william_n cady_n be_v no_o hurt_v of_o any_o man_n these_o deposition_n likewise_o prove_v the_o cruelty_n of_o sir_n john_n and_o yet_o sir_n john_n think_v it_o impossible_a for_o he_o to_o be_v guilty_a of_o so_o much_o blood_n and_o cruelty_n as_o be_v mention_v in_o the_o petition_n of_o cady_n and_o ward_n as_o if_o 26_o wound_n draw_v little_a or_o no_o blood_n and_o as_o if_o chain_n ensue_a deposition_n will_v plain_o manifest_v be_v less_o cruelty_n than_o be_v mention_v in_o their_o moderate_a petition_n we_o do_v pray_v that_o sir_n john_n may_v no_o long_o stand_v on_o public_a extenuation_n of_o these_o and_o the_o ensue_a outrage_n of_o he_o but_o in_o secret_a repent_v they_o humble_o implore_v the_o divine_a mercy_n to_o avoid_v divine_a justice_n be_v the_o oath_n as_o touch_v the_o refusal_n of_o the_o oath_n that_o can_v be_v no_o cause_n of_o dislike_a his_o petition_n it_o may_v be_v of_o refuse_v his_o composition_n the_o oath_n be_v collateral_a to_o the_o petition_n as_o touch_v his_o acknowledgement_n of_o delinquency_n it_o be_v strange_a that_o it_o be_v now_o grow_v with_o sir_n anthony_n a_o find_n of_o fault_n or_o a_o occasion_n to_o pick_v a_o quarrel_n with_o one_o that_o deserve_v no_o favour_n by_o reason_n of_o a_o character_n give_v he_o of_o the_o violent_a and_o early_a enemy_n which_o be_v indeed_o true_a let_v whosoever_o give_v that_o character_n when_o as_o it_o be_v the_o constant_a rule_n by_o which_o that_o committee_n and_o sir_n anthony_n himself_o do_v walk_v neither_o be_v there_o any_o person_n whatsoever_o that_o do_v compound_v without_o it_o let_v he_o deserve_v favour_n or_o not_o but_o if_o sir_n anthony_n intend_v to_o show_v he_o no_o favour_n why_o do_v sir_n anthony_n for_o he_o swear_v that_o we_o do_v give_v he_o time_n for_o eight_o or_o ten_o day_n or_o fortnight_n he_o further_o depose_v that_o he_o do_v not_o certain_o remember_v but_o it_o be_v to_o his_o cetain_v remembrance_n that_o by_o that_o time_n his_o time_n give_v he_o by_o his_o article_n will_v be_v out_o that_o we_o may_v deal_v with_o he_o the_o better_a which_o if_o it_o shall_v be_v believe_v to_o be_v true_a because_o he_o swear_v it_o certain_o sir_n anthony_n be_v then_o too_o severe_a in_o his_o justice_n rather_o injust_a as_o he_o be_v now_o too_o merciful_a neither_o can_v he_o be_v excuse_v of_o cast_v snare_n in_o sir_n johns_n way_n to_o satisfy_v his_o passion_n for_o sir_n anthony_n himself_o be_v then_o the_o violent_a man_n against_o he_o though_o to_o the_o breach_n of_o the_o faith_n of_o the_o army_n and_o nation_n but_o we_o will_v not_o take_v advantage_n with_o a_o habemus_fw-la confitentem_fw-la reum_fw-la we_o will_v not_o for_o his_o own_o credit_n at_o this_o time_n believe_v he_o but_o do_v believe_v mr._n james_n ash_n that_o time_n be_v give_v unto_o sir_n john_n stawell_n upon_o the_o entreaty_n of_o mr._n john_n ash_n and_o in_o hope_n to_o draw_v sir_n john_n in_o the_o interval_n unto_o a_o submission_n sir_n anthony_n testimony_n touch_v sir_n johns_n carriage_n at_o that_o committee_n have_v be_v
before_o sufficient_o confute_v his_o opinion_n that_o sir_n john_n ought_v to_o compound_v as_o his_o expression_n be_v upon_o his_o examination_n and_o his_o desire_n to_o have_v have_v sir_n john_n admit_v to_o composition_n as_o he_o ought_v by_o his_o article_n be_v grant_v for_o sir_n john_n ought_v by_o his_o article_n to_o have_v be_v admit_v to_o a_o composition_n but_o sir_n john_n will_v not_o compound_v in_o such_o manner_n as_o that_o committee_n can_v compound_v with_o he_o and_o therefore_o he_o be_v just_o deny_v such_o a_o admission_n thereunto_o but_o according_a to_o their_o rule_n he_o be_v admit_v and_o may_v have_v compound_v as_o concern_v sir_n anthony_n relation_n touch_v the_o sale_n of_o a_o manor_n of_o sir_n john_n stawel_n it_o be_v but_o a_o relation_n of_o another_o unsworn_a and_o therefore_o no_o evidence_n but_o mr._n ash_n himself_o have_v full_o answer_v it_o and_o therefore_o need_v no_o other_o at_o this_o time_n only_a sir_n anthony_n have_v confess_v that_o the_o whole_a committee_n without_o a_o negative_a do_v resolve_v to_o report_v that_o carriage_n of_o sir_n john_n to_o the_o house_n wherein_o sir_n anthony_n now_o swear_v he_o then_o see_v no_o incivility_n if_o he_o do_v not_o where_o be_v sir_n anthony_n justice_n when_o himself_o vote_v that_o report_n the_o same_o answer_n respective_o may_v be_v give_v to_o sir_n david_n watkins_n certificate_n mention_v in_o the_o remonstrance_n page_n 61._o and_o his_o examination_n before_o this_o committee_n of_o parliament_n both_o agree_v but_o in_o this_o only_a that_o sir_n david_n do_v now_o affirm_v that_o he_o do_v account_n 28_o day_n to_o the_o month_n when_o he_o say_v that_o sir_n john_n stawell_n come_v and_o present_v his_o petition_n to_o the_o committee_n within_o four_o month_n from_o the_o eight_o of_o april_n which_o likewise_o can_v agree_v with_o his_o warrant_n of_o the_o four_o of_o august_n often_o mention_v he_o be_v one_o of_o the_o committee_n that_o grant_v it_o and_o at_o that_o time_n it_o seem_v he_o account_v the_o calendar_n month_n the_o remonstrance_n page_n 62._o do_v surmise_n that_o the_o 15._o of_o august_n 1653._o the_o cause_n of_o sir_n john_n whereof_o the_o court_n of_o article_n take_v the_o cognizance_n upon_o they_o come_v regular_o to_o be_v hear_v but_o how_o reagular_a or_o rather_o how_o extrajudicial_a have_v be_v already_o declare_v when_o the_o parliament_n have_v resume_v it_o to_o themselves_o but_o that_o parliament_n be_v dissolve_v sir_n john_n stawel_n take_v advantage_n thereof_o and_o by_o his_o importunity_n obtain_v from_o that_o court_n of_o article_n a_o further_a though_o most_o extrajudicial_a proceed_n therein_o even_o to_o judgement_n the_o trustee_n of_o drury_n house_n and_o purchaser_n can_v be_v blame_v if_o to_o preserve_v the_o honour_n and_o credit_n of_o act_n of_o parliament_n they_o do_v petition_v the_o then_o commit_v for_o petition_n in_o such_o manner_n as_o the_o remonstrance_n set_v forth_o to_o prevent_v such_o irregularity_n especial_o when_o that_o court_n be_v deliberate_v and_o advise_v upon_o their_o judgement_n the_o order_n of_o which_o committee_n thereon_o be_v as_o be_v remonstrate_v that_o colonel_n rous_n shall_v report_v it_o to_o the_o parliament_n with_o this_o sense_n of_o the_o committee_n that_o the_o purchaser_n ought_v to_o enjoy_v their_o purchase_n and_o sir_n john_n have_v satisfaction_n if_o find_v within_o and_o aught_o to_o have_v the_o benefit_n of_o article_n which_o report_n make_v according_o and_o the_o than_o parliament_n read_v the_o say_v several_a vote_n of_o parliament_n of_o the_o 24_o of_o february_n 1652._o touch_v the_o say_a confirmation_n of_o the_o sale_n and_o resume_v the_o cause_n do_v resolve_v to_o take_v the_o consideration_n thereof_o on_o friday_n follow_v after_o the_o resumption_n whereof_o and_o during_o its_o debate_n by_o the_o parliament_n that_o court_n of_o article_n take_v the_o boldness_n to_o give_v that_o judgement_n for_o sir_n john_n stawell_n at_o large_a set_v forth_o in_o the_o remonstrance_n pag._n 65._o thereby_o break_v through_o resolve_n judgement_n and_o act_n of_o parliament_n to_o the_o contrary_a and_o therefore_o sir_n john_n can_v not_o probable_o conceive_v that_o any_o other_o beside_o himself_o will_v rest_v on_o or_o that_o the_o then_o parliament_n will_v suffer_v their_o proceed_n or_o the_o judgement_n or_o resolution_n of_o their_o predecessor_n to_o be_v question_v and_o annul_v by_o a_o inferior_a jurisdiction_n and_o therefore_o it_o be_v just_o do_v by_o the_o trustee_n and_o purchaser_n to_o endeavour_v to_o render_v those_o illegal_a proceed_n successless_a and_o for_o the_o parliament_n in_o vindication_n of_o their_o supreme_a power_n to_o resume_v the_o debate_n touch_v the_o trustee_n representation_n and_o purchaser_n petition_v the_o soon_o to_o declare_v their_o resentment_n of_o those_o proceed_n which_o they_o do_v on_o the_o 29_o of_o august_n 1653._o and_o upon_o that_o debate_n refer_v back_o to_o the_o same_o committee_n to_o consider_v of_o a_o expedient_a for_o the_o petitioner_n relief_n upon_o which_o reference_n that_o committee_n of_o petition_n upon_o consideration_n have_v of_o that_o judgement_n of_o the_o court_n of_o article_n and_o the_o several_a act_n constitute_v that_o court_n and_o of_o all_o the_o plead_n and_o proceed_n pass_v in_o that_o case_n think_v fit_a to_o report_v that_o the_o purchaser_n ought_v to_o with_o this_o report_n of_o the_o committee_n that_o the_o purchaser_n of_o sir_n john_n stawel_n estate_n shall_v quiet_o possess_v and_o enjoy_v the_o same_o according_a to_o their_o several_a the_o act_n and_o proceed_n of_o the_o former_a parliament_n and_o sale_n of_o the_o estate_n according_o sir_n john_n rest_v not_o but_o now_o pretend_v that_o the_o committee_n for_o petition_n pursue_v not_o the_o intent_n of_o that_o order_n of_o reference_n and_o draw_v that_o pretence_n from_o these_o two_o premise_n the_o one_o because_o sir_n john_n have_v the_o extrajudicial_a judgement_n of_o the_o court_n of_o article_n for_o part_n of_o his_o estate_n therefore_o this_o committee_n do_v not_o pursue_v the_o intent_n of_o that_o order_n whereas_o not_o to_o insist_v upon_o the_o consequence_n the_o judgement_n and_o proceed_n of_o the_o court_n of_o article_n against_o the_o purchaser_n be_v the_o very_a cause_n of_o their_o complaint_n and_o against_o which_o they_o desire_v relief_n from_o a_o superior_a court_n the_o parliament_n think_v fit_a upon_o a_o due_a consideration_n to_o establish_v the_o enjoyment_n of_o the_o land_n and_o by_o consequence_n do_v lay_v aside_o that_o judgement_n that_o will_v have_v disturb_v it_o sir_n john_n again_o say_v that_o in_o regard_n the_o committee_n do_v think_v fit_a to_o confirm_v the_o purchaser_n estate_n therefore_o they_o do_v not_o pursue_v the_o intent_n of_o that_o order_n touch_v the_o purchaser_n relief_n as_o if_o it_o be_v not_o the_o best_a and_o most_o fit_a relief_n to_o confirm_v their_o estate_n notwithstanding_o this_o judgement_n that_o will_v otherwise_o have_v take_v they_o away_o neither_o in_o the_o judgement_n of_o the_o parliament_n itself_o have_v that_o committee_n not_o pursue_v their_o intent_n of_o reference_n for_o both_o by_o a_o resolve_v and_o a_o act_n they_o settle_v the_o estate_n according_o he_o say_v the_o purchaser_n bargain_n and_o contract_n can_v not_o be_v absolute_a and_o direct_a in_o regard_n the_o say_a clause_n of_o limitation_n have_v debar_v the_o trustee_n themselves_o from_o who_o the_o purchaser_n claim_v in_o case_n of_o article_n
