the_o realm_n and_o be_v enlarge_v or_o able_a to_o travel_v repair_v to_o the_o place_n of_o birth_n or_o where_o the_o father_n or_o mother_n of_o such_o person_n shall_v then_o be_v dwell_v and_o the_o queen_n majesty_n all_o such_o person_n as_o by_o this_o act_n be_v to_o make_v their_o repair_n to_o their_o place_n of_o dwell_v or_o to_o the_o place_n of_o their_o birth_n or_o where_o their_o father_n and_o mother_n shall_v be_v dwell_v and_o not_o to_o pass_v above_o five_o mile_n from_o thence_o shall_v within_o twenty_o day_n after_o their_o come_n to_o any_o of_o the_o say_a place_n notify_v their_o come_n thither_o and_o present_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n and_o curate_n of_o the_o parish_n and_o to_o the_o constable_n headborough_z or_o tythingman_n of_o the_o town_n and_o thereupon_o the_o minister_n or_o curate_n shall_v present_o enter_v the_o same_o into_o a_o book_n to_o be_v keep_v in_o every_o parish_n for_o that_o purpose_n and_o afterward_o the_o say_a minister_n or_o curate_n and_o the_o say_a constable_n headborough_z or_o tythingman_n shall_v certify_v the_o same_o in_o write_v to_o the_o justice_n of_o peace_n of_o the_o same_o county_n at_o the_o next_o quarter_n session_n and_o the_o say_a justice_n shall_v enter_v or_o cause_v the_o same_o to_o be_v enter_v by_o the_o clerk_n of_o the_o peace_n in_o the_o roll_n of_o the_o same_o session_n every_o popish_a recusant_n not_o be_v a_o feme_fw-fr covert_n and_o not_o have_v a_o state_n of_o inheritance_n of_o freehold_n to_o usual_a place_n of_o his_o abode_n or_o to_o the_o place_n of_o his_o birth_n or_o the_o dwell_n of_o his_o father_n or_o mother_n and_o thereupon_o notify_v their_o come_n and_o present_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n or_o curate_n of_o the_o parish_n and_o to_o the_o constable_n head-borough_n or_o tythingman_n of_o the_o town_n within_o such_o time_n and_o in_o such_o manner_n as_o aforesaid_a or_o shall_v after_o remove_v five_o mile_n from_o thence_o and_o shall_v not_o within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v conform_v himself_o to_o resort_v usual_o to_o divine_a service_n and_o in_o make_v such_o public_a confession_n and_o submission_n as_o hereafter_o be_v express_v shall_v suffer_v as_o a_o felon_n without_o benefit_n of_o the_o clergy_n every_o person_n suspect_v to_o be_v a_o jesuit_n or_o seminarie-priest_n who_o be_v examine_v by_o lawful_a authority_n and_o refuse_v to_o answer_v direct_o whether_o he_o be_v a_o jesuit_n or_o not_o shall_v be_v commit_v to_o prison_n without_o bail_n or_o mainprize_n until_o he_o answer_v direct_o every_o person_n confine_v as_o aforesaid_a to_o the_o compass_n of_o five_o mile_n that_o have_v necessary_a occasion_n of_o business_n upon_o licence_n from_o two_o justice_n of_o the_o peace_n in_o the_o same_o county_n under_o their_o hand_n with_o the_o assent_n of_o the_o bishop_n of_o the_o diocese_n in_o writing_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n may_v travel_v about_o his_o necessary_a business_n for_o such_o time_n only_o as_o be_v contain_v in_o the_o licence_n no_o person_n so_o restrain_v as_o aforesaid_a which_o shall_v be_v urge_v by_o process_n without_o fraud_n or_o covin_z and_o be_v bind_v to_o make_v appearance_n in_o any_o of_o her_o majesty_n court_n or_o shall_v be_v send_v to_o by_o three_o or_o more_o of_o her_o majesty_n council_n or_o by_o four_o or_o more_o commissioner_n appoint_v by_o her_o majesty_n to_o make_v appearance_n before_o her_o council_n or_o commissioner_n in_o every_o such_o case_n
shall_v retain_v in_o service_n see_v or_o livery_n any_o person_n which_o shall_v forbear_v to_o go_v to_o some_o usual_a place_n of_o divine_a service_n by_o the_o space_n of_o a_o month_n shall_v forfeit_v for_o every_o such_o month_n he_o know_v the_o same_o the_o sum_n of_o ten_o pound_n this_o act_n shall_v not_o extend_v to_o punish_v any_o person_n for_o maintain_v relieve_v or_o harbour_v his_o father_n or_o mother_n want_v without_o fraud_n any_o other_o habitation_n or_o sufficient_a maintenance_n or_o the_o ward_n of_o any_o person_n commit_v by_o authority_n to_o the_o custody_n of_o any_o by_o who_o they_o shall_v be_v so_o relieve_v maintain_v or_o keep_v the_o sheriff_n or_o other_o officer_n upon_o lawful_a writ_n warrant_v or_o process_n to_o he_o award_v to_o take_v or_o apprehend_v any_o popish_a recusant_n stand_v excommunicate_v for_o recusancy_n may_v break_v open_a the_o house_n where_o any_o such_o person_n excommunicate_v shall_v be_v or_o raise_v the_o power_n of_o the_o county_n for_o apprehend_v such_o person_n every_o offence_n commit_v against_o this_o act_n may_v be_v hear_v and_o determine_v before_o the_o justice_n of_o the_o king_n bench_n and_o justice_n of_o assize_n and_o all_o offence_n other_o than_o treason_n shall_v be_v inquire_v hear_v and_o determine_v before_o the_o justice_n of_o peace_n in_o their_o next_o general_n and_o quarter-session_n no_o attainder_n of_o felony_n by_o this_o act_n shall_v extend_v to_o forfeiture_n of_o dower_n or_o corruption_n of_o blood_n the_o defendant_n in_o any_o action_n commence_v or_o bring_v against_o he_o by_o virtue_n of_o any_o thing_n in_o this_o act_n may_v plead_v to_o the_o general_a issue_n by_o a_o evidence_n that_o shall_v prove_v his_o do_n or_o proceed_n where_o of_o the_o lord_n chancellor_n lord_n treasurer_n or_o principle_n secretary_n to_o be_v one_o have_v authority_n to_o require_v the_o same_o at_o any_o time_n of_o any_o nobleman_n or_o noble-woman_n be_v above_o the_o age_n of_o 18._o year_n and_o if_o such_o nobleman_n or_o noble-woman_n other_o than_o the_o woman_n marry_v refuse_v the_o same_o they_o shall_v incur_v the_o penalty_n of_o a_o praemunire_n where_o any_o person_n shall_v pass_v out_o of_o the_o cinque-port_n or_o any_o member_n thereof_o to_o any_o part_n beyond_o the_o sea_n to_o serve_v any_o foreign_a prince_n state_n or_o potentate_n the_o lord_n warden_n of_o the_o cinque-port_n for_o the_o time_n be_v or_o any_o person_n by_o he_o appoint_v have_v power_n to_o take_v bond_n and_o minister_v this_o oath_n to_o such_o passenger_n if_o any_o man_n discover_v any_o recusant_n or_o other_o person_n which_o shall_v entertain_v or_o 5._o stat._n annn._n 3_o jac._n cap._n 5._o relieve_v any_o jesuit_n seminary_n or_o popish_a priest_n or_o shall_v discover_v any_o mass_n to_o have_v be_v say_v and_o the_o person_n which_o be_v present_a and_o the_o priest_n or_o any_o that_o be_v present_a within_o three_o day_n shall_v not_o only_o be_v free_v from_o any_o penalty_n but_o shall_v have_v the_o three_o part_n of_o the_o forfeiture_n of_o all_o such_o sum_n of_o money_n good_n and_o chattel_n which_o shall_v be_v forfeit_v for_o such_o offence_n if_o the_o forfeiture_n exceed_v not_o 150_o l._n if_o it_o do_v exceed_v 150_o l._n then_o the_o discoverer_n to_o have_v 50_o l._n and_o the_o discoverer_n after_o conviction_n of_o the_o offendor_n shall_v have_v a_o certificate_n from_o the_o judge_n or_o justice_n of_o peace_n before_o who_o such_o conviction_n shall_v happen_v to_o be_v direct_v to_o the_o sheriff_n or_o other_o officer_n that_o shall_v seize_v the_o good_n command_v he_o to_o pay_v the_o same_o according_o no_o popish_a recusant_n shall_v come_v into_o the_o house_n where_o the_o king_n or_o the_o heir_n apparent_a shall_v be_v unless_o command_v by_o the_o king_n or_o by_o warrant_n from_o the_o lord_n of_o the_o privy_a council_n upon_o penalty_n of_o one_o hundred_o pound_n the_o one_o moiety_n to_o the_o king_n the_o other_o to_o the_o discoverer_n who_o will_v sue_v for_o the_o same_o in_o any_o court_n of_o record_n where_o no_o essoine_n protection_n or_o law_n gager_n shall_v be_v allow_v all_o convict_v popish_a recusant_n dwell_v in_o london_n or_o within_o five_o mile_n within_o three_o month_n after_o the_o session_n of_o parliament_n shall_v depart_v out_o of_o it_o and_o not_o dwell_v within_o ten_o mile_n and_o deliver_v up_o their_o name_n to_o the_o lord_n major_n if_o they_o dwell_v in_o london_n and_o if_o such_o recusant_n shall_v dwell_v within_o ten_o mile_n of_o london_n to_o deliver_v up_o his_o name_n to_o the_o next_o justice_n of_o peace_n within_o forty_o day_n after_o the_o session_n of_o parliament_n upon_o the_o penalty_n of_o one_o hundred_o pound_n the_o one_o half_a to_o the_o king_n the_o other_o to_o he_o who_o will_v sue_v as_o aforesaid_a all_o recusant_n which_o shall_v dwell_v or_o remain_v in_o london_n or_o within_o ten_o mile_n thereof_o shall_v within_o ten_o day_n after_o indictment_n or_o conviction_n depart_v out_o of_o the_o say_a compass_n and_o deliver_v up_o their_o name_n to_o the_o lord_n mayor_n in_o case_n the_o say_a recusant_n shall_v dwell_v in_o any_o county_n within_o ten_o mile_n of_o london_n then_o within_o ten_o day_n after_o conviction_n or_o indictment_n shall_v give_v up_o his_o name_n to_o the_o next_o justice_n of_o peace_n the_o person_n offend_v shall_v forfeit_v one_o hundred_o pound_n the_o one_o half_a to_o the_o king_n the_o other_o to_o the_o informer_n as_o aforesaid_a tradesman_n recusant_n who_o have_v no_o other_o habitation_n may_v continue_v within_o london_n and_o the_o compass_n of_o ten_o mile_n this_o act_n repeal_v that_o branch_n of_o the_o 35_o eliz._n cap._n 2._o touch_v licence_n of_o recusant_n to_o remove_v or_o pass_v above_o five_o mile_n from_o their_o place_n of_o abode_n the_o king_n or_o three_o or_o more_o of_o the_o privy_a council_n under_o their_o hand_n may_v licence_v a_o recusant_n to_o travel_v out_o of_o the_o compass_n of_o five_o mile_n so_o may_v four_o justice_n of_o peace_n of_o the_o county_n with_o the_o privity_n of_o the_o bishop_n of_o the_o diocese_n in_o writing_n or_o of_o the_o lieutenant_n or_o any_o of_o the_o deputy_n lieutenant_n the_o party_n take_v his_o corporal_a oath_n that_o he_o true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n and_o make_v no_o causeless_a stay_n no_o convict_v recusant_n shall_v practice_v the_o common_a law_n as_o a_o councillor_n clerk_n attorney_n or_o solicitor_n nor_o shall_v practise_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practise_v physic_n nor_o be_v a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o any_o court_n nor_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town-clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v office_n as_o captain_n lieutenant_z corporal_n sergeant_n ancient-bearer_n or_o other_o office_n in_o camp_n troop_n band_n or_o company_n of_o soldier_n nor_o bear_v any_o office_n in_o any_o ship_n castle_n or_o fortress_n of_o the_o king_n upon_o penalty_n of_o one_o hundred_o pound_n to_o be_v forfeit_v as_o aforesaid_a no_o popish_a recusant_n convict_v or_o have_v a_o wife_n convict_v shall_v bear_v any_o public_a office_n in_o the_o commonwealth_n every_o marry_a woman_n be_v a_o recusant_n convict_v her_o husband_n not_o be_v convict_v shall_v forfeit_v 2._o three_o part_n of_o her_o jointure_n and_o dower_n during_o her_o life_n and_o be_v make_v uncapable_a of_o be_v executrix_n or_o administratrix_n to_o her_o husband_n every_o popish_a recusant_n convict_v shall_v be_v deem_v as_o a_o person_n excommunicate_v so_o long_o as_o he_o continue_v not_o conformable_a and_o not_o come_v to_o divine_a service_n and_o receive_v the_o sacrament_n and_o take_v the_o oath_n appoint_v by_o this_o parliament_n in_o the_o first_o chap._n yet_o such_o recusant_n may_v sue_v for_o such_o of_o his_o land_n tenement_n etc._n etc._n and_o for_o the_o profit_n thereof_o which_o be_v not_o
seize_v into_o the_o king_n hand_n for_o his_o recusancy_n or_o any_o part_n thereof_o every_o covicted_a popish_a recusant_n not_o marry_v in_o some_o open_a church_n or_o chappel_n or_o otherwise_o then_o according_a to_o the_o church_n of_o england_n by_o a_o minister_n lawful_o authorize_v shall_v be_v disable_v to_o have_v any_o estate_n of_o freehold_n by_o courtesy_n of_o england_n and_o every_o woman_n be_v a_o popish_a recusant_n convict_v which_o shall_v be_v marry_v in_o other_o form_n then_o as_o aforesaid_a shall_v be_v disable_v not_o only_o to_o claim_v any_o dower_n or_o jointure_n but_o also_o the_o widow_n estate_n and_o frankbanck_n in_o any_o customary_a land_n whereof_o her_o husband_n die_v seize_v and_o likewise_o from_o have_v part_n of_o her_o husband_n good_n by_o virtue_n of_o any_o custom_n of_o any_o county_n city_n or_o place_n and_o if_o a_o man_n be_v marry_v contrary_a to_o the_o true_a intent_n of_o this_o statute_n to_o a_o woman_n who_o have_v no_o land_n or_o tenement_n whereby_o he_o may_v become_v tenant_n by_o courtesy_n he_o shall_v forfeit_v 100_o l._n to_o be_v pay_v as_o aforesaid_a every_o popish_a recusant_n which_o shall_v age_n of_o the_o say_a child_n as_o also_o the_o name_n of_o the_o servant_n of_o the_o say_a recusant_n at_o the_o next_o general_n or_o quarter-session_n of_o that_o shire_n limit_n division_n or_o liberty_n all_o such_o presentment_n shall_v be_v record_v in_o the_o say_a session_n by_o the_o clerk_n of_o the_o peace_n or_o town-clerk_n for_o the_o time_n be_v without_o any_o fee_n and_o for_o default_n of_o every_o such_o presentment_n the_o say_a churchwarden_n constable_n or_o high-constable_n shall_v forfeit_v twenty_o shilling_n and_o for_o default_n of_o record_v such_o presentment_n whosoever_o shall_v take_v any_o lease_n of_o the_o king_n of_o such_o land_n shall_v give_v such_o security_n as_o the_o court_n of_o exchequer_n shall_v allow_v not_o to_o suffer_v any_o waste_n traitor_n all_o they_o which_o shall_v receive_v any_o such_o jesuit_n or_o priest_n after_o such_o time_n shall_v be_v adjudge_v a_o fellow_n without_o benefit_n of_o clergy_n if_o any_o subject_a of_o england_n then_o be_v or_o after_o shall_v be_v of_o or_o bring_v up_o in_o any_o college_n of_o jesuit_n or_o seminary_n already_o erect_v or_o to_o be_v erect_v out_o of_o the_o realm_n shall_v not_o within_o six_o month_n next_o after_o proclamation_n in_o that_o behalf_n make_v in_o london_n under_o the_o broad_a seal_n return_v into_o this_o realm_n and_o within_o two_o day_n after_o before_o the_o bishop_n of_o the_o diocese_n or_o two_o justice_n of_o the_o peace_n of_o the_o county_n where_o he_o shall_v arrive_v submit_v himself_o to_o her_o majesty_n and_o her_o law_n and_o one_o hundred_o pound_n every_o offence_n commit_v against_o this_o act_n may_v be_v hear_v and_o determine_v as_o well_o in_o the_o king_n bench_n as_o also_o in_o any_o county_n within_o this_o realm_n or_o any_o of_o the_o queen_n dominion_n where_o the_o offence_n shall_v be_v commit_v or_o where_o the_o offendor_n shall_v be_v apprehend_v this_o act_n shall_v not_o extend_v to_o any_o jesuit_n etc._n etc._n before_o mention_v as_o shall_v within_o the_o say_v 40._o day_n or_o within_o 40._o day_n after_o he_o come_v into_o the_o realm_n submit_v himself_o to_o some_o archbishop_n or_o bishop_n of_o this_o realm_n or_o to_o some_o justice_n of_o peace_n within_o the_o county_n where_o he_o shall_v arrive_v and_o do_v thereupon_o true_o and_o sincere_o before_o the_o archbishop_n bishop_n or_o justice_n of_o peace_n take_v the_o say_a oath_n set_v forth_o the_o first_o of_o eliz._n and_o under_o his_o hand_n confess_v afterward_o to_o continue_v in_o due_a obedience_n to_o the_o queen_n law_n make_v or_o to_o be_v make_v in_o cause_n of_o religion_n peer_n shall_v be_v try_v by_o their_o peer_n for_o any_o offence_n make_v treason_n felony_n or_o praemunire_n by_o this_o act._n any_o person_n be_v a_o subject_a of_o this_o realm_n which_o shall_v after_o the_o say_v 40._o day_n know_v any_o such_o jesuit_n or_o priest_n etc._n etc._n and_o shall_v not_o discover_v the_o same_o to_o some_o justice_n of_o peace_n or_o high_a officer_n within_o 12._o day_n every_o such_o person_n shall_v be_v fine_v and_o imprison_v according_a to_o the_o queen_n pleasure_n and_o every_o such_o justice_n of_o peace_n or_o high_a officer_n which_o shall_v not_o discover_v the_o same_o within_o 28._o day_n to_o some_o of_o the_o queen_n council_n or_o to_o the_o precedent_n or_o vicepresident_n of_o the_o queen_n council_n establish_v in_o the_o north_n or_o march_n of_o wales_n than_o he_o or_o they_o so_o offend_v shall_v forfeit_v 200_o mark_n shall_v happen_v to_o be_v or_o by_o the_o minister_n or_o curate_n of_o the_o parish_n that_o in_o every_o such_o case_n every_o such_o offendor_n be_v thereunto_o warn_v by_o any_o justice_n of_o peace_n of_o the_o county_n shall_v upon_o his_o or_o their_o corporal_a oath_n before_o the_o justice_n of_o peace_n in_o the_o open_a quarter-session_n or_o at_o the_o assize_n abjure_v the_o or_o read_n of_o the_o gospel_n make_v public_a and_o open_a submission_n and_o declaration_n in_o conformity_n to_o the_o law_n according_a to_o this_o act_n that_o then_o every_o such_o penalty_n inflict_v by_o this_o act_n be_v discharge_v the_o submission_n to_o be_v make_v be_v i_o a._n b._n do_v humble_o confess_v and_o acknowledge_v that_o i_o have_v grievous_o offend_v god_n in_o contemn_v her_o majesty_n godly_a and_o lawful_a government_n and_o authority_n by_o absent_v myself_o from_o church_n and_o hear_v divine_a service_n contrary_a to_o the_o godly_a law_n and_o statute_n of_o this_o realm_n and_o in_o use_v and_o frequent_v disorder_v and_o unlawful_a conventicle_n and_o assembly_n under_o pretence_n and_o colour_n of_o exercise_n of_o religion_n and_o i_o etc._n under_o colour_n of_o exercise_n of_o religion_n contrary_a to_o her_o majesty_n law_n that_o then_o every_o such_o offendor_n shall_v lose_v the_o benefit_n he_o may_v have_v have_v by_o forty_o pound_n for_o every_o month_n that_o he_o or_o they_o shall_v relieve_v etc._n etc._n any_o person_n so_o offend_v this_o act_n shall_v in_o no_o wise_n extend_v to_o punish_v or_o impeach_v any_o person_n for_o relieve_v or_o keep_v his_o father_n wife_n mother_n child_n ward_n brother_n or_o sister_n or_o his_o wife_n father_n or_o mother_n not_o have_v any_o certain_a place_n of_o habitation_n of_o their_o own_o or_o the_o husband_n or_o wife_n of_o any_o of_o they_o or_o for_o relieve_v maintain_v or_o keep_v any_o such_o person_n as_o shall_v be_v commit_v by_o authority_n to_o the_o custody_n of_o any_o by_o who_o they_o shall_v be_v so_o relieve_v or_o maintain_v these_o two_o last_o clause_n be_v repeal_v by_o the_o 3_o jac._n 4._o all_o duty_n forfeiture_n and_o payment_n due_a to_o the_o queen_n by_o virtue_n of_o this_o act_n or_o the_o act_n of_o the_o 23_o of_o eliz._n concern_v recusant_n may_v be_v recover_v and_o levy_v to_o her_o majesty_n use_n by_o feme_fw-fr covert_n shall_v be_v compel_v to_o abjure_v by_o this_o act._n every_o person_n that_o shall_v abjure_v by_o virtue_n of_o this_o act_n and_o refuse_v be_v thereunto_o require_v as_o or_o consent_v unto_o any_o practice_n plot_n or_o conspiracy_n whatsoever_o against_o the_o king_n majesty_n his_o heir_n and_o successor_n or_o any_o of_o he_o or_o their_o estate_n or_o estate_n realm_n or_o dominion_n but_o shall_v within_o convenient_a time_n after_o knowledge_n thereof_o have_v reveal_v &_o disclose_v to_o the_o king_n majesty_n his_o heir_n and_o successor_n or_o some_o of_o the_o lord_n of_o he_o or_o their_o honourable_a privy_a council_n all_o such_o practice_n plot_n and_o conspiracy_n that_o then_o this_o obligation_n to_o be_v void_a the_o customer_n and_o
