for_o such_o recusant_n they_o shall_v present_o be_v deface_v and_o burn_v if_o meet_a to_o be_v burn_v all_o armour_n gunpowder_n and_o munition_n whatsoever_o any_o popish_a recusant_n convict_v have_v or_o shall_v have_v in_o his_o own_o house_n or_o in_o the_o hand_n of_o other_o shall_v be_v take_v from_o they_o by_o warrant_n of_o four_o justice_n of_o peace_n at_o their_o general_n or_o age_n of_o the_o say_a child_n as_o also_o the_o name_n of_o the_o servant_n of_o the_o say_a recusant_n at_o the_o next_o general_n or_o quarter-session_n of_o that_o shire_n limit_n division_n or_o liberty_n all_o such_o presentment_n shall_v be_v record_v in_o the_o say_a session_n by_o the_o clerk_n of_o the_o peace_n or_o town-clerk_n for_o the_o time_n be_v without_o any_o fee_n and_o for_o default_n of_o every_o such_o presentment_n the_o say_a churchwarden_n constable_n or_o high-constable_n shall_v forfeit_v twenty_o shilling_n and_o for_o default_n of_o record_v such_o presentment_n without_o a_o fee_n the_o clerk_n of_o the_o peace_n or_o town-clerke_a shall_v forfeit_v 40._o s._n every_o presenement_n make_v by_o any_o churchwarden_n constable_n or_o high-constable_n as_o such_o manner_n as_o by_o the_o more_o part_n of_o the_o justice_n shall_v be_v order_v by_o warrant_n under_o their_o hand_n and_o seal_n the_o justice_n of_o assiize_n and_o justice_n of_o quarter-session_n have_v power_n to_o hear_v and_o determine_v of_o all_o recusant_n as_o well_o for_o not_o receive_v the_o sacrament_n as_o for_o not_o come_v to_o church_n and_o have_v also_o power_n to_o make_v proclamation_n that_o the_o body_n of_o every_o such_o offendor_n shall_v be_v render_v to_o the_o sheriff_n of_o the_o county_n or_o the_o baylif_n or_o keeper_n of_o the_o goal_n of_o the_o liberty_n before_o the_o next_o assize_n general_n or_o quarter-session_n and_o if_o then_o the_o offendor_n shall_v not_o make_v his_o appearance_n upon_o record_n that_o every_o such_o default_n shall_v be_v deem_v as_o a_o sufficient_a conviction_n by_o verdict_n of_o 12_o man_n this_o statute_n recite_v the_o penalty_n impose_v by_o the_o 29_o eliz._n 6._o upon_o a_o recusant_n the_o mansion_n house_n nor_o shall_v demise_n nor_o lease_n over_o the_o 2_o three_o part_n or_o any_o part_n thereof_o to_o any_o recusant_n nor_o to_o the_o use_n of_o any_o recusant_n and_o whosoever_o shall_v take_v any_o lease_n of_o the_o king_n of_o such_o land_n shall_v give_v such_o security_n as_o the_o court_n of_o exchequer_n shall_v allow_v not_o to_o suffer_v any_o waste_n to_o be_v commit_v upon_o the_o premise_n for_o the_o better_a trial_n how_o the_o king_n subject_n stand_v affect_v in_o point_n of_o loyalty_n and_o due_a obedience_n it_o be_v enact_v that_o deny_v himself_o to_o be_v a_o recusant_n or_o shall_v confess_v or_o not_o deny_v that_o he_o have_v not_o take_v the_o sacrament_n twice_o within_o the_o year_n to_o take_v this_o oath_n hereafter_o of_o england_n then_o be_v or_o after_o shall_v be_v of_o or_o bring_v up_o in_o any_o college_n of_o jesuit_n or_o seminary_n already_o erect_v or_o to_o be_v erect_v out_o of_o the_o realm_n shall_v not_o within_o six_o month_n next_o after_o proclamation_n in_o that_o behalf_n make_v in_o london_n under_o the_o broad_a seal_n return_v into_o this_o realm_n and_o within_o two_o day_n after_o before_o the_o bishop_n of_o the_o diocese_n or_o two_o justice_n of_o the_o peace_n of_o the_o county_n where_o he_o shall_v arrive_v submit_v himself_o to_o her_o majesty_n and_o her_o law_n and_o one_o hundred_o pound_n every_o offence_n commit_v against_o this_o act_n may_v be_v hear_v and_o determine_v as_o well_o in_o the_o king_n bench_n as_o also_o in_o any_o county_n within_o this_o or_o bishop_n of_o this_o realm_n or_o to_o some_o justice_n of_o peace_n within_o the_o county_n where_o he_o shall_v arrive_v and_o do_v thereupon_o true_o and_o sincere_o before_o the_o archbishop_n bishop_n or_o justice_n of_o peace_n take_v the_o say_a oath_n set_v forth_o the_o first_o of_o eliz._n and_o under_o his_o hand_n confess_v afterward_o to_o continue_v in_o due_a queen_n pleasure_n and_o every_o such_o justice_n of_o peace_n or_o high_a officer_n which_o shall_v not_o discover_v the_o same_o within_o 28._o day_n to_o some_o of_o the_o queen_n council_n or_o peace_n of_o the_o county_n shall_v upon_o his_o or_o their_o corporal_a oath_n before_o the_o justice_n of_o peace_n in_o the_o open_a quarter-session_n or_o at_o the_o assize_n abjure_v the_o contemn_v her_o majesty_n godly_a and_o lawful_a government_n and_o authority_n by_o absent_v myself_o from_o church_n and_o hear_v divine_a service_n contrary_a to_o the_o godly_a law_n and_o any_o person_n for_o relieve_v or_o keep_v his_o father_n wife_n mother_n child_n ward_n brother_n or_o sister_n or_o his_o wife_n father_n or_o mother_n not_o have_v any_o certain_a place_n of_o habitation_n of_o their_o own_o or_o the_o husband_n or_o wife_n of_o any_o of_o they_o or_o for_o relieve_v maintain_v or_o keep_v any_o such_o person_n as_o shall_v be_v commit_v by_o authority_n to_o the_o custody_n of_o any_o by_o who_o they_o shall_v be_v so_o relieve_v or_o maintain_v these_o two_o last_o clause_n be_v repeal_v by_o the_o 3_o jac._n 4._o all_o duty_n forfeiture_n and_o
