the_o law_n to_o be_v that_o a_o outlawry_n in_o personal_a action_n be_v no_o cause_n to_o disable_v any_o person_n from_o be_v a_o member_n of_o parliament_n and_o it_o be_v say_v that_o this_o be_v rule_v in_o parliament_n 35th_o of_o queen_n elizabeth_n in_o the_o parliament_n house_n in_o a_o case_n for_o one_o fitz-herbert_n another_o precedent_n be_v 39_o h._n 6._o second_o the_o pardon_n of_o the_o 39th_o of_o queen_n eliz._n and_o 43_o eliz._n have_v pardon_v those_o outlawry_n and_o therefore_o as_o they_o say_v he_o be_v a_o man_n able_a against_o all_o the_o world_n but_o against_o the_o party_n creditor_n and_o against_o he_o he_o be_v not_o but_o in_o this_o case_n the_o party_n be_v pay_v also_o three_o it_o be_v say_v that_o sir_n francis_n goodwin_n be_v not_o outlaw_v because_o no_o proclamation_n be_v issue_v forth_o to_o the_o county_n of_o buck_n where_o he_o be_v commorant_n and_o resiant_a and_o therefore_o the_o outlawry_n be_v in_o the_o husting_n in_o london_n and_o sir_n francis_n goodwin_n be_v commoran_n in_o buck_n the_o outlawry_n no_o proclamation_n issue_v to_o the_o county_n of_o buk_n be_v void_a by_o the_o statute_n of_o the_o 31th_o of_o the_o queen_n which_o in_o such_o case_n make_v the_o outlawry_n void_a four_o it_o be_v say_v that_o the_o outlawry_n be_v 1._o against_o francis_n goodwin_n esq_n 2._o against_o francis_n goodwin_n gent._n and_o 3._o the_o return_n be_v of_o francis_n goodwin_n kt._n et_fw-la quomodo_fw-la constat_fw-la that_o those_o outlawry_n be_v against_o the_o say_a sir_n francis_n goodwin_n for_o these_o reason_n also_o they_o resolve_v that_o the_o outlawry_n be_v not_o any_o matter_n against_o sir_n francis_n goodwin_n to_o disenable_a he_o to_o be_v a_o knight_n for_o the_o county_n of_o buck_n five_o it_o be_v say_v that_o by_o the_o statute_n of_o 7_o h._n 4._o which_o prescribe_v the_o manner_n of_o the_o election_n of_o knight_n and_o burgess_n it_o be_v enact_v that_o the_o election_n shall_v be_v by_o indenture_n between_o the_o sheriff_n and_o the_o freeholder_n etc._n etc._n that_o the_o indenture_n shall_v be_v the_o return_n of_o the_o sheriff_n it_o be_v also_o lord_n chief_a justice_n popham_n be_v speaer_n and_o 3._o in_o the_o 35th_o of_o elizabeth_n there_o be_v three_o precedent_n scil_n one_o of_o fitzherbert_n another_o of_o one_o killigrew_n be_v outlaw_v in_o 52_o outlawry_n and_o the_o three_o of_o sir_n walter_n harecourt_n be_v outlaw_v in_o eighteen_o outlawry_n but_o after_o this_o sentence_n and_o judgement_n of_o the_o parliament_n the_o king_n highness_n be_v displease_v with_o it_o because_o the_o second_o writ_n emanavit_fw-la by_o his_o assent_n and_o by_o the_o advice_n of_o his_o council_n and_o therefore_o it_o be_v move_v to_o the_o judge_n in_o the_o upper_a house_n whether_o a_o person_n outlaw_o can_v be_v a_o member_n of_o parliament_n who_o give_v their_o opinion_n that_o he_o can_v not_o and_o they_o all_o except_z williams_z agree_v that_o the_o pardon_n without_o a_o scire_fw-la facias_fw-la do_v not_o help_v he_o but_o that_o he_o be_v outlaw_v to_o that_o purpose_n as_o if_o no_o pardon_n have_v be_v grant_v and_o upon_o this_o the_o lord_n send_v to_o the_o low_a house_n desire_v a_o conference_n with_o they_o concern_v this_o matter_n which_o conference_n the_o low_a house_n after_o some_o deliberation_n deny_v for_o these_o reason_n 1._o because_o they_o have_v give_v their_o judgement_n before_o and_o therefore_o they_o can_v not_o have_v conference_n de_fw-fr re_fw-mi judicata_fw-la as_o in_o like_a manner_n they_o do_v 27_o queen_n eliz._n upon_o a_o bill_n which_o come_v from_o the_o lord_n and_o be_v reject_v by_o sentence_n upon_o the_o first_o read_v sir_n walter_n mildmay_n be_v then_o of_o the_o privy_a council_n and_o of_o the_o house_n 2._o because_o they_o ought_v not_o to_o give_v any_o account_n of_o their_o action_n to_o any_o other_o person_n but_o to_o the_o king_n himself_o this_o answer_v the_o lord_n do_v ill_o resent_v and_o therefore_o refuse_v conference_n in_o other_o matter_n concern_v ward_n and_o respite_n of_o homage_n and_o
