say_a appeal_n to_o be_v null_n and_o void_a provide_v always_o that_o every_o such_o appeal_n shall_v be_v leave_v with_o the_o person_n or_o person_n so_o convict_v as_o aforesaid_a at_o the_o time_n of_o the_o make_v thereof_o and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n headborough_n and_o tything-man_n by_o warrant_n from_o the_o say_a justice_n justice_n or_o chief_a magistrare_fw-la respective_o shall_v and_o may_v with_o what_o aid_n force_n and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v as_o well_o within_o liberry_n as_o without_o and_o take_v into_o their_o custody_n the_o person_n there_o unlawful_o assemble_v to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act_n and_o that_o the_o lieutenant_n or_o deputy-lieutenant_n or_o any_o commissionated_a officer_n of_o the_o militia_n or_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n and_o foot_n and_o also_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v to_o dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custsdy_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v be_v then_o resident_a shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n head-borough_n tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precincts_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n head-borough_n tythingman_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o and_o of_o the_o constable_n head-borough_n or_o tythingman_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o he_o thereof_o convict_v in_o manner_n aforesaid_a he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o the_o levy_a upon_o his_o good_n and_o chattel_n and_o dispose_v in_o manner_n aforesaid_a and_o that_o if_o any_o justice_n of_o the_o peace_n or_o chief_a magistrate_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n he_o shall_v forfeit_v the_o sum_n of_o one_o hundred_o pound_n the_o one_o moiety_n to_o the_o use_n of_o his_o majesty_n the_o other_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v lie_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidente_n and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n or_o if_o the_o plaintiff_n discontinue_v his_o action_n or_o if_o upon_o demurrer_n judgement_n be_v give_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o full_a treble_n cost_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o this_o act_n and_o all_o clause_n therein_o contain_v shall_v be_v construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o the_o peace_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v as_o aforesaid_a shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_v to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n of_o such_o other_o county_n or_o corporation_n wherein_o the_o say_a person_n or_o person_n be_v inhabitant_n or_o be_v flee_v into_o which_o say_a justice_n or_o chief_a magistrate_n respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n as_o sully_v as_o the_o say_v other_o justice_n of_o peace_n may_v have_v do_v in_o case_n he_o or_o they_o have_v be_v inhabitant_n in_o the_o place_n where_o the_o offence_n be_v commit_v provide_v also_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n unless_o such_o offender_n be_v prosecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o provide_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liverty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberry_n thereof_o for_o the_o examine_v convict_a and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberry_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o this_o act_n be_v direct_v to_o be_v do_v by_o any_o justice_n of_o peace_n in_o any_o county_n of_o england_n provide_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o person_n offend_v and_o convict_a as_o aforesaid_a be_v a_o feme-covert_a cohabit_v with_o her_o husband_n the_o penalty_n of_o five_o shilling_n and_o ten_o shilling_n so_o as_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n be_v appear_v by_o the_o act_n of_o uniformity_n of_o 13_o &_o 14_o car._n 2._o cap._n 4._o which_o be_v common_o print_v before_o the_o service_n book_n or_o book_n of_o common-prayer_n so_o where_o there_o be_v any_o exercise_n of_o religion_n in_o public_a that_o be_v where_o five_o or_o more_o be_v meet_v together_o beside_o those_o of_o the_o same_o household_n there_o if_o the_o prayer_n in_o the_o service_n book_n be_v not_o use_v and_o direction_n of_o that_o book_n observe_v that_o be_v a_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n but_o it_o may_v be_v object_v that_o the_o service_n book_n have_v appoint_v the_o form_n of_o public_a prayer_n and_o administration_n of_o the_o sacrament_n etc._n etc._n but_o have_v not_o appoint_v any_o order_n to_o be_v observe_v in_o preach_v and_o therefore_o preach_v in_o a_o conventicle_n can_v be_v say_v to_o be_v in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n there_o be_v no_o manner_n appoint_v by_o the_o liturgy_n for_o preach_v to_o to_o this_o it_o be_v answer_v that_o by_o the_o 22d_o paragraph_n or_o section_n of_o the_o act_n of_o uniformity_n it_o be_v enact_v that_o at_o all_o and_o every_o time_n and_o time_n when_o any_o sermon_n or_o leaure_n be_v to_o he_o preach_v the_o common_a prayer_n and_o service_n in_o and_o by_o the_o say_a book_n viz._n the_o book_n of_o common-prayer_n appoint_v to_o be_v read_v for_o that_o time_n of_o the_o day_n shall_v be_v open_o public_o and_o solemn_o read_v by_o some_o priest_n or_o deacon_n in_o the_o church_n chapel_n or_o place_n of_o public_a worship_n where_o the_o say_a sermon_n or_o lecture_n be_v to_o be_v preach_v before_o such_o sermon_n or_o lecture_n be_v preach_v and_o that_o the_o lecturer_n then_o to_o preach_v shall_v be_v present_a at_o the_o read_n thereof_o so_o that_o preach_v in_o a_o conventicle_n where_o the_o common_a prayer_n appoint_v to_o be_v read_v for_o the_o time_n of_o the_o day_n be_v not_o first_o solemn_o read_v be_v a_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n and_o a_o offence_n against_o this_o statute_n 8._o in_o any_o place_n within_o the_o kingdom_n of_o england_n etc._n etc._n these_o word_n be_v plain_a and_o therefore_o if_o there_o be_v a_o assembly_n or_o meeting_n in_o a_o church_n by_o five_o person_n or_o more_o under_o pretence_n of_o any_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n the_o same_o be_v a_o conventicle_n within_o this_o act_n where_o any_o one_o or_o more_o present_a who_o be_v of_o the_o age_n of_o 16_o or_o upward_o and_o a_o subject_a of_o this_o realm_n aught_o to_o be_v convict_v but_o this_o be_v not_o to_o be_v understand_v of_o foreigner_n and_o alien_n of_o the_o foreign_a reform_a church_n allow_v or_o to_o be_v allow_v by_o his_o majesty_n his_o heir_n or_o successor_n in_o england_n for_o the_o act_n of_o uniformity_n which_o this_o be_v make_v to_o strengthen_v do_v not_o extend_v to_o they_o as_o by_o the_o proviso_n in_o the_o 15_o paragraph_n of_o that_o act_n appear_v and_o which_o prerogative_n of_o allowance_n to_o such_o foreigner_n or_o alien_n church_n be_v save_v to_o his_o majesty_n by_o this_o act_n which_o be_v where_o five_o or_o more_o where_o there_o be_v no_o household_n be_v meet_v together_o under_o colour_n or_o pretence_n of_o any_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n wherein_o these_o thing_n be_v to_o be_v observe_v 1._o that_o the_o person_n or_o person_n that_o be_v to_o be_v punish_v by_o this_o law_n for_o be_v present_a at_o a_o conventicle_n must_v be_v of_o the_o age_n of_o 16_o or_o upward_o and_o a_o subject_a of_o this_o realm_n 2._o that_o though_o the_o person_n to_o be_v punish_v must_v have_v these_o qualification_n yet_o alien_n or_o minor_n if_o they_o be_v of_o discretion_n may_v make_v up_o the_o number_n of_o five_o to_o make_v it_o a_o nevertheless_o a_o conventicle_n though_o four_o of_o the_o five_o can_v be_v punish_v as_o be_v alien_n yet_o the_o five_o be_v a_o subject_a shall_v be_v convict_v and_o punish_v by_o this_o law_n and_o so_o a_o conventicle_n there_o those_o of_o the_o same_o household_n if_o present_a at_o the_o conventicle_n be_v of_o the_o age_n of_o 16_o and_o subject_n of_o this_o realm_n may_v and_o aught_o to_o be_v convict_v for_o be_v at_o the_o conventicle_n as_o well_o as_o any_o other_o i_o think_v by_o the_o word_n household_n both_o lodger_n and_o inmate_n be_v include_v so_o that_o there_o must_v be_v five_o over_o and_o above_o the_o household_n and_o the_o lodger_n and_o inmate_n as_o part_v of_o the_o household_n 4._o the_o preacher_n or_o teacher_n in_o such_o conventicle_n though_o a_o alien_n or_o not_o of_o the_o age_n of_o 16_o aught_o to_o be_v convict_v see_v the_o three_o paragraph_n of_o this_o act._n 5._o if_o a_o subject_a of_o the_o age_n of_o 16_o or_o upward_o be_v present_a at_o the_o church_n or_o assembly_n of_o foreigner_n or_o alien_n of_o the_o foreign_a reform_a church_n allow_v by_o his_o majesty_n he_o be_v not_o to_o be_v convict_v for_o be_v at_o a_o conventicle_n for_o see_v the_o assembly_n itself_o be_v lawful_a he_o that_o be_v present_a at_o it_o can_v be_v say_v to_o have_v commit_v a_o offence_n within_o this_o act._n 10._o then_o where_o any_o five_o person_n or_o more_o be_v so_o assemble_v as_o aforesaid_a it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o one_o or_o more_o justice_n of_o the_o peace_n of_o officer_n require_v the_o door_n to_o be_v open_v and_o the_o conventicler_n make_v no_o answer_n whether_o they_o will_v or_o will_v not_o open_v the_o door_n or_o if_o they_o answer_v that_o they_o will_v open_v the_o door_n but_o notwithstanding_o they_o do_v not_o open_v the_o door_n this_o be_v a_o refusal_n and_o denial_n in_o law_n as_o strong_a as_o if_o they_o have_v express_o refuse_v or_o deny_v to_o open_v the_o door_n and_o thereupon_o the_o officer_n may_v break_v open_a the_o door_n and_o seize_v the_o offender_n of_o mean_a conventicler_n and_o secure_v they_o in_o custody_n until_o the_o officer_n can_v convenient_o bring_v they_o before_o a_o justice_n of_o peace_n to_o be_v convict_v and_o then_o the_o offender_n be_v to_o be_v discharge_v out_o of_o custody_n but_o first_o receive_v a_o certificate_n under_o the_o hand_n and_o seal_n of_o a_o justice_n of_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o any_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v and_o that_o he_o with_o such_o assistance_n be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o this_o certificate_n may_v be_v make_v sometime_o before_o the_o conventicle_n hold_v as_o well_o as_o at_o the_o time_n and_o though_o it_o can_v be_v so_o well_o know_v before_o hand_n whether_o the_o justice_n or_o chief_a magistrate_n with_o such_o assistance_n etc._n etc._n be_v able_a to_o suppress_v the_o conventicle_n or_o not_o yet_o if_o the_o justice_n have_v reason_n or_o any_o probable_a ground_n to_o believe_v that_o he_o shall_v not_o be_v able_a to_o suppress_v the_o conventicle_n whereof_o he_o have_v notice_n he_o may_v make_v his_o certificate_n that_o the_o military_a power_n may_v be_v ready_a for_o if_o a_o certificate_n shall_v not_o be_v make_v till_o the_o very_a time_n of_o the_o conventicle_n hold_v it_o will_v perhaps_o be_v too_o late_o for_o the_o suppress_n of_o they_o and_o the_o word_n of_o the_o act_n be_v to_o prevent_v such_o unlawful_a meeting_n as_o well_o as_o to_o dissolve_v and_o disperse_v they_o and_o note_v that_o if_o there_o be_v such_o a_o conventicle_n as_o can_v be_v suppress_v by_o the_o justice_n himself_o with_o such_o assistance_n as_o he_o can_v get_v but_o there_o be_v need_n of_o military_a power_n or_o some_o other_o great_a power_n to_o be_v raise_v by_o the_o sheriff_n or_o other_o officer_n in_o such_o case_n the_o conventicler_n or_o so_o many_o of_o they_o as_o the_o officer_n suppress_v of_o they_o shall_v think_v fit_a peer_n of_o the_o realm_n only_o except_v may_v be_v take_v into_o custody_n and_o keep_v in_o custody_n for_o such_o convenient_a time_n till_o they_o shall_v be_v convict_v by_o the_o justice_n or_o chief_a magistrate_n but_o suppose_v the_o justice_n that_o will_v suppress_v the_o conventicle_n be_v himself_o a_o deputy-lieutenant_n and_o he_o as_o a_o justice_n be_v not_o able_a to_o suppress_v the_o conventicle_n i_o conceive_v in_o such_o case_n he_o may_v make_v use_n of_o his_o military_a power_n and_o get_v such_o troop_n or_o company_n of_o horse_n and_o foot_n as_o he_o shall_v think_v meet_a and_o can_v get_v in_o readiness_n with_o the_o soon_o by_o this_o law_n any_o justice_n of_o the_o peace_n constable_n or_o other_o officer_n go_v in_o execution_n of_o this_o act_n to_o suppress_v and_o disperse_v such_o unlawful_a assembly_n they_o may_v call_v or_o command_v any_o person_n whatsoever_o into_o their_o aid_n or_o assistance_n and_o in_o case_n of_o such_o person_n so_o assemble_v as_o they_o shall_v think_v fit_a some_o be_v of_o opinion_n and_o it_o have_v be_v so_o resolve_v that_o by_o force_n of_o these_o word_n they_o may_v imprison_v any_o of_o they_o for_o any_o convenient_a time_n in_o order_n to_o examination_n not_o only_o of_o their_o own_o name_n and_o place_n of_o abide_v but_o of_o the_o teacher_n or_o the_o like_a and_o that_o
