allow_v in_o the_o say_v former_a act_n or_o this_o act_n be_v it_o enact_v that_o all_o &_o every_o such_o encumbrance_n as_o against_o the_o adventurer_n or_o soldier_n so_o settle_v as_o aforesaid_a other_o than_o such_o encumbrance_n as_o be_v the_o proper_a act_n of_o the_o party_n so_o to_o be_v settle_v or_o those_o under_o who_o he_o claim_v be_v utter_o void_a &_o of_o none_o effect_n and_o to_o the_o end_n that_o no_o person_n or_o person_n who_o upon_o the_o seven_o day_n of_o may_n one_o thousand_o six_o hundred_o fifty_o and_o nine_o be_v in_o possession_n of_o any_o land_n tenement_n or_o hereditament_n as_o a_o adventurer_n or_o soldier_n or_o as_o the_o heir_n executor_n or_o assignee_n of_o such_o adventurer_n or_o soldier_n may_v hereafter_o be_v molest_v repute_v to_o be_v hold_v and_o enjoy_v for_o and_o towards_o the_o satisfaction_n of_o any_o adventure_n or_o arrear_n that_o there_o and_o in_o such_o case_n no_o proof_n of_o the_o measn_a parcel_n and_o lot_n wherein_o such_o false_a admeasurement_n be_v pretend_v observe_v therein_o these_o rule_n and_o caution_n follow_v first_o that_o such_o information_n be_v give_v in_o within_o the_o space_n of_o three_o month_n next_o after_o the_o pass_v of_o this_o act._n second_o that_o the_o defendant_n or_o defendant_n against_o who_o such_o information_n be_v give_v be_v first_o hear_v before_o any_o new_a survey_n be_v order_v three_o that_o the_o informer_n or_o informer_n do_v first_o put_v in_o security_n by_o recognizance_n acknowledge_v before_o the_o lord_n chief_a justice_n of_o the_o common_a plea_n for_o the_o time_n be_v and_o with_o good_a and_o sufficient_a surety_n to_o be_v by_o he_o allow_v to_o bear_v the_o whole_a charge_n of_o the_o new_a survey_n and_o over_o and_o above_o to_o pay_v and_o satisfy_v unto_o the_o defendant_n or_o defendant_n he_o and_o their_o full_a damage_n and_o cost_v which_o they_o shall_v sustain_v by_o such_o prosecution_n and_o shall_v offer_v to_o make_v oath_n of_o before_o the_o say_a lord_n chief_a justice_n in_o case_n that_o upon_o the_o return_n of_o such_o survey_n it_o shall_v not_o appear_v that_o the_o defendant_n or_o defendant_n against_o who_o such_o new_a survey_n be_v order_v be_v possess_v of_o more_o land_n by_o a_o full_a ten_o part_n than_o he_o or_o they_o ought_v to_o have_v four_o where_o any_o new_a survey_n be_v order_v the_o same_o shall_v be_v take_v by_o two_o surveyor_n to_o be_v choose_v for_o that_o purpose_n one_o by_o the_o informer_n the_o other_o by_o the_o aforesaid_a interest_n so_o as_o such_o deduction_n do_v not_o exceed_v the_o hundred_o part_n of_o the_o money_n or_o land_n out_o of_o which_o such_o deduction_n be_v to_o be_v make_v which_o receive_v one_o penny_n per_fw-la acre_n out_o of_o all_o the_o land_n in_o the_o admeasurement_n whereof_o he_o be_v employ_v that_o have_v be_v or_o shall_v be_v appoint_v to_o be_v set_v out_o for_o satisfaction_n of_o arrear_n out_o of_o which_o such_o acrige_n be_v agree_v or_o ought_v in_o justice_n to_o be_v pay_v and_o have_v not_o be_v already_o pay_v and_o to_o give_v such_o the_o benefit_n and_o charge_n of_o their_o respective_a improvement_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o the_o protestant_n so_o to_o be_v remove_v shall_v be_v and_o be_v hereby_o enable_v to_o demand_v and_o shall_v upon_o their_o request_n have_v lease_n make_v to_o they_o of_o all_o and_o singular_a the_o message_n and_o land_n in_o their_o manual_a occupation_n for_o three_o life_n or_o one_o and_o twenty_o year_n at_o a_o moderate_a rent_n not_o exceed_v three_o fourthe_n of_o the_o true_a value_n of_o the_o land_n in_o satisfaction_n of_o their_o improvement_n except_o it_o be_v a_o capital_a message_n and_o then_o the_o party_n to_o be_v restore_v shall_v either_o make_v such_o lease_n as_o aforesaid_a or_o pay_v unto_o the_o person_n to_o be_v remove_v in_o ready_a money_n the_o full_a value_n of_o such_o improvement_n and_o in_o case_n of_o default_n or_o refusal_n to_o make_v such_o lease_n as_o aforesaid_a upon_o request_n or_o to_o give_v such_o satisfaction_n in_o money_n shall_v be_v and_o be_v hereby_o enable_v to_o reenter_v and_o to_o retain_v the_o say_v land_n until_o such_o lease_n make_v or_o satisfaction_n give_v as_o aforesaid_a and_o to_o the_o end_n there_o may_v not_o be_v any_o difference_n touch_v the_o value_n of_o the_o land_n so_o to_o be_v demise_v or_o of_o the_o improvement_n to_o be_v satisfy_v as_o aforesaid_a the_o lord_n lieutenant_n or_o other_o chief_a governor_n or_o governor_n and_o council_n for_o the_o time_n be_v be_v hereby_o enable_v upon_o the_o petition_n of_o the_o party_n concern_v to_o appoint_v such_o commissioner_n from_o time_n to_o time_n as_o they_o shall_v think_v fit_a to_o settle_v the_o difference_n aforesaid_a provide_v always_o and_o it_o be_v enact_v that_o nothing_o herein_o contain_v shall_v enable_v any_o of_o the_o four_o and_o fifty_o person_n herein_o before_o mention_v to_o demand_v or_o have_v or_o to_o be_v restore_v unto_o any_o impropriation_n or_o appropriate_a tithe_n or_o to_o any_o glebe_n land_n parcel_n of_o any_o rectory_n impropriate_a but_o that_o the_o same_o shall_v remain_v and_o be_v to_o such_o use_n as_o they_o will_v have_v be_v by_o this_o and_o the_o say_v former_a act_n if_o the_o say_v fifty_o and_o four_o person_n or_o any_o of_o they_o have_v not_o be_v name_v any_o thing_n herein_o contain_v to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o those_o who_o be_v in_o possession_n of_o any_o land_n or_o house_n upon_o the_o two_o and_o twenty_o day_n of_o august_n one_o thousand_o six_o hundred_o sixty_o and_o three_o to_o which_o they_o be_v restore_v by_o virtue_n of_o any_o his_o majesty_n letter_n if_o they_o or_o any_o of_o they_o their_z or_o any_o of_o their_o ancestor_n or_o any_o other_o in_o trust_n for_o they_o or_o any_o of_o they_o be_v thereof_o seize_v or_o possess_v upon_o the_o two_o and_o twenty_o of_o october_n one_o thousand_o six_o hundred_o forty_o and_o one_o and_o thereunto_o rightful_o entitle_v and_o be_v not_o otherwise_o provide_v for_o by_o this_o act_n shall_v by_o the_o commissioner_n for_o execution_n of_o this_o act_n be_v restore_v unto_o and_o put_v in_o possession_n of_o such_o house_n and_o so_o much_o of_o the_o land_n lie_v contiguous_a and_o thereunto_o adjoin_v as_o shall_v not_o exceed_v the_o quantity_n of_o two_o thousand_o acre_n in_o the_o do_v whereof_o the_o commissioner_n be_v to_o proceed_v by_o the_o same_o rule_n order_n and_o direction_n and_o in_o like_a manner_n and_o form_n as_o they_o ought_v to_o proceed_v in_o the_o settlement_n and_o restitution_n of_o any_o of_o the_o four_o and_o fifty_o person_n herein_o before_o name_v and_o not_o otherwise_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o nothing_o in_o the_o say_v former_a act_n or_o in_o this_o present_a act_n herein_o before_o or_o after_o contain_v shall_v be_v understand_v to_o give_v restore_fw-mi or_o confirm_v to_o any_o irish_a papist_n or_o popish_a recusant_n or_o any_o other_o person_n seize_v or_o possess_v in_o trust_n for_o any_o such_o irish_a papist_n or_o popish_a recusant_n any_o advowson_n or_o right_n of_o patronage_n of_o or_o in_o any_o ecclesiastical_a benefice_n or_o promotion_n or_o any_o right_n of_o nomination_n presentation_n or_o collation_n to_o or_o donation_n of_o any_o such_o ecclesiastical_a benefice_n or_o promotion_n but_o that_o all_o and_o every_o such_o advowsons_n and_o right_n of_o patronage_n and_o the_o right_n of_o nomination_n presentation_n or_o collation_n to_o or_o donation_n of_o any_o such_o ecclesiastical_a benefice_n or_o promotion_n but_o that_o all_o and_o every_o such_o advowsons_n and_o right_n of_o patronage_n and_o the_o right_n of_o nomination_n presentation_n donation_n or_o collation_n of_o or_o to_o any_o such_o ecclesiastical_a benefice_n or_o promotion_n shall_v vest_n remain_v and_o continue_v and_o so_o be_v hereby_o adjudge_v to_o vest_n remain_v and_o continue_v in_o his_o majesty_n his_o heir_n and_o successor_n until_o such_o irish_a papist_n or_o popish_a recusant_n or_o the_o right_a heir_n of_o such_o papist_n or_o recusant_n shall_v come_v to_o church_n and_o receive_v the_o sacrament_n according_a to_o the_o rite_n of_o the_o church_n of_o england_n and_o from_o and_o after_o such_o conformity_n shall_v be_v again_o revestel_n in_o the_o person_n so_o conform_v and_o his_o heir_n any_o thing_n in_o this_o or_o the_o say_v former_a act_n contain_v to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o sir_n edward_n smith_n knight_n chief_z justice_n of_o his_o majesty_n court_n of_o common_a plea_n sir_n edward_n dering_n baronet_n sir_n allen_n broderick_n sir_n william_n churchill_n knight_n and_z edward_z cook_n esq_n and_o such_o other_o as_o upon_o the_o death_n or_o removal_n of_o they_o or_o any_o of_o they_o shall_v be_v appoint_v by_o his_o majesty_n from_o time_n to_o time_n shall_v be_v commissioner_n and_o that_o they_o or_o any_o
