themselves_o set_v forth_o that_o all_o plea_n and_o civil_a transaction_n and_o the_o exposition_n and_o construction_n of_o all_o statute_n and_o all_o penalty_n for_o the_o breach_n of_o they_o pertain_v only_o to_o the_o king_n and_o his_o crown_n then_o set_v forth_o the_o time_n of_o make_v the_o act_n of_o 32_o h._n 8._o c._n 38._o and_o the_o act_n itself_o at_o large_a and_o that_o thereby_o it_o be_v enact_v that_o from_o the_o time_n limit_v by_o the_o act_n no_o reservation_n or_o prohibition_n god_n law_n except_v shall_v trouble_v or_o impeach_v any_o marriage_n without_o the_o levitical_a degree_n and_o that_o no_o person_n shall_v be_v admit_v after_o the_o time_n limit_v by_o the_o act_n in_o any_o the_o spiritual_a court_n within_o this_o kingdom_n to_o any_o process_n plea_n or_o allegation_n contrary_a to_o the_o act._n they_o set_v forth_o that_o after_o the_o make_n of_o the_o say_a act_n and_o the_o time_n thereby_o limit_v the_o plaintiff_n be_v lawful_a person_n to_o contract_v marriage_n and_o not_o prohibit_v by_o god_n law_n and_o be_v person_n without_o the_o levitical_a degree_n the_o twenty_o day_n of_o september_n in_o the_o four_o and_o twenty_o year_n of_o the_o king_n at_o lemster_n in_o the_o county_n of_o hereford_n contract_a matrimony_n in_o the_o face_n of_o the_o church_n and_o the_o same_o consummate_v and_o solemninize_v with_o carnal_a knowledge_n and_o fruit_n of_o child_n at_o lemster_n aforesaid_a that_o by_o reason_n thereof_o the_o say_a marriage_n be_v good_a and_o lawful_a and_o ought_v not_o to_o be_v null_v in_o court_n christian_n that_o notwithstanding_o the_o defendant_n praemissorum_fw-la non_fw-la ignarus_fw-la fraudulent_o intend_v to_o grieve_v and_o oppress_v the_o plaintiff_n contract_v matrimony_n within_o the_o degree_n prohibit_v by_o god_n law_n and_o express_v in_o a_o certain_a table_n set_v forth_o by_o public_a authority_n anno_fw-la 1563._o and_o that_o all_o marriage_n so_o contract_v shall_v be_v esteem_v incestuous_a and_o unlawful_a and_o therefore_o shall_v be_v dissolve_v as_o void_a from_o the_o beginning_n and_o also_o that_o whereas_o by_o a_o certain_a act_n of_o parliament_n make_v and_o publish_v in_o the_o eight_o and_o twenty_o year_n of_o king_n henry_n the_o eight_o it_o be_v enact_v that_o no_o person_n or_o person_n subject_a or_o reside_v within_o the_o realm_n of_o england_n or_o within_o the_o king_n dominion_n shall_v marry_v within_o the_o degree_n recite_v in_o the_o say_a act_n upon_o any_o pretence_n whatsoever_o and_o that_o whereas_o the_o say_v thomas_n hill_n have_v take_v to_o wife_n one_o elizabeth_n clark_n and_o for_o several_a year_n cohabit_v with_o she_o as_o man_n and_o wife_n and_o have_v carnal_a kdowledge_n of_o she_o he_o the_o say_a thomas_n notwithstanding_o after_o the_o death_n of_o the_o say_v elizabeth_n have_v marry_v with_o and_o take_v to_o wife_n the_o say_v sarah_n be_v the_o natural_a and_o lawful_a sister_n of_o the_o say_v elizabeth_n against_o the_o form_n of_o the_o say_v last_o mention_v statute_n and_o they_o the_o say_v thomas_n and_o sarah_n have_v cause_v the_o levitical_a degree_n and_o that_o although_o the_o plaintiff_n have_v for_o their_o discharge_n in_o the_o say_a court_n christian_n plead_v the_o say_v first_o recite_v act_n yet_o the_o defendant_n refuse_v to_o admit_v the_o same_o but_o proceed_v against_o they_o as_o for_o a_o incestuous_a marriage_n against_o the_o form_n of_o the_o statute_n and_o that_o notwithstanding_o he_o be_v serve_v with_o the_o king_n write_v of_o prohibition_n to_o desist_v in_o that_o behalf_n in_o contempt_n of_o the_o king_n and_o to_o the_o plaintiff_n damage_n of_o one_o hundred_o pound_n the_o defendant_n deny_v any_o prosecution_n of_o the_o plaintiff_n contrary_a to_o the_o king_n write_v of_o prohibition_n and_o thereupon_o issue_n be_v join_v and_o demur_n upon_o the_o matter_n of_o the_o declaration_n and_o pray_v a_o consultation_n and_o the_o plaintiff_n join_v in_o demurrer_n in_o the_o argument_n upon_o harrison_n case_n i_o say_v and_o still_o say_v that_o if_o grant_v prohibition_n to_o the_o spiritual_a court_n in_o case_n of_o matrimony_n be_v res_fw-la integra_fw-la now_o i_o see_v no_o reason_n why_o we_o shall_v grant_v they_o in_o any_o case_n the_o matter_n be_v whole_o of_o ecclesiastic_a conizance_n my_o reason_n be_v and_o be_v 1._o because_o in_o all_o time_n some_o marriage_n be_v lawful_a and_o other_o prohibit_v by_o divine_a and_o ecclesiastic_a law_n or_o canon_n yet_o the_o temporal_a court_n can_v not_o prohibit_v the_o impeach_a of_o any_o marriage_n how_o lawful_a soever_o nor_o take_v notice_n of_o it_o 2._o if_o by_o act_n of_o parliament_n ancient_o all_o marriage_n not_o prohibit_v by_o god_n law_n or_o canon_n of_o the_o church_n have_v be_v declare_v lawful_a the_o temporal_a court_n thereby_o have_v no_o power_n to_o prohibit_v the_o question_n of_o any_o marriage_n more_o than_o before_o for_o it_o have_v say_v no_o more_o than_o what_o the_o law_n be_v and_o do_v say_v before_o such_o act._n so_o have_v it_o be_v enact_v that_o all_o marriage_n shall_v be_v lawful_a not_o prohibit_v by_o the_o levitical_a law_n the_o church_n have_v retain_v the_o judge_v which_o be_v against_o the_o levitical_a law_n as_o they_o do_v when_o the_o unlawfulness_n be_v not_o confine_v only_o to_o the_o levitical_a law_n and_o the_o question_n now_o concern_v what_o be_v the_o levitical_a degree_n whereof_o we_o assume_v the_o conizance_n be_v but_o the_o same_o as_o the_o question_n will_v be_v concern_v what_o marriage_n be_v prohibit_v in_o the_o eighteen_o of_o leviticus_n for_o though_o such_o act_n of_o parliament_n have_v be_v yet_o they_o have_v give_v no_o new_a jurisdiction_n or_o
