duty_n be_v upon_o the_o act._n and_o first_o i_o do_v say_v where_o the_o constable_n receive_v a_o warrant_n to_o seize_v any_o person_n convict_v he_o ought_v to_o obey_v it_o and_o go_v with_o the_o informer_n to_o seize_v the_o person_n but_o nevertheless_o if_o the_o person_n be_v in_o any_o house_n that_o be_v shut_v and_o the_o door_n refuse_v to_o be_v open_v the_o constable_n have_v the_o common-prayer-book_n and_o without_o in_o the_o pulpit_n then_o sing_v of_o psalm_n than_o a_o sermon_n now_o if_o the_o meeting_n do_v perform_v nothing_o but_o these_o exercise_n it_o can_v by_o this_o act_n be_v make_v a_o conventicle_n and_o if_o there_o be_v any_o meeting_n in_o england_n that_o do_v not_o all_o or_o the_o most_o of_o those_o duty_n then_o let_v the_o middlesex_n justice_n and_o constable_n do_v what_o they_o please_v with_o they_o and_o if_o they_o do_v all_o these_o exercise_n though_o one_o of_o they_o may_v be_v omit_v yet_o i_o think_v it_o can_v be_v this_o clause_n be_v far_o short_a of_o force_v the_o constable_n etc._n etc._n first_o to_o go_v about_o their_o precinct_n to_o seek_v for_o conventicle_n as_o if_o they_o want_v employment_n which_o by_o the_o session_n order_n they_o be_v suppose_v to_o do_v but_o further_a admit_v that_o a_o constable_n or_o other_o officer_n short_a of_o a_o justice_n shall_v whole_o neglect_v his_o duty_n contain_v in_o this_o clause_n yet_o i_o conceive_v he_o run_v no_o hazard_n at_o all_o as_o to_o the_o penalty_n of_o the_o 5_o l._n before_o mention_v nor_o any_o other_o hazard_n upon_o this_o statute_n because_o the_o act_n do_v not_o prescribe_v how_o the_o constable_n shall_v be_v convict_v whether_o by_o the_o session_n the_o justice_n or_o by_o a_o jury_n nor_o in_o what_o manner_n the_o constable_n ought_v to_o be_v prosecute_v for_o the_o 5_o l._n mention_v in_o the_o act_n for_o not_o do_v what_o the_o act_n command_v and_o to_o show_v that_o the_o constable_n and_o most_o considerable_a person_n that_o frequent_v the_o say_a conventicle_n now_o upon_o the_o whole_a matter_n this_o do_v not_o only_o command_v the_o constable_n and_o other_o to_o be_v informer_n but_o contradict_v both_o the_o act_n and_o itself_o for_o the_o act_n warrant_v no_o such_o thing_n the_o act_n allow_v no_o more_o but_o if_o there_o be_v sufficient_a witness_n than_o both_o the_o justice_n be_v to_o convict_v the_o officer_n to_o execute_v for_o the_o first_o offence_n 5_o s._n a_o piece_n the_o second_o conviction_n 10_o s._n a_o piece_n and_o in_o case_n in_o the_o second_o conviction_n insufficiency_n of_o the_o hearer_n then_o to_o the_o value_n of_o 10_o l._n upon_o such_o as_o be_v present_a instead_o of_o those_o not_o able_a but_o by_o the_o way_n and_o with_o the_o justice_n leave_n for_o the_o first_o offence_n by_o this_o act_n there_o can_v be_v no_o more_o levy_v than_o 5_o s._n upon_o poor_a or_o rich_a of_o the_o hearer_n nor_o shall_v any_o answer_n but_o for_o themselves_o till_o the_o second_o conviction_n and_o may_v it_o not_o be_v reply_v to_o the_o justice_n by_o the_o constable_n how_o shall_v they_o get_v these_o person_n to_o give_v they_o their_o name_n so_o exact_o before_o the_o next_o quarter_n session_n as_o the_o order_n direct_v so_o as_o the_o constable_n may_v deliver_v they_o true_o to_o the_o justice_n on_o their_o
