proprietor_n of_o the_o ground_n where_o they_o be_v accustom_v to_o feed_v provide_v the_o say_a proprietor_n cause_v the_o say_a stray_n or_o stray_v to_o be_v cry_v by_o the_o common_a cryer_n three_o distinct_a court_n day_n in_o the_o court_n of_o the_o say_a precinct_n describe_v all_o the_o mark_n of_o the_o say_a stray_n with_o the_o age_n and_o kind_a and_o further_o that_o the_o say_v proprietor_n do_v turn_v loose_a again_o the_o say_a stray_n to_o continue_v in_o the_o same_o feed_a ground_n where_o the_o same_o be_v accustom_v to_o feed_v and_o tie_v a_o with_o about_o the_o neck_n of_o the_o say_a stray_n which_o shall_v be_v a_o common_a mark_n for_o stray_n and_o in_o that_o manner_n to_o continue_v one_o whole_a year_n from_o the_o first_o take_v up_o or_o pen_v of_o the_o same_o provide_v further_o that_o if_o in_o the_o mean_a time_n no_o person_n shall_v challenge_v or_o claim_v the_o same_o that_o then_o the_o property_n of_o all_o such_o stray_v remain_v to_o the_o proprietor_n of_o the_o ground_n as_o before_o they_o give_v satisfaction_n for_o take_v up_o the_o say_a stray_n provide_v always_o that_o this_o act_n extend_v not_o to_o any_o ear-marked_n or_o burnt-marked_n beast_n horse_n mare_n colt_n or_o any_o other_o sort_n of_o cattle_n but_o all_o such_o shall_v belong_v to_o the_o owner_n or_o proprietor_n of_o the_o same_o if_o claim_v at_o any_o time_n after_o the_o expiration_n of_o the_o year_n it_o be_v further_a enact_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o each_o respective_a court_n of_o record_n in_o this_o island_n be_v hereby_o empower_v to_o make_v entry_n and_o toll_n any_o sort_n of_o cattle_n that_o shall_v be_v sell_v from_o one_o person_n to_o another_o take_z as_o near_o description_n of_o the_o several_a mark_n natural_a or_o otherwise_o as_o can_v be_v and_o vouch_v by_o two_o sufficient_a person_n know_v to_o the_o clerk_n which_o entry_n or_o toll_n shall_v be_v good_a against_o any_o former_a sale_n or_o bargain_n or_o any_o other_o title_n whatsoever_o except_o in_o all_o such_o case_n where_o the_o provost_z marshal_z or_o his_o deputy_n have_v levy_v that_o shall_v accrue_v to_o any_o person_n or_o person_n by_o mean_n of_o the_o same_o to_o be_v recover_v if_o not_o exceed_v forty_o shilling_n before_o any_o justice_n of_o the_o peace_n if_o exceed_v forty_o shilling_n by_o action_n of_o debt_n in_o any_o court_n of_o record_n within_o this_o island_n and_o if_o the_o person_n so_o offend_v be_v not_o able_a to_o make_v satisfaction_n to_o owner_n of_o land_n to_o carry_v fire_n in_o their_o own_o plantation_n or_o burn_v their_o own_o savanna_n yet_o to_o be_v liable_a as_o before_o if_o thereby_o they_o injure_v or_o burn_v any_o other_o person_n savanna_n or_o plantation_n and_o that_o all_o penalty_n for_o carry_v of_o fire_n shall_v belong_v to_o the_o person_n that_o sue_v for_o the_o same_o and_o whereas_o it_o be_v find_v by_o experience_n that_o several_a common_a driver_n of_o cattle_n or_o horse-catcher_n do_v frequent_o ride_v and_o drive_v gang_v of_o mare_n and_o other_o cattle_n from_o off_o their_o own_o feed_v ground_n or_o pasture_n whereby_o those_o that_o be_v big_a cast_v their_o young_a and_o young_a one_o be_v often_o separate_v from_o their_o dam_n and_o do_v likewise_o often_o deface_v the_o mark_n of_o such_o cattle_n and_o horse_n or_o new_o mark_v they_o for_o themselves_o or_o other_o with_o wrong_a mark_n to_o the_o great_a damage_n of_o all_o such_o proprietor_n for_o prevention_n whereof_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n whatsoever_o shall_v hereafter_o presume_v to_o drive_v or_o ride_v in_o any_o savanna_n as_o a_o common_a horse-catcher_n after_o any_o horse_n or_o mare_n without_o have_v first_o give_v security_n for_o their_o honesty_n and_o obtain_v leave_n from_o the_o proprietor_n or_o proprietor_n of_o such_o savanna_n or_o the_o major_a part_n of_o they_o under_o the_o penalty_n of_o twenty_o pound_n to_o be_v recover_v as_o aforesaid_a one_o three_o part_n whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n of_o the_o same_o one_o three_o part_n to_o the_o proprietor_n or_o proprietor_n of_o such_o savanna_n where_o the_o offence_n shall_v be_v commit_v the_o remain_a three_o to_o the_o informer_n or_o he_o that_o shall_v sue_v for_o the_o same_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o such_o common_a driver_n or_o horse-catcher_n or_o any_o other_o person_n employ_v by_o or_o for_o he_o or_o they_o shall_v presume_v to_o sell_v or_o barter_n any_o horse_n mare_n or_o colt_n or_o other_o cattle_n but_o such_o as_o he_o shall_v bring_v two_o sufficient_a freeholders_n of_o the_o place_n where_o he_o do_v inhabit_v or_o other_o good_a sufficient_a evidence_n to_o vouch_v before_o the_o clerk_n of_o some_o court_n of_o record_n within_o the_o precinct_n where_o they_o shall_v be_v sell_v or_o barter_v as_o aforesaid_a that_o he_o breed_v they_o or_o otherwise_o come_v lawful_o possess_v of_o they_o
thereupon_o in_o any_o court_n of_o record_n within_o this_o island_n and_o if_o such_o mortgagee_n shall_v not_o within_o three_o month_n after_o request_n and_o tender_v make_v for_o his_o reasonable_a charge_n repair_v to_o the_o office_n of_o enrolment_n and_o there_o make_v such_o acknowledgement_n as_o aforesaid_a he_o she_o or_o they_o so_o refuse_v shall_v for_o every_o such_o offence_n forfeit_a and_o pay_v unto_o the_o party_n or_o party_n aggrieve_v the_o sum_n of_o fifty_o pound_n currant_n money_n of_o this_o island_n to_o be_v recover_v in_o any_o of_o his_o majesty_n court_n of_o record_n within_o this_o island_n by_o bill_n plaint_n or_o information_n wherein_o no_o essoign_n wager_n of_o law_n or_o protection_n shall_v be_v allow_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o judge_n before_o who_o such_o acknowledgement_n of_o deed_n or_o other_o write_n be_v and_o shall_v be_v make_v to_o demand_v and_o receive_v for_o every_o deed_n of_o the_o value_n of_o twenty_o pound_n or_o more_o ten_o shilling_n and_o for_o every_o deed_n under_o the_o value_n of_o twenty_o pound_n five_o shilling_n and_o no_o more_o under_o the_o penalty_n of_o twenty_o pound_n the_o one_o half_a to_o be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o informer_n to_o be_v recover_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o the_o enrolment_n shall_v and_o may_v take_v and_o receive_v for_o enrol_v and_o copy_v a_o ordinary_a deed_n grant_v or_o patent_n for_o one_o or_o more_o parcel_n of_o land_n or_o any_o deed_n or_o conveyance_n not_o exceed_v the_o length_n of_o such_o patent_n five_o shilling_n for_o every_o deed_n exceed_v the_o length_n aforesaid_a eight_o penny_n per_fw-la sheet_n account_v twenty_o line_n to_o a_o sheet_n and_o eight_o word_n to_o a_o line_n for_o every_o short_a write_v not_o exceed_v the_o length_n aforesaid_a twelve_o penny_n for_o record_v every_o plot_n one_o shilling_n and_o three_o penny_n for_o search_v the_o record_n twelve_o penny_n and_o for_o acknowledge_v satisfaction_n in_o the_o margin_n of_o a_o mortgage_n record_v one_o shilling_n and_o three_o penny_n and_o no_o more_o under_o the_o penalty_n of_o ten_o pound_n to_o the_o use_v and_o to_o be_v recover_v as_o aforesaid_a and_o be_v it_o likewise_o enact_v by_o the_o authority_n aforesaid_a that_o all_o patent_n already_o grant_v and_o not_o enrol_v shall_v be_v enrol_v in_o the_o office_n of_o enrolment_n within_o six_o month_n and_o all_o patent_n hereafter_o to_o be_v grant_v shall_v be_v enrol_v within_o six_o month_n after_o the_o seal_v such_o patent_n which_o enrolment_n as_o likewise_o all_o such_o as_o be_v already_o there_o enrol_v shall_v be_v good_a and_o valid_a in_o the_o law_n notwithstanding_o any_o clause_n insert_v in_o the_o say_a patent_n direct_v the_o contrary_a and_o whereas_o it_o be_v most_o manifest_a that_o the_o estate_n of_o several_a orphan_n have_v be_v preserve_v and_o vast_o improve_v by_o be_v during_o their_o minority_n lease_v out_o by_o their_o guardian_n and_o whereas_o it_o may_v be_v disputable_a whether_o such_o lease_n be_v warrant_v by_o the_o law_n of_o england_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o lease_n heretofore_o make_v or_o grant_v or_o that_o hereafter_o shall_v be_v make_v or_o grant_v of_o the_o estate_n of_o any_o orphan_n by_o the_o respective_a guardian_n for_o any_o term_n of_o year_n not_o exceed_v the_o minority_n of_o such_o respective_a orphan_n shall_v be_v good_a and_o valid_a in_o the_o law_n any_o law_n custom_n or_o usage_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o provide_v always_o that_o this_o act_n or_o any_o thing_n therein_o contain_v shall_v not_o extend_v to_o contradict_v or_o alter_v any_o power_n give_v or_o to_o be_v give_v by_o the_o parent_n to_o any_o guardian_n or_o to_o give_v liberty_n for_o the_o future_a to_o any_o guardian_n to_o lease_n out_o the_o estate_n of_o any_o heiress_n for_o any_o long_a term_n or_o time_n than_o till_o she_o shall_v complete_a the_o age_n of_o fourteen_o year_n be_v it_o likewise_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o the_o enrolment_n or_o whosoever_o shall_v execute_v the_o say_a office_n for_o the_o time_n be_v do_v find_v two_o sufficient_a surety_n with_o himself_o to_o become_v bind_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n in_o a_o bond_n of_o the_o penalty_n of_o two_o thousand_o pound_n for_o the_o true_a and_o faithful_a execution_n of_o the_o say_a office_n and_o for_o keep_v of_o the_o same_o in_o the_o town_n of_o st._n jago_n de_fw-fr la_fw-fr vega_n as_o be_v herein_o before_o declare_v and_o not_o elsewhere_o which_o say_v very_a convenient_a way_n between_o the_o salt_n and_o fresh_a river_n in_o the_o parish_n of_o st._n andrews_n and_o st._n catharines_n which_o will_v be_v of_o great_a use_n and_o advantage_n to_o the_o whole_a island_n in_o cause_v a_o more_o near_o and_o easy_a correspondence_n with_o the_o several_a precinct_n and_o whereas_o the_o say_v william_n parker_n have_v likewise_o set_v up_o and_o erect_v a_o ferry_n for_o the_o better_a accommodation_n of_o the_o say_a passage_n and_o whereas_o the_o same_o can_v be_v maintain_v without_o great_a and_o constant_a charge_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o say_v william_n parker_n his_o heir_n and_o assign_v be_v by_o this_o act_n impower_v and_o authorize_v for_o the_o space_n and_o term_v of_o fourteen_o year_n from_o the_o make_n hereof_o to_o ask_v demand_n sue_v for_o recover_v and_o receive_v as_o a_o duty_n and_o toll_n for_o the_o transport_v of_o any_o person_n over_o the_o say_a ferry_n seven_o penny_n half_a penny_n for_o every_o horse_n and_o man_n fifteen_o penny_n for_o every_o grow_v beast_n that_o have_v no_o rider_n seven_o penny_n half_a penny_n for_o every_o sheep_n calf_n or_o hog_n six_o penny_n and_o that_o the_o say_v william_n parker_n his_o heir_n and_o assign_v may_v and_o shall_v erect_v a_o tavern_n or_o victualling-house_n near_o the_o say_a ferry_n and_o shall_v not_o be_v compel_v to_o renew_v or_o pay_v any_o licence_n money_n for_o the_o same_o provide_v always_o that_o if_o the_o say_v william_n parker_n or_o his_o assign_v shall_v not_o finish_v and_o complete_a the_o say_a way_n and_o passage_n within_o twelve_o month_n from_o and_o after_o the_o make_n of_o this_o act_n and_o that_o in_o all_o place_n it_o be_v not_o less_o than_o eight_o foot_n broad_a and_o that_o the_o same_o be_v always_o keep_v in_o good_a and_o sufficient_a repair_n that_o the_o aforesaid_a limitation_n of_o the_o rate_n which_o shall_v be_v pay_v by_o virtue_n of_o this_o act_n or_o any_o letter_n patent_n grant_v for_o the_o same_o shall_v cease_v determine_v and_o be_v utter_o void_a and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o other_o person_n whatsoever_o presume_v to_o erect_v
impower_v he_o or_o they_o to_o levy_v the_o say_a tax_n and_o upon_o refusal_n to_o distrain_v and_o sell_v by_o public_a outcry_n as_o aforesaid_a any_o thing_n in_o this_o act_n seem_v to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o justice_n and_o vestry-man_n of_o each_o parish_n have_v full_a power_n to_o inquire_v into_o arrear_n of_o former_a subscription_n and_o tax_n and_o to_o levy_v the_o same_o arrear_n by_o warrant_n from_o the_o justice_n to_o the_o constable_n aforesaid_a and_o that_o hereof_o a_o action_n of_o debt_n shall_v lie_v in_o any_o court_n of_o record_n or_o before_o any_o justice_n of_o the_o peace_n as_o in_o other_o debt_n for_o the_o several_a churchwarden_n and_o surveyor_n of_o each_o respective_a parish_n and_o their_o successor_n to_o recover_v against_o any_o of_o the_o say_a person_n rate_v or_o assess_v by_o virtue_n of_o this_o act_n or_o any_o of_o they_o or_o their_o agent_n or_o attorney_n here_o all_o such_o sum_n and_o sum_n of_o money_n as_o be_v or_o shall_v be_v rate_v or_o assess_v upon_o they_o as_o aforesaid_a and_o that_o the_o same_o rate_n or_o assessment_n produce_v in_o such_o court_n of_o record_n or_o before_o such_o justice_n of_o the_o peace_n as_o aforesaid_a shall_v be_v sufficient_a evidence_n and_o proof_n for_o the_o master_n of_o the_o several_a family_n who_o be_v hereby_o require_v to_o give_v such_o notice_n under_o the_o penalty_n of_o five_o pound_n shall_v register_n or_o cause_n to_o be_v register_v by_o the_o clerk_n of_o the_o vestry_n of_o that_o parish_n the_o time_n of_o the_o birth_n christen_n marriage_n and_o burial_n of_o all_o such_o person_n or_o person_n that_o shall_v from_o time_n to_o authority_n aforesaid_a that_o where_o any_o prisoner_n or_o prisoner_n under_o execution_n shall_v have_v nothing_o to_o maintain_v he_o her_z or_o themselves_o that_o then_o he_o she_o or_o they_o disclose_v the_o same_o upon_o oath_n unto_o two_o justice_n of_o the_o peace_n of_o the_o parish_n where_o he_o she_o or_o they_o shall_v be_v prisoner_n and_o make_v it_o appear_v to_o the_o judge_n of_o the_o supreme_a court_n that_o he_o she_o or_o they_o have_v give_v notice_n to_o all_o their_o creditor_n ten_o day_n before_o the_o say_a court_n that_o they_o or_o either_o of_o they_o intend_v to_o take_v the_o benefit_n of_o this_o act_n bring_v likewise_o to_o the_o say_a court_n a_o certificate_n of_o such_o their_o oath_n under_o the_o hand_n and_o seal_n of_o the_o say_a justice_n that_o then_o the_o prisoner_n or_o prisoner_n so_o take_v in_o execution_n shall_v be_v public_o let_v to_o hire_v at_o the_o say_a court_n the_o marshal_n receive_v for_o his_o fee_n a_o proportionable_a share_n with_o the_o other_o creditor_n and_o the_o money_n so_o arise_v from_o the_o say_a hire_n shall_v be_v pay_v to_o such_o person_n as_o the_o court_n shall_v appoint_v to_o be_v equal_o divide_v among_o the_o creditor_n as_o aforesaid_a but_o in_o case_n any_o creditor_n shall_v refuse_v to_o consent_v to_o let_v the_o say_a prisoner_n or_o prisoner_n to_o hire_v that_o then_o such_o creditor_n shall_v pay_v or_o cause_v to_o be_v pay_v to_o the_o say_a prisoner_n or_o prisoner_n three_o shilling_n and_o six_o penny_n weekly_a provide_v always_o and_o it_o be_v hereby_o enact_v that_o if_o any_o prisoner_n or_o prisoner_n so_o let_v to_o hire_n shall_v at_o any_o time_n afterward_o come_v to_o have_v or_o enjoy_v a_o estate_n have_v not_o first_o satisfy_v their_o debt_n that_o then_o at_o all_o time_n hereafter_o the_o judgement_n obtain_v against_o he_o her_z or_o they_o shall_v remain_v good_a and_o in_o force_n and_o another_o execution_n shall_v be_v take_v out_o and_o levy_v against_o the_o good_n and_o chattel_n of_o the_o say_a prisoner_n or_o prisoner_n wheresover_n they_o shall_v be_v find_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o provost-marshal_n by_o himself_o or_o any_o of_o his_o deputy_n shall_v levy_v any_o execution_n in_o any_o other_o manner_n than_o what_o be_v herein_o before_o declare_v or_o shall_v ask_v demand_n or_o receive_v any_o mile-money_n for_o the_o execute_v any_o writ_n of_o execution_n or_o venditioni_fw-la exponas_fw-la shall_v forfeit_v one_o hundred_o pound_n currant_n money_n of_o this_o island_n for_o every_o such_o offence_n to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v be_v allow_v the_o one_o moiety_n whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o the_o other_o moiety_n to_o the_o party_n aggrieve_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a fine_n forfeiture_n and_o penalty_n beforementioned_a in_o this_o act_n and_o not_o declare_v how_o they_o shall_v be_v dispose_v of_o shall_v be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v be_v allow_v the_o one_o moiety_n whereof_o shall_v be_v
