any_o town_n or_o county_n within_o this_o province_n be_v hereby_o full_o impower_v and_o authorize_v to_o have_v cognizance_n of_o all_o cause_n case_n of_o debt_n and_o trespass_n to_o the_o value_n of_o forty_o shilling_n or_o under_o which_o cause_n and_o case_n shall_v he_o hear_v try_v and_o final_o determine_v without_o a_o jury_n by_o every_o justice_n of_o the_o peace_n that_o reside_v within_o any_o town_n or_o county_n within_o this_o province_n he_o take_v to_o his_o assistance_n at_o the_o time_n of_o his_o hear_n and_o determine_v such_o cause_n or_o case_n of_o debt_n tuesday_n in_o june_n and_o the_o first_o tuesday_n in_o december_n for_o ulster_n at_o kingston_n the_o first_o tuesday_n in_o september_n and_o the_o first_o tuesday_n in_o march_n for_o the_o county_n of_o richmond_n at_o the_o court-house_n the_o first_o tuesday_n in_o september_n and_o the_o first_o tuesday_n in_o march_n for_o king_n county_n at_o flatbush_n alias_o midwout_n the_o second_o tuesday_n in_o may_n and_o the_o second_o tuesday_n in_o november_n for_o queen_n county_n at_o jamaica_n the_o three_o tuesday_n in_o may_n and_o the_o three_o tuesday_n in_o september_n and_o no_o long_o and_o for_o the_o more_o regular_a and_o beneficial_a distribution_n of_o justice_n to_o the_o inhabitant_n of_o each_o respective_a city_n and_o county_n within_o this_o province_n be_v it_o further_o enact_v by_o the_o authority_n a_o foresay_a that_o there_o be_v keep_v and_o hold_v a_o court_n of_o common_a plea_n in_o each_o respective_a city_n and_o county_n within_o this_o province_n at_o the_o time_n and_o place_n hereafter_o name_v and_o express_v that_o be_v to_o say_v at_o such_o place_n in_o each_o respective_a county_n as_o the_o say_a court_n of_o session_n be_v to_o be_v keep_v and_o to_o begin_v the_o next_o day_n after_o the_o session_n terminate_v and_o only_o to_o hold_v and_o continue_v for_o the_o space_n and_o time_n of_o two_o day_n and_o no_o long_o and_o that_o there_o be_v one_o judge_n with_o three_o justice_n in_o each_o county_n appoint_v and_o commissionated_a to_o hold_v the_o same_o court_n of_o plea_n three_o whereof_o to_o be_v a_o quorum_fw-la and_o that_o the_o several_a and_o respective_a court_n hereby_o establish_v shall_v have_v jurisdiction_n to_o hear_v try_v and_o final_o to_o determine_v all_o action_n or_o cause_n final_a determination_n there_o shall_v not_o be_v any_o appeal_n or_o removal_n by_o habeas_fw-la corpus_fw-la of_o any_o person_n or_o of_o any_o action_n or_o suit_n or_o of_o any_o judgement_n or_o execution_n to_o the_o value_n of_o twenty_o pound_n or_o under_o any_o thing_n contain_v herein_o to_o the_o contrary_a in_o any_o way_n notwithstanding_o to_o which_o respective_a court_n of_o majesty_n subject_n inhabit_v within_o this_o province_n may_v have_v all_o the_o good_a proper_a and_o just_a way_n and_o mean_n for_o the_o secure_n and_o recover_v their_o just_a right_n and_o demand_n within_o the_o same_o be_v it_o further_o enact_v and_o it_o be_v hereby_o enact_v and_o ordain_v by_o authority_n aforesaid_a that_o there_o shall_v be_v hold_v and_o keep_v a_o supreme_a court_n of_o judicature_n which_o shall_v be_v due_o and_o constant_o keep_v at_o the_o city_n of_o new-york_n and_o not_o elsewhere_o at_o the_o several_a and_o respective_a time_n hereafter_o mention_v and_o that_o there_o be_v five_o justice_n at_o least_o appoint_a and_o commissionated_a to_o hold_v the_o same_o court_n two_o whereof_o together_o with_o one_o chief_a justice_n to_o be_v authority_n aforesaid_a that_o all_o and_o every_o of_o the_o justice_n or_o judge_n of_o the_o several_a court_n aforementioned_a be_v and_o be_v hereby_o sufficient_o impower_v to_o make_v ordain_v and_o establish_v all_o such_o rule_n and_o order_n for_o the_o more_o regular_a practise_v and_o proceed_v in_o their_o say_a court_n as_o full_o and_o ample_o to_o all_o intent_n and_o purpose_n whatsoever_o as_o all_o or_o any_o of_o the_o judge_n of_o the_o several_a court_n of_o the_o king_n bench_n common_a plea_n and_o exchequer_n in_o england_n legal_o do_v provide_v always_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n right_o or_o property_n shall_v be_v by_o any_o of_o the_o aforesaid_a court_n determine_v except_o where_o matter_n of_o fact_n be_v either_o acknowledge_v by_o the_o party_n or_o judgement_n he_o acknowledge_v or_o pass_v by_o the_o defendant_n fault_n for_o want_v of_o plea_n or_o answer_n unless_o the_o fact_n be_v find_v by_o the_o verdict_n of_o twelve_o man_n of_o the_o neighbourhood_n as_o it_o ought_v to_o be_v do_v by_o the_o law_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o one_o of_o the_o justice_n of_o the_o say_v supreme_a court_n commissionated_a as_o aforesaid_a shall_v once_o in_o every_o year_n at_o the_o aforesaid_a time_n and_o place_n in_o each_o respective_a county_n aforesaid_a go_v the_o circuit_n and_o at_o the_o place_n and_o time_n aforesaid_a there_o hold_v the_o supreme_a court_n be_v then_o assist_v by_o two_o or_o more_o of_o the_o justice_n of_o the_o peace_n of_o the_o several_a respective_a county_n where_o the_o say_v supreme_a court_n be_v to_o be_v hold_v and_o shall_v there_o hear_v and_o determine_v all_o process_n and_o plea_n there_o depend_v and_o issue_v as_o aforesaid_a always_o provide_v that_o in_o such_o county_n where_o there_o be_v no_o process_n issue_v or_o plea_n depend_v that_o the_o justice_n shall_v not_o be_v then_o oblige_v to_o go_v the_o circuit_n to_o the_o say_a county_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o always_o provide_v the_o session_n of_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o governor_n and_o council_n be_v the_o say_v high_a court_n of_o chancery_n and_o hold_v and_o keep_v the_o say_a court_n and_o that_o the_o governor_n may_v depute_v nominate_v and_o appoint_v in_o his_o stead_n a_o chancellor_n and_o be_v assist_v with_o such_o other_o person_n of_o the_o council_n as_o shall_v by_o he_o be_v think_v fit_a and_o convenient_a together_o with_o all_o necessary_a officer_n clark_n and_o register_n as_o to_o the_o say_v high_a court_n of_o chancery_n be_v needful_a provide_v always_o and_o it_o be_v hereby_o further_o enact_v by_o the_o authority_n aforesaid_a that_o any_o freeholder_n planter_n inhabitant_n or_o sojourner_n within_o this_o province_n may_v have_v liberty_n if_o he_o or_o they_o see_v meet_v to_o make_v his_o or_o their_o appeal_n or_o appeal_n from_o any_o judgement_n obtain_v against_o he_o or_o they_o in_o case_n of_o error_n in_o the_o several_a court_n aforesaid_a in_o such_o manner_n and_o form_n as_o be_v hereafter_o express_v that_o be_v to_o say_v from_o the_o court_n of_o mayor_n and_o alderman_n and_o court_n of_o common_a plea_n to_o the_o supreme_a court_n for_o any_o judgement_n above_o the_o value_n of_o twenty_o pound_n and_o from_o the_o supreme_a court_n at_o new-york_n to_o the_o governor_n and_o council_n for_o any_o judgement_n above_o the_o value_n of_o one_o hundred_o pound_n and_o from_o the_o governor_n and_o council_n to_o their_o majesty_n in_o council_n for_o any_o decree_n or_o judgement_n above_o the_o value_n of_o three_o hundred_o pound_n as_o in_o their_o majesty_n letter_n patent_n to_o his_o excellency_n do_v and_o may_v more_o full_o appear_v always_o provide_v that_o the_o party_n or_o party_n so_o appeal_n shall_v first_o pay_v all_o cost_v of_o such_o judgement_n or_o decree_n from_o which_o the_o appeal_n arise_v and_o enter_v into_o recognizance_n with_o two_o sufficient_a surety_n for_o double_a the_o value_n of_o the_o debt_n matter_n or_o thing_n recover_v or_o obtain_v by_o judgement_n or_o decree_n against_o he_o or_o they_o to_o the_o say_a court_n from_o which_o they_o appeal_v and_o county_n throughout_o the_o same_o &_o the_o trade_n of_o the_o province_n be_v likewise_o very_o much_o discourage_v for_o want_v thereof_o as_o well_o as_o for_o the_o want_n of_o public_a fair_n in_o each_o respective_a city_n and_o county_n to_o be_v hold_v and_o keep_v at_o lest_o once_o in_o every_o year_n for_o remedy_n whereof_o and_o that_o trade_n and_o commerce_n may_v be_v the_o better_o encourage_v and_o propagate_v for_o the_o good_a and_o weal_n of_o all_o the_o inhabitant_n aforesaid_a be_v it_o therefore_o enact_v by_o the_o governor_n and_o council_n and_o representative_n convene_v in_o general_a assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n of_o the_o same_o that_o there_o shall_v be_v hold_v and_o keep_v in_o the_o respective_a county_n aforesaid_a upon_o every_o thursday_n of_o the_o week_n
of_o the_o town_n or_o precinct_n or_o any_o depute_a by_o he_o where_o the_o the_o parry_n complain_v against_o do_v live_v which_o summon_v be_v personal_o serve_v or_o leave_v at_o the_o mention_v that_o be_v to_o say_v at_o such_o place_n in_o each_o respective_a county_n as_o the_o say_a general_n session_n of_o the_o peace_n be_v to_o be_v keep_v and_o to_o begin_v the_o next_o day_n after_o the_o session_n terminate_v and_o then_o only_o to_o hold_v and_o continue_v for_o the_o space_n and_o time_n of_o two_o day_n after_o and_o no_o long_o and_o that_o there_o be_v a_o judge_n assist_v with_o three_o justice_n of_o the_o peace_n in_o each_o respective_a county_n appoint_v and_o commissionated_a to_o hold_v the_o same_o court_n of_o plea_n three_o whereof_o to_o be_v a_o quorum_fw-la and_o that_o the_o several_a and_o respective_a court_n of_o plea_n hereby_o establish_v shall_v have_v power_n and_o jurisdiction_n to_o hear_v try_v and_o final_o determine_v all_o action_n or_o cause_n of_o action_n and_o all_o matter_n and_o thing_n and_o cause_n tryable_a at_o the_o common_a law_n of_o what_o nature_n of_o kind_a whatsoever_o so_o that_o the_o action_n or_o he_o with_o such_o further_a allowance_n for_o his_o pain_n as_o the_o say_a justice_n or_o any_o of_o they_o shall_v judge_v reasonable_a and_o if_o the_o say_a justice_n or_o justice_n shall_v the_o maintenance_n aforesaid_a by_o four_o equal_a and_o quarterly_a payment_n under_o the_o penalty_n and_o forfeiture_n of_o five_o pound_v currant_n money_n aforesaid_a for_o each_o neglect_n collect_v and_o pay_v unto_o their_o most_o excellent_a majesty_n for_o the_o term_n and_o space_n of_o five_o year_n next_o and_o after_o the_o expiration_n of_o the_o term_n limit_v in_o the_o say_a
