warrant_v to_o be_v receiver_n or_o receiver_n of_o all_o and_o singular_a the_o several_a sum_n aforesaid_a mention_v and_o intend_v to_o be_v raise_v on_o the_o several_a parish_n or_o people_n and_o repair_v of_o church_n by_o the_o constable_n or_o constable_n of_o the_o several_a parish_n or_o precinct_n and_o by_o they_o forthwith_o pay_v into_o the_o hand_n of_o the_o churchwarden_n or_o churchwarden_n for_o the_o time_n be_v who_o shall_v and_o be_v hereby_o require_v to_o issue_n forth_o and_o pay_v the_o same_o to_o such_o person_n or_o person_n employ_v in_o guard_v watch_v or_o on_o look-outs_a as_o aforesaid_a by_o warrant_n from_o the_o chief_a officer_n of_o that_o place_n and_o that_o all_o and_o every_o person_n or_o person_n so_o employ_v and_o entrust_v in_o day_n time_n and_o place_n as_o to_o they_o shall_v seem_v convenient_a empower_v justice_n etc._n etc._n empower_v who_o be_v hereby_o then_o and_o there_o impower_v to_o make_v and_o lay_v such_o tax_n they_o be_v assese_v at_o the_o last_o year_n and_o pay_v the_o same_o by_o way_n of_o loan_n unto_o their_o majesty_n for_o keep_v such_o guard_n and_o night-watche_n as_o aforesaid_a until_o they_o can_v be_v otherwise_o provide_v for_o by_o a_o act_n of_o the_o assembly_n nevertheless_o many_o of_o the_o inhabitant_n of_o the_o say_a parish_n have_v neglect_v and_o refuse_v to_o pay_v the_o same_o be_v it_o therefore_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o justice_n and_o vestry_n of_o they_o say_v parish_n be_v hereby_o require_v and_o impower_v at_o their_o first_o meeting_n in_o order_n to_o the_o maintain_v guard_n and_o look-outs_a as_o aforesaid_a to_o tax_n raise_v and_o cause_n to_o be_v levy_v such_o sum_n or_o sum_n of_o money_n as_o shall_v be_v make_v appear_v to_o they_o necessary_a to_o reimburse_v such_o person_n as_o have_v pay_v and_o expend_v their_o money_n for_o the_o watch_n and_o safeguard_v of_o the_o say_a parish_n according_a to_o the_o subscription_n as_o aforesaid_a over_o and_o above_o what_o it_o shall_v be_v think_v necessary_a by_o the_o justice_n and_o vestry_n with_o the_o advice_n of_o the_o chief_a military_a officer_n to_o raise_v and_o assess_v on_o the_o several_a inhabitant_n for_o maintain_v their_o guard_n and_o look-outs_a as_o aforesaid_a which_o say_v sum_n and_o sum_n of_o money_n so_o levy_v as_o aforesaid_a shall_v be_v by_o the_o churchwarden_n forthwith_o pay_v unto_o such_o person_n or_o person_n that_o have_v deposit_v and_o disburse_v their_o money_n for_o guard_v and_o that_o the_o justice_n and_o vestry_n erect_v beacon_n to_o be_v erect_v or_o the_o justice_n within_o the_o commission_n of_o the_o peace_n where_o there_o be_v no_o vestry_n shall_v assess_v and_o levy_v at_o the_o usual_a time_n and_o time_n in_o manner_n aforesaid_a such_o sum_n and_o sum_n of_o money_n to_o erect_v and_o keep_v such_o and_o so_o many_o beacon_n and_o in_o such_o convenient_a place_n and_o place_n as_o a_o regimental_n court-martial_a shall_v think_v fit_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o justice_n or_o justice_n of_o the_o peace_n churchwarden_n or_o churchwarden_n that_o shall_v neglect_v or_o fail_v in_o the_o execution_n of_o he_o or_o their_o duty_n as_o aforesaid_a shall_v forfeit_v the_o sum_n of_o five_o pound_n for_o such_o his_o
neglect_n or_o default_n default_n forfeiture_n upon_o default_n and_o for_o every_o vestry-man_n or_o constable_n the_o sum_n of_o forty_o shilling_n to_o be_v recover_v by_o action_n of_o debt_n if_o not_o above_o forty_o shilling_n before_o any_o justice_n of_o the_o peace_n and_o if_o above-forty_a shilling_n in_o any_o court_n of_o record_n within_o this_o island_n wherein_o no_o tom_n river_n etc._n etc._n and_o that_o the_o same_o be_v a_o public_a road_n or_o king_n highway_n between_o the_o say_v two_o parish_n of_o st._n george_n and_o st._n andrew_n as_o aforesaid_a and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o surveyor_n of_o the_o highway_n for_o the_o parish_n of_o st._n mary_n do_v yearly_a and_o as_o often_o as_o need_v shall_v require_v clear_a and_o amend_v the_o say_a road_n limit_v surveyor_n limit_v or_o highway_n from_o the_o orange_a river_n aforesaid_a over_o the_o say_a mammy_n ridge_n unto_o the_o ford_n at_o the_o foot_n of_o the_o say_a hill_n at_o little_a tom_n river_n aforesaid_a and_o that_o the_o parish_n of_o st._n george_n also_o clear_a their_o road_n or_o highway_n from_o twenty_o five_o pound_n the_o quarter_n shall_v be_v adjudge_v beef_n and_o for_o lamb_n weigh_v above_o eight_o pound_n the_o quarter_n shall_v be_v deem_v mutton_n and_o each_o sold_n by_o the_o quarter_n or_o joint_n at_o the_o respective_a price_n in_o this_o act_n beforementioned_a and_o to_o prevent_v sell_v and_o put_v off_o old_a and_o small_a mutton_n for_o lamb_n lamb._n mutton_n for_o lamb._n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o lamb_n shall_v be_v bring_v into_o the_o open_a market_n with_o the_o head_n on_o and_o show_v before_o cut_v up_o to_o the_o clerk_n thereof_o with_o the_o usual_a sign_n and_o mark_n of_o distinction_n that_o he_o upon_o scruple_n may_v determine_v the_o matter_n between_o buyer_n and_o seller_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o common_a seller_n butcher_n cutter_n up_o of_o tortle_n tortle_n tortle_n or_o any_o other_o person_n whatsoever_o sell_v tortle_n or_o any_o of_o the_o meat_n beforementioned_a by_o retail_n but_o in_o open_a market_n where_o they_o shall_v not_o refuse_v to_o sell_v the_o same_o to_o any_o person_n bring_v ready_a money_n by_o the_o quarter_n joint_n or_o piece_n by_o weight_n not_o less_o than_o the_o value_n of_o seven_o penny_n halfpenny_n at_o the_o price_n aforesaid_a without_o conditional_o impose_v upon_o the_o that_o at_o the_o next_o usual_a time_n of_o assess_v their_o parish-tax_n that_o they_o assess_v such_o sum_n or_o sum_n of_o money_n as_o shall_v have_v be_v lend_v and_o advance_v by_o the_o churchwarden_n or_o justice_n as_o be_v above_o require_v which_o money_n so_o assess_v and_o levy_v shall_v be_v by_o the_o churchwarden_n and_o where_o no_o churchwarden_n be_v reimburse_v how_o to_o be_v reimburse_v by_o the_o justice_n within_o the_o limit_n of_o their_o respective_a commission_n pay_v unto_o the_o hand_n of_o the_o person_n so_o lend_v the_o money_n for_o this_o present_a year_n with_o lawful_a interest_n for_o the_o same_o which_o say_v sum_n with_o the_o say_a interest_n shall_v be_v pay_v by_o the_o churchwarden_n or_o justice_n or_o where_o no_o churchwarden_n be_v by_o the_o justice_n within_o the_o limit_n of_o their_o respective_a commission_n on_o demand_n under_o penalty_n of_o double_a the_o sum_n so_o lend_v and_o demand_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a sum_n yearly_a to_o be_v collect_v as_o aforesaid_a shall_v for_o this_o present_a year_n and_o the_o year_n ensue_v during_o the_o time_n mention_v in_o this_o act_n be_v pay_v by_o the_o churchwarden_n or_o justice_n of_o each_o respective_a parish_n within_o twenty_o one_o day_n after_o their_o receipt_n thereof_o payment_n time_n of_o payment_n into_o the_o hand_n of_o the_o receiver_n or_o receiver_n impower_v to_o receive_v the_o same_o and_o if_o any_o of_o the_o justice_n churchwarden_n vestry-man_n or_o constable_n shall_v neglect_v he_o or_o their_o duty_n in_o assess_v levy_v or_o pay_v the_o say_a sum_n which_o be_v above_o require_v to_o be_v assess_v levy_v and_o pay_v he_o or_o they_o so_o neglect_v or_o fail_v of_o his_o or_o their_o duty_n therein_o shall_v respective_o forfeit_v for_o every_o such_o offence_n the_o sum_n of_o fifty_o pound_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o raise_v and_o pay_v as_o aforesaid_a into_o the_o hand_n of_o the_o say_a receiver_n or_o receiver_n for_o the_o time_n be_v shall_v by_o they_o be_v yearly_o remit_v on_o the_o country_n risque_n in_o such_o manner_n as_o they_o shall_v think_v fit_a into_o the_o hand_n of_o gilbert_n heathcote_n remit_v to_o who_o remit_v bartholomew_n gracedieu_o and_o john_n tutt_n of_o london_n merchant_n or_o any_o one_o of_o they_o or_o such_o other_o person_n or_o person_n as_o shall_v from_o time_n to_o time_n be_v appoint_v to_o solicit_v in_o england_n the_o public_a affair_n of_o this_o island_n as_o occasion_n shall_v require_v and_o as_o to_o they_o shall_v seem_v most_o to_o the_o interest_n and_o advantage_n thereof_o and_o in_o case_n of_o the_o death_n absence_n or_o refusal_n of_o any_o of_o the_o solicitor_n beforementioned_a or_o the_o commissioner_n hereafter_o mention_v in_o this_o act_n that_o then_o the_o person_n remain_v or_o survive_v or_o the_o major_a part_n of_o they_o do_v choose_v to_o themselves_o such_o other_o person_n or_o person_n as_o they_o shall_v think_v fit_a in_o the_o room_n or_o stead_n of_o he_o or_o they_o that_o shall_v remove_v decease_n or_o refuse_v and_o that_o the_o person_n or_o person_n so_o choose_v shall_v here_o and_o in_o england_n each_o for_o themselves_o be_v impower_v to_o act_n as_o full_o to_o all_o intent_n and_o purpose_n in_o each_o place_n as_o if_o he_o or_o they_o have_v be_v mention_v and_o appoint_v by_o name_n in_o this_o act._n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o honourable_a samuel_n bernard_n and_o nicholas_n law_n esquire_n and_o james_n bradshaw_n william_n hutchinson_n thomas_n clarke_n james_n banister_n and_o modyford_n freeman_n esquire_n receiver_n commissioner_n and_o receiver_n shall_v be_v and_o be_v hereby_o impower_v and_o appoint_v to_o be_v commissioner_n and_o they_o or_o the_o major_a part_n of_o they_o from_o time_n to_o time_n to_o appoint_v one_o or_o more_o of_o themselves_o to_o be_v receiver_n or_o receiver_n of_o the_o money_n by_o this_o act_n to_o be_v raise_v and_o whereas_o at_o this_o present_a session_n there_o be_v general_a instruction_n draw_v up_o by_o the_o council_n and_o assembly_n for_o direction_n to_o the_o solicitor_n in_o england_n the_o commissioner_n name_v in_o this_o act_n observe_v instruction_n to_o be_v observe_v be_v at_o no_o time_n to_o order_n any_o thing_n contrary_a to_o any_o particular_n contain_v therein_o but_o full_o to_o observe_v and_o be_v direct_v thereby_o any_o thing_n in_o this_o act_n seem_v to_o the_o contrary_a notwithstanding_o which_o say_v instruction_n be_v to_o be_v sign_v by_o the_o clerk_n of_o the_o council_n and_o the_o speaker_n of_o the_o assembly_n and_o be_v enter_v in_o the_o minute_n of_o both_o house_n provide_v nevertheless_o that_o the_o commissioner_n beforementioned_a instruction_n farther_o instruction_n may_v from_o time_n to_o time_n upon_o any_o sudden_a or_o emergent_a occasion_n give_v to_o the_o solicitor_n in_o england_n such_o further_a instruction_n as_o they_o shall_v think_v fit_a for_o the_o public_a service_n of_o this_o island_n and_o in_o case_n it_o shall_v be_v think_v fit_a at_o any_o time_n hereafter_o to_o turn_v out_o or_o alter_v any_o of_o the_o solicitor_n in_o england_n that_o then_o the_o say_a commissioner_n or_o major_a part_n of_o they_o be_v hereby_o impower_v from_o time_n to_o time_n to_o turn_v out_o change_v solicitor_n change_v or_o alter_v as_o aforesaid_a all_o or_o any_o of_o the_o solicitor_n in_o this_o act_n mention_v and_o be_v it_o further_o enact_v that_o the_o person_n or_o person_n so_o name_v to_o be_v receiver_n or_o receiver_n shall_v receive_v and_o pay_v all_o such_o sum_n or_o sum_n of_o money_n as_o shall_v come_v to_o his_o or_o their_o hand_n arise_v by_o virtue_n of_o this_o act_n of_o all_o which_o the_o receiver_n or_o receiver_n for_o the_o time_n be_v shall_v keep_v a_o exact_a and_o distinct_a account_n of_o all_o payment_n and_o remittance_n make_v for_o the_o use_v and_o purpose_v by_o this_o act_n require_v give_v account_v to_o be_v give_v and_o render_v a_o just_a and_o true_a account_n thereof_o when_o demand_v unto_o the_o rest_n of_o the_o commissioner_n in_o this_o act_n nominate_v or_o the_o major_a part_n of_o they_o when_o thereunto_o require_v or_o to_o the_o assembly_n of_o this_o island_n when_o sit_v and_o assemble_v of_o all_o the_o sum_n and_o sum_n of_o money_n by_o he_o or_o they_o receive_v by_o virtue_n of_o this_o act_n and_o how_o lay_v out_o or_o remit_v and_o if_o the_o say_a receiver_n or_o receiver_n for_o the_o time_n be_v after_o the_o receipt_n of_o any_o of_o the_o say_a money_n shall_v divert_v or_o misapply_v the_o same_o or_o any_o part_n thereof_o by_o any_o pretence_n whatsoever_o otherwise_o than_o before_o intend_v and_o direct_v contrary_a to_o the_o true_a intent_n and_o mean_v of_o this_o act_n the_o person_n or_o person_n so_o offend_a shall_v forfeit_v to_o their_o majesty_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o double_v the_o sum_n so_o divert_v or_o misapply_v and_o the_o say_a receiver_n or_o receiver_n for_o the_o time_n be_v shall_v be_v allow_v all_o his_o or_o their_o reasonable_a expense_n in_o or_o about_o the_o discharge_n of_o the_o trust_v hereby_o repose_v in_o he_o or_o they_o allow_v expense_n allow_v commission_n or_o pretence_n of_o commission_n hereby_o except_v and_o in_o case_n the_o receiver_n or_o receiver_n for_o the_o time_n be_v shall_v neglect_v or_o refuse_v to_o remit_v the_o aforesaid_a sum_n or_o sum_n of_o money_n when_o receive_v yearly_a and_o every_o year_n during_o the_o continuance_n of_o the_o act_n to_o the_o solicitor_n in_o england_n shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o hundred_o pound_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o one_o half_n of_o the_o forfeiture_n contain_v in_o this_o act_n apply_v forfeiture_n apply_v and_o not_o herein_o apply_v shall_v be_v to_o our_o sovereign_a lord_n and_o lady_n the_o king_n and_o queen_n their_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o the_o other_o half_n to_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o
or_o their_o charge_n in_o or_o about_o the_o discharge_n of_o the_o trust_v hereby_o in_o he_o or_o they_o repose_v and_o whereas_o after_o the_o expiration_n of_o this_o act_n some_o of_o the_o money_n arise_v by_o virtue_n hereof_o may_v remain_v in_o the_o hand_n of_o the_o treasurer_n or_o treasurer_n for_o the_o time_n be_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o such_o sum_n or_o sum_n of_o money_n if_o any_o be_v money_n surplus_n of_o money_n in_o the_o hand_n of_o the_o say_a treasurer_n or_o treasurer_n shall_v notwithstanding_o the_o expiration_n of_o this_o act_n be_v there_o and_o still_o in_o his_o or_o their_o hand_n remain_v and_o be_v employ_v to_o the_o use_v and_o intent_n in_o this_o act_n appoint_v be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o secretary_n of_o this_o island_n shall_v from_o time_n to_o time_n upon_o demand_n deliver_v copy_n of_o this_o act_n to_o be_v deliver_v give_v copy_n or_o copy_n of_o this_o act_n to_o any_o person_n without_o delay_n or_o excuse_v for_o every_o of_o which_o he_o shall_v receive_v the_o fee_n or_o sum_n of_o ten_o shilling_n and_o in_o case_n he_o shall_v delay_v or_o refuse_v to_o give_v such_o copy_n or_o copy_n as_o aforesaid_a to_o any_o person_n or_o person_n demand_v the_o same_o he_o shall_v for_o every_o copy_n so_o demand_v and_o not_o give_v forfeit_v the_o sum_n of_o forty_o shilling_n to_o be_v recover_v before_o any_o justice_n of_o the_o peace_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o receiver-general_n or_o his_o lawful_a deputy_n shall_v refuse_v to_o make_v entry_n and_o do_v and_o perform_v all_o and_o every_o such_o thing_n or_o thing_n as_o by_o this_o act_n or_o any_o branch_n thereof_o be_v enjoin_v he_o entry_n forfeiture_n of_o the_o receiver-general_n on_o refusal_n of_o entry_n he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o hundred_o pound_n currant_n money_n of_o this_o island_n and_o all_o other_o person_n or_o person_n offend_a contrary_a to_o the_o true_a intent_n and_o mean_v of_o this_o act_n shall_v forfeit_v for_o every_o such_o offence_n wherein_o penalty_n be_v not_o already_o lay_v the_o sum_n of_o one_o hundred_o pound_n the_o moiety_n of_o all_o the_o forfeiture_n within_o this_o act_n mention_v shall_v be_v to_o their_o majesty_n their_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o moiety_n to_o the_o informer_n or_o he_o that_o shall_v sue_v for_o the_o same_o to_o be_v recover_v by_o action_n of_o debt_n bill_n plaint_n or_o information_n in_o any_o court_n produce_v more_o than_o the_o say_a sum_n of_o three_o hundred_o pound_n sterling_a money_n of_o england_n the_o assembly_n do_v therefore_o most_o humble_o beseech_v your_o most_o excellent_a
