n some_o doubt_n may_v arise_v whether_o they_o to_o who_o the_o power_n of_o make_v such_o allowance_n by_o way_n of_o defalcation_n be_v entrust_v and_o commit_v may_v not_o or_o ought_v not_o upon_o every_o demand_n of_o defalcation_n to_o be_v make_v have_v a_o respect_n to_o and_o consideration_n of_o all_o and_o every_o the_o branch_n of_o revenue_n hereby_o several_o and_o respective_o demise_v as_o aforesaid_a and_o then_o refuse_v to_o make_v any_o defalcation_n unless_o the_o farmer_n so_o demand_v the_o same_o shall_v make_v it_o appear_v that_o they_o have_v sustain_v great_a loss_n upon_o the_o whole_a revenue_n several_o demise_v as_o aforesaid_a although_o they_o shall_v make_v it_o appear_v that_o they_o have_v sustain_v great_a loss_n by_o that_o branch_n of_o revenue_n for_o which_o a_o defalcation_n be_v demand_v for_o better_a explanation_n therefore_o of_o this_o doubt_n his_o majesty_n be_v please_v hereby_o to_o declare_v and_o agree_v that_o when_o and_o as_o often_o as_o any_o defalcation_n shall_v be_v demand_v by_o virtue_n of_o any_o covenant_n clause_n or_o article_n in_o these_o present_v contain_v for_o and_o in_o respect_n of_o damage_n suffer_v in_o any_o particular_a branch_n of_o revenue_n herein_o before_o mention_v and_o demise_v etc._n all_o defalcation_n to_o be_v consider_v in_o every_o particular_a branch_n for_o which_o defalcation_n be_v demand_v not_o collective_o by_o compute_v what_o be_v get_v or_o lose_v upon_o the_o several_a branch_n but_o distributive_o by_o compute_v what_o be_v get_v or_o lose_v by_o that_o particular_a which_o defalcation_n etc._n etc._n that_o then_o and_o in_o every_o such_o case_n the_o lord_n lieutenant_n or_o other_o chief_a governor_n or_o governor_n of_o ireland_n and_o council_n there_o for_o the_o time_n be_v or_o any_o six_o or_o more_o of_o they_o whereof_o the_o lord_n lieutenant_n or_o other_o chief_a governor_n or_o governor_n for_o the_o time_n be_v to_o be_v always_o one_o or_o more_o shall_v from_o time_n to_o time_n proceed_v to_o consider_v of_o such_o defalcation_n without_o any_o respect_n of_o or_o inquiry_n into_o what_o have_v be_v or_o may_v be_v get_v or_o lose_v upon_o the_o whole_a contract_n for_o take_v to_o farm_v all_o the_o several_a branch_n of_o revenue_n herein_o before_o mention_v but_o shall_v only_o take_v into_o consideration_n that_o branch_n of_o revenue_n for_o which_o a_o defalcation_n be_v particular_o demand_v and_o upon_o consideration_n thereof_o have_v if_o it_o shall_v be_v find_v that_o the_o farmer_n and_o lessee_n thereof_o their_o executor_n and_o assign_v have_v sustain_v great_a loss_n and_o damage_n in_o that_o branch_n of_o the_o revenue_n for_o which_o a_o defalcation_n be_v demand_v by_o reason_n of_o such_o accident_n for_o which_o a_o defalcation_n be_v intend_v according_a to_o the_o true_a meaning_n of_o these_o present_n then_o and_o in_o every_o such_o case_n a_o reasonable_a defalcation_n shall_v be_v make_v and_o allow_v as_o aforesaid_a it_o be_v the_o true_a intent_n and_o meaning_n of_o these_o present_n that_o in_o case_n of_o defalcation_n each_o several_a branch_n of_o revenue_n comprise_v in_o any_o of_o the_o several_a demise_n and_o term_n of_o year_n shall_v be_v consider_v several_o and_o apart_o by_o itself_o without_o any_o respect_n to_o or_o consideration_n have_v of_o any_o profit_n or_o advantege_v which_o may_v have_v be_v make_v of_o any_o other_o branch_n of_o revenue_n for_o which_o no_o defalcation_n be_v demand_v provide_v always_o and_o it_o be_v hereby_o declare_v and_o agree_v last_o no_o defalcation_n for_o quitrent_n grant_v away_o before_o michaelmas_n last_o that_o nothing_o herein_o contain_v shall_v any_o way_n entitle_v the_o say_v farmer_n or_o lessee_n their_o executor_n administrator_n or_o assign_v or_o any_o of_o they_o to_o ask_v demand_n or_o have_v any_o
