The Prior of S. was Seized of certain Lands and he and his Predecessors untill the dissoll held discharged of Tythes he surrendred to the King and shews the Statute of 31 H. 8. and conveys the Interest to one who brought a Prohibition Plow 1422. It was agreed between the Master of the Hospital of B. and the Prior that when the Lands were in the hands of the Priors Tenants Tythes should be paid and when in the Priors own hands they should pay no Tithes but then they should have gate for six Cows in such a pasture The Def. conveys the Hospital to the King and from the King to the Def. and Traverseth that the Plaintiff holdeth discharged demurrer adjudged the Plea ill and no good inducement to the Traverse for he makes no title to the Master of the Hospital to Tythes but only pretends an agreement not shewing any Title to make agreement also he doth not shew the Agreement to be in Writing and the inducement of a Traverse ought to be sufficient for the Plaintiff Et modo c. quando c. omne contemptu c. quicquid c. Lands a good and Lawful Surrender or Surrenders into the Lord and Lords hands of whom the same be holden by Copy to the use of the said Henry Keble his Heirs and Assigns according to the Custome and Customes of the Mannor or Mannors whereof they been holden And that the said Lands and Tenements and other the Premisses at the said Feast of All Saints next coming after the date hereof shall be clearly discharged and exonerated of all former Bargains Sales Joyntures Dowers Rents Statutes Recognizances Fines Issues Amerciaments former Titles Charges or Incumbrances whatsoever they be the Rents and Services thereof from henceforth to be due to the chief Lord or Lords of the Fee of whom the Premisses or any part thereof are holden only and one Annuity of Ten pounds issuing out of the Premisses yearly to Thomas Scerfe excepted And that the said Bennet Rivet is true owner and seized of the Premisses in Fee-simple and that he hath full power and authority to Bargain and Sell the same Premisses and every parcel thereof to the said Henry Keble and his Heirs in Form aforesaid And that the said Henry Keble his Heirs and Assigns shall from henceforth have hold and enjoy all the Premisses without any Lawfull eviction or expulsion by reason of any former Title Act or Acts having a being and beginning before the date hereof And that the said Bennet and his Heirs and all persons that hath or claim to have any Right Title or Estate of Freehold or Inheritance of in or to the Premisses or any parcel thereof and every of them shall from henceforth at the Costs and Charges in the Law of the said Henry or of his Heirs do knowledge and suffer to be done from time to time upon every reasonable request to be made to any of them by the said Henry his Heirs or Assigns or any of them all and every such reasonable Act and Acts devise thing and things that shall be reasonably devised or advised by the said Henry and his Heirs or by his or their Learned Councel or by any of them for the further and more better assurance and sure making of the Premisses to the said Henry his Heirs and Assigns discharged as is aforesaid be it by Fine Feoffment Recovery in a Writ of entry in le post or else with Warranty against all persons or otherwise for all and singular such said Lands Tenements and other the Premisses And for the Bargain Sale Covenants and Grants before in these presents made concerning the same the said Henry hath and shall pay to the said Bennet Rivet at the ensealeing of these Indentures the summe of One Hundred pounds of good Currant Money of England which said summe of one Hundred pounds the said Bennet knowledgeth himself to have received And the said Henry his Heirs Executors and Administrators thereof acquitteth and dischargeth by these presents And further the said Henry Keble Covenanteth and granteth for him his Heirs Executors and Administrators and for every of them to and with the said Bennet Rivet his Heirs Executors and Administrators and for every of them to discharge save and keep harmless the said Bennet Rivet and his Heirs against Thomas Scerfe his Excecutors and Administrators as well for the payment of the Annuity of Ten pounds yearly issuing out of the Premisses payable to the said Tho Scerfe during the Natural Life of the said Thomas as also for the payment of Forty pounds of good and Lawfull money of England to the Executors Administrators or Assigns of the said Thomas Scerfe within Four years next after the Decease of the said Thomas as by a Pair of Indentures thereof made between the said Thomas Scarfe of the one party and the said Bennet Rivet of the other party bearing date the Twenty first day of February in the first year of the Reign of our Soveraign Lady the Queens Majesty that now is more plainly may and doth appear Provided alway and it is further Covenanted condiscended concluded and agreed between the said parties that the said Thomas Scerfe shall have during his Life one Chamber within the said Messuage which the said Thomas now liveth in with sufficient fewel and free egress and regress in and to the same without any interruption lett or denial of the said Henry Rivet his Heirs Executors Administrators or Assigns during the life time of the said Thomas Scerfe as long as the said Thomas Scerfe will there continue remain and abide In Witness whereof the parties abovesaid to
