which_o lie_v in_o firm_a annual_a or_o demand_v annual_a they_o be_v charge_v as_o sheriff_n in_o aforetime_o have_v be_v charge_v and_o thus_o stand_v the_o business_n of_o the_o sheriff_n firme_v until_o the_o statute_n of_o 34_o h._n 8._o which_o be_v the_o next_o period_n chap._n viii_o touch_v the_o state_n of_o the_o sheriff_n firme_v from_o the_o statute_n of_o 34_o h._n 8._o till_o the_o firm_a after_o the_o statute_n of_o rutland_n and_o how_o the_o statute_n of_o 4_o h._n 5._o cap._n 2._o bound_v the_o firme_v charge_v upon_o the_o sheriff_n close_o upon_o they_o than_o for_o some_o year_n before_o and_o so_o they_o continue_v till_o the_o make_n of_o the_o statute_n of_o 34_o h._n 8._o cap._n 16._o this_o statute_n recite_v those_o several_a firme_v charge_v to_o the_o sheriff_n sub_fw-la nomine_fw-la vicecomitis_fw-la viz._n de_fw-fr remanent_fw-la ’_o firm_a post_fw-la terras_fw-la datas_fw-la firma_n de_fw-fr proficuo_fw-la comitatus_fw-la and_o those_o other_o minute_n firme_v demand_v sub_fw-la nomine_fw-la vicecomitis_fw-la and_o many_o of_o these_o particular_a small_a rent_n that_o make_v up_o these_o firme_v charge_v upon_o the_o sheriff_n be_v lose_v or_o not_o leviable_a or_o extinguish_v by_o attainder_n and_o dissolution_n of_o monastery_n and_o yet_o the_o sheriff_n continue_v charge_v with_o their_o firme_v as_o former_o it_o enact_v 1._o that_o all_o sheriff_n that_o have_v no_o tally_n of_o record_n shall_v upon_o their_o day_n of_o prefixion_n deliver_v in_o roll_n or_o schedule_n of_o parchment_n contain_v th●_n particular_a sum_n of_o money_n which_o he_o have_v or_o may_v have_v levy_v as_o parcel_n of_o the_o say_v ancient_a firme_v name_v the_o person_n and_o land_n of_o which_o they_o be_v to_o be_v levy_v 2._o that_o after_o such_o schedule_n deliver_v the_o court_n shall_v have_v power_n to_o allow_v and_o make_v deduction_n in_o the_o say_a sheriff_n firme_v of_o all_o such_o sum_n of_o money_n as_o the_o firme_v shall_v be_v more_o than_o the_o sum_n in_o such_o schedule_n shall_v amount_v unto_o 3._o and_o the_o court_n shall_v proceed_v to_o the_o recovery_n of_o such_o sum_n belong_v to_o the_o say_a firme_v as_o be_v omit_v in_o such_o schedule_n 4._o that_o the_o sheriff_n have_v allowance_n and_o discharge_n of_o all_o such_o illeviable_a sum_n as_o be_v write_v to_o he_o in_o process_n 5._o that_o the_o sheriff_n have_v allowance_n for_o entertainment_n of_o justice_n etc._n etc._n but_o this_o be_v but_o a_o temporary_a act_n and_o discontinue_v at_o the_o next_o parliament_n but_o a_o far_a act_n be_v after_o make_v for_o the_o ease_n of_o the_o sheriff_n especial_o in_o relation_n to_o those_o firme_v viz._n 2_o and_o 3_o e._n 6_o cap._n 4._o by_o this_o it_o be_v enact_v 1._o that_o the_o sheriff_n shall_v have_v such_o allowance_n and_o tally_n of_o reward_n as_o they_o have_v before_o the_o act_n of_o 34_o h._n 8._o or_o may_v account_v according_a to_o the_o act_n at_o their_o election_n 2._o that_o they_o that_o account_n and_o take_v no_o tally_n of_o record_n shall_v be_v treat_v in_o the_o exchequer_n as_o though_o the_o act_n of_o 34_o h._n 8._o be_v in_o force_n 3._o that_o those_o that_o have_v no_o tally_n of_o reward_n shall_v have_v allowance_n of_o the_o diet_n of_o the_o justice_n etc._n etc._n 4._o that_o all_o such_o sheriff_n as_o take_v no_o tally_n of_o reward_n shall_v be_v discharge_v of_o all_o firme_v good_n chattel_n profit_n casualty_n etc._n etc._n as_o they_o can_v levy_v or_o come_v by_o 5._o that_o all_o that_o have_v tally_n of_o reward_n shall_v be_v discharge_v of_o all_o firme_v and_o sum_v of_o money_n that_o they_o can_v levy_v except_o vicontiel_n with_o which_o they_o be_v to_o remain_v chargeable_a as_o before_o the_o make_n of_o the_o former_a act._n 6._o that_o sheriff_n shall_v have_v allowance_n of_o such_o vicontiel_n as_o be_v extinguish_v by_o unity_n of_o possession_n in_o the_o crown_n by_o dissolution_n of_o monastery_n 7._o that_o the_o sheriff_n at_o his_o day_n of_o prefixion_n when_o he_o be_v swear_v to_o his_o account_n shall_v be_v swear_v to_o deliver_v into_o the_o court_n of_o exchequer_n roll_n or_o schedule_n of_o parchment_n contain_v all_o the_o particular_a sum_n of_o money_n which_o he_o have_v levy_v or_o may_v levy_v of_o his_o vicontiel_n or_o other_o firme_v mention_v the_o person_n and_o land_n of_o which_o they_o be_v leviable_a and_o the_o court_n to_o take_v care_n for_o the_o levy_n of_o such_o of_o the_o vicontiel_n or_o firme_v which_o be_v omit_v out_o of_o the_o schedule_n for_o save_v the_o king_n right_n and_o to_o make_v out_o process_n for_o the_o same_o upon_o these_o act_n these_o thing_n be_v observable_a i._o that_o those_o sheriff_n that_o have_v tally_n of_o reward_n may_v not_o discharge_v themselves_o of_o their_o vicontiel_n viz._n the_o remanent_fw-la ’_o firm_a post_fw-la terras_fw-la datas_fw-la and_o cro_n comitatus_fw-la and_o other_o small_a rent_n charge_v sub_fw-la nomine_fw-la vicecomitis_fw-la if_o he_o take_v his_o tally_n of_o reward_n by_o oath_n that_o he_o can_v levy_v it_o or_o all_o of_o it_o ii_o but_o if_o such_o a_o sheriff_n will_v wave_v his_o tally_n of_o reward_n he_o may_v account_v according_a to_o the_o statute_n of_o 34_o h._n 8._o and_o so_o discharge_v himself_o of_o his_o vicontiel_n or_o firme_v thereof_o as_o well_o as_o other_o firme_v and_o the_o truth_n be_v i_o think_v ancient_o there_o be_v some_o sheriff_n that_o have_v tally_n of_o reward_n viz._n york_n northampton_n cumb'land_n hereford_n etc._n etc._n but_o since_o the_o make_n of_o this_o act_n they_o have_v wave_v they_o account_v it_o more_o beneficial_a to_o take_v the_o benefit_n of_o those_o statute_n upon_o their_o account_n than_o to_o take_v their_o tally_n of_o reward_n so_o that_o now_o all_o sheriff_n have_v a_o equal_a benefit_n of_o the_o statute_n of_o 34_o h._n 8._o and_o 2_o and_o 3_o e._n 6._o iii_o but_o those_o sheriff_n that_o have_v no_o tally_n of_o reward_n may_v discharge_v themselves_o of_o their_o vicontiel_n and_o firme_v de_fw-fr remanente_fw-la comitatus_fw-la as_o well_o as_o other_o thing_n that_o they_o can_v not_o levy_v iv_o that_o all_o sheriff_n as_o well_o those_o that_o have_v or_o have_v not_o tally_n of_o reward_n may_v discharge_v themselves_o of_o the_o casual_a charge_n or_o their_o annual_a uncertain_a charge_n and_o consequent_o may_v and_o most_o ordinary_o after_o this_o statute_n do_v discharge_v themselves_o of_o the_o entire_a firm_a
