hue_n and_o cry_n it_o shall_v and_o may_v be_v lawful_a for_o any_o person_n who_o shall_v endeavour_v to_o take_v they_o upon_o the_o resistance_n of_o such_o negro_n mulatto_n indian_a slave_n or_o servant_n for_o life_n to_o kill_v or_o wound_v he_o or_o they_o so_o resist_v provide_v always_o and_o it_o be_v the_o true_a intent_n and_o meaning_n thereof_o that_o such_o negro_n mulatto_n indian_a slave_n or_o servant_n for_o life_n be_v name_v and_o describe_v in_o the_o hue_n and_o cry_n kill_v runaway_n negro_n mulatto_n indian_n slave_n or_o servant_n for_o life_n resist_v may_v be_v kill_v which_o be_v also_o to_o be_v sign_v by_o the_o master_n or_o owner_n of_o the_o say_a runaway_n and_o if_o it_o happen_v that_o such_o negro_n mulatto_n indian_a slave_n or_o servant_n for_o life_n do_v die_v of_o any_o wound_n in_o such_o their_o resistance_n obtain_v the_o master_n or_o owner_n of_o such_o shall_v receive_v satisfaction_n from_o the_o public_a public_a the_o master_n shall_v receive_v satisfaction_n from_o the_o public_a for_o his_o negro_n mulatto_n indian_a slave_n or_o servant_n for_o life_n so_o kill_v or_o die_a of_o such_o wound_n and_o the_o person_n who_o shall_v kill_v or_o wound_v by_o virtue_n of_o any_o such_o hue_n and_o cry_n any_o such_o so_o resist_v in_o manner_n as_o aforesaid_a shall_v not_o be_v question_v for_o the_o same_o he_o forthwith_o give_v notice_n thereof_o and_o return_v the_o hue_n and_o cry_n or_o warrant_v to_o the_o master_n or_o owner_n of_o he_o or_o they_o so_o kill_v or_o wound_v or_o to_o the_o next_o justice_n of_o the_o peace_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a value_v at_o what_o rate_v such_o negro_n and_o slave_n shall_v be_v value_v that_o all_o such_o negro_n and_o slave_n shall_v be_v value_v at_o four_o thousand_o five_o hundred_o pound_n of_o tobacco_n and_o cask_n a_o piece_n and_o indian_n at_o three_o thousand_o pound_n of_o tobacco_n and_o cask_n and_o further_o if_o it_o shall_v happen_v that_o any_o negro_n mulatto_n indian_a slave_n or_o servant_n for_o life_n in_o such_o their_o resistance_n to_o receive_v any_o wound_n whereof_o they_o may_v not_o happen_v to_o die_v but_o shall_v lie_v any_o considerable_a time_n sick_a or_o disable_v then_o also_o the_o master_n or_o owner_n of_o the_o same_o so_o sick_a or_o disable_v shall_v receive_v from_o the_o public_a a_o reasonable_a satisfaction_n for_o such_o damage_n as_o they_o shall_v make_v appear_v they_o have_v sustain_v thereby_o at_o the_o county-court_n who_o shall_v thereupon_o grant_v the_o master_n or_o owner_n a_o certificate_n to_o the_o next_o assembly_n of_o what_o damage_n they_o shall_v make_v appear_v peace_n the_o neighbour_n indian_n require_v to_o seize_v runaway_n and_o bring_v they_o before_o some_o justice_n of_o the_o peace_n and_o it_o be_v further_o enact_v that_o the_o neighbour_n indian_n do_v and_o they_o be_v hereby_o require_v length_n of_o rhoanoke_n or_o the_o value_n thereof_o do_v the_o recompense_n allow_v for_o so_o do_v as_o the_o indian_a shall_v like_v of_o for_o which_o the_o say_a justice_n of_o the_o peace_n shall_v receive_v from_o the_o public_a two_o hundred_o and_o fifty_o pound_n of_o tobacco_n and_o the_o say_a justice_n be_v to_o proceed_v in_o convey_v the_o runaway_n to_o his_o master_n according_a to_o the_o law_n force_n how_o long_o this_o act_n shall_v continue_v in_o force_n in_o such_o case_n already_o provide_v this_o act_n to_o continue_v in_o force_n until_o the_o next_o assembly_n and_o no_o long_a unless_o than_o it_o be_v think_v fit_a to_o continue_v it_o ix_o a_o act_n concern_v swamp_n and_o marsh_n whereas_o several_a inconvenience_n may_v arise_v to_o many_o of_o the_o inhabitant_n of_o this_o country_n who_o have_v land_n adjoin_v to_o swamp_n marsh_n and_o sink_a land_n unpattent_v if_o any_o other_o who_o be_v disjoin_v from_o the_o same_o may_v be_v admit_v present_o to_o take_v up_o and_o patent_n they_o this_o grand_a assembly_n take_v the_o same_o into_o their_o consideration_n and_o be_v willing_a that_o man_n very_a conveniency_n be_v preserve_v unto_o they_o from_o which_o in_o this_o case_n they_o need_v not_o depart_v but_o by_o their_o own_o default_n have_v enact_v and_o ordain_v and_o it_o be_v by_o the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o enact_v and_o ordain_v that_o it_o shall_v not_o be_v lawful_a for_o any_o person_n whatsoever_o to_o take_v up_o any_o marsh_n swamp_n or_o sink_a land_n adjoin_v to_o any_o man_n land_n land_n who_o may_v take_v up_o swamp_n marsh_n or_o sink_a land_n but_o shall_v first_o give_v notice_n to_o the_o owner_n or_o owner_n of_o the_o land_n to_o which_o it_o adjoin_v who_o shall_v have_v one_o year_n time_n to_o resolve_v whether_o he_o or_o they_o will_v take_v up_o the_o same_o or_o no_o and_o in_o case_n at_o the_o expiration_n of_o that_o term_n the_o owner_n or_o owner_n of_o the_o land_n adjoin_v to_o the_o say_a land_n marsh_n or_o swain_n shall_v then_o refuse_v to_o survey_v and_o patent_n the_o the_o same_o according_a to_o law_n x._o a_o act_n declare_v man_n note_n how_o far_o pleadable_a against_o their_o estate_n if_o dead_a whereas_o it_o have_v be_v controvert_v whether_o note_n charge_v on_o person_n by_o a_o man_n in_o his_o life_n time_n be_v pleadable_a after_o his_o decease_n for_o determination_n whereof_o party_n note_n pleadable_a after_o decease_n of_o the_o party_n the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n have_v enact_v and_o ordain_v and_o by_o the_o authority_n aforesaid_a it_o be_v enact_v and_o ordain_v that_o all_o such_o estate_n of_o person_n die_v intestate_a and_o of_o what_o part_n thereof_o ought_v to_o appertain_v to_o the_o widow_n for_o the_o clear_v whereof_o be_v it_o enact_v by_o the_o governor_n council_n three_o part_n of_o the_o real_a estate_n to_o be_v equal_o divide_v as_o to_o house_n fence_v ground_n orchard_n real_a widow_n shall_v be_v endow_v with_o the_o three_o part_n of_o estate_n real_a wood_n and_o other_o valuable_a convenience_n during_o her_o natural_a life_n and_o the_o three_o part_n of_o the_o estate_n personal_a if_o there_o be_v but_o one_o or_o two_o child_n but_o if_o there_o be_v any_o number_n of_o child_n more_o how_o many_o soever_o in_o that_o case_n the_o personal_a estate_n to_o be_v divide_v among_o the_o widow_n and_o all_o her_o child_n case_n the_o provision_n for_o child_n in_o such_o case_n share_n and_o share_v alike_o and_o in_o case_n the_o husband_n make_v will_n that_o he_o have_v it_o in_o his_o power_n to_o
attendance_n on_o the_o general_n court_n for_o every_o general_a court_n or_o assembly_n they_o shall_v attend_v and_o that_o no_o person_n or_o person_n heretofore_o tythable_a by_o any_o law_n custom_n or_o usuage_v be_v from_o henceforth_o exempt_v from_o pay_v public_a or_o county-levy_n the_o right_a honourable_a the_o governor_n and_o his_o servant_n except_v county-levy_n who_o only_o be_v exempt_v from_o the_o payment_n of_o public_a or_o county-levy_n the_o single_a person_n of_o every_o one_o of_o the_o council_n and_o also_o all_o minister_n benefice_v in_o this_o country_n and_o such_o lame_a or_o impotent_a person_n as_o either_o already_o be_v or_o shall_v from_o time_n to_o time_n be_v order_v to_o be_v exempt_v out_o of_o the_o list_n by_o the_o county-courts_a where_o they_o dwell_v x._o a_o act_n regulate_v ordinary_n and_o the_o price_n of_o liquor_n whereas_o the_o multiplicity_n of_o ordinary_n in_o this_o colony_n be_v find_v to_o be_v pernicious_a and_o hurtful_a to_o the_o inhabitant_n be_v it_o therefore_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o hold_v not_o more_o than_o two_o ordinary_n in_o any_o one_o county_n except_o in_o that_o where_o the_o general_a court_n be_v hold_v and_o it_o be_v hereby_o enact_v that_o from_o and_o after_o the_o publication_n of_o this_o act_n there_o shall_v not_o be_v admit_v suffer_v or_o licence_v above_o two_o ordinary_n in_o any_o one_o county_n of_o this_o colony_n at_o one_o time_n except_o in_o that_o county_n where_o the_o general_a court_n shall_v be_v hold_v and_o that_o the_o power_n of_o grant_v licence_n be_v in_o the_o respective_a county_n court_v the_o right_a honourable_a the_o governor_n be_v pay_v for_o such_o licence_n according_a to_o former_a law_n in_o such_o case_n and_o that_o no_o person_n be_v license_v to_o keep_v ordinary_n but_o such_o as_o be_v accountable_a and_o will_v enter_v into_o sufficient_a bond_n to_o find_v and_o provide_v constant_o for_o traveller_n good_a diet_n lodging_n and_o horsmeat_n and_o will_v rate_v and_o sell_v their_o provision_n and_o liquor_n according_a to_o the_o rate_n and_o price_n hereafter_o set_v down_o and_o allow_v by_o this_o law_n upon_o such_o penalty_n and_o forfeiture_n as_o shall_v be_v therein_o provide_v and_o inflict_v which_o penalty_n shall_v be_v and_o belong_v the_o one_o half_a to_o the_o person_n or_o person_n who_o shall_v inform_v of_o and_o sue_v for_o the_o same_o and_o the_o other_o half_a to_o the_o county_n wherein_o the_o same_o shall_v be_v forfeit_v and_o be_v it_o enact_v by_o this_o grand_a assembly_n and_o the_o authority_n thereof_o that_o all_o ordinary_n sell_v liquor_n do_v demand_n or_o take_v no_o more_o for_o virginia_n dram_fw-la strong_a beer_n or_o ale_n then_o be_v set_v down_o in_o the_o act_n of_o assembly_n lodging_n what_o price_n shall_v be_v pay_v at_o ordinary_n for_o liquor_n diet_n and_o lodging_n make_v in_o september_n 1671._o that_o the_o rate_n for_o cider_n and_o perry_n if_o boil_a be_v twenty_o pound_n of_o tobacco_n for_o one_o gallon_n and_o if_o raw_a eighteen_o pound_n of_o tobacco_n per_fw-la gallon_n that_o the_o price_n of_o lodging_n be_v three_o pound_n of_o tobacco_n for_o one_o night_n that_o the_o price_n of_o diet_n where_o the_o general_a court_n of_o assembly_n be_v hold_v be_v twelve_o pound_n of_o tobacco_n each_o meal_n for_o the_o master_n and_o eight_o pound_n for_o the_o servant_n and_o in_o all_o other_o ordinary_n in_o the_o country_n ten_o pound_n of_o tobacco_n each_o meal_n for_o the_o master_n and_o six_o pound_n for_o the_o servant_n that_o the_o rate_n of_o horse-pastorage_a be_v six_o pound_n of_o tobacco_n for_o one_o day_n and_o night_n and_o if_o house_v oates_n horse-pastorage_a hay_o and_o oates_n for_o straw_n and_o hay_n eight_o pound_n of_o tobacco_n the_o day_n and_o night_n and_o for_o indian_a corn_n after_o the_o rate_n of_o forty_o pound_n of_o tobacco_n per_fw-la bushel_n and_o for_o oat_n after_o the_o rate_n of_o sixty_o pound_n of_o tobacco_n per_fw-la bushel_n and_o that_o all_o ordinary-keeper_n be_v and_o be_v hereby_o enjoin_v to_o secure_v all_o horse_n that_o they_o have_v charge_n of_o year_n justice_n to_o appoint_v the_o price_n of_o liquor_n twice_o in_o the_o year_n from_o run_v away_o and_o be_v steal_v upon_o the_o penalty_n of_o pay_v the_o charge_n of_o find_v the_o horse_n or_o horse_n or_o pay_v for_o they_o if_o lose_v and_o that_o the_o justice_n of_o every_o respective_a court_n within_o this_o colony_n be_v enjoin_v in_o the_o month_n of_o may_n and_o november_n yearly_o to_o meet_v at_o their_o county-court-house_n and_o assess_v and_o set_v the_o rate_n on_o all_o liquor_n as_o be_v not_o herein_o mention_v and_o rate_v according_a as_o the_o market_n price_n than_o rule_v for_o such_o liquor_n and_o that_o no_o ordinary-keeper_n presume_v to_o advance_v and_o take_v for_o such_o liquor_n so_o by_o the_o justice_n rate_v above_o cent_z per_fw-mi cent_z profit_n upon_o the_o penalty_n and_o forfeit_n of_o tenfold_o such_o exaction_n and_o over_o rate_n by_o they_o demand_v or_o take_v and_o that_o all_o such_o person_n buy_v and_o expend_v at_o ordinary_n who_o shall_v at_o any_o time_n pay_v great_a rate_n then_o be_v hereby_o allow_v and_o set_v down_o forfeit_a and_o pay_v for_o every_o such_o payment_n or_o obligation_n for_o payment_n five_o fold_n the_o sum_n so_o overpay_v and_o that_o all_o those_o county-courts_a neglect_v to_o meet_v and_o assess_v the_o rate_n and_o price_n as_o aforesaid_a be_v fine_v five_o thousand_o pound_n of_o tobacco_n and_o cask_n all_o which_o fine_n shall_v come_v and_o belong_v the_o one_o half_a to_o the_o use_n of_o the_o county_n where_o such_o forfeiture_n be_v make_v the_o other_o half_o to_o he_o or_o they_o who_o shall_v inform_v of_o or_o sue_v for_o the_o same_o xi_o a_o act_n dispose_v amerciament_n upon_o cast_a action_n whereas_o by_o a_o act_n of_o assembly_n make_v in_o the_o year_n 1674._o it_o be_v enact_v that_o certain_a amerciament_n therein_o set_v down_o shall_v be_v pay_v upon_o action_n cast_v at_o law_n and_o that_o a_o account_n of_o such_o amerciament_n be_v return_v to_o the_o assembly_n to_o be_v by_o they_o cast_v at_o law_n repeal_v and_o amerciament_n be_v pay_v and_o dispose_v to_o the_o use_n of_o the_o county_n where_o the_o same_o become_v due_a towards_o the_o defray_n of_o that_o countys-charge_n and_o that_o the_o several_a respective_a county-court_n inquire_v into_o the_o same_o and_o dispose_v of_o they_o according_o xii_o a_o act_n concern_v servant_n who_o be_v out_o in_o rebellion_n repeal_v by_o his_o excellency_n proclamation_n anno_fw-la 1680._o xiii_o a_o act_n for_o the_o lay_n of_o parish_n levy_n for_o the_o better_a and_o more_o equal_a lay_n of_o parish_n levy_n and_o to_o be_v draw_v the_o one_o of_o which_o to_o remain_v with_o the_o appraiser_n and_o the_o other_o part_n with_o the_o owner_n or_o owner_n of_o such_o sloop-boat_n etc._n etc._n and_o such_o continue_v in_o such_o employment_n more_o than_o ten_o day_n at_o a_o time_n then_o for_o all_o such_o time_n as_o he_o shall_v serve_v above_o ten_o day_n between_o september_n and_o march_n after_o the_o rate_n of_o two_o hundred_o pound_n of_o tobacco_n per_fw-la month_n and_o betwixt_o march_n and_o september_n after_o the_o rate_n of_o three_o hundred_o pound_n of_o tobacco_n per_fw-la month_n and_o if_o any_o horse_n or_o horse_n be_v impress_v by_o the_o public_a or_o county_n impress_v rate_n allow_v for_o horse_n impress_v the_o owner_n or_o owner_n of_o such_o horse_n shall_v receive_v fifteen_o pound_n of_o tobacco_n per_fw-la day_n for_o the_o first_o twenty_o day_n and_o if_o he_o be_v continue_v long_o than_o twenty_o day_n then_o for_o all_o the_o time_n he_o shall_v be_v employ_v over_o and_o above_o the_o twenty_o day_n after_o the_o rate_n of_o ten_o pound_n of_o tobacco_n per_fw-la day_n and_o before_o the_o impressor_n shall_v take_v such_o horse_n or_o horse_n impress_v away_o he_o shall_v first_o bring_v two_o able_a honest_a man_n of_o the_o neighbourhood_n to_o appraise_v the_o say_a horse_n or_o horse_n and_o a_o writing_n shall_v be_v draw_v and_o sign_v intimate_v the_o value_n and_o if_o such_o horse_n or_o horse_n be_v kill_v in_o the_o service_n or_o otherways_o lose_v it_o shall_v be_v at_o the_o choice_n of_o the_o owner_n of_o such_o horse_n or_o horse_n to_o receive_v the_o value_n as_o appraised_a or_o the_o wage_n for_o hire_n if_o for_o the_o use_n of_o the_o county_n to_o be_v pay_v by_o the_o county_n if_o for_o the_o use_n of_o the_o public_a to_o be_v punctual_o pay_v upon_o return_v certificate_n from_o the_o county-court_n as_o in_o case_n of_o sloop_n and_o in_o case_n any_o person_n or_o person_n shall_v and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o a_o fee_n for_o a_o coroners-inquest_n be_v thirteen_o shilling_n and_o fourpence_n according_a to_o the_o allowance_n in_o england_n in_o such_o case_n or_o one_o hundred_o thirty_o three_o pound_n of_o tobacco_n and_o cask_n at_o the_o choice_n of_o the_o coroner_n to_o be_v pay_v out_o of_o the_o estate_n of_o the_o person_n decease_a aforesaid_a in_o county_n where_o there_o be_v no_o corner_n a_o justice_n of_o peace_n shall_v perform_v his_o office_n and_o receive_v the_o fee_n aforesaid_a if_o such_o there_o be_v and_o for_o want_v of_o such_o estate_n by_o the_o county_n where_o the_o party_n cause_v the_o inquest_n shall_v die_v and_o where_o there_o be_v no_o coroner_n in_o the_o county_n that_o the_o justice_n of_o peace_n do_v the_o office_n shall_v have_v the_o fee_n xi_o a_o act_n declare_v the_o year_n 1676._o to_o be_v out_o of_o the_o statute_n of_o limitation_n for_o as_o much_o

estern_a shoar_n to_o ship_v their_o tobacco_n without_o certificate_n repeal_v and_o that_o the_o inhabitant_n on_o potomack_n river_n and_o on_o the_o eastern_a shore_n have_v like_a and_o equal_a liberty_n and_o privilege_n with_o the_o rest_n his_o majesty_n subject_n in_o this_o colony_n to_o sell_v dispose_n pay_v and_o make_v delivery_n of_o their_o tobacco_n to_o their_o best_a advantage_n and_o convenience_n vi_o a_o act_n ascertain_v collector_n fee_n for_o entry_n and_o clear_n ship_n etc._n etc._n whereas_o several_a complaint_n have_v be_v make_v to_o this_o present_a grand_a assembly_n that_o several_a collector_n in_o this_o colony_n have_v exact_v and_o take_v great_a and_o unreasonable_a fee_n for_o enter_v and_o clear_v ship_n and_o small_a vessel_n trade_v into_o this_o country_n which_o if_o permit_v and_o continue_v may_v prove_v prejudicial_a to_o trade_n for_o prevention_n whereof_o for_o the_o future_a be_v it_o enact_v by_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o from_o hence_o forward_o no_o collector_n or_o collector_n shall_v or_o may_v demand_v or_o take_v other_o country_n and_o the_o inhabitant_n thereof_o for_o prevention_n of_o like_a mischief_n and_o inconvenience_n for_o the_o future_a be_v it_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o from_o and_o after_o the_o ten_o day_n of_o october_n next_o after_o this_o present_a session_n no_o tobacco_n pack_v in_o cask_n or_o otherways_o shall_v be_v bring_v from_o
grant_v in_o open_a court_n at_o the_o time_n and_o place_n by_o law_n appoint_v provide_v always_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o d_o spatch_n of_o merchant_n and_o other_o sea_n affair_n make_v a_o proviso_n make_v which_o can_v without_o much_o prejudice_n and_o detriment_n to_o the_o say_a merchant_n or_o master_n be_v defer_v till_o the_o court_n in_o course_n shall_v come_v it_o be_v enact_v that_o it_o shall_v be_v lawful_a for_o any_o justice_n of_o the_o quorum_fw-la by_o his_o warrant_n direct_v to_o the_o sheriff_n to_o call_v a_o particular_a court_n punishable_a by_o fine_n which_o be_v by_o the_o present_a law_n to_o be_v dispose_v of_o to_o the_o use_n of_o the_o county_n in_o which_o the_o trespass_n be_v commit_v and_o yet_o nothing_o do_v for_o the_o good_a of_o any_o county_n as_o be_v intend_v whereby_o it_o may_v be_v presume_v that_o the_o say_v fine_n be_v either_o not_o gather_v whereby_o the_o trespasser_n by_o this_o lenity_n and_o impunity_n be_v encourage_v to_o persist_v in_o their_o contempt_n of_o the_o law_n or_o else_o the_o say_a fine_n be_v by_o some_o evil_a common-wealths-man_n pervert_v to_o their_o private_a that_o county_n they_o desire_v to_o oyster_n or_o gather_v wild_a fruit_n in_o as_o aforesaid_a they_o the_o say_v justice_n shall_v grant_v a_o licence_n to_o the_o say_a indian_n to_o oyster_n or_o gather_v wild_a fruit_n as_o aforesaid_a provide_v the_o say_a justice_n limit_v the_o time_n the_o indian_n be_v to_o stay_v and_o the_o indian_n bring_v not_o with_o they_o any_o gun_n or_o ammunition_n or_o other_o offensive_a weapon_n but_o only_o such_o tool_n or_o implement_n as_o serve_v for_o the_o end_n of_o their_o come_n and_o if_o any_o english_a man_n shall_v presume_v to_o take_v from_o the_o indian_n so_o come_v in_o any_o of_o their_o good_n or_o shall_v kill_v wound_v or_o maim_v any_o indian_a he_o shall_v suffer_v as_o if_o he_o have_v do_v the_o same_o to_o a_o many_o underhand_o and_o unlicensed_a trader_n do_v truck_v and_o trade_n with_o the_o indian_n contrary_a to_o the_o act_n of_o assembly_n and_o to_o the_o great_a prejudice_n of_o all_o such_o as_o legal_o procure_v commission_n from_o the_o governor_n under_o pretence_n that_o the_o thing_n truck_v for_o be_v give_v they_o by_o the_o indian_n be_v it_o therefore_o enact_v that_o what_o person_n soever_o shall_v upon_o any_o pretence_n whatsoever_o buy_v take_v or_o receive_v any_o thing_n or_o commodity_n from_o a_o indian_a shall_v upon_o proof_n thereof_o at_o any_o court_n be_v order_v to_o pay_v treble_a the_o value_n of_o the_o thing_n receive_v to_o the_o person_n injure_v thereby_o governor_n difference_n arise_v in_o trade_n with_o the_o indian_n shall_v be_v refer_v to_o the_o governor_n and_o because_o sometime_o difference_n may_v arise_v between_o the_o indian_n and_o those_o they_o trade_n with_o which_o if_o we_o shall_v proceed_v by_o way_n of_o arrest_n may_v tend_v much_o to_o the_o disturbance_n of_o the_o peace_n of_o the_o country_n be_v it_o therefore_o enact_v that_o any_o commissionated_a trader_n have_v a_o difference_n with_o any_o indian_a king_n or_o other_o shall_v repair_v to_o the_o governor_n for_o he_o or_o such_o other_o as_o he_o shall_v appoint_v to_o determine_v the_o matter_n in_o controversy_n between_o they_o and_o because_o the_o imprisonment_n of_o a_o indian_a may_v bring_v a_o war_n upon_o the_o country_n council_n no_o person_n shall_v imprison_v any_o indian_a king_n without_o warrant_n from_o the_o governor_n and_o two_o of_o the_o council_n and_o consequent_o the_o make_n of_o peace_n and_o war_n be_v wrest_v out_o of_o those_o hand_n it_o be_v by_o his_o majesty_n commission_n entrust_v into_o the_o power_n of_o every_o individual_a in_o the_o country_n be_v it_o therefore_o enact_v that_o no_o person_n of_o what_o quality_n soever_o presume_v to_o imprison_v any_o indian_a king_n without_o a_o special_a warrant_n from_o the_o governor_n and_o two_o of_o the_o council_n as_o they_o will_v answer_v the_o contrary_a at_o their_o uttermost_a peril_n and_o because_o this_o act_n can_v be_v put_v in_o execution_n without_o commissioner_n to_o view_v the_o present_a bound_n of_o the_o english_a and_o indian_n be_v it_o therefore_o enact_v that_o the_o honourable_a governor_n be_v desire_v and_o authorize_v to_o appoint_v uninteress_v person_n commissioner_n annual_o bound_n betwixt_o the_o english_a and_o the_o indian_n shall_v be_v fix_v and_o commissioner_n thereto_o appoint_v shall_v view_v the_o same_o annual_o to_o go_v with_o party_n of_o horse_n to_o the_o several_a indian_a town_n and_o there_o to_o proclaim_v these_o and_o the_o follow_a article_n of_o peace_n between_o we_o and_o the_o indian_n to_o settle_v the_o bound_n between_o we_o and_o to_o appoint_v other_o of_o the_o most_o integrity_n to_o fix_v the_o time_n and_o assess_v the_o work_n to_o help_v the_o indian_n fence_n and_o all_o other_o thing_n by_o this_o act_n enjoin_v and_o for_o prevention_n of_o future_a intrenchment_n beyond_o the_o bound_n once_o fix_v be_v it_o further_o enact_v that_o the_o governor_n be_v desire_v and_o authorize_v to_o commissionate_a certain_a person_n annual_o to_o visit_v the_o same_o and_o to_o take_v care_n that_o no_o entrenchment_n be_v henceforth_o make_v upon_o the_o indian_n and_o because_o a_o interval_n between_o the_o indian_n can_v in_o the_o present_a nearness_n of_o seat_v be_v so_o lay_v out_o as_o may_v whole_o secure_v the_o english_a from_o the_o indian_n come_v in_o and_o pilfer_a thing_n from_o they_o if_o a_o free_a intercourse_n be_v admit_v be_v it_o therefore_o enact_v for_o the_o prevention_n thereof_o and_o to_o the_o end_n that_o the_o nation_n may_v be_v distinguish_v and_o so_o if_o they_o be_v take_v in_o the_o manner_n of_o do_v any_o injury_n the_o sufferer_n know_v to_o what_o king_n to_o address_v themselves_o for_o remedy_n that_o badge_n viz._n silver_n plate_n and_o copper_n plate_n with_o the_o name_n of_o the_o town_n grave_v upon_o they_o be_v give_v to_o all_o adjacent_a king_n within_o our_o protection_n badge_n indian_n shall_v not_o come_v within_o the_o bound_n of_o the_o english_a without_o badge_n and_o that_o all_o the_o say_a king_n give_v it_o in_o charge_n to_o their_o people_n that_o none_o of_o they_o presume_v upon_o what_o occasion_n soever_o to_o come_v within_o the_o english_a bound_n without_o those_o badge_n upon_o they_o or_o one_o with_o a_o badge_n in_o their_o public_a and_o in_o case_n of_o disability_n lie_v six_o month_n in_o prison_n without_o bail_n or_o mainprise_n and_o be_v it_o further_o enact_v that_o all_o indian_a king_n tributary_n to_o the_o english_a colony_n indian_a king_n who_o be_v tributary_n to_o the_o english_a shall_v acquaint_v they_o of_o any_o invasion_n they_o know_v of_o intend_v by_o any_o strange_a indian_n upon_o this_o colony_n when_o they_o have_v the_o least_o notice_n of_o any_o march_n by_o any_o strange_a indian_n near_o our_o quarter_n shall_v repair_v themselves_o or_o at_o least_o send_v

again_o offend_v therein_o and_o shall_v in_o form_n aforesaid_a be_v thereof_o lawful_o convict_v shall_v for_o the_o second_o offence_n forfeit_v and_o pay_v five_o hundred_o pound_n of_o tobacco_n to_o be_v levy_v by_o distress_n or_o sale_n of_o the_o good_n of_o the_o party_n so_o convict_v by_o warrant_n from_o any_o one_o justice_n of_o the_o peace_n before_o who_o they_o shall_v be_v so_o convict_v render_v the_o overplus_n to_o the_o owner_n if_o any_o be_v and_o for_o want_v of_o such_o distress_n or_o for_o want_n of_o ability_n of_o any_o person_n among_o they_o to_o pay_v the_o say_v fine_a or_o fine_n than_o it_o shall_v be_v lawful_a to_o levy_v and_o recover_v the_o same_o from_o the_o rest_n of_o the_o separatist_n or_o quaker_n or_o any_o one_o of_o they_o then_o for_o prevention_n of_o neglect_v in_o the_o due_a execution_n of_o this_o act_n by_o any_o magistrate_n or_o magistrate_n officer_n or_o officer_n of_o this_o colony_n that_o in_o case_n any_o justice_n of_o the_o peace_n or_o any_o other_o officer_n shall_v neglect_v the_o performance_n of_o their_o duty_n in_o prosecute_a this_o act_n or_o shall_v direct_o or_o indirect_o connive_v at_o any_o breach_n thereof_o he_o or_o they_o for_o every_o such_o offence_n shall_v be_v fine_v two_o thousand_o pound_n of_o tobacco_n to_o be_v levy_v by_o distress_n and_o sale_n of_o the_o goood_n of_o the_o person_n so_o offend_v he_o or_o they_o be_v thereof_o lawful_o convict_v by_o the_o virdict_n of_o twelve_o man_n by_o his_o own_o confession_n or_o evidence_n of_o fact_n fines_n justice_n of_o peace_n within_o the_o limit_n of_o their_o commission_n to_o hear_v &_o determine_v offence_n of_o this_o kind_n and_o to_o grant_v their_o warrant_n for_o levy_v of_o fines_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o the_o justice_n the_o peace_n in_o their_o several_a county_n shall_v be_v hereafter_o empower_v to_o inquire_v hear_v and_o to_o the_o use_n of_o the_o parish_n where_o the_o fact_n be_v commit_v that_o the_o five_o thousand_o pound_n of_o tobacco_n impose_v on_o each_o master_n that_o shall_v bring_v in_o any_o quaker_n of_o levy_n and_o fine_n for_o unlawful_a assembly_n how_o to_o be_v dispose_v of_o shall_v be_v pay_v half_a to_o the_o informer_n half_a to_o the_o use_n of_o the_o parish_n in_o the_o county_n where_o the_o person_n or_o person_n do_v arrive_v that_o the_o five_o thousand_o pound_n of_o tobacco_n impose_v upon_o every_o inhabitant_n that_o shall_v entertain_v as_o aforesaid_a in_o or_o near_o his_o house_n any_o quaker_n shall_v be_v pay_v half_a to_o the_o informer_n half_a to_o the_o parish_n in_o the_o county_n where_o he_o live_v for_o pious_a use_n provide_v always_o
be_v and_o still_o be_v the_o constant_a endeavour_n of_o this_o assembly_n to_o give_v all_o possible_a encouragement_n to_o merchant_n and_o trader_n into_o this_o colony_n and_o have_v hitherto_o leave_v the_o receive_n or_o refuse_v their_o debt_n to_o their_o own-discretion_n without_o other_o restriction_n to_o they_o or_o liberty_n to_o the_o planter_n then_o this_o that_o if_o by_o the_o last_o of_o january_n the_o creditor_n do_v not_o demand_v his_o tobacco_n it_o may_v then_o be_v lawful_a for_o the_o debtor_n to_o dispose_v of_o it_o leave_v the_o debtor_n still_o liable_a to_o be_v sue_v that_o year_n for_o security_n for_o his_o debt_n upon_o which_o divers_a person_n for_o their_o private_a advantage_n do_v omit_v the_o demand_v of_o the_o tobacco_n in_o time_n and_o thereby_o render_v the_o planter_n uncapable_a of_o dispose_v of_o his_o tobacco_n or_o clear_n himself_o from_o the_o engagement_n for_o redress_v of_o which_o inconvenience_n january_n creditor_n to_o demand_n and_o receive_v their_o tobacco_n by_o the_o last_o of_o january_n be_v it_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o that_o if_o the_o creditor_n refuse_v or_o omit_v to_o demand_v and_o receive_v his_o tobacco_n by_o the_o last_o of_o january_n that_o then_o it_o shall_v be_v lawful_a for_o the_o debtor_n at_o any_o time_n between_o that_o and_o the_o twenty_o of_o february_n to_o address_v himself_o to_o the_o two_o next_o convenient_a justice_n of_o the_o peace_n who_o be_v hereby_o require_v and_o impower_v to_o appoint_v three_o honest_a and_o able_a man_n of_o the_o neighbourhood_n on_o their_o oath_n to_o view_v the_o tobacco_n and_o if_o they_o find_v it_o legal_o merchantable_a whether_o old_a or_o new_a then_o to_o weigh_v and_o mark_v it_o for_o the_o use_n of_o the_o creditor_n on_o who_o account_n the_o tobacco_n so_o view_v and_o approve_v as_o aforesaid_a shall_v after_o lie_n the_o debtor_n still_o endeavour_v to_o secure_v it_o as_o before_o the_o tender_a and_o the_o debtor_n upon_o produce_v the_o certificate_n of_o the_o say_v tender_a from_o the_o say_a justice_n to_o the_o next_o court_n umpire_n difference_n between_o debtor_n and_o creditor_n whether_o the_o tobacco_n tender_v be_v merchantable_a or_o not_o to_o be_v decide_v by_o a_o umpire_n that_o court_n shall_v by_o their_o order_n discharge_v the_o debtor_n from_o his_o debt_n provide_v the_o tender_a be_v make_v in_o place_n according_a to_o specialty_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o in_o case_n of_o difference_n between_o the_o debtor_n and_o creditor_n or_o his_o attorney_n if_o either_o of_o they_o be_v present_a whether_o the_o tobacco_n tender_v be_v merchantable_a or_o not_o then_o two_o commissioner_n as_o aforesaid_a be_v hereby_o impower_v to_o appoint_v a_o three_o person_n as_o a_o indifferent_a umpire_n to_o determine_v the_o difference_n between_o they_o iii_o a_o act_n for_o alter_a the_o day_n of_o the_o general_n court_n whereas_o the_o right_a honourable_a the_o governor_n and_o council_n for_o divers_a reason_n they_o thereunto_o move_v have_v desire_v that_o the_o general_n court_n beginning_n by_o the_o present_a act_n the_o twenty_o day_n of_o march_n may_v hence_o forth_o be_v hold_v the_o 15_o day_n of_o april_n april_n the_o general_a court_n to_o be_v hold_v on_o the_o fifteen_o of_o april_n it_o be_v enact_v by_o this_o present_a grand_a assembly_n and_o engagement_n in_o repel_v the_o assault_n of_o the_o adjacent_a indian_n that_o their_o act_n though_o full_o at_o their_o assembly_n confirm_v can_v not_o be_v send_v to_o virginia_n and_o mary_n land_n by_o the_o time_n in_o the_o article_n agree_v upon_o for_o which_o cause_n the_o governor_n and_o council_n of_o mary_n land_n though_o they_o still_o acknowledge_v the_o act_n itself_o for_o a_o total_a cessation_n from_o plant_v as_o aforesaid_a to_o remain_v in_o its_o full_a force_n and_o in_o pursuance_n of_o the_o establishment_n thereof_o have_v cause_v a_o proclamation_n to_o issue_n require_v and_o command_v all_o person_n in_o the_o say_a province_n to_o yield_v conformity_n and_o due_a obedience_n thereto_o of_o which_o to_o testify_v their_o full_a intent_n of_o execute_v the_o say_a act_n transmit_v a_o copy_n to_o the_o right_n honourable_a the_o governor_n of_o virginia_n yet_o in_o his_o letter_n declare_v that_o by_o reason_n of_o the_o say_a act_n of_o carolina_n not_o come_n to_o they_o by_o the_o time_n in_o the_o treaty_n prefix_v they_o conceive_v that_o all_o the_o article_n in_o the_o say_a treaty_n contain_v the_o mean_n to_o have_v the_o 1667_o be_v and_o remain_v in_o full_a force_n and_o be_v hereby_o ratify_v and_o confirm_v and_o all_o person_n be_v require_v to_o take_v notice_n thereof_o and_o yield_v their_o due_a obedience_n thereunto_o for_o the_o sure_a establishment_n thereof_o the_o commissioner_n in_o the_o aforesaid_a act_n nominate_v and_o appoint_v or_o so_o many_o of_o they_o as_o be_v there_o require_v be_v hereby_o again_o impower_v and_o desire_v to_o renew_v the_o former_a treaty_n with_o the_o commissioner_n of_o mary_n land_n and_o to_o re-establish_a the_o article_n in_o the_o former_a treaty_n the_o say_a commissioner_n for_o observance_n of_o the_o say_a article_n under_o their_o hand_n and_o seal_n and_o the_o like_a reciprocal_o take_v from_o the_o commissioner_n of_o mary_n land_n shall_v bind_v this_o country_n and_o every_o inhabitant_n thereof_o to_o a_o full_a performance_n in_o the_o say_v act._n and_o that_o no_o scruple_n may_v remain_v be_v full_o agree_v that_o two_o instrument_n of_o one_o tenor_n make_v one_o to_o the_o governor_n of_o virginia_n the_o other_o to_o the_o lieutenant_n general_n of_o mary_n land_n from_o the_o governor_n of_o carolina_n that_o the_o inhabitant_n of_o that_o province_n will_v true_o observe_v the_o article_n agree_v upon_o between_o the_o governor_n of_o virginia_n and_o mary_n land_n cessation_n mary-land_n to_o concur_v in_o the_o cessation_n shall_v be_v accept_v and_o repute_v a_o sufficient_a engagement_n for_o the_o conformity_n of_o that_o province_n in_o the_o observance_n of_o that_o act_n and_o if_o there_o shall_v appear_v to_o the_o commissioner_n any_o emergent_a occasion_n for_o any_o thing_n or_o thing_n in_o the_o aforesaid_a treaty_n conclude_v and_o agree_v upon_o to_o be_v add_v or_o alter_v they_o be_v by_o this_o act_n impower_v to_o proceed_v therein_o as_o they_o in_o their_o discretion_n shall_v find_v the_o necessity_n of_o affair_n to_o require_v and_o the_o governors_n honour_n be_v hereby_o request_v by_o his_o honour_n commission_n and_o instruction_n to_o confirm_v the_o full_a power_n and_o authority_n unto_o they_o and_o to_o the_o intent_n that_o notice_n may_v be_v give_v to_o the_o honourable_a lieutenant_n general_n of_o mary-land_n of_o our_o intention_n to_o renew_v the_o treaty_n the_o governors_n honour_n hereby_o request_v to_o send_v message_n to_o the_o proclamation_n the_o full_a intent_n and_o tenor_n thereof_o to_o the_o several_a county_n of_o this_o colony_n ii_o a_o act_n show_v how_o debt_n be_v to_o be_v pay_v the_o cessation_n year_n whereas_o it_o be_v apparent_a to_o all_o that_o the_o establishment_n of_o a_o cessation_n from_o plant_v will_v certain_o advance_v the_o gain_n of_o the_o merchant_n by_o give_v he_o time_n to_o have_v only_o for_o the_o supply_n of_o people_n necessity_n and_o enable_v they_o to_o provide_v for_o their_o subsistance_n in_o the_o vacant_a year_n from_o plant_v have_v enact_v and_o by_o the_o governor_n security_n debt_n due_a the_o cessation-year_n to_o be_v pay_v one_o half_o down_o time_n to_o be_v allow_v for_o the_o other_o half_a give_v reasonable_a security_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o be_v it_o enact_v that_o for_o all_o debt_n already_o contract_v to_o be_v pay_v this_o present_a year_n in_o tobacco_n except_o public_a due_n any_o debtor_n pay_v one_o half_a of_o the_o say_a debt_n in_o kind_n shall_v have_v liberty_n for_o the_o payment_n of_o the_o other_o half_a until_o the_o 10_o of_o november_n 1668_o give_v reasonable_a security_n if_o request_v to_o pay_v the_o remain_v half_o at_o the_o time_n aforesaid_a and_o in_o case_n the_o creditor_n will_v not_o stay_v out_o that_o time_n but_o prosecute_v the_o debtor_n for_o payment_n to_o be_v make_v soon_o it_o shall_v be_v in_o the_o liberty_n and_o choice_n of_o the_o debtor_n to_o make_v tender_a of_o his_o estate_n before_o the_o next_o justice_n of_o peace_n to_o legal_a valuation_n for_o payment_n of_o the_o say_v second_o moiety_n provide_v that_o if_o the_o say_a debt_n be_v under_o two_o hogshead_n of_o tobacco_n it_o shall_v not_o be_v lawful_a for_o the_o debtor_n to_o prejudice_v the_o creditor_n by_o break_v a_o hogshead_n of_o tobacco_n and_o pay_v a_o parcel_n thereof_o iii_o a_o act_n for_o valuation_n of_o commodity_n for_o payment_n of_o public_a due_n be_v it_o also_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o public_a due_n this_o year_n in_o regard_n of_o the_o cessation_n and_o cause_n that_o expectation_n of_o advance_v the_o value_n of_o tobacco_n there_o be_v a_o abatement_n of_o the_o sum_v former_o allow_v and_o that_o all_o public_a and_o county_n debt_n minister_n and_o parish_n due_n officer_n fee_n fine_n quit_v rent_n and_o all_o other_o rate_n and_o debt_n general_o that_o shall_v be_v contract_v and_o become_v due_a in_o the_o vacant_a year_n from_o plant_v may_v be_v pay_v in_o the_o country_n commodity_n at_o the_o rate_n here_o follow_v plant_v valuation_n of_o commodity_n for_o payment_n of_o public_a due_n during_o the_o cessation_n from_o plant_v viz._n wheat_n garravance_n and_o english_a pease_n per_fw-la bushell_n forty_o pound_n of_o tobacco_n or_o four_o shilling_n indian_a corn_n shelled_a two_o shilling_n or_o twenty_o pound_n of_o tobacco_n barley_n per_fw-la bushell_n thirty_o five_o pound_n of_o tobacco_n or_o three_o shilling_n six_o penny_n wound_v silk_n per_fw-la pound_n two_o hundred_o pound_n of_o tobacco_n or_o twenty_o shilling_n indian_a pease_n of_o all_o sort_n except_o garravance_n per_fw-mi bushell_n thirty_o five_o pound_n of_o tobacco_n or_o three_o shilling_n six_o penny_n oat_n per_fw-la bushell_n thirty_o pound_n of_o tobacco_n or_o three_o shilling_n provide_v that_o for_o prevention_n of_o inconvenience_n that_o the_o receiver_n be_v subject_a to_o if_o he_o have_v not_o cask_n to_o carry_v his_o grain_n it_o be_v further_o enact_v that_o the_o debtor_n shall_v provide_v and_o pay_v the_o grain_n in_o cask_n and_o the_o creditor_n to_o allow_v he_o ten_o per_fw-la cent._n as_o in_o case_n of_o tobacco_n no_o rate_n be_v set_v upon_o flax_n by_o reason_n of_o the_o uncertainty_n of_o the_o quantity_n nor_o beef_n not_o pork_n because_o perishable_a but_o both_o these_o leave_v to_o valuation_n according_a to_o condition_n and_o goodness_n iv_o a_o act_n for_o rate_v of_o ordinary_a keeper_n vide_fw-la act_n 3_o anno_fw-la 1671_o and_o act_n 10._o anno_fw-la 1676_o 7._o v._o a_o act_n ascertain_v surveyor_n fe_n whereas_o the_o act_n concern_v the_o fee_n of_o surveyor_n by_o reason_n of_o the_o low_a rate_n set_v therein_o which_o seem_v to_o have_v be_v first_o make_v above_o twenty_o year_n since_o when_o tobacco_n bear_v a_o great_a value_n than_o can_v now_o be_v expect_v deter_v any_o man_n of_o part_n ability_n or_o integrity_n from_o exercise_v the_o say_a function_n in_o the_o faithful_a and_o well_o discharge_v whereof_o the_o peace_n and_o possession_n of_o the_o inhabitant_n of_o this_o country_n be_v so_o much_o concern_v and_o yet_o for_o want_v of_o a_o penalty_n therein_o express_v leave_v a_o liberty_n to_o every_o one_o to_o extort_v from_o the_o people_n what_o sum_v they_o please_v be_v it_o therefore_o enact_v by_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o that_o for_o encouragement_n of_o able_a man_n in_o that_o science_n to_o practise_v the_o same_o that_o the_o fee_n limit_v in_o that_o act_n be_v double_v viz._n double_v fee_n former_o allow_v to_o surveyor_n double_v forty_o pound_n of_o tobacco_n for_o measure_v every_o hundred_o acre_n of_o land_n if_o the_o whole_a dividend_n exceed_v not_o or_o amount_v to_o one_o thousand_o acre_n but_o if_o under_o that_o quantity_n than_o four_o hundred_o pound_n of_o tobacco_n and_o for_o the_o same_o shall_v deliver_v a_o exact_a plat_v of_o the_o land_n survey_v and_o if_o any_o surveyor_n upon_o reasonable_a demand_n fine_v surveyor_n refuse_v to_o measure_v land_n at_o the_o rate_n herein_o appoint_v to_o be_v fine_v not_o be_v by_o sickness_n or_o any_o other_o lawful_a impediment_n hinder_v shall_v refuse_v to_o measure_v the_o land_n of_o any_o person_n whatsoever_o for_o the_o consideration_n and_o satisfaction_n aforesaid_a every_o such_o surveyor_n shall_v be_v fine_v and_o pay_v for_o such_o his_o refusal_n four_o thousand_o
prosecute_v at_o the_o charge_n of_o the_o county_n but_o most_o by_o those_o county_n where_o the_o offender_n dwell_v or_o the_o fact_n be_v commit_v for_o avoidance_n of_o which_o charge_v it_o unless_o the_o say_a servant_n can_v prove_v that_o what_o he_o do_v be_v do_v by_o order_n of_o the_o master_n which_o fine_a shall_v be_v recover_v by_o any_o person_n injure_v by_o action_n of_o stand_v in_o the_o pillory_n with_o their_o ear_n nail_v thereto_o shall_v a_o second_o time_n be_v convict_v thereof_o then_o for_o such_o his_o default_n he_o shall_v stand_v two_o hour_n in_o the_o to_o be_v make_v without_o any_o fee_n and_o to_o be_v void_a to_o all_o intent_n as_o if_o never_o make_v if_o not_o put_v in_o suit_n upon_o due_a certificate_n to_o be_v procure_v by_o the_o to_o the_o justice_n or_o first_o in_o commission_n of_o such_o county-court_n to_o which_o county_n such_o soldier_n or_o soldier_n etc._n etc._n shall_v belong_v shall_v forthwith_o be_v supply_v fifty_o pound_n of_o tobacco_n and_o cask_n and_o it_o be_v hereby_o declare_v and_o enact_v that_o every_o attorney_n or_o attorney_n shall_v have_v for_o every_o cause_n he_o undertake_v in_o the_o general_a court_n five_o hundred_o pound_n of_o tobacco_n and_o cask_n and_o for_o every_o cause_n he_o undertake_v in_o the_o county-court_n one_o hundred_o and_o fifty_o pound_n of_o tobacco_n and_o five_o hundred_o pound_n of_o tobacco_n and_o cask_n shall_v forfeit_v and_o pay_v to_o the_o person_n grieve_v five_o hundred_o pound_n of_o tobacco_n and_o cask_n after_o legal_a conviction_n on_o due_a proof_n thereof_o make_v to_o be_v recover_v by_o due_a process_n of_o law_n aforesaid_a fine_a lay_v on_o attorney_n refuse_v to_o plead_v for_o the_o fee_fw-mi aforesaid_a and_o upon_o refusal_n of_o any_o cause_n in_o the_o county-court_n shall_v pay_v to_o the_o party_n grieve_v one_o hundred_o and_o fifty_o pound_n of_o tobacco_n and_o cask_n after_o legal_a conviction_n as_o aforesaid_a to_o be_v recover_v by_o due_a process_n of_o law_n cause_n any_o person_n may_v notwithstanding_o plead_v his_o own_o cause_n provide_v always_o that_o this_o act_n or_o any_o clause_n therein_o shall_v not_o extend_v to_o debar_v any_o man_n that_o be_v capable_a of_o plead_v and_o manage_v his_o own_o cause_n in_o any_o the_o say_a general_n or_o county-courts_a but_o that_o he_o may_v be_v permit_v and_o allow_v to_o plead_v and_o manage_v his_o own_o business_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o vii_o a_o act_n ascertain_v the_o time_n when_o negro-children_n shall_v be_v tythable_a whereas_o it_o be_v deem_v too_o hard_a and_o severe_a that_o child_n as_o well_o christian_n as_o slave_n import_v into_o this_o colony_n shall_v be_v liable_a to_o tax_n before_o they_o be_v capable_a of_o work_v be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o all_o negro_n child_n import_v or_o to_o be_v import_v into_o this_o colony_n shall_v within_o three_o month_n after_o the_o publication_n of_o this_o law_n or_o after_o their_o arrival_n be_v bring_v to_o the_o county-court_n where_o their_o age_n shall_v be_v adjudge_v of_o by_o the_o judge_n hold_v court_n and_o put_v upon_o record_n which_o say_v negro_n or_o other_o slave_n so_o bring_v to_o court_n adjudge_v and_o record_v shall_v not_o be_v account_v tythable_a until_o he_o attain_v the_o age_n of_o twelve_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a and_o it_o be_v hereby_o enact_v that_o no_o christian_a servant_n import_v into_o this_o country_n 14._o and_o christian_a servant_n import_v not_o till_o they_o be_v 14._o shall_v be_v tythable_a before_o they_o attain_v to_o the_o age_n of_o fourteen_o year_n any_o former_a law_n usage_n or_o custom_n to_o the_o contrary_a notwithstanding_o viii_o a_o act_n licens_v a_o free_a trade_n with_o indian_n be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n before_o one_o single_a justice_n of_o the_o peace_n if_o the_o same_o exceed_v not_o two_o hundred_o pound_n of_o tobacco_n x_o a_o act_n for_o prevent_v negro_n insurrection_n whereas_o the_o frequent_a meeting_n of_o considerable_a number_n of_o negro-slave_n under_o pretence_n of_o feast_n and_o burial_n be_v judge_v and_o deem_v of_o dangerous_a consequence_n for_o prevention_n whereof_o for_o the_o future_a be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o from_o and_o after_o the_o publication_n of_o this_o law_n it_o shall_v not_o be_v lawful_a for_o any_o negro_n or_o other_o slave_n to_o carry_v or_o arm_v himself_o with_o any_o club_n staff_n gun_n sword_n or_o any_o other_o weapon_n of_o defence_n certificate_n negro_n shall_v not_o go_v arm_v nor_o depart_v from_o off_o their_o master_n ground_n without_o certificate_n or_o offence_n nor_o to_o go_v or_o depart_v from_o off_o his_o master_n ground_n without_o a_o certificate_n from_o his_o master_n mistress_z or_o overseer_n and_o such_o permission_n not_o to_o be_v grant_v but_o upon_o particular_a and_o necessary_a occasion_n and_o every_o negro_n or_o slave_n so_o offend_v not_o have_v certificate_n as_o aforesaid_a shall_v be_v send_v to_o the_o next_o constable_n who_o be_v hereby_o enjoin_v and_o require_v to_o give_v the_o say_a negro_n twenty_o lash_n on_o the_o bare_a back_n well_o lay_v on_o and_o so_o send_v home_o to_o his_o say_a master_n mistress_z or_o overseer_n punish_v resistance_n of_o negro_n or_o any_o other_o slave_n punish_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o act_n for_o presentation_n and_o delivery_n of_o grievance_n for_o as_o much_o as_o it_o have_v be_v the_o frequent_a practice_n of_o ill_o dispose_v and_o seditious_a person_n to_o deliver_v to_o their_o burgess_n and_o they_o to_o the_o assembly_n scandalous_a and_o seditious_a paper_n and_o to_o entitle_v or_o call_v they_o the_o grievance_n of_o such_o county_n or_o county_n wherein_o they_o dwell_v neither_o give_v or_o present_v the_o same_o in_o lawful_a manner_n nor_o in_o truth_n be_v know_v to_o any_o other_o of_o his_o majesty_n good_a subject_n of_o such_o county_n who_o title_n they_o bear_v be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n sign_v sberiff_n of_o each_o county_n shall_v before_o every_o session_n of_o assembly_n appoint_v a_o time_n and_o place_n for_o receive_v presentment_n of_o grievance_n such_o presentment_n shall_v be_v sign_v and_o it_o be_v hereby_o enact_v general_n assembly_n and_o it_o be_v hereby_o enact_v that_o from_o and_o after_o publication_n of_o this_o act_n it_o shall_v not_o be_v lawful_a for_o any_o person_n or_o person_n whatsoever_o to_o export_v out_o of_o this_o his_o majesty_n colony_n of_o virginia_n any_o untainted-hides_a or_o deer-skin_n upon_o the_o penalty_n of_o pay_v for_o every_o raw-hide_a or_o deer-skin_n one_o hundred_o pound_n of_o tobacco_n and_o cask_n that_o shall_v be_v find_v on_o board_n any_o ship_n boat_n sloop_n or_o other_o vessel_n in_o order_n to_o such_o exportation_n over_o and_o beside_o the_o chapel_n within_o this_o his_o majesty_n colony_n whilst_o the_o minister_n be_v exercise_v his_o ministerial_a function_n and_o shall_v disturb_v he_o by_o word_n or_o any_o other_o manner_n of_o mean_n whatsoever_o or_o shall_v there_o appear_v in_o any_o unseemly_a or_o undecent_a gesture_n any_o justice_n sheriff_z or_o other_o officer_n then_o present_a shall_v put_v such_o person_n or_o person_n so_o offend_v under_o restraint_n during_o divine_a service_n who_o shall_v also_o for_o the_o first_o offence_n be_v fine_v two_o hundred_o pound_n of_o tobacco_n and_o cask_n and_o for_o every_o such_o offence_n as_o shall_v be_v by_o they_o or_o any_o of_o they_o commit_v after_o in_o the_o like_a quality_n shall_v be_v fine_v five_o hundred_o pound_n of_o like_a tobacco_n and_o cask_n for_o every_o such_o offence_n which_o fine_n shall_v be_v levy_v by_o the_o sheriff_n upon_o the_o estate_n of_o the_o person_n or_o person_n so_o offend_v by_o virtue_n of_o a_o warrant_n from_o a_o justice_n of_o the_o peace_n and_o such_o justice_n of_o the_o peace_n that_o shall_v refuse_v or_o neglect_v to_o put_v this_o law_n into_o severe_a execution_n shall_v be_v fine_v five_o hundred_o pound_n of_o tobacco_n and_o cask_n to_o the_o use_n of_o the_o parish_n for_o every_o such_o neglect_n fourteen_o a_o act_n revive_v and_o reinforcing_a a_o act_n make_v at_o james-city_n merchandize_v good_n in_o carriage_n thereof_o to_o and_o from_o the_o ship_n for_o the_o better_a prevention_n thereof_o for_o the_o future_a etc._n justice_n of_o the_o country_n court_n shall_v annual_o appoint_v the_o surveyor_n of_o the_o river_n and_o creek_n to_o clear_v the_o same_o from_o all_o tree_n log_n rubbish_n etc._n etc._n be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o from_o and_o after_o the_o publication_n of_o this_o law_n the_o respective_a justice_n of_o the_o several_a county-court_n do_v annual_o in_o june_n or_o july-court_n appoint_v and_o order_v the_o surveyor_n for_o the_o river_n to_o clear_v all_o and_o all_o manner_n of_o log_n tree_n root_n of_o tree_n and_o other_o rubbish_n as_o may_v any_o way_n hurt_v and_o endanger_v any_o sloop_n boat_n or_o other_o vessel_n from_o out_o of_o the_o respective_a river_n or_o creek_n head_n or_o part_n of_o any_o river_n or_o rivers_n creek_n or_o creek_n within_o their_o county_n and_o limit_v bound_n as_o surveyor_n which_o say_v clear_v and_o removal_n of_o all_o log_n tree_n root_n of_o tree_n and_o other_o rubbish_n shall_v be_v as_o aforesaid_a annual_o perform_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act_n under_o such_o pain_n and_o penalty_n for_o every_o delinquent_n and_o offender_n as_o be_v set_v down_o in_o 97th_o act_n of_o assembly_n in_o the_o print_a book_n entitle_v tobacco_n such_o as_o shall_v fall_v tree_n into_o the_o river_n and_o not_o clear_a away_o the_o same_o fine_v 500_o l._n of_o tobacco_n surveyor_n for_o highway_n and_o if_o any_o shall_v presume_v to_o fall_v tree_n into_o the_o river_n or_o creek_n and_o not_o clear_v the_o same_o the_o offender_n shall_v be_v fine_v five_o hundred_o pound_n of_o tobacco_n the_o first_o offence_n to_o the_o use_n of_o the_o county_n and_o for_o the_o second_o one_o thousand_o pound_n of_o tobacco_n to_o the_o use_n aforesaid_a xvi_o additional_a fee_n ascertain_v to_o county-court_n clerk_n be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n and_o it_o be_v hereby_o enact_v that_o those_o additional_a fee_n hereafter_o set_v down_o inhabitant_n of_o this_o country_n or_o to_o or_o with_o any_o master_n of_o or_o mariner_n or_o other_o person_n belong_v to_o any_o ship_n vessel_n boat_n or_o sloop_n any_o iron_n wool_n woolfels_n other_o as_o shall_v not_o give_v due_a obedience_n to_o this_o act._n shall_v upon_o command_n make_v to_o he_o in_o his_o majesty_n name_n refuse_v to_o be_v aid_v or_o assist_v to_o such_o sheriff_n or_o other_o officer_n in_o the_o execution_n of_o such_o warrant_n every_o such_o person_n so_o offend_v shall_v forfeit_v the_o sum_n of_o one_o thousand_o pound_n of_o tobacco_n with_o cask_n one_o half_a of_o all_o such_o fine_n and_o forfeiture_n to_o be_v pay_v to_o the_o king_n majesty_n and_o the_o other_o half_a to_o he_o or_o they_o that_o will_v inform_v to_o be_v recover_v as_o be_v before_o direct_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o collector_n in_o this_o country_n shall_v at_o the_o entry_n of_o every_o ship_n or_o vessel_n acquaint_v every_o master_n of_o such_o ship_n or_o vessel_n with_o this_o act_n and_o enter_v a_o particular_a clause_n in_o the_o condition_n of_o their_o entry-bond_n for_o the_o performance_n of_o the_o same_o provide_v always_o and_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o if_o any_o person_n or_o person_n shall_v hereafter_o be_v sue_v or_o implead_v by_o virtue_n hereof_o for_o the_o breach_n of_o any_o clause_n or_o prohibition_n herein_o contain_v upon_o the_o forfeiture_n or_o penalty_n herein_o before_o mention_v express_v or_o other_o or_o former_a law_n force_n the_o time_n this_o act_n shall_v continue_v in_o force_n custom_n or_o usage_n to_o the_o contrary_a notwithstanding_o provide_v also_o that_o this_o act_n shall_v continue_v in_o force_n until_o the_o ten_o day_n of_o november_n which_o shall_v be_v in_o the_o year_n of_o our_o lord_n 1685._o and_o from_o thence_o to_o the_o end_n of_o the_o next_o session_n of_o assembly_n v._o a_o act_n direct_v how_o commission_n of_o dedimus_fw-la potestatem_fw-la and_o other_o writ_n shall_v issue_v whereas_o the_o present_a course_n of_o
every_o time_n he_o shall_v neglect_v such_o range_v and_o scouting_n one_o thousand_o pound_n of_o tobacco_n and_o cask_n and_o that_o every_o soldier_n that_o shall_v neglect_v or_o omit_v to_o appear_v at_o such_o muster_n shall_v forfeit_v one_o hundred_o pound_n of_o tobacco_n in_o cask_n and_o for_o not_o scouting_n and_o range_v as_o aforesaid_a two_o hundred_o pound_n of_o tobacco_n and_o cask_n for_o every_o such_o default_n all_o which_o forfeiture_n to_o be_v recover_v by_o action_n of_o debt_n by_o he_o or_o they_o that_o will_v inform_v the_o one_o half_a to_o the_o informer_n and_o the_o other_o half_a to_o the_o use_n of_o the_o county_n and_o be_v it_o further_o enact_v by_o the_o auhtority_n aforesaid_a that_o upon_o notice_n advice_n or_o discovery_n of_o the_o approach_n or_o attempt_v of_o any_o enemy_n the_o say_a captain_n or_o corporal_n of_o the_o troop_n be_v hereby_o require_v to_o give_v speedy_a advice_n thereof_o to_o some_o one_o or_o more_o of_o the_o chief_a officer_n of_o the_o militia_n militia_n the_o captain_n of_o the_o say_a troop_n upon_o approach_n of_o any_o enemy_n shall_v give_v notice_n thereof_o to_o the_o officer_n of_o the_o militia_n and_o he_o or_o they_o to_o his_o excellency_n the_o governor_n the_o right_a honourable_a the_o deputy_n governor_n or_o some_o one_o of_o the_o honourable_a council_n and_o in_o the_o mean_a time_n to_o observe_v and_o attend_v the_o motion_n of_o the_o enemy_n only_o unless_o he_o shall_v obstinate_o persist_v to_o commit_v act_n of_o hostility_n and_o in_o such_o case_n of_o necessity_n to_o engage_v or_o destroy_v they_o if_o he_o see_v cause_n and_o in_o all_o thing_n to_o attend_v and_o execute_v such_o order_n and_o command_n as_o he_o shall_v receive_v from_o the_o governor_n and_o council_n and_o it_o be_v further_o enact_v that_o for_o their_o better_a management_n and_o order_v their_o horse_n and_o make_v they_o fit_a for_o service_n no_o soldier_n presume_v to_o use_v or_o bring_v to_o service_n any_o other_o horse_n then_o that_o only_o which_o shall_v be_v first_o mustered_n and_o approve_v of_o of_o which_o each_o captain_n be_v to_o take_v such_o particular_a notice_n as_o that_o he_o may_v know_v the_o horse_n again_o unless_o in_o case_n such_o horse_n shall_v be_v by_o some_o accident_n make_v unfit_a for_o service_n in_o which_o case_n such_o soldier_n may_v provide_v himself_o of_o another_o able_a horse_n in_o his_o stead_n which_o he_o be_v likewise_o not_o to_o part_v with_o unless_o for_o his_o first_o horse_n again_o and_o this_o act_n to_o continue_v in_o force_n for_o three_o year_n from_o the_o first_o day_n of_o january_n now_o next_o ensue_v provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o aforesaid_a recite_v act_n of_o the_o 8_o of_o june_n 1680._o entitle_v a_o act_n for_o the_o continuation_n of_o the_o several_a garrison_n and_o fortification_n at_o the_o head_n of_o the_o four_o great_a river_n be_v repeal_v and_o it_o be_v hereby_o repeal_v for_o three_o year_n under_o his_o majesty_n good_a like_n and_o after_o until_o his_o majesty_n pleasure_n mischief_n be_v it_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o general_a assembly_n and_o it_o be_v hereby_o enact_v and_o declare_v that_o if_o any_o person_n or_o person_n shall_v at_o any_o time_n after_o the_o publish_v this_o present_a act_n malicious_o and_o advise_o publish_v and_o declare_v by_o word_n or_o writing_n the_o act_n of_o assembly_n of_o virginia_n not_o repeal_v expire_v vacate_v or_o annul_v by_o the_o king_n most_o excellent_a majesty_n be_v not_o of_o force_n or_o bind_v within_o this_o his_o say_a majesty_n dominion_n to_o all_o his_o majesty_n subject_n inhabit_v or_o be_v therein_o such_o person_n or_o person_n so_o offend_v shall_v be_v adjudge_v deem_v and_o take_v to_o be_v factious_a and_o seditious_a and_o contemner_n of_o the_o law_n and_o be_v thereof_o lawful_o convict_v shall_v for_o the_o first_o offence_n be_v fine_v one_o thousand_o pound_n of_o tobacco_n and_o suffer_v one_o month_n imprisonment_n without_o bail_n or_o mainprize_n and_o for_o the_o second_o offence_n two_o thousand_o pound_n of_o tobacco_n and_o two_o month_n imprisonment_n and_o for_o every_o such_o offence_n after_o double_v the_o penalty_n and_o forfeiture_n aforesaid_a one_o half_a of_o which_o forfeiture_n to_o the_o king_n majesty_n his_o heir_n and_o successor_n and_o the_o other_o half_a to_o the_o informer_n to_o be_v recover_v by_o action_n of_o debt_n in_o any_o of_o his_o majesty_n court_n in_o this_o his_o majesty_n country_n which_o say_v penalty_n be_v to_o be_v add_v and_o impose_v over_o and_o beside_o all_o other_o punishment_n that_o may_v be_v legal_o inflict_v on_o such_o offender_n ix_o a_o act_n repeal_n a_o exception_n in_o the_o 9th_o act_n of_o assembly_n make_v anno_fw-la 1664._o whereas_o the_o 9th_o act_n of_o assembly_n make_v at_o james_n city_n the_o twenty_o day_n of_o september_n 1664._o entitle_v a_o act_n concern_v arrest_n in_o court-time_n exempt_v the_o inhabitant_n of_o james-city-county_n from_o the_o benefit_n thereof_o leave_v they_o liable_a to_o arrest_n in_o time_n of_o general_n court_n and_o assembly_n which_o be_v find_v injurious_a to_o many_o of_o the_o inhabitant_n of_o the_o say_a county_n be_v it_o therefore_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o general_a assembly_n and_o it_o it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o latter_a clause_n of_o the_o say_v recite_v act_n whereby_o the_o inhabitant_n of_o the_o say_a county_n be_v except_v out_o of_o the_o say_a act_n assembly_n the_o inhabitant_n of_o james-city-county_n free_v from_o arrest_n during_o the_o general_n assembly_n be_v repeal_v and_o make_v void_a and_o that_o the_o inhabitant_n of_o the_o say_a county_n have_v equal_a benefit_n of_o the_o say_v recite_v act_n with_o the_o other_o inhabitant_n of_o this_o country_n provide_v always_o nevertheless_o that_o this_o act_n shall_v not_o extend_v to_o the_o inhabitant_n of_o james-city_n but_o that_o they_o and_o every_o of_o they_o shall_v be_v liable_a to_o arrest_n in_o court-time_n as_o though_o the_o exception_n in_o the_o say_a act_n of_o assembly_n james-city_n but_o not_o the_o inhabitant_n of_o james-city_n anno_fw-la 1664._o do_v still_o remain_v in_o full_a force_n any_o thing_n in_o this_o act_n before_o mention_v to_o the_o contrary_a notwithstanding_o x._o a_o act_n that_o witness_n be_v free_a from_o arrest_n for_o asmuch_o as_o many_o person_n summon_v or_o subpenae_v as_o evidence_n in_o cause_n depend_v in_o the_o court_n of_o this_o country_n many_o time_n fail_v in_o appear_v for_o fear_v of_o be_v arrest_v when_o they_o appear_v at_o court_n as_o witness_n whereby_o many_o time_n many_o inhabitant_n of_o this_o country_n lose_v their_o suit_n and_o just_a due_a be_v it_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o general_a assembly_n and_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o from_o henceforth_o all_o person_n subpenae_v as_o evidence_n or_o witness_n in_o any_o cause_n or_o matter_n depend_v in_o any_o court_n in_o virginia_n shall_v be_v free_a from_o arrest_n for_o any_o debt_n or_o trespass_n except_o at_o the_o king_n suit_n during_o their_o attendance_n at_o court_n and_o their_o direct_a come_n to_o court_n and_o return_v home_o xi_o a_o act_n for_o the_o encouragement_n of_o the_o manufactory_n of_o linen_n and_o woollen_a cloth_n be_v it_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o general_n assemby_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o what_o person_n or_o person_n soever_o shall_v produce_v to_o the_o county-court_n where_o he_o or_o they_o shall_v reside_v a_o certificate_n under_o the_o hand_n of_o two_o justice_n of_o the_o peace_n of_o the_o same_o county_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la that_o such_o person_n or_o person_n have_v produce_v to_o they_o upon_o oath_n of_o his_o or_o their_o own_o growth_n or_o
manufacture_n a_o great_a or_o lesser_a quantity_n of_o flax_n seed_n hempseed_n or_o either_o of_o they_o shall_v have_v give_v and_o allow_v he_o or_o they_o for_o encouragement_n to_o persist_v in_o so_o useful_a a_o manufacture_n for_o every_o peck_n of_o flax-seed_n four_o and_o twenty_o pound_n of_o tobacco_n and_o for_o every_o peck_n of_o hempseed_n twenty_o pound_n of_o tobacco_n for_o which_o the_o county-court_n be_v impower_v to_o give_v every_o person_n or_o person_n certificate_n thereof_o hempseed_n 24_o l._n of_o tobacco_n allow_v by_o the_o public_a for_o every_o peck_n of_o flax-seed_n of_o the_o growth_n of_o the_o country_n and_o 20_o l._n of_o tobacco_n for_o every_o peck_n of_o hempseed_n attest_v by_o their_o clerk_n which_o shall_v be_v a_o sufficient_a proof_n to_o the_o general_n assembly_n to_o order_v the_o say_a person_n or_o person_n their_o say_a encouragement_n out_o of_o the_o public_a levy_n provide_v such_o certificate_n from_o the_o justice_n to_o the_o county-court_n be_v file_v at_o the_o court_n and_o fix_v up_o there_o to_o the_o intent_n that_o all_o person_n whatever_o may_v have_v a_o view_n of_o the_o same_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o what_o person_n or_o person_n soever_o shall_v by_o his_o industry_n of_o his_o own_o growth_n and_o manufacture_n work_v up_o his_o flax_n and_o hemp_n fit_a for_o the_o spindle_n and_o produce_v the_o same_o to_o the_o next_o county-court_n wrought_v allowance_n for_o flax_n or_o hemp_n wrought_v or_o make_v the_o same_o appear_v by_o certificate_n as_o aforesaid_a for_o every_o pound_n so_o wrought_v up_o either_o of_o flax_n or_o hemp_n he_o or_o they_o shall_v be_v allow_v two_o pound_n of_o tobacco_n for_o he_o or_o their_o encouragement_n by_o the_o public_a and_o a_o certificate_n thereof_o shall_v be_v give_v from_o the_o say_a county-court_n to_o the_o general_n assembly_n which_o certificate_n shall_v be_v a_o sufficient_a proof_n for_o he_o to_o be_v allow_v out_o of_o the_o public_a levy_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o for_o the_o further_o and_o better_a encouragement_n of_o the_o aforesaid_a manufacture_n of_o hemp_n and_o flax_n and_o for_o the_o work_n up_o our_o wool_n into_o cloth_n that_o every_o person_n that_o shall_v make_v or_o cause_n to_o be_v make_v the_o say_a hemp_n or_o flax_n so_o wrought_v to_o the_o spindle_n as_o aforesaid_a into_o linnen-cloth_n that_o such_o person_n or_o person_n shall_v be_v allow_v for_o every_o ell_n of_o such_o linen_n that_o shall_v be_v three_o quarter_n of_o a_o yard_n wide_a or_o more_o six_o pound_n of_o tobacco_n and_o for_o every_o yard_n of_o woolen-cloth_n or_o linsey_n woolsey_n of_o the_o like_a breadth_n six_o pound_n of_o tobacco_n to_o be_v pay_v by_o the_o public_a linsey-woolsey_n allowance_n for_o the_o same_o make_v into_o cloth_n also_o for_o woollen_a cloth_n and_o for_o linsey-woolsey_n such_o person_n or_o person_n produce_v the_o say_a linen_n or_o woolen-cloth_n or_o linsey_n woolsey_n to_o the_o county-court_n where_o he_o or_o they_o shall_v reside_v who_o be_v hereby_o require_v and_o empower_v to_o examine_v and_o inquire_v and_o take_v proof_n that_o the_o say_a linen_n or_o woolen_n or_o linsey-woolsey_n be_v of_o their_o proper_a growth_n and_o manufacture_n and_o according_o certify_v the_o same_o to_o the_o next_o assembly_n which_o certificate_n shall_v be_v receive_v as_o proof_n to_o the_o assembly_n for_o the_o allow_v thereof_o out_o of_o the_o public_a levy_n and_o whereas_o it_o be_v well_o hope_v that_o by_o the_o encouragement_n aforesaid_a there_o will_v be_v such_o great_a quantity_n of_o flax-seed_n and_o hempseed_n produce_v in_o this_o country_n as_o will_v abundant_o furnish_v the_o inhabitant_n for_o the_o end_n and_n purpose_n hereafter_o mention_v and_o that_o the_o inhabitant_n be_v remember_v careful_o to_o provide_v themselves_o seed_n the_o next_o ensue_a year_n for_o the_o year_n follow_v be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o tythable_a person_n that_o shall_v be_v in_o the_o country_n in_o the_o year_n 1684._o according_a as_o he_o be_v usual_o note_v or_o set_v down_o in_o the_o list_n of_o tythable_n after_o for_o every_o tythable_a in_o the_o year_n 1684._o shall_v be_v make_v one_o pound_n of_o flax_n and_o one_o pound_n of_o hemp_n dress_v or_o two_o pound_n of_o either_o and_o so_o yearly_o after_o shall_v make_v or_o cause_n to_o be_v make_v one_o pound_n of_o dress_v flax_n and_o one_o pound_n of_o dress_v hemp_n or_o two_o pound_n of_o either_o and_o yearly_a and_o every_o year_n thereafter_o under_o the_o penalty_n of_o fifty_o pound_n of_o tobacco_n for_o every_o pound_n of_o flax_n or_o hemp_n neglect_v or_o omitt_v to_o be_v make_v as_o aforesaid_a the_o same_o to_o be_v pay_v the_o one_o half_a to_o the_o county_n the_o other_o to_o the_o informer_n by_o such_o master_n owner_n or_o overseer_n of_o any_o family_n or_o company_n of_o servant_n or_o any_o other_o tythable_a that_o shall_v be_v find_v to_o neglect_v or_o omit_v as_o aforesaid_a &_o for_o the_o better_a discovery_n of_o such_o neglect_n or_o omission_n that_o all_o master_n owner_n or_o overseer_n who_o have_v the_o charge_n of_o family_n and_o company_n of_o servant_n and_o other_o tythable_n shall_v at_o some_o convenient_a time_n before_o the_o lay_n of_o the_o levy_n in_o the_o respective_a county_n default_n the_o penalty_n of_o a_o default_n produce_v before_o some_o justice_n of_o the_o peace_n of_o the_o county_n the_o aforesaid_a quantity_n of_o hemp_n or_o flax_n as_o be_v herein_o enjoin_v to_o be_v make_v and_o the_o same_o deliver_v upon_o oath_n which_o oath_n the_o say_a justice_n be_v hereby_o impower_v to_o administer_v that_o the_o flax_n or_o hemp_n so_o produce_v be_v of_o his_o own_o growth_n and_o manufacture_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a country_n allowance_n by_o the_o public_a for_o hat_n make_v of_o wool_n or_o furr_n of_o the_o growth_n of_o this_o country_n that_o there_o shall_v be_v allow_v and_o pay_v out_o of_o the_o public_a levy_n for_o every_o well-wrought_a hat_n make_v of_o wool_n or_o furr_n in_o this_o country_n to_o the_o maker_n thereof_o ten_o pound_n of_o tobacco_n and_o for_o every_o dozen_o pair_n of_o man_n or_o woman_n woollen_a or_o worsted_n hose_n twelve_o pound_n of_o tobacco_n to_o be_v prove_v and_o certify_v in_o such_o manner_n and_o form_n as_o in_o this_o act_n before_o be_v express_v for_o linen_n and_o woolen-cloth_n force_n the_o time_n this_o act_n shall_v continue_v in_o force_n provide_v always_o nevertheless_o and_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o this_o law_n shall_v continue_v in_o force_n until_o the_o ten_o day_n of_o november_n which_o shall_v be_v in_o the_o year_n of_o our_o lord_n 1685._o and_o no_o long_o any_o thing_n in_o this_o act_n before_o contain_v to_o the_o contrary_a notwithstanding_o xii_o a_o act_n for_o the_o advancement_n of_o manufacture_n of_o the_o growth_n of_o this_o country_n and_o for_o the_o better_a and_o more_o speedy_a payment_n of_o debt_n and_o levy_n for_o encouragement_n of_o manufacture_n and_o improvement_n of_o commodity_n of_o the_o growth_n of_o the_o country_n and_o also_o ascertain_v the_o rate_n and_o price_n be_v it_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o general_a assembly_n that_o all_o debt_n either_o in_o money_n or_o tobacco_n contract_v after_o publication_n hereof_o in_o this_o his_o majesty_n colony_n and_o dominion_n of_o virginia_n where_o the_o debtor_n upon_o demand_n of_o the_o creditor_n can_v pay_v the_o same_o in_o specie_fw-la or_o kind_n and_o shall_v upon_o his_o oath_n declare_v before_o some_o one_o justice_n of_o the_o peace_n which_o oath_n the_o say_a justice_n be_v hereby_o impower_v and_o require_v to_o administer_v the_o sum_n of_o money_n or_o quantity_n of_o tobacco_n he_o have_v here_o or_o elsewhere_o and_o shall_v make_v tender_a of_o so_o much_o towards_o payment_n of_o his_o debt_n that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o every_o such_o debtor_n to_o make_v payment_n of_o his_o debt_n or_o the_o remainder_n thereof_o in_o the_o commodity_n and_o manufacture_n of_o this_o country_n hereafter_o mention_v country_n debt_n may_v be_v pay_v in_o commodity_n of_o the_o growth_n and_o mnnufocturos_fw-la of_o this_o country_n at_o the_o rate_n and_o price_n hereafter_o follow_v viz._n tobacco_n at_o ten_o shilling_n per_fw-la cent_z wheat_n english_a pease_n and_o galavance_n at_o four_o shilling_n or_o forty_o pound_n of_o tobacco_n per_fw-la bushel_n barley_n oates_n and_o all_o other_o indian_a pease_n at_o three_o shilling_n seven_o penny_n farthing_n or_o thirty_o six_o pound_n of_o tobacco_n per_fw-la bushel_n
