and_o eight_o penny_n shall_v be_v pay_v upon_o sign_v judgement_n to_o the_o proper_a officer_n who_o sign_v the_o same_o in_o full_a satisfaction_n of_o the_o capiatur_fw-la fine_a and_o all_o fee_n precedent_n council_n and_o justice_n aforesaid_a and_o the_o king_n attorney_n and_o solicitor_n which_o precedent_n council_n justices_z and_o the_o king_n attorney_n and_o solicitor_n shall_v be_v put_v in_o every_o commission_n of_o peace_n in_o every_o of_o the_o say_v twelve_o shire_n and_o whereas_o this_o clause_n be_v find_v inconvenient_a be_v it_o enact_v that_o the_o say_a clause_n be_v repeal_v and_o that_o it_o may_v be_v lawful_a to_o and_o for_o the_o king_n and_o queen_n by_o commission_n under_o the_o great_a seal_n to_o constitute_v nominate_v and_o appoint_v any_o such_o number_n of_o person_n to_o be_v justice_n of_o peace_n in_o any_o of_o the_o say_a county_n of_o wales_n as_o they_o shall_v think_v fit_v according_a to_o such_o way_n and_o method_n as_o be_v common_o use_v for_o the_o constitute_n nominate_v and_o appoint_v of_o justice_n of_o peace_n for_o any_o county_n of_o england_n and_o that_o the_o person_n so_o constitute_v nominate_v and_o appoint_v shall_v have_v power_n and_o authority_n to_o act_v and_o do_v any_o thing_n appertain_v to_o the_o office_n of_o a_o justice_n of_o peace_n in_o as_o large_a and_o ample_a manner_n as_o any_o justice_n of_o peace_n within_o the_o dominion_n of_o wales_n may_v or_o aught_o to_o have_v do_v before_o the_o make_n of_o this_o act_n any_o law_n etc._n etc._n to_o the_o contrary_a notwithstanding_o i._o stat._n 5_o &_o 6_o w._n &_o m._n sess_n 5._o cap._n 5._o indictment_n certiorari_fw-la to_o remove_v indictment_n that_o in_o termtime_n no_o certiorari_fw-la at_o the_o prosecution_n of_o any_o party_n indict_v shall_v be_v grant_v out_o of_o the_o court_n of_o king_n bench_n to_o remove_v any_o indictment_n before_o trial_n have_v and_o from_o before_o the_o justice_n of_o the_o general_n or_o quarter_n session_n of_o the_o peace_n unless_o such_o certiorari_fw-la shall_v be_v grant_v upon_o motion_n of_o council_n and_o rule_n of_o court_n in_o open_a court_n and_o that_o the_o party_n indite_v prosecute_a such_o certiorari_fw-la shall_v find_v two_o manucaptor_n before_o one_o or_o two_o justice_n of_o the_o county_n in_o 20_o l._n to_o plead_v after_o the_o say_a term_n if_o the_o king_n bench_n shall_v not_o appoint_v any_o other_o time_n and_o if_o any_o other_o time_n then_o notice_n to_o be_v give_v to_o the_o prosecutor_n and_o the_o say_a recognizance_n and_o certiorari_fw-la to_o be_v certify_v into_o the_o king_n bench_n and_o there_o file_v and_o the_o name_n of_o the_o prosecutor_n to_o be_v endorse_v and_o if_o the_o party_n prosecute_a such_o certiorari_fw-la be_v the_o defendant_n shall_v not_o before_o allowance_n thereof_o procure_v such_o manucaptor_n to_o be_v bind_v in_o a_o recognizance_n the_o justice_n of_o peace_n may_v try_v the_o say_a indictment_n at_o the_o say_a session_n notwithstanding_o such_o certiorari_fw-la so_o deliver_v ii_o certiorari_fw-la cost_v against_o prosecutor_n of_o a_o so_o contribute_v as_o he_o or_o she_o may_v have_v have_v receive_v and_o enjoy_v if_o the_o respective_a life_n for_o the_o same_o have_v be_v name_v within_o the_o respective_a time_n by_o the_o meaning_n of_o this_o act_n and_o be_v entitle_v to_o have_v and_o receive_v a_o proportion_n discharge_v guardian_n discharge_v as_o any_o other_o contributor_n and_o the_o say_a guardian_n and_o trustee_n as_o to_o the_o say_a sum_n of_o 100_o l._n so_o advance_v be_v hereby_o discharge_v xxvii_o nominee_n contributor_n demand_v money_n shall_v produce_v a_o certificate_n of_o the_o life_n and_o search_v gratis_o and_o if_o any_o ware-house-keeper_n etc._n etc._n shall_v not_o keep_v such_o book_n or_o not_o make_v entry_n as_o aforesaid_a or_o undue_a entry_n or_o refuse_v in_o the_o daytime_n to_o produce_v the_o book_n to_o be_v search_v such_o offender_n be_v convict_v in_o manner_n aforesaid_a shall_v forfeit_v for_o every_o firkin_n of_o butter_n two_o shilling_n and_o six_o to_o their_o customer_n in_o cask_n or_o by_o the_o gallon_n without_o notice_n give_v to_o the_o officer_n of_o excise_n for_o the_o place_n where_o he_o live_v unless_o from_o the_o 29_o day_n of_o septemb_n to_o the_o 25_o of_o march_n yearly_a between_o 5_o in_o the_o morning_n and_o 8_o at_o night_n and_o from_o the_o 25_o of_o march_n to_o the_o 29_o of_o septemb_n between_o 3_o in_o the_o within_o fourteen_o day_n after_o their_o acceptance_n of_o this_o office_n and_o so_o from_o time_n to_o time_n every_o four_o month_n view_v the_o road_n watercourse_n bridge_n cawseys_n etc._n etc._n within_o the_o parish_n etc._n etc._n where_o he_o be_v a_o surveyor_n that_o be_v to_o be_v repair_v by_o the_o parish_n etc._n etc._n and_o present_a upon_o oath_n in_o what_o condition_n public_a notice_n of_o in_o the_o parish-church_n and_o if_o the_o same_o be_v not_o amend_v within_o thirty_o day_n after_o such_o surveyor_n shall_v within_o thirty_o day_n amend_v the_o same_o and_o dispose_v of_o the_o annoyance_n for_o the_o repair_n of_o the_o highway_n and_o shall_v be_v reimburse_v their_o charge_n by_o the_o party_n who_o shall_v have_v do_v the_o same_o and_o in_o case_n of_o refusal_n by_o the_o party_n to_o pay_v such_o charge_n the_o surveyor_n shall_v apply_v themselves_o to_o a_o justice_n of_o peace_n and_o upon_o oath_n before_o he_o make_v of_o notice_n to_o the_o defaulter_n give_v as_o aforesaid_a the_o surveyor_n shall_v be_v repay_v such_o charge_n as_o the_o justice_n of_o peace_n shall_v think_v reasonable_a to_o be_v levy_v as_o aforesaid_a viii_o the_o justice_n of_o peace_n shall_v once_o in_o four_o month_n hold_v a_o special_a session_n and_o summon_v thereunto_o all_o the_o surveyor_n of_o the_o highway_n and_o declare_v to_o they_o what_o they_o be_v oblige_v to_o do_v by_o virtue_n of_o this_o or_o any_o former_a act_n after_o which_o the_o surveyor_n shall_v make_v a_o presentment_n to_o they_o upon_o oath_n of_o the_o state_n of_o the_o highway_n within_o their_o respective_a parish_n etc._n etc._n and_o what_o offence_n and_o neglect_v any_o be_v guilty_a of_o and_o before_o any_o surveyor_n be_v discharge_v of_o his_o office_n he_o shall_v at_o some_o such_o special_a session_n give_v a_o account_n upon_o oath_n of_o all_o money_n that_o have_v come_v to_o his_o hand_n which_o ought_v to_o be_v employ_v in_o amend_v the_o highway_n and_o how_o it_o have_v be_v dispose_v and_o if_o any_o remain_n in_o his_o hand_n he_o shall_v deliver_v it_o to_o the_o next_o surveyor_n or_o in_o case_n of_o failure_n shall_v forfeit_v double_a the_o value_n to_o be_v levy_v and_o dispose_v as_o aforesaid_a ix_o surveyor_n neglect_v their_o duty_n in_o any_o thing_n require_v by_o this_o act_n shall_v forseit_v quarter_n can_v be_v pay_v as_o this_o act_n direct_v and_o where_o any_o soldier_n shall_v be_v upon_o their_o march_n so_o as_o no_o subsistence_n can_v be_v remit_v they_o every_o such_o officer_n before_o departure_n out_o of_o his_o quarter_n where_o such_o regiment_n etc._n etc._n shall_v remain_v for_o any_o time_n whatsoever_o shall_v make_v up_o the_o account_n as_o this_o act_n direct_v upon_o every_o muster_n close_o the_o muster-roll_n upon_o the_o place_n the_o same_o the_o muster_n be_v take_v and_o return_v one_o of_o the_o roll_n in_o parchment_n to_o the_o paymaster_n general_n the_o next_o day_n after_o if_o in_o london_n or_o within_o twenty_o mile_n distance_n and_o if_o at_o a_o far_a distance_n by_o the_o next_o post_n on_o pain_n of_o lose_v their_o employment_n xxix_o justice_n of_o peace_n require_v by_o order_n of_o he_o or_o her_o majesty_n show_v to_o they_o by_o any_o officer_n of_o the_o regiment_n etc._n etc._n then_o march_v shall_v
