be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n and_o chattel_n or_o in_o case_n of_o the_o poverty_n of_o such_o offender_n levy_v upon_o the_o good_n and_o chattel_n of_o any_o other_o person_n or_o person_n who_o shall_v then_o be_v convict_v in_o manner_n aforesaid_a of_o the_o like_a offence_n at_o the_o same_o conventicle_n at_o the_o discretion_n of_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o so_o as_o the_o sum_n to_o be_v levy_v or_o any_o one_o person_n in_o case_n of_o the_o poverty_n of_o other_o offender_n amount_v not_o his_o name_n and_o habitation_n not_o know_v or_o be_v flee_v and_o can_v be_v find_v or_o in_o the_o judgement_n of_o the_o justice_n justice_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v shall_v be_v think_v unable_a to_o pay_v the_o same_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o be_v hereby_o empower_v and_o require_v to_o levy_v the_o 4._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a house_n that_o every_o person_n who_o shall_v witting_o and_o willing_o suffer_v any_o such_o conventicle_n meet_v or_o unlawful_a assembly_n aforesaid_a to_o be_v hold_v in_o his_o or_o her_o house_n outhouse_n barn_n yard_n or_o backside_n and_o be_v convict_v thereof_o in_o manner_n aforesaid_a shall_v forseit_v the_o sum_n of_o 20_o l._n to_o be_v levy_v in_o manner_n aforesaid_a upon_o his_o or_o her_o good_n and_o chattel_n or_o in_o case_n of_o he_o or_o her_o povetry_n or_o inability_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o such_o persous_a who_o shall_v be_v convict_v in_o manner_n aforesaid_a of_o be_v present_a at_o the_o same_o conventicle_n and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a 5._o provide_v always_o proviso_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n shall_v by_o any_o clause_n of_o this_o act_n be_v liable_a to_o pay_v above_o 10_o l._n for_o any_o one_o meet_v in_o regard_n of_o the_o poverty_n of_o any_o other_o person_n or_o person_n 6._o provide_v also_o and_o be_v it_o further_o enact_v that_o in_o all_o case_n of_o this_o act_n where_o the_o penalty_n or_o sum_n charge_v upon_o any_o offender_n exceed_v the_o sum_n of_o 10_o s._n case_n and_o such_o offender_n shall_v find_v himself_o aggrieve_v it_o shall_v and_o may_v be_v lawful_a for_o he_o within_o one_o week_n after_o the_o say_a penalty_n or_o money_n charge_v shall_v be_v pay_v or_o levy_v to_o appeal_n in_o write_v from_o the_o person_n or_o person_n convict_v to_o the_o judgement_n of_o the_o justice_n of_o the_o peace_n in_o their_o next_o quarter_n session_n to_o who_o the_o justice_n or_o justice_n of_o peace_n chief_a magistrate_n or_o alderman_n that_o first_o convict_v such_o offender_n shall_v return_v the_o money_n levy_v upon_o the_o appellant_n and_o shall_v certify_v under_o his_o and_o their_o hand_n and_o seal_n the_o evidence_n upon_o which_o the_o conviction_n past_a with_o the_o whole_a record_n thereof_o and_o the_o say_a appeal_n whereupon_o such_o offender_n may_v plead_v and_o make_v defence_n and_o have_v his_o trial_n by_o a_o jury_n thereupon_o and_o in_o cafe_z such_o appellant_n shall_v not_o prosecute_v with_o effect_n or_o if_o upon_o such_o trial_n he_o shall_v not_o be_v acquit_v or_o judgement_n pass_v not_o for_o he_o upon_o his_o say_a appeal_n the_o say_a justice_n at_o the_o session_n shall_v give_v treble_a cost_v again_o such_o offender_n for_o his_o unjust_a appeal_n and_o no_o other_o court_n whatsoever_o shall_v intermeddle_v with_o any_o cause_n or_o cause_n of_o appeal_n upon_o this_o act_n but_o they_o shall_v be_v final_o determine_v in_o the_o quarter_n session_n only_o recognizance_n 7._o provide_v always_o and_o be_v it_o further_o enact_v that_o upon_o the_o delivery_n of_o such_o appeal_n as_o aforesaid_a the_o person_n or_o person_n appellant_n shall_v enter_v before_o the_o person_n or_o person_n convict_v into_o a_o recognizance_n to_o present_v the_o say_a appeal_n with_o effect_n which_o say_v recognizance_n the_o person_n or_o person_n convict_v be_v hereby_o empower_v to_o take_v and_o require_v to_o certify_v the_o same_o to_o the_o next_o quarter_n session_n and_o in_o case_n no_o such_o recognizance_n be_v enter_v into_o the_o say_a appeal_n to_o be_v null_n and_o void_a 8._o provide_v always_o that_o every_o such_o appeal_n shall_v be_v leave_v with_o the_o person_n or_o person_n so_o convict_v as_o aforesaid_a at_o the_o time_n of_o the_o make_v thereof_o 9_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a doâ—rs_n that_o the_o justice_n justices_z of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n head-borough_n and_o tything_n man_n by_o warrant_n from_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o shall_v and_o may_v with_o what_o aid_n force_n and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o
any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v as_o well_o within_o liberty_n as_o without_o and_o take_v into_o their_o custody_n the_o person_n there_o unlawful_o assemble_v to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n and_o that_o the_o lieutenant_n or_o deputy-licutenants_a or_o any_o commissionated_a officer_n of_o the_o militia_n or_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n and_o foot_n and_o also_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n foot_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o barwick_n upon_o tweed_n with_o such_o other_o assistance_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v to_o dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n 10._o provide_v always_o realm_n that_o no_o dwell_a house_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v then_o be_v resident_a shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majessiy_a under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v 11._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a act._n that_o if_o any_o constable_n headborough_z tythingman_n church-wardon_a or_o overfeer_v of_o the_o poor_a who_o shall_v know_v â—r_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precinct_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n headborough_z tythingman_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o aid_n of_o the_o constable_n headborough_z or_o tything-man_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o 5_o l._n to_o be_v levy_v upon_o his_o good_n and_o chattel_n and_o dispose_v in_o manner_n aforesaid_a and_o that_o if_o any_o justice_n of_o the_o peace_n or_o chief_a magistrate_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n he_o shall_v forfeit_v the_o sum_n of_o 100_o l._n the_o one_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v lie_v 12_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a execution_n that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_a issue_n and_o give_v the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o vordict_n pass_v for_o the_o defendant_n or_o if_o the_o plaintiff_n discontinue_v his_o action_n or_o if_o upon_o demur_n judgement_n be_v give_v for_o the_o desendant_n every_o such_o desendant_n shall_v have_v his_o full_a treble_n cost_v 13._o and_o be_v it_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o peace_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v as_o aforesaid_a shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_v to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n of_o such_o county_n or_o corporation_n wherein_o the_o say_a person_n or_o person_n be_v inhabitant_n or_o be_v flee_v into_o which_o say_v justice_n or_o chief_a magistrate_n respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n as_o full_o as_o the_o say_v other_o justice_n of_o peace_n may_v have_v do_v in_o case_n he_o or_o they_o have_v be_v inhabitant_n in_o the_o place_n wlfere_o the_o offence_n be_v commit_v 14._o provide_v also_o elsewhere_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n unless_o such_o offender_n be_v profecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o 15._o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liberty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o fame_n power_n and_o authority_n within_o london_n and_o the_o liberty_n thereof_o for_o the_o examine_n convict_a and_o punish_v of_o crown_n of_o this_o realm_n or_o to_o that_o end_n or_o purpose_n shall_v advise_o or_o malicious_o move_v or_o persuade_v any_o other_o person_n whatsoever_o to_o forbear_v or_o abstain_v from_o come_v to_o church_n to_o hear_v divine_a service_n or_o to_o receive_v the_o communion_n according_a to_o her_o majesty_n law_n and_o statute_n aforesaid_a or_o to_o come_v to_o or_o to_o be_v present_a at_o any_o unlawful_a assembly_n conventicle_n or_o meeting_n under_o colour_n or_o pretence_n of_o any_o exercise_n of_o religion_n contrary_a to_o her_o majesty_n say_v law_n and_o statute_n or_o if_o any_o person_n or_o person_n which_o shall_v obstinate_o refuse_v to_o repair_v to_o some_o church_n chappel_n or_o usual_a place_n of_o common_a prayer_n and_o shall_v forbear_v by_o the_o space_n of_o a_o month_n to_o hear_v divine_a service_n as_o be_v aforesaid_a shall_v after_o the_o say_v forty_o day_n either_o of_o he_o or_o themselves_o or_o by_o the_o motion_n persuasion_n entertainment_n or_o allurement_n of_o any_o other_o willing_o join_v in_o or_o be_v present_a at_o any_o such_o assembly_n conventicle_n or_o meeting_n under_o colour_n or_o pretence_n of_o any_o such_o exercise_n of_o religion_n contrary_n to_o the_o law_n and_o statute_n of_o this_o realm_n as_o be_v aforesaid_a that_o then_o every_o such_o person_n so_o offend_v as_o aforesaid_a and_o be_v thereof_o lawful_o convict_v shall_v be_v commit_v to_o prison_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o they_o shall_v conform_v and_o yield_v themselves_o to_o come_v to_o some_o church_n chappel_n or_o usual_a place_n of_o common_a prayer_n and_o hear_v divine_a service_n according_a to_o her_o majesty_n law_n and_o statute_n aforesaid_a and_o to_o make_v such_o open_a submission_n and_o declaration_n of_o their_o say_a conformity_n as_o hereafter_o in_o this_o act_n be_v declare_v and_o appoint_v provide_v always_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o such_o person_n or_o person_n which_o shall_v offend_v against_o this_o act_n as_o aforesaid_a shall_v not_o within_o three_o month_n next_o after_o they_o shall_v be_v convict_v for_o their_o say_a offence_n conform_v themselves_o to_o the_o obedience_n of_o the_o law_n and_o statute_n of_o this_o realm_n in_o come_v to_o the_o church_n to_o hear_v divine_a service_n and_o in_o make_v such_o public_a confession_n and_o submission_n as_o hereafter_o in_o this_o act_n be_v appoint_v and_o express_v be_v thereunto_o require_v by_o the_o bishop_n of_o the_o diocese_n or_o any_o justice_n of_o the_o peace_n of_o the_o county_n where_o the_o same_o person_n shall_v happen_v to_o be_v or_o by_o the_o minister_n or_o curate_n of_o the_o parish_n that_o in_o every_o such_o case_n every_o such_o offender_n be_v thereunto_o warn_v &_o require_v by_o any_o justice_n of_o the_o peace_n of_o the_o same_o county_n where_o such_o offender_n shall_v then_o be_v shall_v upon_o his_o and_o their_o corporal_a oath_n before_o the_o justice_n of_o the_o peace_n in_o the_o open_a quarter_n session_n of_o the_o same_o county_n or_o at_o the_o assize_n and_o gaol-delivery_n of_o the_o same_o county_n before_o the_o justice_n of_o the_o same_o assize_n and_o gaol_n delivery_n abjure_v abjure_v this_o realm_n of_o england_n and_o all_o other_o the_o queen_n majesty_n dominion_n for_o ever_o unless_o her_o majesty_n shall_v licence_v the_o party_n to_o return_v and_o thereupon_o shall_v depart_v out_o of_o this_o realm_n at_o such_o haven_n or_o port_n and_o within_o such_o time_n as_o shall_v in_o that_o behalf_n be_v assign_v and_o appoint_v by_o the_o say_a justice_n before_o who_o such_o abjuration_n shall_v be_v make_v unless_o the_o same_o offender_n be_v let_v or_o stay_v by_o such_o lawful_a and_o reasonable_a mean_n or_o cause_n as_o by_o the_o common_a law_n of_o this_o realm_n be_v permit_v and_o allow_v in_o case_n of_o abjuration_n for_o felony_n and_o in_o such_o case_n of_o let_v or_o stay_v then_o within_o such_o reasonable_a and_o convenient_a time_n after_o as_o the_o common_a law_n require_v in_o case_n of_o abjuration_n for_o felony_n as_o be_v aforesaid_a and_o that_o the_o justice_n of_o peace_n before_o who_o any_o such_o abjuration_n shall_v happen_v to_o be_v make_v as_o be_v aforesaid_a shall_v cause_v the_o same_o present_o to_o be_v enter_v of_o record_n before_o they_o and_o shall_v certify_v the_o same_o to_o the_o justice_n of_o assize_n and_o gaol_n delivery_n of_o the_o say_a county_n at_o the_o next_o assize_n or_o gaol-delivery_n to_o be_v hold_v in_o the_o same_o county_n and_o if_o any_o such_o offender_n which_o by_o the_o tenor_n and_o intent_n of_o this_o act_n be_v to_o be_v abjure_v as_o be_v aforesaid_a shall_v refuse_v to_o make_v such_o abjuration_n as_o be_v aforesaid_a or_o after_o such_o abjuration_n make_v shall_v not_o go_v to_o such_o haven_n and_o within_o such_o time_n as_o be_v before_o appoint_v and_o from_o thence_o depart_v out_o of_o this_o realm_n according_a to_o this_o present_a act_n or_o after_o such_o his_o departure_n shall_v return_v or_o come_v again_o into_o any_o her_o majesty_n realm_n or_o dominion_n without_o her_o majesty_n special_a licence_n in_o that_o behalf_n first_o have_v and_o obtain_v that_o then_o in_o every_o such_o case_n the_o person_n so_o offend_v shall_v be_v adjudge_v a_o felon_n and_o shall_v suffer_v as_o in_o case_n of_o felony_n without_o benefit_n of_o clergy_n and_o furthermore_o be_v it_o enact_v by_o the_o authority_n of_o this_o present_a
of_o parliament_n be_v make_v touch_v the_o continuance_n or_o discontinuance_n of_o the_o say_a statute_n and_o act_n in_o the_o say_a act_n of_o the_o three_o year_n of_o his_o majesty_n reign_n continue_v as_o aforesaid_a and_o from_o this_o statute_n we_o find_v nothing_o of_o the_o 35_o eliz._n cap._n 1._o till_o we_o come_v to_o the_o 16_o of_o his_o now_o majesty_n and_o that_o act_n i_o have_v recite_v here_o at_o large_a as_o follow_v viz._n a_o act_n to_o suppress_v seditious_a conventicle_n whereas_o a_o act_n make_v in_o the_o 35th_o 4._o year_n of_o the_o reign_n of_o our_o late_a sovereign_a lady_n the_o queen_n elizabeth_n sectary_n entitle_v a_o act_n to_o retain_v the_o queen_n majesty_n subject_n in_o their_o due_a obedience_n have_v not_o be_v put_v in_o execution_n by_o reason_n of_o some_o doubt_n of_o late_o make_v whether_o the_o say_a act_n be_v still_o in_o force_n although_o it_o be_v very_o clear_a and_o evident_a and_o it_o be_v hereby_o declare_v that_o the_o say_a act_n be_v still_o in_o force_n and_o aught_o to_o be_v put_v in_o due_a execution_n 2._o for_o provide_v therefore_o of_o further_a and_o more_o speedy_a remedy_n against_o the_o grow_a and_o dangerous_a practice_n of_o seditious_a sectary_n and_o other_o disloyal_a person_n who_o under_o pretence_n of_o tender_a conscience_n do_v at_o their_o meeting_n contrive_v insurrection_n as_o late_a experience_n have_v show_v 3._o be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n forbid_v by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o authority_n of_o the_o same_o that_o if_o any_o person_n of_o the_o age_n of_o 16_o year_n or_o upward_o be_v a_o subject_a of_o this_o realm_n at_o any_o time_n after_o the_o first_o day_n of_o july_n which_o shall_v be_v in_o the_o year_n of_o our_o lord_n 1664_o shall_v be_v present_a at_o any_o assembly_n conventicle_n or_o meet_v under_o colour_n or_o pretence_n of_o any_o exercise_n of_o religion_n in_o other_o manner_n than_o be_v allow_v by_o the_o liturgy_n or_o practice_n of_o the_o church_n of_o england_n in_o any_o place_n within_o the_o kingdom_n of_o england_n dominion_n of_o wales_n and_o town_n of_o berwick_n upon_o tweed_n at_o which_o conventicle_n meet_v or_o assembly_n there_o shall_v be_v five_o person_n or_o more_o assemble_v together_o over_z and_o above_o those_o of_o the_o same_o household_n than_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o two_o justice_n of_o the_o peace_n of_o the_o county_n limit_v division_n or_o liberty_n wherein_o the_o offence_n aforesaid_a shall_v be_v commit_v or_o for_o the_o chief_a magistrate_n of_o the_o place_n where_o such_o offence_n aforesaid_a shall_v be_v commit_v if_o it_o be_v within_o a_o corporation_n where_o there_o be_v not_o two_o justice_n of_o the_o peace_n and_o they_o be_v hereby_o require_v and_o enjoin_v offence_n upon_o proof_n to_o they_o or_o he_o respective_o make_v of_o such_o offence_n either_o by_o confession_n of_o the_o party_n or_o oath_n of_o witness_n or_o notorious_a evidence_n of_o the_o fact_n which_o oath_n the_o say_a justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o be_v hereby_o impower_v and_o require_v to_o administer_v to_o make_v a_o record_n of_o every_o such_o offence_n and_o offence_n under_o their_o hand_n and_o seal_n respective_o which_o record_n so_o make_v as_o aforesaid_a shall_v to_o all_o intent_n and_o purpose_n be_v in_o law_n take_v and_o adjudge_v to_o be_v a_o full_a and_o perfect_a conviction_n of_o every_o such_o offender_n for_o such_o offence_n and_o thereupon_o the_o say_a justice_n and_o chief_a magistrate_n respective_o shall_v commit_v every_o such_o offender_n so_o convict_v as_o aforesaid_a to_o the_o gaol_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n for_o any_o time_n not_o exceed_v the_o space_n of_o three_o month_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_v 5_o l._n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v shall_v fine_v the_o say_a offender_n at_o for_o his_o or_o her_o say_a offence_n which_o money_n shall_v be_v pay_v to_o the_o churchwarden_n for_o the_o relief_n of_o the_o poor_a of_o the_o parish_n where_o such_o offender_n do_v last_o inhabit_v 4._o offence_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n contrary_a to_o this_o act_n and_o be_v thereof_o in_o manner_n aforesaid_a convict_v than_o such_o offender_n so_o convict_v of_o such_o second_o offence_n shall_v incur_v the_o penalty_n of_o imprisonment_n in_o the_o gaol_n or_o house_n of_o correction_n for_o any_o time_n not_o exceed_v six_o month_n without_o bail_n or_o mainprize_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o say_a justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_v 10_o l._n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v thereunto_o authorize_v and_o require_v as_o aforesaid_a shall_v fine_v the_o say_a offender_n at_o for_o his_o or_o her_o say_v second_o offence_n the_o say_v fine_a to_o be_v dispose_v in_o manner_n aforesaid_a 5._o offence_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o such_o offender_n so_o convict_v of_o a_o second_o offence_n contrary_a to_o this_o act_n in_o manner_n aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n contrary_a to_o this_o act_n than_o any_o two_o justice_n of_o the_o peace_n and_o chief_a magistrate_n as_o aforesaid_a respective_o shall_v commit_v every_o such_o offender_n to_o the_o gaol_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o the_o next_o general_n quarter_n session_n assizes_n gaol-delivery_n great_a session_n or_o sit_v of_o any_o commission_n of_o oyer_n and_o terminer_n in_o the_o respective_a county_n limit_v division_n or_o liberty_n which_o shall_v first_o happen_v when_o and_o where_o every_o such_o offender_n shall_v be_v proceed_v against_o by_o indictment_n for_o such_o offence_n and_o shall_v forthwith_o be_v arraign_v upon_o such_o indictment_n and_o shall_v then_o plead_v the_o general_n issue_n of_o not_o guilty_a and_o give_v any_o special_a matter_n in_o evidence_n or_o confess_v the_o indictment_n and_o if_o such_o offender_n proceed_v against_o shall_v be_v lawful_o convict_v of_o such_o offence_n either_o by_o confession_n or_o verdict_n or_o if_o such_o offender_n shall_v refuse_v to_o plead_v the_o general_n issue_n or_o to_o confess_v the_o indictment_n then_o the_o respective_a justice_n of_o the_o peace_n at_o their_o general_n quarter_n session_n judge_n of_o assize_n and_o gaol-delivery_n at_o the_o assize_n and_o gaol-delivery_n justice_n of_o the_o great_a session_n at_o the_o great_a session_n and_o commissioner_n of_o oyer_n and_o terminer_n at_o their_o sit_v be_v hereby_o enable_v and_o require_v to_o cause_n judgement_n to_o be_v enter_v against_o such_o offender_n that_o such_o offender_n shall_v be_v transport_v beyond_o the_o sea_n to_o any_o of_o his_o majesty_n foreign_a plantation_n virginia_n and_o new_a engl._n only_o except_v there_o to_o remain_v seven_o year_n and_o shall_v forthwith_o under_o their_o hand_n and_o seal_n make_v out_o warrant_v to_o the_o sheriff_n or_o sheriff_n of_o the_o same_o county_n where_o such_o conviction_n or_o refusal_n to_o plead_v or_o to_o confess_v as_o aforesaid_a shall_v be_v safe_o to_o convey_v such_o offender_n to_o some_o port_n or_o haven_n near_o or_o most_o commodious_a to_o be_v appoint_v by_o they_o respective_o and_o from_o thence_o to_o embark_v such_o offender_n to_o be_v safe_o transport_v to_o any_o of_o his_o majesty_n plantation_n beyond_o the_o sea_n as_o shall_v be_v also_o by_o they_o respective_o appoint_v virginia_n and_o new_a england_n only_o except_v whereupon_o the_o say_a sheriff_n shall_v safe_o convey_v and_o embark_v or_o cause_n to_o be_v convey_v or_o embark_v such_o offender_n to_o be_v transport_v as_o aforesaid_a under_o pain_n of_o forfeit_v for_o default_n of_o so_o transport_v every_o such_o offender_n the_o sum_n of_o 40_o l._n of_o lawful_a money_n the_o one_o moiety_n thereof_o to_o the_o king_n and_o the_o other_o moiety_n to_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o in_o any_o of_o the_o king_n court_n of_o record_n by_o bill_n plaint_n action_n of_o debt_n or_o information_n in_o any_o of_o which_o no_o wager_n of_o law_n essoin_fw-fr or_o protection_n shall_v be_v admit_v and_o the_o say_v respective_a court_n shall_v
then_o also_o make_v out_o warrant_v to_o the_o several_a constable_n head-borough_n or_o tythingman_n of_o the_o respective_a place_n where_o the_o estate_n real_a or_o personal_a of_o such_o offender_n to_o be_v transport_v shall_v happen_v to_o be_v command_v they_o thereby_o to_o sequester_v into_o their_o hand_n the_o profit_n of_o the_o land_n and_o to_o distrain_v and_o sell_v the_o good_n of_o the_o offender_n so_o to_o be_v transport_v for_o the_o reimburse_n of_o the_o say_a sheriff_n and_o such_o reasonable_a charge_n as_o he_o shall_v be_v at_o and_o shall_v be_v allow_v he_o by_o the_o say_v respective_a court_n for_o such_o convey_n and_o embarque_a of_o such_o offender_n so_o to_o be_v transport_v render_v to_o the_o party_n or_o he_o or_o her_o assign_v the_o overplus_n of_o the_o same_o if_o any_o be_v unless_o such_o offender_n or_o some_o other_o on_o the_o behalf_n of_o such_o offender_n so_o to_o be_v transport_v shall_v give_v the_o sheriff_n such_o surety_n as_o he_o shall_v approve_v of_o for_o the_o pay_v all_o the_o say_a charge_n unto_o he_o 6._o transport_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o in_o default_n of_o defray_v such_o charge_n by_o the_o party_n to_o be_v transport_v or_o some_o other_o in_o their_o behalf_n or_o in_o default_n of_o security_n give_v to_o the_o sheriff_n as_o aforesaid_a it_o shall_v and_o may_v be_v lawful_a for_o every_o such_o sheriff_n to_o contract_n with_o any_o master_n of_o a_o ship_n merchant_n or_o other_o person_n for_o the_o transport_v of_o such_o offender_n at_o the_o best_a rate_n he_o can_v and_o that_o in_o every_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o such_o person_n so_o contract_v with_o any_o sheriff_n for_o transport_v such_o offender_n as_o aforesaid_a to_o detain_v and_o employ_v every_o such_o offender_n so_o by_o they_o transport_v as_o a_o labourer_n to_o they_o or_o their_o assign_v for_o the_o space_n of_o five_o year_n to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o she_o be_v bind_v by_o indenture_n to_o such_o person_n for_o that_o purpose_n and_o that_o the_o respective_a sheriff_n shall_v be_v allow_v or_o pay_v from_o the_o king_n upon_o their_o respective_a account_n in_o the_o exchequer_n all_o such_o charge_n by_o they_o expend_v for_o convey_v embarque_a and_o transport_v of_o such_o person_n which_o shall_v be_v allow_v by_o the_o say_v respective_a court_n from_o whence_o they_o receive_v their_o respective_a warrant_n and_o which_o shall_v not_o have_v be_v by_o any_o of_o the_o way_n aforementioned_a pay_v secure_v or_o reimburse_v unto_o they_o as_o aforesaid_a vii_o pâ—und_n provide_v always_o and_o be_v it_o further_o enact_v that_o in_o case_n the_o offender_n so_o indict_v and_o convict_v for_o the_o say_v three_o offence_n shall_v pay_v into_o the_o hand_n of_o the_o register_n or_o cler_n of_o the_o coart_n or_o session_n where_o he_o shall_v be_v convict_v before_o the_o say_a court_n or_o session_n shall_v be_v end_v the_o sum_n of_o 10_o l._n that_o then_o the_o say_a offender_n shall_v be_v discharge_v from_o transportation_n and_o the_o judgement_n for_o the_o same_o 8._o offence_n and_o be_v it_o further_o enact_v that_o the_o like_a imprisonment_n indictment_n arraignment_n and_o proceed_n shall_v be_v against_o every_o such_o offender_n as_o often_o as_o he_o shall_v again_o offer_v after_o such_o three_o offence_n nevertheless_o be_v dischargeable_a and_o discharge_v by_o the_o payment_n of_o the_o like_a sum_n as_o be_v pay_v by_o such_o offender_n for_o he_o or_o her_o say_a offence_n next_o before_o commit_v together_o with_o the_o additional_a and_o increase_v sum_n of_o 100_o l._n dispose_v more_o upon_o every_o new_a offence_n commit_v the_o say_v respective_a sum_n to_o be_v pay_v as_o aforesaid_a and_o to_o be_v dispose_v of_o as_o follow_v viz._n the_o one_o moiety_n for_o the_o repair_n of_o the_o parish-church_n or_o church_n chappel_n or_o chapel_n of_o such_o parish_n within_o which_o such_o conventicle_n assembly_n or_o meeting_n shall_v be_v hold_v and_o the_o other_o moiety_n to_o the_o repair_n of_o the_o highway_n of_o the_o say_a parish_n or_o parish_n if_o need_v require_v or_o otherwise_o for_o the_o amendment_n of_o such_o high_a way_n as_o the_o justice_n of_o the_o peace_n at_o their_o respective_a quarter-session_n shall_v direct_v and_o appoint_v and_o if_o any_o constable_n head_n orough_n or_o tythingman_n shall_v neglect_v to_o execute_v any_o the_o say_a warrant_n make_v unto_o they_o for_o sequester_v distrain_v and_o sell_v any_o of_o the_o good_n and_o chattel_n of_o any_o offender_n against_o this_o act_n for_o the_o levy_v such_o sum_n of_o money_n as_o shall_v be_v impose_v for_o the_o first_o or_o second_o offence_n he_o shall_v forfeit_v for_o every_o such_o neglect_n the_o sum_n of_o 5_o l._n of_o lawful_a money_n of_o england_n the_o one_o moiety_n thereof_o to_o the_o king_n and_o the_o other_o moiety_n to_o he_o that_o will_v sue_v for_o the_o same_o in_o any_o of_o the_o king_n court_n of_o record_n as_o aforesaid_a and_o if_o any_o person_n be_v at_o any_o time_n suâ—d_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n transportation_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n thereupon_o or_o if_o the_o plaintiff_n discontinue_v his_o action_n or_o if_o upon_o demurrer_n judgement_n be_v give_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o or_o their_o treble_n cost_v 9_o and_o be_v it_o further_o enact_v that_o if_o any_o person_n against_o who_o judgement_n of_o transportation_n shall_v be_v give_v in_o manner_n aforesaid_a shall_v make_v escape_n before_o transportation_n or_o be_v transport_v as_o aforesaid_a shall_v return_v unto_o this_o realm_n of_o england_n dominion_n of_o wales_n and_o town_n of_o barwick_n upon_o tweed_n without_o the_o special_a licence_n of_o his_o majesty_n his_o heir_n and_o successor_n in_o that_o behalf_n first_o have_v and_o obtain_v that_o the_o party_n so_o escape_v or_o return_v shall_v be_v adjudge_v a_o felon_n and_o shall_v suffer_v death_n as_o in_o case_n of_o felony_n without_o benefit_n of_o clergy_n and_o shall_v forfeit_v and_o loose_a to_o his_o majesty_n all_o his_o or_o her_o good_n and_o chattel_n for_o ever_o and_o shall_v further_o loose_v to_o his_o majesty_n all_o his_o or_o her_o good_n and_o chattel_n land_n tenement_n and_o hereditament_n for_o and_o during_o the_o life_n of_o such_o offender_n and_o no_o long_o and_o that_o the_o wife_n of_o any_o such_o offender_n by_o force_n of_o this_o act_n shall_v not_o lose_v her_o dower_n nor_o shall_v any_o corruption_n of_o may_v after_o the_o death_n of_o such_o offender_n have_v and_o enjoy_v the_o land_n tenement_n and_o hereditament_n of_o such_o offender_n as_o if_o this_o act_n have_v not_o be_v make_v 10._o conventicle_n and_o for_o better_a prevent_v of_o the_o mischief_n which_o may_v grow_v by_o such_o seditious_a and_o tumultuous_a meeting_n under_o pretence_n of_o religious_a worship_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o lieutenant_n or_o debuty-lieutenant_n or_o any_o commissioned_n officer_n of_o the_o militia_n or_o any_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n or_o foot_n and_o also_o the_o sheriff_n and_o justice_n of_o peace_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n as_o aforesaid_a of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v or_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v to_o dissolve_v and_o dissipate_v or_o
prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o of_o those_o person_n so_o unlawful_o assemble_v as_o they_o shall_v judge_n to_o be_v the_o leader_n and_o seducer_n of_o the_o rest_n and_o such_o other_o as_o they_o shall_v think_v fit_a to_o be_v proceed_v against_o according_a to_o law_n for_o such_o their_o offence_n 11._o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n who_o shall_v witting_o and_o willing_o suffer_v any_o such_o conveticle_n house_n unlawful_a assembly_n or_o meet_v aforesaid_a to_o be_v hold_v in_o his_o or_o her_o house_n outhouse_n barn_n or_o room_n yard_n or_o backside_n wood_n or_o ground_n shall_v incur_v the_o same_o penalty_n and_o forfeiture_n as_o any_o other_o offender_n against_o this_o act_n ought_v to_o incur_v and_o be_v proceed_v against_o in_o all_o point_n in_o such_o manner_n as_o any_o other_o offender_n against_o this_o act_n ought_v to_o be_v proceed_v agianst_a 12._o provide_v also_o and_o be_v it_o enact_v by_o the_o authhrity_n aforesaid_a that_o if_o any_o keeper_n of_o any_o goal_n or_o house_n of_o correction_n large_a shall_v suffer_v any_o person_n commit_v to_o his_o custody_n for_o any_o offence_n against_o this_o act_n to_o go_v at_o large_a contrary_a to_o the_o warrant_n of_o his_o commitment_n according_a to_o this_o act_n or_o shall_v permit_v any_o person_n who_o be_v at_o large_a to_o join_v with_o any_o person_n commit_v to_o his_o custody_n by_o virtue_n of_o this_o act_n in_o the_o exercise_n of_o religion_n disfer_v from_o the_o rite_n of_o the_o church_n of_o england_n then_o every_o such_o keeper_n of_o a_o goal_n or_o house_n of_o correction_n shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o 10._o penalty_n l._n to_o be_v levy_v raise_v and_o dispose_v by_o such_o person_n and_o in_o such_o manner_n as_o the_o penalty_n for_o the_o first_o and_o second_o offence_n against_o this_o act_n be_v to_o be_v levy_v raise_v and_o dispose_v 13._o provide_v always_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n prosecute_v unless_o such_o offender_n be_v prosecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o 14._o provide_v also_o and_o be_v it_o enact_v punish_v that_o judgement_n of_o transportation_n shall_v not_o be_v give_v against_o any_o feme_fw-fr covert_n unless_o her_o husband_n be_v at_o the_o same_o time_n under_o the_o like_a judgement_n and_o not_o discharge_v by_o the_o payment_n of_o money_n as_o aforesaid_a but_o that_o instead_o thereof_o she_o shall_v by_o the_o respective_a court_n be_v commit_v to_o the_o goal_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n for_o any_o time_n not_o exceed_v 12_o month_n unless_o her_o husband_n shall_v pay_v down_o such_o sum_n not_o exceed_v 40_o l._n to_o redeem_v she_o from_o think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v 16._o provide_v peer_n that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n while_o he_o or_o his_o wife_n shall_v be_v there_o resident_n shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o prefence_n of_o the_o lieutenant_n or_o one_o of_o the_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v nor_o shall_v any_o other_o dwellinghouse_n of_o any_o peer_n or_o other_o person_n whatsoever_o be_v enter_v into_o with_o force_n by_o virtue_n of_o this_o act_n but_o in_o the_o presence_n of_o one_o justice_n into_o as_o aforesaid_a in_o the_o presence_n of_o one_o justice_n of_o the_o peace_n alderman_n deputy-alderman_n or_o any_o one_o commissoner_n for_o the_o lieutenancy_n for_o the_o city_n of_o london_n 17._o provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a correction_n that_o no_o person_n shall_v by_o virtue_n of_o this_o act_n be_v commit_v to_o the_o house_n of_o correction_n that_o shall_v satisfy_v the_o say_a justice_n of_o the_o peace_n or_o chief_a magistrate_n respective_o that_o he_o or_o she_o and_o in_o case_n of_o a_o feme_fw-fr covert_n that_o her_o husband_n have_v a_o estate_n of_o freehold_n or_o copyhold_n to_o the_o value_n of_o 5_o l._n per_fw-la annum_fw-la or_o personal_a estate_n to_o the_o value_n of_o 50_o l._n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o 18._o and_o in_o regard_n a_o certain_a sect_n call_v quaker_n and_o other_o sectary_n be_v find_v not_o only_o to_o offend_v in_o the_o matter_n provide_v against_o by_o this_o act_n ca._n but_o also_o obstruct_v the_o proceed_n of_o justice_n by_o their_o obstinate_a refusal_n to_o take_v oath_n lawful_o tender_v unto_o they_o in_o the_o ordinary_a course_n of_o law_n therefore_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n be_v due_o and_o legal_o serve_v with_o process_n or_o other_o summons_n to_o appear_v in_o any_o court_n of_o record_n except_o court-leet_n as_o a_o witness_n or_o return_v to_o serve_v of_o any_o jury_n or_o order_v to_o be_v examine_v upon_o interrogatory_n or_o be_v present_a in_o court_n shall_v refuse_v to_o take_v any_o judicial_a oath_n legal_o tender_v to_o he_o by_o the_o judge_n or_o judge_n of_o the_o same_o court_n have_v no_o legal_a plea_n to_o justify_v or_o excuse_v the_o refusal_n of_o the_o same_o oath_n or_o if_o any_o person_n or_o person_n be_v due_o serve_v with_o process_n to_o answer_v any_o bill_n exhibit_v against_o he_o or_o they_o in_o any_o court_n of_o equity_n or_o any_o suit_n in_o any_o court_n ecclesiastical_a shall_v refuse_v to_o answer_v such_o bill_n or_o suit_n upon_o his_o or_o their_o corporal_a oath_n in_o case_n where_o the_o law_n require_v such_o answer_n to_o be_v put_v in_o upon_o oath_n or_o be_v summon_v to_o be_v a_o witness_n in_o any_o such_o court_n or_o order_v to_o be_v examine_v upon_o interrogatiory_n shall_v for_o any_o cause_n or_o reason_v not_o allow_v by_o law_n refuse_v to_o take_v such_o oath_n as_o in_o such_o case_n be_v require_v by_o law_n that_o then_o and_o in_o such_o case_n the_o several_a and_o respective_a court_n wherein_o such_o refusal_n shall_v be_v make_v shall_v be_v and_o be_v hereby_o enable_v to_o record_n enter_v or_o register_v such_o refusal_n which_o record_n or_o entry_n shall_v be_v and_o be_v hereby_o make_v a_o conviction_n of_o such_o offence_n and_o all_o and_o every_o person_n and_o person_n so_o aforesaid_a offend_v shall_v for_o every_o such_o offence_n incur_v the_o judgement_n and_o punishment_n of_o transportation_n in_o such_o manner_n as_o be_v appoint_v by_o this_o act_n for_o other_o offence_n 19_o provide_v always_o that_o if_o any_o person_n or_o person_n aforesaid_a shall_v come_v into_o such_o court_n and_o take_v he_o or_o their_o oath_n in_o these_o word_n i_o do_v swear_v acquit_v that_o i_o do_v not_o hold_v the_o take_n of_o a_o oath_n to_o be_v unlawful_a nor_o refuse_v to_o take_v a_o oath_n on_o that_o account_n 20._o which_o oath_n the_o respective_a court_n or_o court_n aforesaid_a be_v hereby_o authorize_v and_o require_v forthwith_o to_o tender_v administer_v and_o register_n before_o the_o entry_n of_o the_o conviction_n aforesaid_a or_o shall_v take_v such_o oath_n before_o some_o justice_n of_o the_o peace_n who_o be_v hereby_o authorize_v and_o require_v to_o administer_v the_o same_o to_o be_v return_v into_o such_o court_n such_o oath_n so_o acquit_v he_o or_o they_o from_o such_o punishment_n any_o thing_n herein_o to_o the_o contrary_a notwithstanding_o 21._o provide_v always_o that_o every_o person_n convict_v as_o aforesaid_a in_o court_n aforesaid_a other_o than_o his_o majesty_n court_n of_o kings-bench_n or_o before_o the_o justice_n of_o assize_n or_o general_a goal-delivery_n shall_v by_o warrant_n contain_v a_o it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o peer_n of_o this_o realm_n shall_v offend_v against_o this_o act_n he_o shall_v pay_v 10_o l._n for_o the_o first_o offence_n and_o 20_o l._n for_o the_o second_o offence_n to_o be_v levy_v upon_o his_o good_n and_o chattel_n by_o warrant_n from_o any_o two_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o the_o say_v three_o year_n and_o no_o long_o since_o this_o be_v finish_v i_o find_v in_o the_o london_n gazette_n publish_v thursday_n april_n 21._o 1681._o this_o paragraph_n viz._n to_o undeceive_v the_o subsidy_n grant_v by_o the_o spiritualty_n and_o temporalty_n hence_o a_o question_n arise_v 20_o jac._n whether_o 35_o eliz._n be_v not_o discontinue_v upon_o this_o ground_n that_o 18_o jac._n be_v a_o session_n by_o pass_v the_o subsidy_n act_n which_o be_v refer_v to_o all_o the_o judge_n nine_o of_o they_o be_v of_o opinion_n 35_o eliz._n with_o the_o other_o law_n continue_v 1_o jac._n be_v thereby_o discontinue_v to_o prevent_v which_o mischief_n the_o parliament_n 21_o jac._n not_o only_o revive_v 35_o eliz._n and_o those_o other_o law_n in_o all_o 58._o but_o enact_n that_o they_o
