the_o justice_n leave_n for_o the_o first_o offence_n by_o this_o act_n there_o can_v be_v no_o more_o levy_v than_o 5_o s._n upon_o poor_a or_o rich_a of_o the_o hearer_n nor_o shall_v any_o answer_n but_o for_o themselves_o till_o the_o second_o conviction_n and_o may_v it_o not_o be_v reply_v to_o the_o justice_n by_o the_o constable_n how_o shall_v they_o get_v these_o person_n to_o give_v they_o their_o name_n so_o exact_o before_o the_o next_o quarter_n session_n as_o the_o order_n direct_v so_o as_o the_o constable_n may_v deliver_v they_o true_o to_o the_o justice_n on_o their_o oath_n as_o be_v express_v in_o the_o order_n suppose_v wrong_a name_n be_v give_v to_o the_o constable_n must_v they_o swear_v to_o they_o to_o convict_v the_o metre_n and_o what_o if_o the_o person_n will_v not_o give_v they_o their_o name_n for_o that_o the_o law_n force_v no_o man_n to_o give_v his_o name_n to_o convict_v himself_o and_o it_o may_v not_o be_v amiss_o to_o consider_v further_o that_o the_o constable_n if_o they_o turn_v informer_n must_v also_o swear_v that_o no_o part_n of_o divine_a service_n be_v read_v at_o that_o meet_v all_o the_o time_n of_o their_o be_v together_o which_o can_v well_o be_v swear_v unless_o by_o irish_a witness_n and_o without_o they_o do_v prove_v that_o it_o be_v no_o conventicle_n within_o the_o law_n in_o the_o next_o place_n the_o order_n command_v to_o make_v a_o true_a return_n of_o the_o name_n so_o take_v to_o the_o justice_n of_o the_o session_n in_o write_v of_o such_o person_n as_o preach_v and_o be_v at_o conventicle_n the_o day_n of_o the_o month_n and_o place_n where_o they_o be_v hold_v and_o the_o officer_n to_o prove_v it_o upon_o oath_n to_o the_o end_n such_o conventicle_n may_v be_v convict_v according_a to_o law_n now_o what_o law_n these_o gentleman_n mean_v i_o know_v not_o i_o be_o sure_a it_o can_v be_v the_o conventicle-act_n for_o that_o
that_o on_o the_o 5_o of_o november_n the_o act_n of_o parliament_n shall_v be_v read_v in_o every_o church_n by_o they_o at_z before_o or_o after_o divine_a service_n for_o celebrate_v the_o day_n minister_n conform_v of_o the_o son_n of_o the_o church_n than_o those_o that_o be_v now_o to_o be_v prosecute_v for_o hold_v of_o conventicle_n but_o again_o as_o to_o the_o very_a act_n of_o uniformity_n make_v in_o this_o king_n reign_n 2._o 〈◊〉_d 2._o it_o be_v there_o express_o declare_v that_o no_o other_o form_n or_o ceremony_n shall_v be_v use_v but_o what_o be_v prescribe_v in_o that_o act_n and_o in_o the_o book_n of_o common_a prayer_n annex_v yet_o if_o you_o please_v to_o look_v into_o the_o act_n and_o the_o book_n you_o will_v find_v that_o the_o conform_v clergy_n do_v not_o conform_v to_o that_o law_n neither_o for_o they_o use_v divers_a ceremony_n that_o be_v not_o there_o and_o omit_v much_o of_o what_o be_v there_o witness_v their_o go_v up_o to_o the_o altar_n as_o they_o call_v it_o to_o read_v second_o service_n and_o give_v a_o reverend_a bow_n there_o then_o their_o come_n out_o of_o the_o pulpit_n after_o sermon_n as_o some_o of_o they_o do_v and_o read_v some_o prayer_n out_o of_o the_o book_n in_o the_o desk_n or_o at_o the_o altar_n again_o and_o give_v the_o blessing_n not_o in_o the_o pulpit_n at_o all_o then_o in_o their_o set_v the_o communion-table_n at_o the_o east-end_n of_o the_o church_n altarwise_a east_n and_o west_n in_o some_o place_n with_o glorious_a cover_v and_o rail_v in_o as_o a_o altar_n when_o as_o it_o ought_v to_o be_v set_v north_n and_o south_n and_o in_o the_o body_n of_o the_o church_n or_o convenient_a place_n with_o a_o clean_a linen_n cloth_n and_o then_o as_o to_o their_o turn_v their_o face_n all_o of_o a_o sudden_a to_o the_o east_n turn_v their_o breech_n upon_o god_n almighty_a and_o bow_v at_o the_o name_n of_o jesus_n yet_o not_o at_o the_o name_n of_o god_n or_o christ_n pray_v in_o what_o place_n may_v these_o thing_n be_v find_v in_o that_o act_n i_o will_v be_v very_o glad_a they_o will_v give_v a_o reason_n of_o this_o nonconformity_n or_o over-conformity_n which_o be_v the_o same_o in_o strictness_n but_o sir_n if_o you_o consider_v there_o be_v not_o only_o a_o nonconformity_n among_o the_o clergy_n in_o these_o point_n but_o also_o a_o nonconformity_n in_o divers_a of_o the_o lay_v man_n too_o as_o for_o instance_n c._n 1_o jacob._n cap._n 9.21_o jacob_n cap._n 7._o 1_o car._n c._n swear_v and_o drunkenness_n they_o be_v real_o against_o express_a law_n as_o well_o as_o conventicle_n and_o as_o much_o against_o the_o good_a of_o the_o king_n and_o peace_n of_o the_o kingdom_n as_o any_o thing_n in_o the_o world_n can_v be_v and_o then_o in_o the_o next_o place_n all_o the_o alehouse_n and_o innkeeper_n in_o england_n be_v all_o nonconformist_n too_o against_o express_a statute_n both_o of_o king_n james_n king_n charles_n i_o and_o this_o king_n which_o law_n say_v that_o no_o alehousekeeper_n or_o victualer_n in_o england_n shall_v sell_v the_o best_a strong_a beer_n and_o ale_n for_o more_o than_o one_o penny_n for_o a_o full_a quart_n and_o two_o quart_n of_o small_a for_o one_o penny_n yet_o i_o believe_v there_o be_v scarce_o one_o this_o day_n in_o england_n obey_v those_o law_n though_o they_o be_v in_o as_o much_o force_n as_o the_o conventicle_n act_n and_o aught_o by_o the_o justice_n good_a leave_n to_o be_v as_o severe_o prosecute_v as_o well_o as_o divers_a other_o law_n which_o for_o brevity_n i_o forbear_v to_o mention_v therefore_o shall_v say_v no_o more_o of_o this_o matter_n but_o come_v to_o the_o order_n itself_o and_o consider_v how_o well_o it_o be_v suit_v with_o the_o act._n first_o the_o order_n tell_v you_o that_o whereas_o it_o be_v his_o majesty_n express_a order_n of_o the_o 14_o of_o december_n that_o all_o conventicle_n and_o meeting_n shall_v be_v suppress_v etc._n etc._n so_o will_v his_o majesty_n no_o doubt_n have_v all_o the_o other_o law_n put_v in_o execution_n for_o the_o good_a of_o his_o people_n and_o they_o as_o justices_z aught_o to_o have_v know_v and_o do_v their_o duty_n if_o they_o have_v no_o such_o particular_a order_n as_o they_o be_v please_v to_o mention_v and_o to_o put_v all_o those_o other_o law_n against_o swear_v drunkenness_n popish_a recusant_n and_o against_o nonresidence_n and_o plurality_n and_o against_o clergyman_n that_o pretend_v to_o be_v the_o only_a son_n of_o the_o church_n and_o yet_o have_v new_a invention_n that_o the_o act_n never_o hear_v of_o and_o also_o to_o take_v care_n that_o the_o law_n against_o victualler_n shall_v be_v put_v in_o execution_n and_o many_o other_o law_n as_o serviceable_a as_o this_o of_o prosecute_a conventicle_n can_v be_v but_o the_o order_n go_v on_o and_o tell_v we_o all_o unlawful_a meeting_n upon_o pretence_n of_o religious_a worship_n now_o i_o shall_v crave_v leave_n before_o i_o proceed_v any_o further_a to_o say_v that_o the_o act_n do_v not_o intend_v to_o disturb_v any_o person_n that_o meet_v true_o to_o worship_n god_n but_o such_o as_o pretend_v religious_a worship_n and_o under_o that_o notion_n disturb_v the_o peace_n and_o quiet_a of_o the_o kingdom_n which_o i_o never_o yet_o hear_v any_o of_o the_o protestant_a dissenter_n ever_o do_v at_o their_o meeting_n and_o therefore_o a_o question_n will_v arise_v whether_o the_o act_n of_o the_o 22th_o of_o this_o king_n there_o be_v now_o no_o other_o in_o force_n against_o conventicle_n be_v a_o act_n that_o can_v disturb_v any_o that_o real_o do_v worship_n god_n in_o their_o meeting_n quiet_o and_o in_o reality_n and_o not_o make_v it_o a_o pretence_n of_o religious_a worship_n in_o the_o next_o place_n the_o order_n tell_v we_o viz._n it_o be_v this_o day_n ordered_n etc._n etc._n that_o the_o law_n for_o suppress_v all_o conventicle_n and_o unlawful_a meeting_n upon_o pretence_n of_o religious_a worship_n within_o this_o county_n etc._n etc._n and_o that_o the_o say_v justice_n do_v use_v their_o utmost_a endeavour_n etc._n etc._n now_o i_o suppose_v that_o this_o order_n be_v make_v by_o the_o justice_n of_o the_o county_n themselves_o and_o for_o the_o same_o justice_n to_o desire_v themselves_o to_o do_v justice_n in_o my_o opinion_n be_v to_o put_v a_o doubt_n or_o a_o distrust_n upon_o their_o worship_n and_o that_o which_o seem_v most_o strange_a be_v the_o general_n order_v itself_o ground_v upon_o this_o act_n when_o in_o the_o act_n itself_o there_o be_v no_o colour_n nor_o warrant_n for_o any_o such_o general_n order_n but_o only_o that_o in_o case_n there_o be_v any_o unlawful_a meeting_n in_o any_o county_n precinct_n or_o division_n and_o be_v prove_v upon_o the_o oath_n of_o two_o witness_n to_o the_o justice_n in_o manner_n and_o form_n as_o by_o the_o act_n be_v direct_v than_o the_o justice_n shall_v grant_v their_o warrant_n to_o the_o constable_n etc._n etc._n to_o seize_v and_o levy_v the_o penalty_n but_o how_o this_o act_n will_v support_v such_o a_o general_n order_n make_v on_o supposition_n without_o any_o witness_n of_o particular_n be_v worthy_a to_o be_v consider_v by_o the_o reader_n then_o the_o order_n go_v on_o viz._n and_o to_o the_o intent_n this_o good_a work_n may_v be_v effectual_o perform_v it_o be_v far_o order_v that_o warrant_n be_v make_v and_o direct_v to_o the_o constable_n etc._n etc._n within_o this_o county_n by_o name_n command_v they_o and_o every_o of_o they_o within_o their_o parish_n division_n and_o limit_n that_o they_o and_o every_o of_o they_o do_v make_v diligent_a inquiry_n of_o all_o the_o conventicle_n and_o unlawful_a meeting_n in_o their_o several_a precinct_n etc._n etc._n now_o this_o order_n seem_v to_o have_v no_o manner_n of_o relation_n to_o the_o act_n or_o thing_n intend_v for_o the_o act_n give_v no_o such_o direction_n either_o to_o the_o justice_n or_o the_o constable_n to_o obey_v any_o such_o order_n for_o though_o the_o act_n command_v the_o officer_n that_o they_o shall_v execute_v any_o warrant_n send_v by_o a_o justice_n to_o seize_v any_o person_n or_o his_o good_n after_o the_o person_n be_v convict_v if_o the_o officer_n or_o constable_n have_v knowledge_n thereof_o by_o good_a information_n yet_o it_o say_v not_o one_o word_n that_o the_o
