or_o for_o the_o chief_a magistrate_n of_o the_o place_n where_o the_o offence_n aforesaid_a shall_v be_v commit_v and_o he_o and_o they_o be_v hereby_o require_v and_o enjoin_v upon_o proof_n to_o he_o or_o they_o respective_o make_v of_o such_o offence_n either_o by_o confession_n of_o the_o party_n or_o oath_n of_o two_o witness_n 3._o which_o oath_n the_o say_a justice_n and_o justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o be_v hereby_o require_v and_o impower_v to_o administer_v or_o by_o notorious_a evidence_n and_o circumstance_n of_o the_o fact_n to_o make_v a_o record_n of_o every_o such_o offence_n under_o he_o or_o their_o hand_n and_o seal_n respective_o which_o record_n so_o make_v as_o aforesaid_a shall_v to_o all_o intent_n and_o purpose_n be_v in_o law_n take_v and_o adjudge_v to_o be_v a_o full_a and_o perfect_a conviction_n of_o every_o such_o offender_n for_o such_o offence_n and_o thereupon_o the_o say_a justice_n justices_z and_o chief_z magistrate_n respective_o shall_v impose_v on_o every_o such_o offender_n so_o convict_v as_o aforesaid_a a_o fine_a of_o five_o shilling_n for_o such_o first_o offence_n which_o record_n and_o conviction_n shall_v be_v certify_v by_o the_o say_a justice_n justices_z or_o chief_z magistrate_n at_o the_o next_o quarter-session_n of_o the_o peace_n for_o the_o county_n or_o place_n where_o the_o offence_n be_v commit_v 2._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n or_o offence_n contrary_a to_o this_o act_n and_o be_v thereof_o in_o manner_n aforesaid_a convict_v than_o such_o offender_n so_o convict_v of_o such_o like_a offence_n or_o offence_n shall_v for_o every_o such_o offence_n incur_v the_o penalty_n of_o ten_o shilling_n 2._o which_o fine_a and_o fine_n for_o the_o first_o and_o every_o other_o offence_n shall_v be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n and_o chattel_n or_o in_o case_n of_o the_o poverty_n of_o such_o offender_n upon_o the_o good_n and_o chattel_n of_o any_o other_o person_n or_o person_n who_o shall_v be_v then_o convict_v in_o manner_n aforesaid_a of_o the_o like_a offence_n at_o the_o same_o conventicle_n at_o the_o discretion_n of_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o so_o as_o the_o sum_n to_o be_v levy_v on_o any_o one_o person_n in_o case_n of_o the_o poverty_n of_o other_o offender_n amount_v not_o in_o the_o whole_a to_o above_o the_o sum_n of_o ten_o pound_n upon_o occasion_n of_o any_o one_o meet_v as_o aforesaid_a 3._o and_o every_o constable_n headborough_z tythingman_n churchwarden_n and_o overseer_n of_o the_o poor_a respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o same_o according_o have_v first_o receive_v a_o warrant_n under_o the_o hand_n and_o seal_n of_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o so_o to_o do_v 4_o the_o say_a money_n so_o to_o be_v levy_v to_o be_v forthwith_o deliver_v to_o the_o same_o justice_n justices_z or_o chief_a magistrate_n and_o by_o he_o or_o they_o to_o be_v distribute_v the_o one_o three_o part_n thereof_o to_o the_o use_n of_o the_o king_n majesty_n his_o heir_n and_o successor_n to_o be_v pay_v to_o the_o high_a sheriff_n of_o the_o county_n for_o the_o time_n be_v in_o manner_n follow_v that_o be_v to_o say_v the_o justice_n or_o justice_n of_o peace_n shall_v pay_v the_o same_o into_o the_o court_n of_o the_o respective_a quarter-session_n which_o say_v court_n shall_v deliver_v the_o same_o to_o the_o sheriff_n and_o make_v a_o memorial_n on_o record_n of_o the_o payment_n and_o delivery_n thereof_o which_o say_v memorial_n shall_v be_v a_o sufficient_a and_o final_a discharge_n to_o the_o say_a justice_n and_o justice_n and_o a_o charge_n to_o the_o sheriff_n which_o say_v discharge_v and_o charge_n shall_v be_v certify_v into_o the_o exchequer_n together_o and_o not_o one_o without_o the_o other_o and_o no_o justice_n shall_v or_o may_v be_v question_v or_o accountable_a for_o the_o same_o in_o the_o exchequer_n or_o elsewhere_o than_o in_o quarter-session_n another_o three_o part_n thereof_o to_o and_o for_o the_o use_n of_o the_o poor_a of_o the_o parish_n where_o such_o offence_n shall_v be_v commit_v and_o the_o other_o three_o part_n thereof_o to_o the_o informer_n and_o informer_n and_o to_o such_o person_n and_o person_n as_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o shall_v appoint_v have_v regard_n to_o their_o diligence_n and_o industry_n in_o the_o discovery_n disperse_v and_o punish_v of_o the_o say_a conventicle_n 3._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n who_o shall_v take_v upon_o he_o to_o preach_v or_o teach_v in_o any_o such_o meeting_n assembly_n or_o conventicle_n and_o shall_v thereof_o be_v convict_v as_o aforesaid_a shall_v forfeit_v for_o every_o such_o first_o offence_n the_o sum_n of_o twenty_o pound_n to_o be_v levy_v in_o manner_n aforesaid_a upon_o his_o good_n and_o chattle_n 2._o and_o if_o the_o say_a preacher_n or_o teacher_n so_o convict_v be_v a_o stranger_n and_o his_o name_n and_o habitation_n not_o know_v and_o be_v flee_v and_o can_v be_v find_v or_o in_o the_o judgement_n of_o the_o justice_n justices_z or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v shall_v be_v think_v unable_a to_o pay_v the_o same_o the_o say_a
justice_n justices_z or_o chief_a magistrate_n respective_o be_v hereby_o impower_v and_o require_v to_o levy_v the_o same_o by_o warrant_n as_o aforesaid_a upon_o the_o good_n &_o chattel_n of_o any_o such_o person_n who_o shall_v be_v present_a at_o the_o same_o conventicle_n any_o thing_n in_o this_o or_o any_o other_o act._n law_n or_o statute_n to_o the_o contrary_a notwithstanding_o and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a 3._o and_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n or_o offence_n contrary_a to_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a than_o such_o offender_n so_o convict_v of_o such_o like_a offence_n or_o offence_n shall_v for_o every_o such_o offence_n incur_v the_o penalty_n of_o forty_o pound_n to_o be_v levy_v and_o dispose_v as_o aforesaid_a 4._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n that_o shall_v witting_o and_o willing_o suffer_v any_o such_o conventicle_n meeting_n or_o unlawful_a assembly_n aforesaid_a to_o be_v hold_v in_o his_o or_o her_o house_n outhouse_n barn_n yard_n or_o backside_n and_o be_v convict_v thereof_o in_o manner_n aforesaid_a shall_v forfeit_v the_o sum_n of_o 20_o l._n to_o be_v levy_v in_o manner_n aforesaid_a upon_o his_o or_o her_o good_n and_o chattel_n or_o in_o case_n of_o he_o or_o her_o poverty_n or_o inability_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o such_o person_n who_o shall_v be_v convict_v in_o manner_n abovesaid_a of_o be_v present_a at_o the_o same_o conventicle_n and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a 5._o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n shall_v by_o any_o clause_n of_o this_o act_n be_v liable_a to_o pay_v above_o ten_o pound_n for_o any_o one_o meeting_n in_o regard_n of_o the_o poverty_n of_o any_o other_o person_n or_o person_n provide_v also_o and_o be_v it_o further_o enact_v that_o in_o all_o case_n of_o this_o act_n where_o the_o penalty_n or_o sum_n charge_v upon_o any_o offender_n exceed_v the_o sum_n of_o ten_o shilling_n and_o such_o offendor_n shall_v find_v himself_o aggrieve_v it_o shall_v and_o may_v be_v lawful_a for_o he_o within_o one_o week_n after_o the_o say_a penalty_n or_o money_n charge_v shall_v be_v pay_v or_o levy_v to_o appeal_v in_o write_v from_o the_o person_n or_o person_n convict_v to_o the_o judgement_n of_o the_o justice_n of_o the_o peace_n in_o the_o next_o quarter-session_n 2._o to_o who_o the_o justice_n or_o justice_n of_o peace_n chief_a magistrate_n or_o alderman_n that_o first_o convict_v such_o offendor_n shall_v return_v the_o money_n levy_v upon_o the_o appellant_n and_o shall_v certify_v under_o his_o and_o their_o hand_n and_o seal_n the_o evidence_n upon_o which_o the_o conviction_n past_a with_o the_o whole_a record_n thereof_o and_o the_o say_a appeal_n 3._o whereupon_o such_o offender_n may_v plead_v and_o make_v defence_n and_o have_v his_o trial_n by_o a_o jury_n thereupon_o 4._o and_o in_o case_n such_o appellant_n shall_v not_o prosecute_v with_o effect_n or_o if_o that_o upon_o such_o trial_n he_o shall_v not_o be_v acquit_v or_o judgement_n pass_v not_o for_o he_o upon_o his_o say_a appeal_n the_o say_a justice_n at_o the_o session_n shall_v give_v treble_a cost_n against_o such_o offender_n for_o his_o unjust_a appeal_n 5._o and_o no_o other_o court_n whatsoever_o shall_v intermeddle_v with_o any_o cause_n or_o cause_n of_o appeal_n upon_o this_o act_n but_o they_o shall_v be_v final_o determine_v in_o the_o quarter-session_n only_o 7._o provide_v always_o and_o be_v it_o further_o enact_v that_o upon_o the_o delivery_n of_o such_o appeal_n as_o aforesaid_a the_o person_n or_o person_n appellant_n shall_v enter_v before_o the_o person_n or_o person_n convict_v into_o a_o recognizance_n to_o prosecute_v the_o say_a appeal_n with_o effect_n 2._o which_o say_v recognizance_n the_o person_n or_o person_n convict_v be_v hereby_o impower_v to_o take_v and_o require_v to_o certify_v the_o same_o to_o the_o next_o quarter_n session_n 3._o and_o in_o case_n no_o such_o recognizance_n be_v enter_v into_o the_o say_a appeal_n to_o be_v null_n and_o void_a 8._o provide_v always_o that_o every_o such_o appeal_n shall_v be_v leave_v with_o the_o person_n or_o person_n so_o convict_v as_o aforesaid_a at_o the_o time_n of_o the_o make_v thereof_o 9_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n justices_z of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n headborough_n and_o tythingman_n by_o warrant_n from_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o shall_v and_o may_v with_o what_o aid_n force_v and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v of_o any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v as_o well_o within_o liberty_n as_o without_o 2._o and_o take_v into_o their_o custody_n the_o person_n there_o unlawful_o assemble_v to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act_n 3._o and_o that_o the_o lieutenant_n or_o deputy_n lieutenant_n or_o any_o commissionated_a officer_n of_o the_o militia_n or_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n and_o foot_n and_o also_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o of_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n 10._o provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v then_o be_v resident_n shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy_n lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v 11._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n headborough_z tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precinct_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n headborough_z tything-man_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o aid_n of_o the_o constable_n headborough_z or_o tything-man_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o be_v levy_v upon_o his_o good_n and_o chattel_n and_o dispose_v in_o manner_n aforesaid_a 2._o and_o that_o if_o any_o justice_n of_o the_o peace_n or_o chief_a magistrate_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n he_o shall_v forfeit_v the_o sum_n of_o one_o
shall_v be_v try_v for_o any_o offence_n against_o this_o act_n by_o his_o peer_n but_o if_o convict_a shall_v be_v disable_v to_o sit_v in_o parliament_n during_o life_n and_o thus_o much_o for_o what_o be_v treason_n at_o this_o day_n by_o the_o statute_n of_o 1_o and_o 2_o phil._n and_o mar._n cap_n 10._o all_o trial_n for_o treason_n shall_v be_v only_o according_a to_o the_o course_n of_o the_o common_a law_n and_o though_o the_o great_a part_n of_o that_o statute_n be_v temporary_a be_v expire_v yet_o this_o clause_n be_v still_o in_o force_n the_o judgement_n in_o all_o case_n of_o high_a treason_n except_o for_o counterfeit_v coin_n for_o a_o man_n be_v that_o he_o shall_v be_v draw_v on_o a_o hurdle_n or_o sledge_n to_o the_o place_n of_o execution_n and_o there_o be_v hang_v by_o the_o neck_n to_o be_v cut_v down_o be_v yet_o alive_a his_o privy_a member_n cut_v off_o his_o bowel_n rip_v up_o take_v out_o and_o burn_v before_o his_o face_n his_o headsevered_a from_o his_o body_n his_o body_n divide_v into_o four_o quarter_n which_o be_v to_o be_v dispose_v of_o as_o the_o king_n shall_v order_v but_o for_o counterfeit_v coin_n only_o draw_v and_o hang_v and_o in_o both_o case_n for_o a_o woman_n for_o modesty_n sake_n it_o be_v only_o that_o she_o shall_v be_v burn_v the_o reason_n or_o signification_n of_o this_o horrid_a judgement_n on_o a_o man_n for_o treason_n be_v thus_o by_o some_o render_v and_o interpret_v 1._o he_o be_v draw_v on_o a_o sledg_n or_o hurdle_n on_o the_o ground_n in_o the_o dirt_n to_o show_v that_o his_o pride_n be_v bring_v down_o for_o treason_n common_o spring_v from_o ambition_n 2._o on_o this_o hurdle_n he_o be_v draw_v backward_o to_o show_v that_o his_o act_n have_v be_v contrary_a to_o order_n unnatural_a and_o preposterous_a 3._o he_o be_v hang_v between_o heaven_n and_o earth_n as_o unworthy_a of_o either_o 4._o he_o be_v cut_v down_o yet_o alive_a and_o his_o privity_n cut_v off_o to_o show_v that_o he_o quarter_n of_o the_o world_n head_v being_n part_n of_o the_o judgement_n in_o treason_n the_o king_n common_o to_o person_n of_o quality_n pardon_n all_o the_o rest_n of_o the_o sentence_n and_o so_o they_o be_v only_o behead_v but_o if_o a_o person_n be_v attaint_v of_o murder_n or_o any_o other_o felony_n if_o he_o be_v behead_v it_o be_v no_o execution_n of_o the_o judgement_n because_o there_o the_o judgement_n always_o be_v that_o he_o be_v hang_v till_o he_o be_v dead_a which_o can_v be_v alter_v so_o that_o have_v count_n cunning_a smark_n late_o be_v convict_v and_o condemn_v for_o the_o murder_n of_o esquire_n thynn_n all_o his_o guiny_n or_o his_o friend_n can_v not_o have_v preserve_v he_o from_o the_o gallow_n unless_o they_o can_v have_v get_v a_o entire_a pardon_n any_o person_n be_v indict_v for_o treason_n may_v challenge_v that_o be_v except_o against_o or_o refuse_v five_o and_o thirty_o juror_n peremptory_o that_o be_v for_o his_o pleasure_n or_o for_o reason_n best_o know_v to_o himself_o and_o without_o assign_v any_o cause_n to_o the_o court_n but_o if_o he_o challenge_v more_o that_o be_v above_o three_o full_a jury_n he_o forseit_v his_o good_n and_o judgement_n of_o peinfort_n &_o dure_v that_o be_v of_o be_v press_v to_o death_n shall_v pass_v upon_o he_o as_o one_o that_o refuse_v the_o trial_n of_o the_o law_n in_o case_n of_o murder_n and_o felony_n a_o man_n can_v challenge_v peremptory_o above_o the_o number_n of_o twenty_o but_o with_o cause_n he_o may_v except_v against_o more_o and_o this_o be_v by_o the_o stat._n of_o 22._o h._n 8._o cap._n 14._o and_o certain_o since_o the_o law_n of_o england_n which_o be_v a_o law_n of_o mercy_n do_v in_o favour_n of_o life_n not_o only_o order_v a_o man_n to_o be_v try_v by_o a_o jury_n of_o his_o country_n and_o equal_n but_o also_o allow_v he_o to_o refuse_v and_o have_v liberty_n of_o except_v against_o so_o many_o of_o those_o as_o shall_v be_v impanel_v for_o that_o purpose_n it_o can_v be_v suppose_v that_o the_o same_o law_n ever_o intend_v that_o the_o prisoner_n shall_v be_v deny_v a_o copy_n of_o the_o panel_n of_o his_o jury_n that_o so_o by_o the_o information_n of_o his_o friend_n or_o otherwise_o he_o may_v know_v their_o quality_n circumstance_n and_o inchnation_n for_o how_o else_o shall_v he_o know_v who_o to_o challenge_v peremptory_o and_o who_o to_o challenge_v with_o cause_n to_o allow_v a_o man_n such_o liberty_n of_o challenge_n and_o give_v he_o no_o opportunity_n of_o such_o inquiry_n be_v but_o to_o mock_v the_o prisoner_n to_o who_o possible_o the_o whole_a jury_n by_o face_n and_o name_n may_v be_v utter_a stranger_n and_o sure_o the_o wisdom_n of_o our_o law_n never_o think_v every_o prisoner_n so_o skill_v in_o metoposcopy_n that_o mere_o by_o look_v on_o a_o parcel_n of_o man_n he_o can_v tell_v which_o of_o they_o be_v indifferent_a and_o which_o bias_v against_o he_o another_o statute_n of_o king_n edward_n the_o three_o anno_fw-la 2._o edw._n 3._o cap._n 2._o in_o what_o case_n only_o pardon_v of_o felony_n shall_v be_v grant_v etc._n etc._n item_n whereas_o offender_n have_v be_v great_o encourage_v because_o the_o charter_n of_o pardon_n have_v be_v so_o easy_o grant_v in_o time_n pass_v of_o manslaughter_n robery_n felony_n and_o other_o trespass_n against_o the_o peace_n 2_o it_o be_v ordain_v and_o enact_v that_o such_o charter_n shall_v not_o be_v grant_v but_o only_o where_o the_o king_n may_v do_v it_o by_o his_o oath_n that_o be_v to_o say_v where_o a_o man_n slay_v another_o in_o his_o own_o defence_n or_o by_o misfortune_n 3_o and_o also_o they_o have_v be_v encourage_v because_o that_o the_o justice_n of_o the_o goal-delivery_n and_o of_o oyer_n and_o terminer_n have_v be_v procure_v by_o great_a man_n against_o the_o form_n of_o the_o statute_n make_v in_o the_o 27_o year_n of_o the_o reign_n of_o king_n edward_n grandfather_n to_o our_o lord_n the_o king_n that_o now_o be_v wherein_o be_v contain_v that_o justice_n assign_v to_o take_v assize_n if_o they_o be_v lay-man_n shall_v make_v deliverance_n and_o if_o the_o one_o be_v a_o clerk_n and_o the_o other_o a_o colour_n or_o pretence_n of_o exercise_n of_o religion_n contrary_a to_o the_o law_n and_o statute_n of_o this_o kingdom_n have_v settle_v themselves_o in_o divers_a corporation_n in_o england_n sometime_o three_o or_o more_o of_o they_o in_o a_o place_n thereby_o take_v a_o opportunity_n to_o distil_v the_o poisonous_a principle_n of_o schism_n and_o rebellion_n into_o the_o heart_n of_o his_o majesty_n subject_n to_o the_o great_a danger_n of_o the_o church_n and_o kingdom_n ii_o be_v it_o therefore_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o say_a parson_n vicar_n curate_n lecturer_n and_o other_o person_n in_o holy_a order_n or_o pretend_v holy_a order_n or_o pretend_v to_o holy_a order_n and_o all_o stipendiaries_n or_o other_o person_n who_o have_v be_v possess_v of_o any_o ecclesiastical_a or_o spiritual_a promotion_n and_o every_o of_o they_o who_o have_v not_o declare_v their_o unfeigned_a assent_n and_o consent_v as_o aforesaid_a and_o subscribe_v the_o declaration_n aforesaid_a and_o shall_v not_o take_v and_o subscribe_v the_o oath_n follow_v i_o a._n b._n do_v swear_v that_o it_o be_v not_o lawful_a upon_o any_o pretence_n whatsoever_o to_o take_v arm_n against_o the_o king_n and_o that_o i_o do_v abhor_v that_o traitorous_a position_n of_o take_v arm_n by_o his_o authority_n against_o his_o person_n or_o town_n or_o place_n as_o aforesaid_a or_o for_o any_o other_o person_n or_o person_n as_o shall_v not_o first_o take_v and_o subscribe_v the_o aforesaid_a oath_n and_o as_o shall_v not_o frequent_v divine_a service_n establish_v by_o the_o law_n of_o this_o kingdom_n and_o carry_v he_o or_o herself_o reverent_o decent_o and_o orderly_o there_o to_o teach_v any_o public_a or_o private_a school_n or_o take_v any_o boarder_n or_o tabler_n that_o be_v teach_v or_o instruct_v by_o he_o or_o herself_o or_o any_o other_o upon_o pain_n for_o every_o such_o offence_n to_o forfeit_v the_o sum_n of_o forty_o pound_n to_o be_v recover_v and_o distribute_v as_o aforesaid_a v._o provide_v also_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v be_v lawful_a for_o any_o two_o justice_n of_o the_o peace_n of_o the_o respective_a county_n upon_o oath_n to_o they_o of_o any_o offence_n against_o this_o act_n which_o oath_n they_o be_v hereby_o impower_v to_o administer_v to_o commit_v the_o offender_n for_o six_o month_n without_o bail_n or_o mainprize_n unless_o upon_o or_o before_o such_o commitment_n he_o shall_v before_o the_o say_a justice_n of_o psalm_n of_o david_n point_v as_o they_o be_v to_o be_v sing_v or_o say_v in_o church_n and_o the_o form_n and_o manner_n of_o make_v ordain_v and_o consecrate_v of_o bishop_n priest_n and_o deacon_n the_o declaration_n be_v by_o the_o act_n last_o mention_v as_o
hundred_o pound_n the_o one_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v lie_v 12._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n 2._o and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o full_a treble_n cost_v 13._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o this_o act_n and_o all_o clause_n therein_o contain_v shall_v be_v construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o 2._o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n 3._o and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o peace_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v as_o aforesaid_a shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_n to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n of_o such_o other_o county_n or_o corporation_n wherein_o the_o say_a person_n or_o person_n be_v inhabitant_n or_o be_v flee_v into_o 4._o which_o say_v justice_n or_o chief_a magistrate_n respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n as_o full_o as_o the_o say_v other_o justice_n of_o peace_n may_v have_v do_v in_o case_n he_o or_o they_o have_v be_v inhabitant_n in_o the_o place_n where_o the_o offence_n be_v commit_v 14._o provide_v also_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n unless_o such_o offender_n be_v prosecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v 2._o and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o 15._o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liberty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberty_n thereof_o for_o the_o examine_v convict_v and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberty_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o this_o act_n be_v direct_v to_o be_v do_v by_o any_o justice_n of_o peace_n in_o any_o county_n of_o england_n 16._o provide_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o person_n offend_a and_o convict_a as_o aforesaid_a be_v a_o feme-covert_n cohabit_v with_o her_o husband_n the_o penalty_n of_o five_o shilling_n and_o ten_o shilling_n so_o as_o aforesaid_a incur_v shall_v be_v levy_v by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o the_o husband_n of_o each_o feme-covert_n 17._o provide_v also_o that_o no_o peer_n of_o this_o realm_n shall_v be_v attach_v or_o imprison_v by_o virtue_n or_o force_n of_o this_o act_n any_o thing_n matter_n or_o clause_n therein_o to_o the_o contrary_a notwithstanding_o 18._o provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o invalidate_v or_o avoid_v his_o majesty_n supremacy_n in_o ecclesiastical_a affair_n 2._o but_o that_o his_o as_o full_o and_o as_o ample_o as_o himself_o or_o any_o of_o his_o predecessor_n have_v or_o may_v have_v do_v the_o same_o any_o thing_n in_o this_o act_n notwithstanding_o note_n upon_o the_o forego_n act._n 1._o by_o the_o title_n preamble_n and_o scope_n of_o the_o act_n it_o appear_v that_o the_o same_o be_v intend_v for_o suppress_v seditious_a conventicle_n under_o pretence_n of_o religious_a worship_n that_o be_v where_o the_o conventicler_n meet_v together_o under_o a_o pretence_n of_o worship_n not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n but_o indeed_o to_o carry_v on_o ill_a design_n against_o the_o state_n 2._o if_o any_o such_o conventicle_n be_v the_o justices_z know_v it_o by_o the_o oath_n of_o two_o witness_n may_v make_v a_o record_n thereof_o and_o then_o the_o person_n so_o offend_v shall_v forfeit_v so_o as_o in_o the_o act_n you_o have_v hear_v 3._o it_o must_v appear_v upon_o oath_n before_o the_o justice_n or_o confession_n of_o the_o party_n 1._o that_o it_o be_v a_o seditious_a conventicle_n meet_v together_o to_o disturb_v the_o peace_n under_o pretence_n of_o religion_n 2._o that_o the_o worship_n there_o practise_v be_v not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n so_o that_o the_o informer_n must_v be_v present_a the_o whole_a time_n of_o the_o meeting_n for_o if_o they_o only_o hear_v a_o man_n pray_v or_o preach_v that_o be_v not_o contrary_a to_o the_o practice_n of_o the_o church_n of_o england_n and_o how_o do_v it_o appear_v that_o they_o do_v not_o read_v the_o liturgy_n 3._o it_o must_v be_v prove_v that_o there_o be_v assemble_v five_o person_n or_o more_o beside_o the_o inhabitant_n in_o the_o house_n 4._o if_o a_o party_n be_v fine_v above_o ten_o shilling_n if_o he_o pay_v down_o the_o money_n or_o it_o be_v levy_v within_o one_o week_n after_o such_o payment_n or_o levy_n he_o may_v appeal_v from_o the_o justice_n convict_v to_o the_o next_o quarter-session_n where_o he_o shall_v have_v a_o trial_n by_o jury_n thereupon_o and_o undoubted_o if_o it_o do_v not_o appear_v to_o the_o say_a jury_n that_o it_o be_v a_o seditious_a meeting_n they_o ought_v to_o find_v for_o the_o appealer_n 5._o a_o general_n warrant_v from_o any_o justice_n or_o justice_n to_o constable_n to_o inquire_v after_o seize_v etc._n etc._n all_o conventicle_n in_o their_o precinct_n be_v not_o good_a it_o ought_v to_o particularize_v the_o house_n and_o place_n house_n and_o place_n where_o the_o conventicle_n be_v or_o conventicle_n be_v hold_v and_o then_o the_o constable_n ought_v forthwith_o to_o go_v and_o if_o he_o find_v it_o so_o to_o suppress_v it_o but_o otherwise_o the_o constable_n may_v be_v put_v to_o endless_a vexation_n in_o hunt_v after_o meeting_n to_o no_o purpose_n whereas_o the_o act_n enjoin_v he_o no_o such_o trouble_n and_o if_o you_o go_v once_o and_o find_v no_o conventicle_n you_o be_v not_o oblige_v to_o go_v a_o second_o time_n on_o the_o same_o warrant_n but_o aught_o to_o have_v a_o new_a one_o nor_o be_v the_o constable_n oblige_v to_o turn_v informer_n 6._o as_o to_o break_v open_a door_n you_o see_v the_o act_n direct_v that_o it_o may_v be_v do_v first_o only_a in_o a_o house_n where_o it_o be_v inform_v there_o be_v actual_o a_o conventicle_n as_o aforesaid_a that_o be_v upon_o the_o oath_n of_o two_o person_n 2._o the_o constable_n &c._n &c._n can_v do_v this_o without_o first_o there_o be_v a_o demand_n and_o denial_n to_o enter_v 3._o nor_o then_o neither_o without_o a_o warrant_n from_o the_o justice_n to_o that_o purpose_n if_o a_o constable_n upon_o a_o light_n vain_a tale_n without_o two_o person_n swear_v it_o that_o there_o be_v at_o such_o a_o house_n a_o meeting_n and_o without_o warrant_n shall_v venture_v to_o break_v open_a the_o door_n and_o there_o be_v find_v no_o conventicle_n he_o make_v himself_o liable_a to_o
liberty_n and_o of_o other_o contain_v in_o our_o charter_n of_o liberty_n of_o our_o forest_n the_o archbishop_n bishop_n abbot_n prior_n earl_n baron_n knight_n freeholder_n and_o other_o our_o subject_n have_v give_v unto_o we_o the_o fifteen_o part_n of_o all_o their_o movable_n 5._o and_o we_o have_v grant_v unto_o they_o on_o the_o other_o part_n that_o neither_o we_o nor_o our_o heir_n shall_v procure_v or_o do_v any_o thing_n whereby_o the_o liberty_n in_o this_o charter_n contain_v shall_v be_v infringe_v or_o broken_n 6._o and_o if_o any_o thing_n be_v procure_v by_o any_o
