be_v as_o well_o within_o the_o franchise_n as_o without_o shall_v make_v due_a search_n weekly_o or_o at_o the_o further_a at_o all_o time_n hereafter_o once_o every_o month_n in_o all_o place_n where_o any_o such_o house_n ally_n play_n or_o place_n shall_v be_v suspect_v to_o be_v have_v keep_v and_o maintain_v and_o if_o the_o say_a mayor_n sheriff_n bailiff_n constable_n and_o other_o head_n officer_n within_o their_o city_n borough_n and_o town_n as_o well_o within_o franchise_n as_o without_o do_v not_o make_v due_a search_n at_o the_o further_a once_o every_o month_n if_o the_o that_o then_o every_o such_o mayor_n sheriff_n bailiff_n constable_n or_o other_o head_n officer_n to_o pay_v and_o forfeit_v for_o every_o month_n not_o make_v such_o search_n nor_o execute_v the_o same_o xl_o s._n be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o no_o manner_n of_o artificer_n or_o craft_n man_n of_o any_o handy_a craft_n or_o occupation_n husbandman_n apprentice_n labourer_n servant_n at_o husbandry_n journeyman_n or_o servant_n of_o artificer_n mariner_n fisherman_n waterman_n or_o any_o serve_a man_n shall_v from_o the_o say_a feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n play_v at_o the_o table_n tennis_n dice_n card_n bowl_n clash_n coyt_v logate_a or_o any_o other_o unlawful_a game_n out_o of_o christmas_n under_o the_o pain_n of_o xx_o s._n to_o be_v forfeit_a for_o every_o time_n and_o in_o christmas_n to_o play_v at_o any_o of_o the_o say_a game_n in_o their_o master_n house_n or_o in_o their_o master_n presence_n and_o also_o that_o no_o manner_n of_o person_n shall_v at_o any_o time_n play_v at_o any_o bowl_n or_o bowl_n in_o open_a place_n out_o of_o his_o garden_n or_o orchard_n under_o the_o pain_n for_o every_o time_n so_o offend_v to_o forfeit_v vi_fw-mi s._n viij_o d._n and_o that_o all_o justice_n of_o peace_n mayor_n bailiff_n sheriff_n and_o all_o other_o head_n officer_n and_o every_o of_o they_o find_v or_o know_v any_o manner_n person_n or_o person_n use_v or_o exercise_v any_o unlawful_a game_n contrary_a to_o this_o present_a statute_n shall_v have_v full_a power_n and_o authority_n to_o commit_v every_o such_o offender_n to_o ward_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o such_o time_n that_o they_o so_o offend_v be_v bind_v by_o obligation_n to_o the_o king_n use_n in_o such_o sum_n of_o money_n as_o by_o the_o discretion_n of_o the_o say_a justice_n major_n bailiff_n or_o other_o head_n officer_n shall_v be_v think_v reasonable_a that_o they_o or_o any_o of_o they_o shall_v not_o from_o henceforth_o use_v such_o unlawful_a game_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o other_o offence_n all_o suit_n upon_o this_o statute_n shall_v be_v within_o the_o year_n after_o the_o offence_n statute_n make_v for_o the_o restraint_n of_o unlawful_a game_n or_o for_o the_o maintenance_n of_o artillery_n as_o touch_v the_o penalty_n or_o forfeiture_n of_o the_o same_o shall_v be_v from_o henceforth_o utter_o void_a and_o all_o information_n plaint_n action_n or_o suit_n that_o shall_v be_v take_v or_o sue_v upon_o any_o part_n of_o this_o statute_n shall_v be_v commence_v within_o the_o year_n after_o the_o offence_n commit_v and_o do_v or_o otherwise_o no_o advantage_n or_o suit_n to_o be_v take_v and_o where_o any_o such_o forfeiture_n shall_v happen_v to_o be_v find_v court_n where_o such_o forfeiture_n shall_v be_v in_o any_o franchise_n or_o leet_n the_o lord_n to_o have_v one_o moiety_n thereof_o and_o the_o other_o to_o he_o that_o will_v sue_v for_o the_o same_o in_o any_o the_o king_n court_n within_o the_o precinct_n of_o any_o franchise_n leet_n or_o lawday_n than_o the_o lord_n shall_v be_v commit_v or_o shall_v thereof_o be_v convict_v by_o the_o oath_n of_o two_o master_n for_o every_o profane_a oath_n or_o curse_n the_o offender_n shall_v upon_o conviction_n by_o two_o witness_n or_o confession_n forfeit_v 12._o d._n to_o the_o poor_a the_o constable_n ch._n warden_n and_o overseer_n for_o the_o poor_a shall_v by_o warrant_n of_o the_o justice_n of_o peace_n levy_v justice_n of_o peace_n or_o head_n officer_n to_o levy_v the_o same_o sum_n and_o sum_n of_o money_n by_o distress_n and_o sale_n of_o the_o offender_n good_n render_v to_o the_o party_n the_o overplus_n and_o in_o defect_n of_o such_o distress_n the_o offender_n if_o he_o or_o she_o be_v above_o the_o age_n of_o 12._o year_n shall_v by_o warrant_n from_o such_o justice_n of_o the_o peace_n prayer_n twice_o in_o the_o year_n anno_fw-la primo_fw-la jacobi_n regis_fw-la cap._n ix_o several_a penalty_n of_o alehouse-keeper_n for_o their_o several_a offence_n whereas_o the_o ancient_a true_a and_o principal_a use_n of_o inn_n alehouse_n victualling-house_n the_o true_a and_o principal_a use_n of_o inn_n alehouse_n and_o other_o victualling-house_n and_o victualling-house_n be_v for_o the_o receipt_n and_o lodging_n of_o wayfaring_a people_n travel_v from_o place_n to_o place_n and_o for_o such_o supply_n of_o the_o want_n of_o such_o people_n as_o be_v not_o able_a by_o great_a quantity_n to_o make_v their_o provision_n of_o victual_n and_o not_o mean_v for_o entertainment_n and_o harbour_v of_o lewd_a and_o idle_a people_n to_o spend_v and_o consume_v their_o money_n and_o their_o time_n in_o lewd_a and_o drunken_a manner_n be_v it_o therefore_o enact_v by_o the_o king_n most_o excellent_a majesty_n and_o the_o lord_n and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o if_o after_o forty_o day_n next_o ensue_v after_o the_o end_n of_o this_o present_a session_n of_o parliament_n any_o innkeeper_n victualler_n or_o alehousekeeper_n within_o this_o realm_n of_o england_n or_o the_o dominion_n of_o wales_n do_v permit_v or_o suffer_v any_o person_n or_o person_n inhabit_v and_o dwell_v in_o any_o city_n town_n corporate_a market_n town_n village_n or_o hamlet_n within_o this_o realm_n of_o england_n and_o dominion_n of_o wales_n where_o any_o such_o inn_n alehouse_n or_o tippling-house_n be_v or_o shall_v be_v to_o remain_v &_o continue_v drink_v or_o tipple_a in_o the_o say_a inn_n victual_v house_n tippling-house_n or_o alehouse_n other_o than_o such_o as_o shall_v be_v invite_v by_o any_o traveller_n &_o shall_v accompany_v he_o during_o his_o necessary_a abode_n there_o and_o other_o then_o labour_v and_o handicraftsman_n in_o city_n and_o town_n corporate_a and_o market_n town_n upon_o the_o usual_a work_a day_n for_o one_o hour_n at_o dinner_n time_n to_o take_v their_o diet_n in_o a_o alehouse_n and_o other_o than_o labourer_n and_o workman_n which_o for_o the_o follow_v of_o their_o work_n by_o the_o day_n or_o by_o the_o distress_n if_o a_o alehousekeeper_n suffer_v a_o dweller_n of_o the_o town_n or_o village_n where_o the_o inn_n or_o alehouse_n be_v to_o continue_v drink_v there_o but_o such_o as_o shall_v be_v invite_v by_o a_o traveller_n he_o shall_v for_o every_o offence_n forfeit_v 10._o s_o to_o the_o poor_a such_o offence_n be_v see_v by_o any_o major_n or_o justice_n or_o prove_v by_o oath_n of_o two_o witness_n to_o be_v take_v by_o such_o major_a or_o justice_n 21._o jac._n 7._o one_o witness_n be_v to_o be_v take_v if_o he_o sell_v less_o than_o a_o ale-quart_n of_o the_o best_a bear_n or_o ale_n for_o a_o penny_n and_o 2._o quart_n of_o the_o small_a he_o shall_v forfeit_v 20._o s._n to_o the_o poor_a for_o every_o offence_n prove_v as_o above_o limit_a the_o say_v penalty_n to_o be_v leyy_v by_o the_o constable_n and_o ch._n warden_n by_o distress_n great_a in_o any_o city_n town_n corporate_a market_n town_n or_o offence_n forfeit_a and_o lose_v the_o sum_n of_o ten_o shilling_n of_o currant_n money_n of_o england_n to_o the_o use_n of_o the_o poor_a of_o the_o parish_n where_o such_o offence_n shall_v be_v commit_v the_o same_o offence_n be_v view_v and_o see_v by_o any_o major_n bailiff_n or_o justice_n of_o peace_n within_o their_o several_a limit_n or_o prove_v by_o the_o oath_n of_o two_o witness_n that_o the_o chancellor_n master_n and_o scholar_n and_o the_o successor_n of_o they_o and_o either_o of_o they_o may_v as_o full_o use_v and_o enjoy_v all_o their_o jurisdiction_n right_n privilege_n for_o the_o same_o offence_n present_v indict_v or_o convict_v within_o six_o month_n after_o such_o offence_n commit_v this_o act_n to_o continue_v until_o the_o end_n of_o the_o first_o session_n of_o the_o next_o parliament_n 21._o jac._n 7._o make_v perpetual_a anno_fw-la septimo_fw-la jacobi_n regis_fw-la cap._n x._o the_o penalty_n for_o a_o offence_n commit_v against_o any_o of_o the_o person_n so_o confess_v shall_v and_o may_v be_v take_v by_o such_o as_o by_o the_o say_a act_n have_v authority_n to_o minister_v a_o oath_n and_o shall_v be_v a_o sufficient_a proof_n against_o
