such_o submission_n and_o declaration_n as_o in_o this_o act_n be_v afterward_o declare_v and_o appoint_v if_o any_o person_n who_o shall_v offend_v as_o aforesaid_a shall_v not_o within_o three_o month_n after_o they_o be_v convict_v conform_v themselves_o to_o the_o obedience_n of_o the_o law_n in_o come_v to_o church_n to_o hear_v divine_a service_n and_o in_o make_v such_o public_a confession_n and_o submission_n as_o in_o this_o act_n be_v appoint_v be_v thereunto_o require_v by_o the_o bishop_n of_o the_o diocese_n or_o any_o justice_n of_o peace_n where_o the_o person_n shall_v happen_v to_o be_v or_o by_o the_o minister_n or_o curate_n of_o the_o parish_n that_o in_o every_o such_o case_n every_o such_o offendor_n be_v thereunto_o warn_v by_o any_o justice_n of_o peace_n of_o the_o county_n shall_v upon_o his_o or_o their_o corporal_a oath_n before_o the_o justice_n of_o peace_n in_o the_o open_a quarter-session_n or_o at_o the_o assize_n abjure_v the_o realm_n and_o all_o other_o the_o queen_n dominion_n for_o ever_o unless_o her_o majesty_n shall_v licence_v the_o party_n to_o return_v and_o shall_v depart_v out_o of_o the_o realm_n at_o such_o port_n and_o within_o such_o time_n as_o shall_v be_v appoint_v by_o the_o say_a justice_n before_o who_o the_o say_a abjuration_n be_v make_v unless_o the_o offendor_n be_v let_v by_o such_o lawful_a time_n after_o as_o the_o common_a law_n require_v in_o case_n of_o abjuration_n for_o felony_n the_o justice_n of_o peace_n before_o who_o any_o such_o abjuration_n shall_v be_v make_v shall_v cause_v the_o same_o to_o be_v present_o enter_v into_o record_n before_o they_o and_o shall_v certify_v the_o same_o to_o the_o justice_n of_o assize_n and_o goal-delivery_n of_o the_o say_a county_n at_o the_o next_o assize_n if_o any_o such_o offender_n which_o by_o the_o tenor_n of_o this_o act_n be_v to_o be_v abjure_v shall_v refuse_v to_o make_v such_o abjuration_n and_o shall_v not_o go_v to_o such_o haven_n within_o such_o time_n appoint_v and_o depart_v out_o of_o the_o realm_n or_o after_o such_o departure_n shall_v return_v without_o licence_n that_o in_o such_o case_n the_o party_n offend_v shall_v suffer_v as_o in_o case_n of_o felony_n without_o benefit_n of_o the_o clergy_n if_o any_o person_n offend_v against_o this_o act_n shall_v before_o he_o be_v require_v as_o aforesaid_a to_o make_v such_o abjuration_n repair_v to_o some_o parish_n church_n on_o some_o sunday_n or_o festival_n and_o then_o and_o there_o hear_v divine_a service_n and_o before_o sermon_n or_o read_n of_o the_o gospel_n make_v public_a and_o open_a submission_n and_o declaration_n in_o conformity_n to_o the_o law_n according_a to_o this_o act_n that_o then_o every_o such_o penalty_n inflict_v by_o this_o act_n be_v discharge_v the_o submission_n to_o be_v make_v be_v i_o a._n b._n do_v humble_o confess_v and_o acknowledge_v that_o i_o have_v grievous_o offend_v god_n in_o contemn_v her_o majesty_n godly_a and_o lawful_a government_n and_o authority_n by_o absent_v myself_o from_o church_n and_o hear_v divine_a service_n contrary_a to_o the_o godly_a law_n and_o statute_n of_o this_o realm_n and_o in_o use_v and_o frequent_v disorder_v and_o unlawful_a conventicle_n and_o assembly_n under_o pretence_n and_o colour_n of_o exercise_n of_o religion_n and_o i_o be_o hearty_o sorry_a for_o the_o same_o and_o do_v acknowledge_v and_o testify_v in_o my_o conscience_n that_o no_o other_o person_n have_v or_o aught_o to_o have_v authority_n over_o her_o majesty_n and_o i_o do_v promise_n and_o protest_v without_o any_o dissimulation_n or_o any_o colour_n or_o mean_n of_o any_o dispensation_n that_o from_o henceforth_o i_o will_v from_o time_n to_o time_n obey_v and_o perform_v her_o majesty_n law_n and_o statute_n in_o repair_v to_o the_o church_n and_o hear_v divine_a service_n and_o do_v my_o uttermost_a endeavour_n to_o perfom_v the_o same_o the_o for_o that_o purpose_n and_o within_o ten_o day_n after_o certify_v the_o same_o in_o write_v to_o the_o bishop_n of_o the_o diocese_n if_o any_o such_o offendor_n after_o such_o submission_n shall_v afterward_o relapse_n and_o obstinate_o refuse_v to_o repair_v to_o some_o church_n or_o usual_a place_n of_o divine_a service_n or_o shall_v be_v present_a at_o any_o such_o conventicle_n etc._n etc._n under_o colour_n of_o exercise_n of_o religion_n contrary_a to_o her_o majesty_n law_n that_o then_o every_o such_o offendor_n shall_v lose_v the_o benefit_n he_o may_v have_v have_v by_o virtue_n of_o his_o submission_n if_o any_o person_n shall_v hereafter_o relieve_v maintain_v or_o keep_v in_o his_o house_n or_o otherwise_o any_o person_n which_o shall_v obstinate_o refuse_v to_o forty_o pound_n for_o every_o month_n that_o he_o or_o they_o shall_v relieve_v etc._n etc._n any_o person_n so_o offend_v this_o act_n shall_v in_o no_o wise_n extend_v to_o punish_v or_o impeach_v any_o person_n for_o relieve_v or_o keep_v his_o father_n wife_n mother_n child_n ward_n brother_n or_o sister_n or_o his_o wife_n father_n or_o mother_n not_o have_v any_o certain_a place_n of_o habitation_n of_o their_o own_o or_o the_o husband_n or_o wife_n of_o any_o of_o they_o or_o for_o relieve_v maintain_v or_o keep_v any_o such_o person_n as_o shall_v be_v commit_v by_o authority_n to_o the_o custody_n of_o any_o by_o who_o they_o shall_v be_v so_o relieve_v or_o maintain_v these_o two_o last_o clause_n be_v repeal_v by_o the_o 3_o jac._n 4._o all_o duty_n forfeiture_n and_o payment_n due_a to_o the_o queen_n by_o virtue_n of_o this_o act_n or_o the_o act_n of_o the_o 23_o of_o eliz._n concern_v recusant_n may_v be_v recover_v and_o levy_v to_o her_o majesty_n use_n by_o action_n of_o debt_n bill_n plaint_n information_n or_o otherwise_o in_o any_o of_o the_o court_v call_v the_o king_n bench_n common-plea_n or_o exchequer_n in_o such_o sort_n as_o by_o the_o ordinary_a course_n of_o the_o common-law_n any_o other_o debt_n due_a by_o any_o person_n in_o any_o other_o case_n may_v be_v recover_v or_o levy_v where_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n be_v admit_v the_o three_o part_n of_o the_o penalty_n have_v or_o receive_v by_o virtue_n of_o this_o act_n shall_v be_v employ_v and_o bestow_v to_o such_o good_a and_o charitable_a use_n in_o such_o manner_n and_o form_n as_o be_v limit_v and_o appoint_v in_o the_o statute_n make_v in_o the_o 29_o eliz._n c._n 6._o concern_v recusant_n no_o popish_a recusant_n or_o feme_fw-fr covert_n shall_v be_v compel_v to_o abjure_v by_o this_o act._n every_o person_n that_o shall_v abjure_v by_o virtue_n of_o this_o act_n and_o refuse_v be_v thereunto_o require_v as_o aforesaid_a shall_v forfeit_v to_o the_o queen_n all_o his_o good_n and_o chattel_n for_o ever_o and_o his_o land_n and_o tenement_n during_o life_n the_o wife_n of_o any_o such_o offendor_n shall_v not_o lose_v her_o dowry_n nor_o any_o corruption_n of_o blood_n shall_v grow_v or_o be_v by_o reason_n of_o any_o offence_n mention_v in_o this_o act._n every_o person_n above_o sixteen_o year_n of_o age_n bear_v within_o any_o of_o the_o 2._o stat._n 35_o eliz._n cap._n 2._o queen_n dominion_n or_o make_v a_o denizen_n be_v a_o popish_a recusant_n and_o before_o the_o end_n of_o that_o session_n of_o parliament_n convict_v for_o not_o repair_v to_o some_o church_n or_o usual_a place_n of_o divine-service_n but_o forbear_v the_o same_o contrary_a to_o the_o law_n establish_v and_o have_v a_o certain_a place_n of_o abode_n within_o the_o realm_n shall_v within_o forty_o day_n next_o after_o the_o session_n of_o parliament_n if_o they_o be_v in_o the_o realm_n and_o not_o restrain_v by_o imprisonment_n or_o by_o command_n of_o
her_o majesty_n or_o by_o order_n of_o six_o or_o more_o of_o the_o privy-councell_n or_o by_o such_o sickness_n and_o infirmity_n of_o body_n that_o they_o shall_v not_o be_v able_a to_o travel_v without_o imminent_a danger_n of_o their_o life_n and_o in_o such_o case_n of_o absence_n out_o of_o the_o realm_n restraint_n or_o stay_n then_o within_o two_o day_n next_o after_o they_o shall_v return_v into_o the_o realm_n and_o be_v enlarge_v of_o such_o imprisonment_n or_o shall_v be_v able_a to_o travel_v repair_v to_o their_o usual_a place_n of_o abode_n and_o shall_v not_o at_o any_o time_n after_o remove_v above_o five_o mile_n from_o thence_o every_o person_n bear_v in_o any_o of_o the_o queen_n dominion_n or_o denizen_n which_o have_v or_o shall_v have_v any_o certain_a place_n of_o abode_n within_o this_o realm_n which_o be_v a_o popish_a recusant_n and_o thereof_o lawful_o convict_v for_o not_o repair_v to_o some_o church_n or_o usual_a place_n of_o divine_a service_n and_o be_v within_o the_o realm_n at_o the_o time_n they_o shall_v be_v convict_v shall_v within_o forty_o day_n after_o such_o conviction_n if_o they_o be_v not_o restrain_v by_o imprisonment_n or_o otherwise_o as_o aforesaid_a and_o in_o such_o case_n of_o restraint_n then_o within_o twenty_o day_n after_o they_o shall_v be_v enlarge_v or_o be_v able_a to_o travel_v repair_v to_o the_o place_n of_o their_o usual_a dwell_n and_o not_o at_o any_o time_n after_o remove_v above_o five_o mile_n from_o thence_o upon_o pain_n of_o forfeiture_n of_o all_o his_o good_n and_o chattel_n and_o all_o his_o rent_n land_n tenement_n and_o hereditament_n to_o the_o queen_n during_o the_o life_n of_o the_o offendor_n every_o person_n above_o sixteen_o year_n of_o age_n bear_v in_o any_o of_o the_o queen_n dominion_n who_o have_v no_o certain_a place_n of_o abode_n within_o the_o relme_n and_o be_v a_o popish_a recusant_n and_o not_o usual_o repair_v to_o some_o church_n or_o usual_a place_n of_o common-prayer_n but_o forbear_v the_o same_o contrary_a to_o the_o law_n establish_v shall_v within_o 40_o day_n after_o the_o session_n of_o parliament_n if_o they_o be_v within_o the_o realm_n and_o not_o imprison_v or_o stay_v as_o aforesaid_a and_o in_o such_o case_n of_o absence_n out_o of_o the_o realm_n imprisonment_n or_o stay_n then_o within_o twenty_o day_n after_o return_n into_o the_o realm_n and_o be_v enlarge_v or_o able_a to_o travel_v repair_v to_o the_o place_n of_o birth_n or_o where_o the_o father_n or_o mother_n of_o such_o person_n shall_v then_o be_v dwell_v and_o shall_v not_o remove_v above_o five_o mile_n from_o thence_o upon_o pain_n of_o forfeit_v all_o his_o good_n and_o chattel_n and_o all_o his_o land_n tenement_n hereditament_n rent_n and_o annuity_n to_o the_o queen_n during_o the_o life_n of_o the_o offender_n every_o offendor_n aforesaid_a that_o have_v land_n or_o tenement_n by_o copy_n of_o court-roll_n etc._n etc._n shall_v forfeit_v all_o such_o copyhold_a estate_n during_o the_o life_n of_o the_o offendor_n if_o his_o estate_n so_o long_o continue_v to_o the_o lord_n of_o who_o they_o be_v immediate_o hold_v if_o the_o lord_n be_v not_o a_o popish_a recusant_n nor_o convict_v for_o not_o come_v to_o divine_a service_n nor_o seize_v upon_o trust_n for_o such_o recusant_n and_o in_o such_o case_n the_o forfeiture_n to_o be_v to_o the_o queen_n majesty_n all_o such_o person_n as_o by_o this_o act_n be_v to_o make_v their_o repair_n to_o their_o place_n of_o dwell_v or_o to_o the_o place_n of_o their_o birth_n or_o where_o their_o father_n and_o mother_n shall_v be_v dwell_v and_o not_o to_o pass_v above_o five_o mile_n from_o thence_o shall_v within_o twenty_o day_n after_o their_o come_n to_o any_o of_o the_o say_a place_n notify_v their_o come_n thither_o and_o present_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n and_o curate_n of_o the_o parish_n and_o to_o the_o constable_n headborough_z or_o tythingman_n of_o the_o town_n and_o thereupon_o the_o minister_n or_o curate_n shall_v present_o enter_v the_o same_o into_o a_o book_n to_o be_v keep_v in_o every_o parish_n for_o that_o purpose_n and_o afterward_o the_o say_a minister_n or_o curate_n and_o the_o say_a constable_n headborough_z or_o tythingman_n shall_v certify_v the_o same_o in_o write_v to_o the_o justice_n of_o peace_n of_o the_o same_o county_n at_o the_o next_o quarter_n session_n and_o the_o say_a justice_n shall_v enter_v or_o cause_v the_o same_o to_o be_v enter_v by_o the_o clerk_n of_o the_o peace_n in_o the_o roll_n of_o the_o same_o session_n every_o popish_a recusant_n not_o be_v a_o feme_fw-fr covert_n and_o not_o have_v a_o state_n of_o inheritance_n of_o freehold_n to_o the_o clear_a yearly_a value_n of_o twenty_o mark_n or_o in_o good_n and_o chattel_n to_o the_o value_n of_o forty_o pound_n that_o shall_v not_o within_o the_o limit_a time_n repair_v to_o the_o usual_a place_n of_o his_o abode_n or_o to_o the_o place_n of_o his_o birth_n or_o the_o dwell_n of_o his_o father_n or_o mother_n and_o thereupon_o notify_v their_o come_n and_o present_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n or_o curate_n of_o the_o parish_n and_o to_o the_o constable_n head-borough_n or_o tythingman_n of_o the_o town_n within_o such_o time_n and_o in_o such_o manner_n as_o aforesaid_a or_o shall_v after_o remove_v five_o mile_n from_o thence_o and_o shall_v not_o within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v conform_v himself_o to_o resort_v usual_o to_o divine_a service_n and_o in_o make_v such_o public_a confession_n and_o submission_n as_o hereafter_o be_v express_v be_v thereunto_o require_v by_o the_o bishop_n of_o the_o diocese_n or_o any_o justice_n of_o peace_n in_o the_o county_n where_o the_o same_o person_n shall_v chance_v to_o be_v or_o by_o the_o minister_n or_o curate_n of_o the_o parish_n that_o in_o every_o such_o case_n every_o such_o offendor_n be_v thereunto_o warn_v by_o any_o two_o justice_n of_o peace_n or_o coroner_n of_o the_o county_n where_o such_o offendor_n shall_v be_v shall_v upon_o his_o corporal_a oath_n before_o any_o two_o justice_n of_o peace_n or_o coroner_n or_o the_o same_o county_n abjure_v this_o realm_n and_o all_o dominion_n of_o the_o queen_n for_o ever_o and_o thereupon_o shall_v depart_v the_o realm_n in_o such_o time_n as_o shall_v be_v assign_v by_o the_o say_a justice_n or_o coroner_n unless_o within_o the_o time_n appoint_v and_o depart_v the_o realm_n or_o after_o shall_v return_v without_o licence_n from_o the_o queen_n that_o then_o in_o every_o such_o case_n the_o person_n offend_v shall_v suffer_v as_o a_o felon_n without_o benefit_n of_o the_o clergy_n every_o person_n suspect_v to_o be_v a_o jesuit_n or_o seminarie-priest_n who_o be_v examine_v by_o lawful_a authority_n and_o refuse_v to_o answer_v direct_o whether_o he_o be_v a_o jesuit_n or_o not_o shall_v be_v commit_v to_o prison_n without_o bail_n or_o mainprize_n until_o he_o answer_v direct_o every_o person_n confine_v as_o aforesaid_a to_o the_o compass_n of_o five_o mile_n that_o have_v necessary_a occasion_n of_o business_n upon_o licence_n from_o two_o justice_n of_o the_o peace_n in_o the_o same_o county_n under_o their_o hand_n with_o the_o assent_n of_o the_o bishop_n of_o the_o diocese_n in_o writing_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n may_v travel_v about_o his_o necessary_a business_n for_o such_o time_n only_o as_o be_v contain_v in_o the_o licence_n no_o person_n so_o restrain_v as_o aforesaid_a which_o shall_v be_v urge_v by_o process_n without_o fraud_n or_o covin_z and_o be_v bind_v to_o make_v appearance_n in_o any_o of_o her_o majesty_n court_n or_o shall_v be_v send_v to_o by_o three_o or_o more_o of_o her_o majesty_n council_n or_o by_o four_o or_o more_o commissioner_n appoint_v by_o her_o majesty_n to_o make_v appearance_n before_o her_o council_n or_o commissioner_n in_o every_o such_o case_n
seize_v into_o the_o king_n hand_n for_o his_o recusancy_n or_o any_o part_n thereof_o every_o covicted_a popish_a recusant_n not_o marry_v in_o some_o open_a church_n or_o chappel_n or_o otherwise_o then_o according_a to_o the_o church_n of_o england_n by_o a_o minister_n lawful_o authorize_v shall_v be_v disable_v to_o have_v any_o estate_n of_o freehold_n by_o courtesy_n of_o england_n and_o every_o woman_n be_v a_o popish_a recusant_n convict_v which_o shall_v be_v marry_v in_o other_o form_n then_o as_o aforesaid_a shall_v be_v disable_v not_o only_o to_o claim_v any_o dower_n or_o jointure_n but_o also_o the_o widow_n estate_n and_o frankbanck_n in_o any_o customary_a land_n whereof_o her_o husband_n die_v seize_v and_o likewise_o from_o have_v part_n of_o her_o husband_n good_n by_o virtue_n of_o any_o custom_n of_o any_o county_n city_n or_o place_n and_o if_o a_o man_n be_v marry_v contrary_a to_o the_o true_a intent_n of_o this_o statute_n to_o a_o woman_n who_o have_v no_o land_n or_o tenement_n whereby_o he_o may_v become_v tenant_n by_o courtesy_n he_o shall_v forfeit_v 100_o l._n to_o be_v pay_v as_o aforesaid_a every_o popish_a recusant_n which_o shall_v have_v a_o child_n bear_v and_o shall_v not_o within_o a_o month_n after_o cause_n it_o to_o be_v baptize_v by_o a_o lawful_a minister_n according_a to_o the_o law_n of_o the_o realm_n in_o some_o usual_a place_n of_o baptism_n or_o if_o by_o infirmity_n the_o child_n can_v be_v bring_v to_o such_o place_n then_o to_o be_v baptize_v by_o some_o minister_n within_o the_o month_n if_o he_o beliving_a by_o the_o space_n of_o a_o month_n or_o if_o he_o be_v dead_a than_o mother_n of_o such_o child_n shall_v for_o every_o such_o offence_n forfeit_v one_o hundred_o pound_n one_o three_o part_n to_o the_o king_n the_o other_o to_o the_o informer_n who_o will_v sue_v for_o it_o the_o other_o three_o part_n to_o the_o poor_a of_o the_o say_a parish_n to_o be_v recover_v in_o any_o of_o the_o king_n court_n wherein_o no_o essoine_n etc._n etc._n shall_v be_v allow_v if_o any_o popish_a recusant_n not_o be_v excommunicate_v shall_v be_v bury_v in_o any_o place_n other_o than_o the_o church_n or_o church-yard_n or_o not_o according_a to_o the_o ecclesiastical_a law_n of_o the_o realm_n that_o the_o executor_n or_o administrator_n of_o every_o such_o person_n so_o bury_v know_v the_o same_o or_o the_o party_n that_o so_o buri_v he_o shall_v forfeit_v twenty_o pound_n to_o be_v pay_v as_o aforesaid_a if_o the_o child_n of_o any_o of_o the_o subject_n within_o this_o realm_n the_o say_a child_n not_o be_v soldier_n mariner_n merchant_n or_o their_o apprentice_n or_o factor_n shall_v be_v send_v or_o go_v beyond_o sea_n without_o licence_n of_o the_o king_n or_o six_o of_o the_o privy_a council_n whereof_o the_o principal_a secretary_n to_o be_v one_o under_o their_o hand_n and_o seal_n that_o very_o such_o child_n shall_v take_v no_o benefit_n by_o any_o gift_n conveyance_n descent_n devise_n or_o otherwise_o until_o he_o be_v above_o the_o age_n of_o eighteen_o year_n take_v the_o oath_n mention_v in_o a_o act_n make_v that_o session_n entitle_v a_o act_n for_o the_o better_a discovery_n and_o repress_v popish_a recusant_n etc._n etc._n before_o some_o justice_n of_o peace_n of_o the_o county_n where_o such_o parent_n of_o such_o child_n as_o shall_v be_v send_v do_v or_o shall_v inhabit_v in_o the_o mean_a time_n the_o next_o of_o kin_n who_o be_v no_o popish_a recusant_n shall_v enjoy_v all_o the_o say_a land_n etc._n etc._n until_o the_o not_o within_o six_o month_n next_o after_o proclamation_n in_o that_o behalf_n make_v in_o london_n under_o the_o broad_a seal_n return_v into_o this_o realm_n and_o within_o two_o day_n after_o shall_v not_o discover_v the_o same_o to_o some_o justice_n of_o peace_n or_o high_a officer_n within_o 12._o day_n every_o such_o person_n shall_v be_v fine_v and_o imprison_v according_a to_o the_o queen_n pleasure_n and_o every_o such_o justice_n of_o peace_n or_o high_a officer_n which_o shall_v not_o discover_v the_o same_o within_o 28._o day_n to_o some_o of_o the_o queen_n council_n or_o to_o the_o precedent_n or_o vicepresident_n of_o the_o queen_n council_n establish_v in_o the_o north_n or_o march_n of_o wales_n than_o he_o or_o they_o so_o offend_v shall_v forfeit_v 200_o mark_n this_o act_n shall_v be_v certify_v into_o the_o chancery_n by_o such_o party_n before_o who_o the_o same_o shall_v be_v make_v within_o three_o month_n after_o such_o submission_n upon_o pain_n of_o forfeiture_n of_o 100_o l._n for_o every_o such_o offence_n to_o the_o queen_n if_o any_o person_n so_o submit_v himself_o shall_v within_o 10._o year_n after_o come_v within_o 10._o mile_n of_o the_o not_o repair_v to_o some_o church_n chappel_n or_o usual_a place_n of_o common-prayer_n or_o which_o be_v or_o shall_v be_v revokable_a at_o the_o pleasure_n of_o such_o offendor_n or_o in_o any_o wise_a direct_o or_o indirect_o intend_v or_o mean_v to_o or_o for_o the_o behoof_n or_o disposition_n of_o such_o offendor_n or_o in_o consideration_n whereby_o his_o family_n may_v be_v maintain_v shall_v be_v deem_v and_o take_v for_o utter_o void_a etc._n etc._n every_o conviction_n heretofore_o record_v for_o any_o offence_n before_o mention_v not_o already_o estreat_v or_o certify_v into_o the_o queen_n court_n of_o exchequer_n shall_v from_o the_o justice_n before_o who_o the_o record_n of_o such_o conviction_n shall_v be_v remain_v be_v estreat_v and_o certify_v into_o the_o since_o the_o same_o conviction_n in_o manner_n follow_v viz._n one_o moiety_n before_o the_o end_n of_o trinity_n term_n the_o other_o moiety_n before_o the_o end_n of_o hilary_n term_n or_o at_o such_o other_o time_n as_o the_o lord_n treasurer_n chancellor_n and_o chief_a baron_n or_o any_o two_o of_o they_o shall_v by_o composition_n upon_o good_a security_n be_v limit_v before_o the_o end_n of_o the_o say_v trinity_n term_n if_o any_o such_o composition_n shall_v happen_v to_o be_v and_o shall_v also_o in_o every_o easter_n and_o michaelmas_n term_n until_o such_o time_n as_o the_o same_o person_n do_v make_v such_o submission_n pay_v into_o the_o exchequer_n 20_o l._n for_z every_o month_n which_o shall_v incur_v in_o all_o that_o mean_a time_n for_o default_v of_o payment_n of_o the_o say_v 20_o l._n a_o month_n in_o every_o easter_n and_o michaelmas_n term_n after_o such_o conviction_n the_o queen_n by_o process_n out_o of_o the_o say_a exchequer_n may_v take_v seize_v and_o enjoy_v all_o the_o good_n and_o two_o part_n as_o well_o of_o all_o the_o land_n and_o tenement_n etc._n etc._n of_o such_o offendor_n as_o of_o all_o other_o land_n and_o tenement_n liable_a to_o such_o seizure_n by_o the_o true_a intent_n of_o this_o act_n leave_v only_o a_o three_o part_n for_o the_o relief_n of_o the_o offender_n his_o wife_n child_n and_o family_n for_o the_o more_o speedy_a conviction_n of_o such_o offendor_n the_o indictment_n shall_v be_v sufficient_a although_o it_o be_v not_o mention_v that_o the_o offendor_n be_v or_o be_v inhabit_v within_o the_o realm_n of_o england_n or_o any_o other_o of_o the_o queen_n dominion_n but_o if_o it_o shall_v happen_v that_o any_o such_o offendor_n be_v not_o within_o any_o of_o the_o queen_n dominion_n that_o in_o such_o case_n the_o party_n shall_v be_v relieve_v by_o plea_n to_o be_v put_v in_o in_o that_o behalf_n and_o not_o otherwise_o and_o upon_o indictment_n a_o proclamation_n shall_v be_v make_v the_o same_o assize_n or_o goal-delivery_n that_o the_o party_n indict_v shall_v yield_v his_o body_n to_o the_o sheriff_n and_o if_o at_o next_o assize_n or_o goal-delivery_n the_o say_a party_n shall_v not_o make_v appearance_n of_o record_n that_o then_o such_o default_n shall_v be_v deem_v a_o sufficient_a conviction_n in_o law_n if_o any_o such_o offendor_n shall_v make_v submission_n and_o become_v conformable_a according_a to_o the_o form_n of_o the_o statute_n make_v in_o the_o 23_o of_o eliz._n or_o shall_v fortune_n to_o die_v that_o then_o no_o forfeiture_n of_o 20_o l._n a_o month_n nor_o seizure_n of_o land_n from_o and_o after_o such_o submission_n and_o conformity_n or_o death_n and_o full_a satisfaction_n of_o all_o arrearage_n of_o 20_o l._n monthly_o before_o such_o seizure_n due_a or_o payable_a shall_v ensue_v or_o be_v continue_v against_o such_o offendor_n so_o long_o as_o he_o shall_v continue_v in_o come_v to_o divine_a service_n according_a to_o the_o intent_n of_o the_o statute_n the_o lord_n treasurer_n of_o england_n chancellor_n and_o chief_a baron_n or_o any_o two_o of_o they_o may_v assign_v and_o dispose_v of_o the_o full_a three_o part_n of_o the_o twenty_o pound_n for_o every_o month_n pay_v into_o the_o receipt_n of_o the_o exchequer_n towards_o the_o relief_n of_o the_o poor_a of_o house_n of_o correction_n and_o of_o impotent_a and_o maim_a soldier_n this_o act_n or_o any_o thing_n contain_v in_o it_o do_v not_o in_o any_o wise_a extend_v to_o make_v void_a or_o impeach_v any_o grant_n or_o lease_n make_v bonâ_fw-la fide_fw-la without_o fraud_n or_o covin_z and_o not_o revocable_a at_o the_o will_n and_o pleasure_n of_o the_o offendor_n this_o act_n or_o any_o thing_n contain_v therein_o shall_v not_o in_o any_o wise_a be_v construe_v to_o continue_v any_o seizure_n of_o any_o land_n or_o tenement_n of_o such_o offendor_n in_o her_o majesty_n hand_n after_o the_o say_v offender_n death_n which_o land_n or_o tenement_n he_o shall_v have_v or_o be_v seize_v of_o only_a for_o term_v of_o life_n or_o in_o right_a of_o his_o wife_n for_o the_o prevent_n of_o such_o great_a inconvenience_n and_o peril_n as_o a_o month_n without_o lawful_a excuse_n or_o shall_v at_o any_o time_n after_o forty_o day_n after_o the_o session_n of_o that_o parliament_n by_o word_n or_o write_v advise_o go_v about_o to_o move_v or_o persuade_v any_o of_o the_o queen_n subject_n or_o any_o other_o within_o her_o realm_n or_o dominion_n to_o deny_v or_o withstand_v her_o majesty_n power_n or_o authority_n in_o cause_n ecclesiastical_a unite_a and_o annex_v to_o the_o imperial_a crown_n of_o this_o realm_n or_o shall_v advise_o persuade_v any_o person_n to_o forbear_v come_v to_o church_n to_o hear_v divine_a service_n establish_v or_o to_o come_v to_o or_o be_v present_a at_o any_o unlawful_a assembly_n conventicle_n etc._n etc._n upon_o pretence_n of_o religion_n contrary_a to_o the_o establish_a law_n shall_v retain_v in_o service_n see_v or_o livery_n any_o person_n which_o shall_v forbear_v to_o go_v to_o some_o usual_a place_n of_o divine_a service_n by_o the_o space_n of_o a_o month_n shall_v justice_n of_o peace_n of_o the_o county_n with_o the_o privity_n of_o the_o bishop_n of_o the_o diocese_n in_o writing_n or_o of_o the_o lieutenant_n or_o any_o of_o the_o deputy_n lieutenant_n the_o party_n take_v his_o corporal_a oath_n that_o he_o true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n and_o make_v no_o causeless_a stay_n no_o convict_v recusant_n shall_v practice_v the_o common_a law_n as_o a_o councillor_n clerk_n attorney_n or_o solicitor_n nor_o shall_v practise_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practise_v physic_n nor_o be_v a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o any_o court_n nor_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town-clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v office_n as_o captain_n lieutenant_z corporal_n sergeant_n ancient-bearer_n or_o other_o office_n in_o camp_n troop_n band_n or_o company_n of_o soldier_n nor_o bear_v any_o office_n in_o any_o ship_n castle_n or_o fortress_n of_o the_o king_n upon_o penalty_n of_o one_o hundred_o pound_n to_o be_v forfeit_v as_o aforesaid_a no_o popish_a recusant_n convict_v or_o have_v a_o wife_n convict_v shall_v bear_v any_o public_a office_n in_o the_o commonwealth_n every_o marry_a woman_n be_v a_o recusant_n convict_v her_o husband_n not_o be_v convict_v shall_v forfeit_v 2._o three_o part_n of_o her_o jointure_n and_o dower_n during_o her_o life_n and_o be_v make_v uncapable_a of_o be_v executrix_n or_o administratrix_n to_o her_o husband_n every_o popish_a recusant_n convict_v shall_v be_v deem_v as_o a_o person_n excommunicate_v so_o long_o as_o he_o continue_v not_o conformable_a and_o not_o come_v to_o divine_a service_n and_o receive_v the_o sacrament_n and_o take_v the_o oath_n appoint_v by_o this_o parliament_n in_o the_o first_o chap._n yet_o such_o recusant_n may_v sue_v for_o such_o of_o his_o land_n tenement_n etc._n make_v against_o popish_a recusant_n vile_a attempt_n intend_v not_o only_o against_o the_o very_a person_n of_o the_o king_n but_o even_o of_o his_o posterity_n which_o have_v not_o advance_v the_o design_n of_o the_o conspirator_n and_o the_o church_n and_o all_o the_o nobility_n not_o of_o their_o faction_n with_o the_o commons_o in_o parliament_n assemble_v and_o the_o conspirator_n have_v proceed_v so_o far_o that_o they_o have_v not_o only_o make_v provision_n to_o have_v effect_v their_o purpose_n and_o intend_v the_o five_o of_o november_n be_v the_o day_n for_o the_o convention_n
