be_v lawful_a for_o such_o collector_n as_o shall_v be_v appoint_v by_o the_o churchwarden_n aforesaid_a to_o detain_v or_o keep_v in_o his_o possession_n the_o good_n of_o the_o person_n or_o below_o the_o stop_n be_v upon_o small_a flood_n total_o overflow_v and_o the_o stop_n by_o the_o mean_v aforesaid_a daily_o increase_v so_o that_o it_o be_v evident_a that_o in_o a_o short_a time_n if_o no_o remedy_n be_v apply_v all_o the_o settlement_n and_o sugar-work_n thereabouts_o will_v be_v altogether_o lose_v and_o what_o be_v good_a manurable_a land_n now_o will_v be_v turn_v into_o mere_a bog_n and_o morass_n unfit_a to_o raise_v cattle_n in_o or_o convert_v to_o any_o other_o use_n which_o will_v not_o only_o be_v a_o very_a great_a loss_n to_o to_o this_o island_n in_o general_n but_o a_o utter_a ruin_n to_o the_o
under_o the_o penalty_n of_o fifty_o pound_n to_o be_v recover_v and_o dispose_v of_o as_o aforesaid_a and_o whosoever_o shall_v buy_v barter_n or_o bargain_n with_o any_o such_o know_a horse-catcher_n or_o driver_n for_o any_o cattle_n or_o horse_n without_o the_o same_o be_v first_o vouch_v as_o aforesaid_a he_o she_o or_o they_o so_o offend_a shall_v for_o every_o such_o offence_n he_o or_o they_o shall_v for_o such_o offence_n be_v guilty_a of_o felony_n it_o be_v further_a enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n that_o be_v keeper_n or_o owner_n of_o goat_n shall_v suffer_v their_o goat_n to_o feed_v in_o any_o person_n land_n except_o their_o own_o and_o if_o any_o do_v suffer_v the_o same_o to_o feed_v in_o any_o person_n land_n it_o shall_v be_v deem_v trespass_n and_o the_o owner_n of_o the_o land_n shall_v recover_v in_o any_o court_n of_o record_n full_a cost_v of_o suit_n in_o the_o say_a action_n beside_o what_o damage_n shall_v be_v give_v by_o the_o jury_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n whatsoever_o shall_v be_v capable_a of_o hunt_v with_o any_o gang_n of_o dog_n in_o this_o island_n that_o be_v not_o a_o planter_n in_o it_o and_o have_v not_o at_o least_o five_o acre_n of_o land_n plant_v and_o that_o any_o person_n that_o shall_v presume_v to_o hunt_v any_o gang_n of_o dog_n within_o this_o island_n be_v not_o qualify_v as_o aforesaid_a shall_v forfeit_v for_o every_o such_o offence_n his_o gang_n of_o dog_n and_o the_o sum_n of_o ten_o pound_n sterling_a to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n by_o bill_n plaint_n or_o information_n the_o one_o moiety_n or_o half_a part_n of_o all_o such_o forfeiture_n shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o the_o support_n of_o the_o government_n and_o contingent_a charge_n thereof_o and_o the_o other_o moiety_n shall_v be_v to_o the_o informer_n or_o any_o person_n that_o shall_v sue_v for_o the_o same_o and_o it_o shall_v not_o be_v lawful_a for_o any_o planter_n or_o planter_n in_o this_o island_n to_o own_o any_o hunt_a gang_n of_o dog_n which_o shall_v not_o proper_o belong_v to_o themselves_o their_o mate_n in_o plant_v or_o hunt_v by_o their_o servant_n under_o the_o penalty_n of_o ten_o pound_n sterling_a for_o each_o time_n he_o or_o they_o shall_v so_o offend_v to_o be_v recover_v in_o manner_n and_o form_n aforesaid_a and_o to_o be_v dispose_v of_o as_o aforesaid_a and_o it_o be_v further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o if_o any_o hunt_a gang_n of_o dog_n shall_v kill_v or_o maim_v any_o tame_a stock_n belong_v to_o any_o planter_n or_o person_n whatsoever_o or_o do_v he_o or_o they_o any_o prejudice_n or_o damage_n the_o party_n so_o damnify_v lift_v the_o damage_n amount_v to_o not_o above_o forty_o shilling_n satisfaction_n for_o the_o same_o shall_v be_v recover_v by_o warrant_n from_o any_o justice_n of_o the_o peace_n but_o if_o it_o amount_v to_o more_o than_o forty_o shilling_n the_o person_n or_o person_n so_o injure_v shall_v sue_v for_o the_o same_o at_o common_a law_n and_o if_o any_o person_n shall_v kill_v or_o maim_v any_o manner_n of_o tame_a stock_n as_o sheep_n hog_n or_o goat_n either_o by_o hunt_v or_o otherwise_o and_o shall_v not_o forthwith_o discover_v the_o same_o to_o the_o next_o justice_n or_o constable_n to_o the_o end_n the_o damage_n may_v be_v know_v and_o recover_v as_o aforesaid_a such_o offender_n kill_v maim_v or_o injure_v any_o such_o tame_a stock_n and_o not_o discover_v it_o as_o aforesaid_a shall_v pay_v five_o pound_n for_o every_o default_n beside_o whatsoever_o shall_v hunt_v any_o gang_n of_o dog_n within_o four_o mile_n of_o any_o crawâ—_n or_o settlement_n except_o in_o his_o own_o land_n or_o leave_v from_o the_o proprietor_n of_o the_o same_o upon_o pain_n of_o ten_o pound_n sterling_a and_o that_o no_o person_n or_o person_n whatsoever_o shall_v set_v any_o snare_n or_o engine_n in_o any_o place_n whatsoever_o his_o plant_v ground_n only_o except_v under_o penalty_n of_o forty_o shilling_n for_o every_o time_n any_o person_n shall_v so_o offend_v in_o either_o of_o the_o premise_n to_o be_v recover_v as_o aforesaid_a and_o dispose_v of_o as_o aforesaid_a and_o to_o pay_v all_o other_o damage_n that_o shall_v accrue_v by_o the_o same_o a_o act_n secure_v the_o purchaser_n of_o thomas_n bun_n land_n upon_o port_n royal._n whereas_o one_o thomas_n bun_n late_o of_o this_o island_n in_o the_o fourteen_o year_n of_o his_o majesty_n reign_n patent_v a_o certain_a parcel_n of_o land_n on_o port_n royal_a and_o after_o that_o constitute_v and_o appoint_v one_o martin_n vanolphin_n his_o attorney_n thereby_o give_v he_o full_a power_n and_o authority_n for_o he_o and_o in_o his_o name_n to_o bargain_n and_o sell_v all_o and_o singular_a the_o land_n and_o tenement_n of_o the_o say_v thomas_n bun_n and_o that_o he_o the_o say_v martin_n vanolphin_n in_o pursuance_n of_o the_o aforesaid_a authority_n do_v for_o a_o valuable_a consideration_n well_o and_o true_o pay_v to_o the_o aforesaid_a thomas_n bun_n bargain_n and_o sell_v the_o aforesaid_a parcel_n of_o land_n unto_o william_n parker_n esquire_n and_o robert_n swanley_n and_o that_o a_o moiety_n of_o the_o say_a land_n be_v sell_v by_o the_o say_v swanley_n to_o one_o thomas_n tothill_n decease_a who_o estate_n real_a be_v in_o pursuance_n of_o a_o act_n of_o this_o island_n expose_v to_o sale_n and_o sell_v for_o and_o towards_o the_o satisfaction_n of_o the_o just_a debt_n of_o the_o say_v thomas_n tothill_n to_o sir_n charles_n modyford_n baronet_n and_o the_o whole_a purchase_v as_o aforesaid_a sell_v by_o the_o say_a sir_n charles_n modyford_n baronet_n and_o william_n parker_n esq_n to_o edward_n yeoman_n esq_n for_o a_o valuable_a consideration_n and_o the_o aforesaid_a letter_n of_o attorney_n through_o the_o ignorance_n and_o neglect_v of_o those_o time_n not_o prove_v and_o record_v as_o the_o law_n of_o this_o baronet_n and_o the_o say_v william_n parker_n esq_n any_o law_n or_o custom_n usage_n or_o pretence_n of_o right_n whatsoever_o to_o the_o contrary_a in_o any_o wise_n notwithstanding_o a_o act_n encourage_v the_o importation_n of_o white_a servant_n forasmuch_o as_o it_o be_v provide_v in_o a_o act_n of_o this_o country_n entitle_v a_o act_n for_o regulate_a servant_n for_o the_o strengthen_n and_o better_a defence_n of_o this_o his_o majesty_n island_n every_o master_n and_o owner_n of_o slave_n shall_v have_v such_o quantity_n of_o white_a servant_n proportionable_a to_o the_o number_n shilling_n for_o every_o deed_n exceed_v the_o length_n aforesaid_a eight_o penny_n per_fw-la sheet_n account_v twenty_o line_n to_o a_o sheet_n and_o eight_o word_n to_o a_o line_n for_o every_o short_a write_v not_o exceed_v the_o length_n aforesaid_a twelve_o penny_n for_o record_v every_o plot_n one_o shilling_n and_o three_o penny_n for_o search_v the_o record_n twelve_o penny_n and_o for_o acknowledge_v satisfaction_n in_o the_o margin_n of_o a_o mortgage_n record_v one_o shilling_n and_o three_o penny_n and_o no_o more_o under_o the_o penalty_n of_o ten_o pound_n to_o the_o use_v very_a convenient_a way_n between_o the_o salt_n and_o fresh_a river_n in_o the_o parish_n of_o st._n andrews_n and_o st._n catharines_n which_o will_v be_v of_o great_a use_n and_o advantage_n to_o the_o whole_a island_n in_o cause_v a_o more_o near_o and_o easy_a correspondence_n with_o the_o several_a precinct_n and_o whereas_o the_o say_v william_n parker_n have_v likewise_o set_v up_o and_o erect_v a_o ferry_n for_o the_o better_a accommodation_n of_o the_o say_a passage_n and_o whereas_o the_o same_o can_v be_v maintain_v without_o great_a and_o constant_a charge_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o say_v william_n parker_n his_o heir_n and_o assign_v be_v by_o this_o act_n impower_v and_o authorize_v for_o the_o space_n and_o term_v of_o fourteen_o year_n from_o the_o make_n hereof_o to_o ask_v demand_n sue_v for_o recover_v and_o receive_v as_o a_o duty_n and_o toll_n for_o the_o transport_v of_o any_o person_n over_o the_o say_a ferry_n seven_o penny_n half_a penny_n for_o every_o horse_n and_o man_n fifteen_o penny_n for_o every_o grow_v beast_n that_o have_v no_o rider_n seven_o penny_n half_a penny_n for_o every_o sheep_n calf_n or_o hog_n six_o penny_n and_o that_o the_o say_v william_n parker_n his_o heir_n and_o assign_v may_v and_o shall_v erect_v a_o tavern_n or_o victualling-house_n near_o the_o say_a ferry_n and_o shall_v not_o be_v compel_v to_o renew_v or_o pay_v any_o licence_n money_n for_o the_o same_o provide_v always_o that_o if_o the_o say_v william_n parker_n or_o his_o assign_v shall_v not_o finish_v and_o complete_a the_o say_a way_n and_o passage_n within_o twelve_o month_n from_o and_o after_o the_o make_n of_o this_o act_n and_o that_o in_o all_o place_n it_o be_v not_o less_o than_o eight_o foot_n broad_a and_o that_o the_o same_o be_v always_o keep_v in_o good_a and_o sufficient_a repair_n that_o the_o aforesaid_a limitation_n of_o the_o rate_n which_o shall_v be_v pay_v by_o virtue_n of_o this_o act_n or_o any_o letter_n patent_n grant_v for_o the_o same_o shall_v cease_v determine_v and_o be_v utter_o void_a and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o other_o person_n whatsoever_o presume_v to_o erect_v
settler_n in_o particular_a who_o have_v expend_v great_a sum_n of_o money_n in_o plant_v thereabouts_o for_o prevention_n of_o so_o great_a and_o grow_a a_o mischief_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o governor_n or_o commander_n in_o chief_a for_o the_o time_n be_v do_v issue_n out_o a_o commission_n in_o the_o nature_n of_o a_o commission_n of_o sewer_n under_o the_o broad_a seal_n of_o this_o island_n thereby_o constitute_v the_o say_a commission_n after_o he_o have_v knowledge_n thereof_o shall_v take_v his_o corporal_a oath_n to_o lay_v a_o reasonable_a tax_n upon_o all_o the_o land_n or_o negro_n or_o upon_o both_o
