the_o time_n be_v or_o some_o one_o of_o they_o or_o if_o there_o be_v none_o than_o the_o chief_a constable_n of_o the_o hundred_o where_o such_o town_n parish_n or_o chapel_n be_v or_o one_o of_o they_o as_o well_o in_o place_n exempt_a as_o not_o exempt_a shall_v once_o every_o year_n present_v the_o monthly_a absence_n from_o church_n of_o all_o popish_a recusant_n within_o such_o town_n and_o parish_n and_o shall_v present_v the_o name_n of_o every_o of_o the_o child_n of_o the_o say_a recusant_n be_v above_o the_o age_n of_o nine_o year_n and_o as_o near_o as_o they_o can_v the_o age_n of_o the_o say_a child_n as_o also_o the_o name_n of_o the_o servant_n of_o the_o say_a recusant_n at_o the_o next_o general_n or_o quarter-session_n of_o that_o shire_n limit_n division_n or_o liberty_n all_o such_o presentment_n shall_v be_v record_v in_o the_o say_a session_n by_o the_o clerk_n of_o the_o peace_n or_o town-clerk_n for_o the_o time_n be_v without_o any_o fee_n and_o for_o default_n of_o every_o such_o presentment_n the_o say_a churchwarden_n constable_n or_o high-constable_n shall_v forfeit_v twenty_o shilling_n and_o for_o default_n of_o record_v such_o presentment_n without_o a_o fee_n the_o clerk_n of_o the_o peace_n or_o town-clerke_a shall_v forfeit_v 40._o s._n every_o presenement_n make_v by_o any_o churchwarden_n constable_n or_o high-constable_n as_o aforesaid_a whereby_o any_o recusant_n shall_v happen_v to_o be_v convict_v shall_v be_v reward_v by_o have_v 40._o s._n to_o be_v levy_v out_o of_o such_o recusants_n good_n and_o estate_n in_o such_o manner_n as_o by_o the_o more_o part_n of_o the_o justice_n shall_v be_v order_v by_o warrant_n under_o their_o hand_n and_o seal_n the_o justice_n of_o assiize_n and_o justice_n of_o quarter-session_n have_v power_n to_o hear_v and_o determine_v of_o all_o recusant_n as_o well_o for_o not_o receive_v the_o sacrament_n as_o for_o not_o come_v to_o church_n and_o have_v also_o power_n to_o make_v proclamation_n that_o the_o body_n of_o every_o such_o offendor_n shall_v be_v render_v to_o the_o sheriff_n of_o the_o county_n or_o the_o baylif_n or_o keeper_n of_o the_o goal_n of_o the_o liberty_n before_o the_o next_o assize_n general_n or_o quarter-session_n and_o if_o then_o the_o offendor_n shall_v not_o make_v his_o appearance_n upon_o record_n that_o every_o such_o default_n shall_v be_v deem_v as_o a_o sufficient_a conviction_n by_o verdict_n of_o 12_o man_n this_o statute_n recite_v the_o penalty_n impose_v by_o the_o 29_o eliz._n 6._o upon_o a_o recusant_n convict_v and_o that_o every_o conviction_n shall_v be_v certify_v into_o the_o exchequer_n as_o be_v in_o the_o statute_n of_o 23_o el._n 1._o concern_v recusant_n monthly_a forfeiture_n yet_o by_o this_o statute_n the_o king_n may_v refuse_v the_o 20_o l._n a_o month_n and_o take_v the_o 2_o part_n of_o the_o recusants_n land_n yet_o the_o king_n shall_v not_o take_v into_o his_o two_o part_n the_o mansion_n house_n nor_o shall_v demise_n nor_o lease_n over_o the_o 2_o three_o part_n or_o any_o part_n thereof_o to_o any_o recusant_n nor_o to_o the_o use_n of_o any_o recusant_n and_o whosoever_o shall_v take_v any_o lease_n of_o the_o king_n of_o such_o land_n shall_v give_v such_o security_n as_o the_o court_n of_o exchequer_n shall_v allow_v not_o to_o suffer_v any_o waste_n to_o be_v commit_v upon_o the_o premise_n for_o the_o better_a trial_n how_o the_o king_n subject_n stand_v affect_v in_o point_n of_o loyalty_n and_o due_a obedience_n it_o be_v enact_v that_o after_o the_o end_n of_o the_o session_n of_o parliament_n any_o bishop_n of_o the_o diocese_n or_o any_o two_o justice_n of_o peace_n whereof_o one_o of_o the_o quorum_fw-la within_o the_o jurisdiction_n of_o their_o session_n may_v require_v any_o person_n of_o the_o age_n of_o 18_o year_n or_o above_o be_v or_o which_o shall_v be_v convict_v or_o indict_v for_o any_o recusancy_n except_o nobleman_n and_o noble_a woman_n for_o not_o repair_v to_o divine_a service_n according_a to_o law_n or_o have_v not_o receive_v the_o sacrament_n twice_o within_o the_o year_n next_o pass_v or_o any_o person_n pass_v through_o the_o county_n or_o liberty_n and_o unknown_a except_o as_o be_v before_o except_v that_o be_v examine_v by_o they_o upon_o oath_n shall_v confess_v or_o not_o deny_v himself_o to_o be_v a_o recusant_n or_o shall_v confess_v or_o not_o deny_v that_o he_o have_v not_o take_v the_o sacrament_n twice_o within_o the_o year_n to_o take_v this_o oath_n hereafter_o upon_o the_o holy_a evangelist_n which_o say_v bishop_n or_o two_o justice_n shall_v certify_v in_o write_v subscribe_v with_o his_o or_o their_o hand_n at_o the_o next_o general_n or_o quarter-session_n the_o christian_a name_n surname_n and_o place_n of_o abode_n of_o every_o person_n which_o shall_v take_v the_o say_a oath_n which_o certificate_n shall_v be_v there_o record_v and_o keep_v among_o record_n of_o the_o say_a session_n if_o any_o person_n other_o than_o nobleman_n and_o noble_a woman_n shall_v refuse_v to_o answer_v upon_o oath_n to_o such_o bishop_n or_o justice_n of_o peace_n or_o take_v the_o say_a oath_n due_o tender_v than_o the_o say_a bishop_n or_o justice_n of_o peace_n shall_v commit_v the_o same_o person_n to_o the_o common_a goal_n without_o bail_n or_o mainprize_n until_o the_o next_o assize_n or_o quarter_n session_n where_o the_o say_a oath_n shall_v be_v again_o tender_v unto_o they_o by_o the_o justice_n of_o affize_v or_o justice_n of_o peace_n or_o the_o great_a part_n of_o they_o and_o if_o such_o person_n shall_v then_o refuse_v to_o take_v the_o oath_n he_o shall_v incur_v the_o penalty_n of_o a_o praemunire_n except_o woman_n covert_a who_o upon_o refusal_n shall_v only_o be_v commit_v to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o they_o take_v the_o say_a oath_n the_o tenor_n of_o the_o oath_n i_o a._n b_o do_v true_o and_o sincere_o acknowledge_v profess_v testify_v and_o declare_v in_o my_o conscience_n before_o god_n and_o the_o world_n that_o our_o sovereign_a offer_v any_o violence_n or_o hurt_n to_o his_o majesty_n royal_a person_n state_n or_o government_n or_o to_o any_o of_o his_o majesty_n subject_n within_o his_o majesty_n dominion_n also_o i_o swear_v from_o my_o heart_n that_o notwithstanding_o any_o declaration_n or_o sentence_n of_o excommunication_n or_o deprivation_n make_v or_o grant_v or_o to_o be_v make_v or_o grant_v by_o the_o pope_n or_o his_o successor_n or_o by_o any_o authority_n derive_v or_o pretend_v to_o be_v derive_v from_o he_o or_o he_o see_v against_o the_o say_a king_n his_o heir_n and_o suceessor_n or_o any_o by_o reason_n or_o colour_n of_o any_o such_o declaration_n or_o sentence_n or_o otherwise_o and_o will_v do_v my_o endeavour_n to_o disclose_v and_o make_v know_v unto_o his_o majesty_n his_o heir_n and_o successor_n all_o treason_n and_o traitorous_a conspiracy_n which_o i_o shall_v know_v or_o hear_v of_o to_o be_v against_o he_o or_o any_o of_o they_o i_o do_v far_o swear_v that_o i_o do_v discharge_v reverse_v for_o default_n of_o form_n other_o then_o by_o direct_a travers_n to_o the_o point_n of_o not_o come_v to_o church_n or_o not_o receive_v the_o say_a sacrament_n if_o any_o person_n so_o indict_v afterward_o submit_v and_o conform_v himself_o and_o become_v obedient_a to_o the_o law_n of_o the_o church_n of_o england_n and_o hear_v divine_a service_n according_a to_o the_o statute_n in_o that_o case_n make_v and_o public_o receive_v the_o sacrament_n according_a to_o the_o law_n of_o this_o realm_n that_o then_o every_o such_o person_n may_v reverse_v and_o discharge_v the_o say_a indictment_n every_o subject_n of_o this_o realm_n that_o shall_v pass_v out_o of_o this_o realm_n and_o voluntary_o serve_v any_o foreign_a prince_n state_n or_o potentate_n not_o have_v take_v this_o oath_n as_o aforesaid_a shall_v be_v a_o fellow_n if_o any_o gentleman_n or_o person_n of_o high_a degree_n or_o any_o person_n or_o person_n which_o have_v bear_v or_o shall_v bear_v any_o office_n of_o captain_n lieutenant_z or_o any_o other_o office_n in_o camp_n army_n or_o company_n of_o soldier_n shall_v after_o voluntary_o serve_v any_o foreign_a prince_n state_n or_o potentate_n before_o he_o shall_v become_v bind_v by_o obligation_n with_o two_o such_o surety_n as_o shall_v be_v allow_v by_o the_o officer_n which_o by_o this_o act_n be_v limit_v to_o take_v such_o bond_n unto_o the_o king_n in_o the_o sum_n of_o 20_o l._n at_o least_o with_o condition_n to_o the_o effect_n follow_v shall_v be_v a_o felon_n the_o tenor_n of_o the_o condition_n follow_v viz._n that_o if_o the_o within_o bind_a etc._n etc._n shall_v not_o at_o any_o time_n then_o after_o be_v reconcile_v to_o the_o pope_n or_o sea_n of_o rome_n nor_o shall_v enter_v into_o or_o consent_v unto_o any_o practice_n plot_n or_o conspiracy_n whatsoever_o against_o the_o king_n majesty_n his_o heir_n and_o successor_n or_o any_o of_o he_o or_o their_o estate_n or_o estate_n realm_n or_o dominion_n but_o shall_v within_o convenient_a time_n after_o knowledge_n thereof_o have_v reveal_v &_o disclose_v to_o the_o king_n majesty_n his_o heir_n and_o successor_n or_o some_o of_o the_o lord_n of_o he_o or_o their_o honourable_a privy_a council_n all_o such_o practice_n plot_n and_o conspiracy_n that_o then_o this_o obligation_n to_o be_v void_a the_o customer_n and_o controller_n of_o every_o port_n haven_n or_o creek_n or_o one_o of_o they_o and_o their_o deputy_n and_o none_o other_o may_v receive_v such_o bond_n to_o the_o use_v aforesaid_a and_o minister_v the_o oath_n aforesaid_a take_v for_o such_o bond_n six_o penny_n and_o no_o more_o and_o for_o such_o oath_n nothing_o which_o say_v customer_n and_o controller_n shall_v register_n and_o certify_v such_o bond_n and_o oath_n so_o take_v into_o the_o exchequer_n at_o westminster_n once_o every_o year_n upon_o penalty_n of_o 5_o l._n for_o every_o bond_n not_o so_o certify_v and_o 20_o s._n for_o every_o oath_n not_o so_o certify_v if_o any_o person_n put_v in_o practice_n to_o absolve_v or_o persuade_v any_o of_o the_o king_n subject_n from_o their_o natural_a obedience_n to_o his_o majesty_n either_o within_o or_o without_o the_o dominion_n or_o upon_o the_o sea_n etc._n etc._n or_o to_o reconcile_v they_o to_o the_o pope_n or_o sea_n of_o rome_n or_o any_o other_o prince_n state_n or_o potentate_n that_o then_o every_o such_o person_n their_o aider_n counsellor_n and_o abettor_n shall_v be_v adjudge_v traitor_n and_o every_o person_n which_o shall_v willing_o be_v absolve_v or_o reconcile_v as_o aforesaid_a shall_v be_v adjudge_v a_o traitor_n the_o last_o branch_n shall_v not_o extend_v to_o any_o person_n which_o shall_v be_v only_o reconcile_v to_o the_o pope_n or_o see_v of_o rome_n and_o shall_v return_v into_o this_o realm_n and_o within_o six_o day_n after_o before_o the_o bishop_n of_o the_o diocese_n or_o two_o justice_n of_o peace_n joint_o or_o several_o submit_v himself_o to_o his_o majesty_n law_n and_o take_v the_o oath_n of_o supremacy_n make_v in_o the_o first_o year_n of_o the_o queen_n *_o and_o also_o the_o 1._o cap._n 1._o oath_n mention_v in_o this_o statute_n where_o oath_n be_v so_o take_v the_o bishop_n and_o justice_n shall_v at_o the_o next_o general_n or_o quarter-session_n certify_v upon_o the_o penalty_n of_o forty_o pound_n all_o person_n who_o offend_v against_o this_o branch_n of_o the_o statute_n shall_v be_v indict_v and_o try_v by_o the_o justice_n of_o assize_n and_o goal-delivery_n of_o that_o county_n for_o the_o time_n be_v or_o before_o the_o justice_n of_o the_o king_n bench_n and_o there_o be_v proceed_v against_o according_a to_o the_o law_n against_o traitor_n as_o if_o the_o offence_n have_v be_v commit_v in_o the_o same_o county_n if_o any_o peer_n of_o the_o realm_n shall_v happen_v to_o be_v indict_v of_o any_o offence_n make_v treason_n by_o this_o act_n he_o shall_v be_v try_v by_o his_o peer_n if_o any_o person_n shall_v not_o resort_v weekly_o to_o some_o usual_a place_n of_o divine_a service_n any_o justice_n of_o peace_n in_o the_o limit_v division_n or_o liberty_n where_o such_o person_n shall_v dwell_v may_v give_v a_o warrant_n to_o the_o churchwarden_n of_o the_o parish_n upon_o proof_n or_o confession_n make_v before_o he_o to_o levy_v twelve_o penny_n for_o every_o such_o default_n by_o distress_n and_o sale_n of_o the_o good_n of_o the_o offendor_n and_o for_o default_n of_o such_o distress_n the_o say_a justice_n may_v commit_v the_o offendor_n to_o prison_n until_o payment_n be_v make_v no_o man_n shall_v be_v impeach_v upon_o this_o clause_n except_o it_o be_v within_o one_o month_n after_o such_o default_n make_v no_o man_n be_v punish_v according_a to_o this_o branch_n shall_v for_o the_o same_o offence_n be_v punish_v by_o forfeiture_n of_o twelve_o penny_n upon_o the_o law_n make_v in_o the_o first_o year_n of_o queen_n eliz._n this_o statute_n repeal_v the_o two_o branch_n of_o 35_o eliz._n 1._o the_o first_o beginning_n be_v for_o that_o every_o person_n have_v house_n or_o family_n be_v in_o bind_a duty_n to_o have_v special_a regard_n of_o the_o goal_n governance_n and_o order_n of_o the_o same_o and_o so_o forth_o to_o the_o next_o clause_n begin_v thus_o provide_v nevertheless_o that_o this_o act_n shall_v not_o in_o any_o wise_a extend_v to_o punish_v or_o impeach_v any_o person_n for_o relieve_v etc._n etc._n end_n with_o these_o word_n any_o thing_n in_o this_o act_n contain_v to_o the_o contrary_a notwithstanding_o in_o lieu_n whereof_o every_o person_n which_o shall_v willing_o maintain_v relieve_v or_o keep_v in_o his_o house_n any_o servant_n sojourner_n or_o stranger_n which_o shall_v not_o repair_v to_o some_o usual_a place_n of_o divine_a service_n according_a to_o law_n by_o the_o space_n of_o one_o month_n not_o have_v a_o reasonable_a excuse_n shall_v forfeit_v ten_o shilling_n for_o every_o such_o month_n every_o person_n which_o
seize_v into_o the_o king_n hand_n for_o his_o recusancy_n or_o any_o part_n thereof_o every_o covicted_a popish_a recusant_n not_o marry_v in_o some_o open_a church_n or_o chappel_n or_o otherwise_o then_o according_a to_o the_o church_n of_o england_n by_o a_o minister_n lawful_o authorize_v shall_v be_v disable_v to_o have_v any_o estate_n of_o freehold_n by_o courtesy_n of_o england_n and_o every_o woman_n be_v a_o popish_a recusant_n convict_v which_o shall_v be_v marry_v in_o other_o form_n then_o as_o aforesaid_a shall_v be_v disable_v not_o only_o to_o claim_v any_o dower_n or_o jointure_n but_o also_o the_o widow_n estate_n and_o frankbanck_n in_o any_o customary_a land_n whereof_o her_o husband_n die_v seize_v and_o likewise_o from_o have_v part_n of_o her_o husband_n good_n by_o virtue_n of_o any_o custom_n of_o any_o county_n city_n or_o place_n and_o if_o a_o man_n be_v marry_v contrary_a to_o the_o true_a intent_n of_o this_o statute_n to_o a_o woman_n who_o have_v no_o land_n or_o tenement_n whereby_o he_o may_v become_v tenant_n by_o courtesy_n he_o shall_v forfeit_v 100_o l._n to_o be_v pay_v as_o aforesaid_a every_o popish_a recusant_n which_o shall_v have_v a_o child_n bear_v and_o shall_v not_o within_o a_o month_n after_o cause_n it_o to_o be_v baptize_v by_o a_o lawful_a minister_n according_a to_o the_o law_n of_o the_o realm_n in_o some_o usual_a place_n of_o baptism_n or_o if_o by_o infirmity_n the_o child_n can_v be_v bring_v to_o such_o place_n then_o to_o be_v baptize_v by_o some_o minister_n within_o the_o month_n if_o he_o beliving_a by_o the_o space_n of_o a_o month_n or_o if_o he_o be_v dead_a than_o mother_n of_o such_o child_n shall_v for_o every_o such_o offence_n forfeit_v one_o hundred_o pound_n one_o three_o part_n to_o the_o king_n the_o other_o to_o the_o informer_n who_o will_v sue_v for_o it_o the_o other_o three_o part_n to_o the_o poor_a of_o the_o say_a parish_n to_o be_v recover_v in_o any_o of_o the_o king_n court_n wherein_o no_o essoine_n etc._n etc._n shall_v be_v allow_v if_o any_o popish_a recusant_n not_o be_v excommunicate_v shall_v be_v bury_v in_o any_o place_n other_o than_o the_o church_n or_o church-yard_n or_o not_o according_a to_o the_o ecclesiastical_a law_n of_o the_o realm_n that_o the_o executor_n or_o administrator_n of_o every_o such_o person_n so_o bury_v know_v the_o same_o or_o the_o party_n that_o so_o buri_v he_o shall_v forfeit_v twenty_o pound_n to_o be_v pay_v as_o aforesaid_a if_o the_o child_n of_o any_o of_o the_o subject_n within_o this_o realm_n the_o say_a child_n not_o be_v soldier_n mariner_n merchant_n or_o their_o apprentice_n or_o factor_n shall_v be_v send_v or_o go_v beyond_o sea_n without_o licence_n of_o the_o king_n or_o six_o of_o the_o privy_a council_n whereof_o the_o principal_a secretary_n to_o be_v one_o under_o their_o hand_n and_o seal_n that_o very_o such_o child_n shall_v take_v no_o benefit_n by_o any_o gift_n conveyance_n descent_n devise_n or_o otherwise_o until_o he_o be_v above_o the_o age_n of_o eighteen_o year_n take_v the_o oath_n mention_v in_o a_o act_n make_v that_o session_n entitle_v a_o act_n for_o the_o better_a discovery_n and_o repress_v popish_a recusant_n etc._n etc._n before_o some_o justice_n of_o peace_n of_o the_o county_n where_o such_o parent_n of_o such_o child_n as_o shall_v be_v send_v do_v or_o shall_v inhabit_v in_o the_o mean_a time_n the_o next_o of_o kin_n who_o be_v no_o popish_a recusant_n shall_v enjoy_v all_o the_o say_a land_n etc._n etc._n until_o the_o person_n so_o send_v shall_v conform_v himself_o and_o take_v the_o say_a oath_n &_o receive_v the_o sacrament_n of_o the_o lord_n supper_n and_o then_o he_o who_o have_v receive_v any_o profit_n as_o aforesaid_a shall_v restore_v the_o good_n or_o value_n to_o he_o who_o shall_v so_o conform_v himself_o he_o that_o shall_v so_o send_v his_o child_n beyond_o sea_n shall_v forfeit_v one_o hundred_o pound_n to_o be_v recover_v as_o aforesaid_a no_o convict_v popish_a recusant_n shall_v present_v to_o a_o benefice_n with_o cure_n prebend_n or_o grant_v a_o advowson_n or_o collate_n or_o nominate_v to_o any_o free-school_n or_o donative_n whatsoever_o the_o chancellor_n and_o scholar_n of_o the_o university_n of_o oxford_n when_o any_o such_o become_v void_a shall_v have_v the_o nomination_n for_o such_o recusant_n they_o shall_v present_o be_v deface_v and_o burn_v if_o meet_a to_o be_v burn_v all_o armour_n gunpowder_n and_o munition_n whatsoever_o any_o popish_a recusant_n convict_v have_v or_o shall_v have_v in_o his_o own_o house_n or_o in_o the_o hand_n of_o other_o shall_v be_v take_v from_o they_o by_o warrant_n of_o four_o justice_n of_o peace_n at_o their_o general_n or_o quarter-session_n other_o than_o such_o necessary_a weapon_n as_o the_o four_o justice_n shall_v think_v meet_a for_o defence_n of_o the_o say_a recusant_n in_o defence_n of_o their_o house_n and_o
