that_o time_n no_o further_o against_o he_o in_o that_o court_n but_o have_v then_o consideration_n of_o the_o article_n of_o exon_n and_o to_o preserve_v the_o faith_n of_o their_o army_n from_o all_o colour_n of_o violation_n they_o still_o reserve_v their_o mercy_n for_o he_o if_o he_o have_v but_o then_o implore_v it_o but_o sir_n john_n continue_v in_o his_o averse_a resolution_n out_o of_o a_o confidence_n of_o the_o late_a king_n restitution_n to_o his_o power_n and_o authority_n and_o a_o design_n thereby_o to_o receive_v his_o whole_a estate_n gratis_o with_o a_o great_a reward_n for_o his_o many_o suffering_n in_o own_v and_o justify_v the_o late_a king_n cause_n beyond_o any_o of_o his_o party_n be_v the_o only_a subject_n of_o he_o that_o refuse_v to_o comply_v john_n next_o appear_v and_o he_o do_v but_o twice_o appear_v before_o that_o committee_n it_o be_v about_o three_o day_n after_o the_o four_o month_n limit_v by_o the_o exeter_z article_n for_o it_o be_v grant_v by_o all_o that_o his_o second_o appearance_n be_v on_o the_o thirteen_o of_o august_n for_o of_o that_o date_n be_v his_o mittimus_fw-la and_o the_o order_n likewse_n of_o goldsmith_n hall_n for_o mr._n stephen_n report_n as_o appear_v by_o the_o remonstrance_n page_n 25._o now_o the_o thirteen_o day_n be_v three_o day_n after_o the_o ten_o of_o august_n the_o day_n of_o the_o expiration_n of_o the_o calendar_n month_n but_o can_v not_o be_v so_o after_o the_o thirty_o day_n of_o july_n the_o day_n of_o the_o expiration_n of_o the_o four_o month_n after_o the_o rate_n of_o eight_o and_o twenty_o day_n to_o the_o month_n which_o construction_n make_v the_o oath_n true_a in_o every_o particular_a otherwise_o it_o will_v prove_v repugnant_a to_o itself_o and_o this_o do_v also_o agree_v with_o the_o deposition_n of_o mr._n michael_n herring_n one_o other_o of_o that_o committee_n who_o do_v swear_v before_o the_o high_a court_n of_o justice_n and_o have_v since_o affirm_v before_o the_o committee_n of_o parliament_n in_o the_o star-chamber_n that_o that_o committee_n of_o goldsmith_n hall_n do_v not_o refuse_v his_o pretend_a petition_n for_o that_o he_o come_v not_o in_o time_n but_o because_o he_o observe_v not_o the_o rule_n of_o that_o committee_n by_o which_o oath_n if_o sir_n john_n appear_v on_o the_o four_o and_o twenty_o of_o july_n he_o can_v not_o be_v say_v not_o to_o come_v in_o time_n but_o if_o on_o the_o six_o of_o august_n than_o he_o come_v not_o in_o time_n according_a to_o the_o rate_n of_o eight_o and_o twenty_o day_n to_o the_o month_n and_o although_o that_o committee_n out_o of_o favour_n to_o sir_n john_n in_o hope_n of_o his_o future_a submission_n take_v no_o advantage_n of_o time_n yet_o sir_n johns_n come_v to_o goldsmith_n hall_n on_o the_o six_o day_n of_o august_n when_o his_o article_n be_v expire_v and_o that_o not_o voluntary_o but_o by_o constraint_n upon_o the_o summons_n of_o that_o committee_n argue_v he_o not_o very_o willing_a to_o endeavour_v his_o composition_n and_o make_v he_o real_o guilty_a of_o a_o neglect_n of_o performance_n of_o his_o article_n in_o point_n of_o time_n he_o have_v delay_v the_o time_n of_o make_v his_o composition_n or_o the_o least_o submit_v unto_o it_o until_o the_o four_o month_n expire_v again_o when_o sir_n john_n do_v tender_v his_o pretend_a petition_n be_v it_o either_o on_o the_o 24_o of_o july_n and_o so_o within_o the_o four_o month_n as_o sir_n john_n will_v have_v it_o or_o after_o the_o four_o of_o august_n and_o expiration_n of_o they_o as_o that_o order_n of_o summons_n do_v evidence_n yet_o can_v not_o that_o committee_n receive_v his_o petition_n in_o regard_n he_o have_v not_o by_o that_o petition_n confess_v his_o delinquency_n nor_o express_v some_o act_n of_o he_o amount_v unto_o delinquency_n and_o although_o sir_n john_n seem_v to_o complain_v of_o mr._n ashe_n for_o that_o he_o refuse_v his_o pretend_a petition_n upon_o that_o ground_n yet_o sir_n john_n can_v but_o know_v that_o mr._n ashe_n be_v then_o chairman_n as_o himself_o confess_v do_v not_o refuse_v it_o as_o contrary_a to_o the_o rule_v prescribe_v that_o committee_n in_o his_o opinion_n alone_o but_o in_o the_o judgement_n of_o the_o whole_a committee_n and_o the_o reason_n why_o they_o can_v not_o compound_v with_o any_o without_o this_o committee_n shall_v compound_v shall_v be_v delinquent_n for_o they_o be_v therein_o denominate_v by_o the_o word_n delinquent_n as_o do_v appear_v by_o the_o several_a order_n and_o resolution_n of_o the_o six_o of_o march_n 1644._o of_o the_o 18_o of_o october_n 1645._o of_o the_o four_o of_o november_n 1645._o and_o the_o 13_o of_o december_n 1645._o and_o divers_a other_o and_o such_o be_v delinquent_n only_a within_o the_o intention_n of_o those_o resolution_n as_o have_v commit_v any_o act_n for_o which_o their_o estate_n be_v liable_a to_o sequestration_n and_o no_o by_o the_o resolution_n of_o the_o 24_o of_o july_n 1644._o of_o the_o house_n of_o commons_o the_o committee_n at_o goldsmith_n hall_n have_v power_n to_o contract_v with_o person_n for_o the_o sale_n of_o land_n and_o house_n of_o delinquent_n according_a to_o the_o former_a order_n of_o the_o ten_o of_o that_o month_n of_o july_n at_o eight_o year_n purchase_n for_o land_n at_o least_o and_o six_o year_n purchase_n for_o house_n at_o least_o at_o the_o rate_v they_o be_v let_v at_o before_o the_o war_n begin_v by_o the_o resolution_n of_o the_o four_o of_o october_n 1645._o the_o before_o the_o first_o of_o january_n than_o next_o the_o three_o of_o march_n 1644._o the_o committee_n of_o goldsmith_n hall_n make_v their_o proposition_n to_o the_o house_n of_o commons_o in_o these_o word_n follow_v that_o whereas_o now_o this_o committee_n do_v only_o take_v into_o consideration_n such_o delinquent_n as_o come_v recommend_v unto_o they_o by_o particular_a order_n if_o this_o honourable_a house_n shall_v think_v fit_a to_o give_v this_o committee_n a_o general_a power_n to_o receive_v treat_v and_o compound_v with_o whatsoever_o delinquent_n shall_v immediate_o tender_v themselves_o to_o this_o committee_n to_o be_v compound_v with_o all_o they_o first_o represent_v unto_o this_o honourable_a assembly_n such_o composition_n make_v or_o fine_n set_v upon_o they_o before_o any_o thing_n be_v conclude_v it_o will_v much_o promote_v the_o present_a affair_n and_o have_v power_n to_o send_v for_o such_o person_n as_o they_o shall_v think_v to_o attend_v that_o committee_n about_o their_o composition_n and_o fine_a whereupon_o on_o the_o six_o day_n of_o march_n follow_v the_o house_n do_v resolve_v that_o they_o assent_v unto_o this_o proposition_n and_o order_v it_o according_o by_o the_o order_n of_o the_o 23_o of_o march_n 1645._o the_o rule_n for_o goldsmith_n hall_n to_o go_v by_o upon_o composition_n with_o delinquent_n be_v to_o be_v those_o rule_n that_o be_v set_v by_o the_o house_n upon_o the_o proposition_n for_o such_o as_o come_v in_o sithence_o the_o first_o of_o december_n by_o which_o several_a order_n and_o resolution_n the_o committee_n at_o goldsmith_n hall_n be_v to_o compound_v with_o delinquent_n alone_o that_o word_n be_v only_o use_v for_o a_o expression_n and_o according_a to_o certain_a rule_n and_o order_n and_o to_o conclude_v with_o no_o delinquent_n without_o certify_v the_o composition_n itself_o to_o the_o house_n this_o committee_n then_o have_v power_n to_o compound_v with_o delinquent_n only_o and_o delinquent_n particular_o describe_v it_o be_v requisite_a for_o that_o committee_n and_o it_o be_v their_o constant_a rule_n that_o the_o compounder_n shall_v acknowledge_v either_o his_o delinquency_n or_o some_o act_n do_v by_o he_o which_o amount_v unto_o the_o same_o to_o enable_v they_o to_o treat_v with_o he_o for_o if_o a_o person_n have_v commit_v no_o offence_n worthy_a of_o
