deed_n be_v judge_v good_a for_o the_o prior_n can_v 118._o not_o seal_v with_o that_o seal_n in_o the_o custody_n of_o the_o other_o four_o and_o therefore_o that_o statute_n repugnant_a in_o itself_o and_o so_o void_a it_o be_v likewise_o declare_v by_o the_o judge_n 111._o that_o where_o a_o statute_n give_v power_n to_o a._n to_o determine_v all_o plea_n happen_v within_o his_o manor_n in_o that_o case_n a._n shall_v not_o have_v power_n to_o determine_v such_o plea_n as_o concern_v himself_o and_o the_o same_o it_o be_v if_o the_o statute_n shall_v in_o express_a word_n grant_v word_n that_o all_o patent_n from_o the_o king_n of_o that_o office_n of_o sheriff_n for_o year_n for_o life_n in_o tail_n or_o in_o fee_n shall_v be_v void_a any_o clause_n or_o word_n of_o non_fw-la obstante_fw-la put_v into_o such_o patent_n notwithstanding_o now_o thisstatute_n as_o to_o the_o king_n power_n be_v by_o the_o judge_n of_o the_o realm_n declare_v void_a and_o although_o that_o statute_n be_v never_o repeal_v all_o king_n since_o may_v have_v grant_v that_o office_n for_o life_n in_o tail_n or_o in_o fee_n and_o grant_v thereof_o have_v be_v make_v according_o contrary_v to_o the_o express_a word_n of_o that_o statute_n yet_o resolve_v to_o be_v good_a b._n and_o ever_o since_o that_o act_n all_o king_n have_v most_o frequent_o continue_v sheriff_n in_o their_o office_n for_o long_a time_n than_o a_o year_n even_o common_a experience_n show_v that_o the_o power_n of_o the_o old_a sheriff_n do_v not_o cease_v or_o determine_v until_o the_o king_n have_v make_v a_o new_a sheriff_n and_o notice_n thereof_o give_v to_o the_o old_a which_o oftentimes_o happen_v to_o be_v after_o the_o year_n and_o in_o michaelmas_n term_n 5._o and_o 6._o of_o queen_n 36._o eliz._n the_o sheriff_n by_o reason_n of_o the_o great_a plague_n then_o and_o of_o the_o adjournment_n of_o that_o term_n whole_o be_v make_v and_o name_v by_o the_o queen_n without_o the_o assembly_n of_o the_o justice_n in_o the_o exchequer_n according_a to_o the_o common_a usage_n and_o though_o for_o the_o most_o part_n none_o be_v name_v but_o one_o of_o the_o two_o which_o remain_v in_o the_o bill_n of_o the_o year_n than_o last_o pass_v yet_o by_o all_o the_o justice_n and_o sergeant_n at_o law_n it_o be_v hold_v that_o the_o queen_n by_o her_o prerogative_n may_v have_v make_v a_o sheriff_n without_o any_o such_o election_n notwithstanding_o any_o statute_n to_o the_o contrary_a which_o appear_v in_o dyer_n report_n 35._o the_o king_n be_v fountain_n of_o justice_n &_o mercy_n therefore_o if_o it_o be_v enact_v that_o he_o shall_v not_o grant_v commission_n to_o determine_v felony_n or_o that_o from_o henceforth_o it_o shall_v not_o be_v in_o his_o power_n to_o pardon_v any_o crime_n or_o that_o all_o such_o pardon_n shall_v be_v void_a such_o law_n will_v be_v void_a and_o will_v not_o bind_v as_o be_v repugnant_a to_o law_n government_n 37._o and_o the_o sheriff_n for_o though_o by_o that_o statute_n of_o 23_o h._n 6._o it_o be_v enact_v that_o all_o patent_n of_o the_o king_n shall_v be_v void_a as_o before_o although_o with_o a_o non_fw-la obstante_fw-la yet_o the_o judge_n at_o all_o time_n have_v resolve_v it_o as_o a_o thing_n without_o dispute_n that_o those_o patent_n although_o express_o against_o the_o word_n and_o intent_n of_o that_o act_n with_o a_o non_fw-la obstante_fw-la be_v good_a in_o law_n and_o so_o the_o book_n take_v it_o for_o a_o fundamental_a ground_n that_o the_o king_n may_v by_o his_o patent_n with_o a_o non_fw-la obstante_fw-la dispense_v with_o law_n make_v by_o act_n of_o parliament_n and_o put_v the_o difference_n 37._o between_o act_n prohibit_v what_o the_o common-law_n prohibit_v 35._o in_o which_o case_n the_o king_n can_v by_o his_o letter_n patent_n with_o a_o non_fw-la obstante_fw-la how_o strong_a soever_o it_o be_v pen_v dispense_v with_o such_o act_n or_o any_o one_o point_n of_o
