next_o justice_n of_o peace_n by_o two_o witness_n or_o upon_o certificate_n under_o hand_n of_o the_o commissary_n of_o the_o muster_n or_o chief_a magistrate_n as_o aforesaid_a make_v to_o such_o justice_n shall_v be_v commit_v to_o the_o house_n of_o correction_n for_o ten_o day_n and_o have_v his_o ear_n cut_v off_o by_o the_o gaoler_n or_o keeper_n thereof_o if_o any_o person_n lend_v a_o horse_n to_o be_v muster_v not_o belong_v to_o the_o troop_n such_o horse_n shall_v be_v forfeit_v to_o the_o informer_n if_o it_o belong_v to_o the_o person_n lend_v if_o not_o the_o lender_n shall_v justice_n of_o peace_n i._o repeal_v justice_n of_o peace_n in_o wales_n limit_v to_o eight_o in_o each_o county_n repeal_v stat._n 5_o w._n &_o m._n sess_n 5._o cap._n 4._o whereas_o by_o a_o statute_n make_v the_o 34_o and_o 35_o of_o h._n 8._o entitle_v a_o act_n for_o certain_a ordinance_n in_o the_o king_n majesty_n dominion_n and_o principality_n of_o wales_n there_o be_v a_o clause_n contain_v in_o these_o word_n viz._n that_o there_o shall_v not_o exceed_v the_o number_n of_o eight_o justice_n of_o the_o peace_n in_o any_o of_o the_o say_a shire_n over_o and_o above_o the_o precedent_n council_n and_o justice_n aforesaid_a and_o the_o king_n attorney_n and_o solicitor_n which_o precedent_n council_n justices_z and_o the_o king_n attorney_n and_o solicitor_n shall_v be_v put_v in_o every_o commission_n of_o peace_n in_o every_o of_o the_o say_v twelve_o shire_n and_o whereas_o this_o clause_n be_v find_v inconvenient_a be_v it_o enact_v that_o the_o say_a clause_n be_v repeal_v and_o that_o it_o may_v be_v lawful_a to_o and_o for_o the_o king_n and_o queen_n by_o commission_n under_o the_o great_a seal_n to_o constitute_v nominate_v and_o appoint_v any_o such_o number_n of_o person_n to_o be_v justice_n of_o peace_n in_o any_o of_o the_o say_a county_n of_o wales_n as_o they_o shall_v think_v fit_v according_a to_o such_o way_n and_o method_n as_o be_v common_o use_v for_o the_o constitute_n nominate_v and_o appoint_v of_o justice_n of_o peace_n for_o any_o county_n of_o england_n and_o that_o the_o person_n so_o constitute_v nominate_v and_o appoint_v shall_v have_v power_n and_o authority_n to_o act_v and_o do_v any_o thing_n appertain_v to_o the_o office_n of_o a_o justice_n of_o peace_n in_o as_o large_a and_o ample_a manner_n as_o any_o justice_n of_o peace_n within_o the_o dominion_n of_o wales_n may_v or_o aught_o to_o have_v do_v before_o the_o make_n of_o this_o act_n any_o law_n etc._n etc._n to_o the_o contrary_a notwithstanding_o i._o stat._n 5_o &_o 6_o w._n &_o m._n sess_n 5._o cap._n 5._o indictment_n certiorari_fw-la to_o remove_v indictment_n that_o in_o termtime_n no_o certiorari_fw-la at_o the_o prosecution_n of_o any_o party_n indict_v shall_v be_v grant_v out_o of_o the_o court_n of_o king_n bench_n to_o remove_v any_o indictment_n before_o trial_n have_v and_o from_o before_o the_o justice_n of_o the_o general_n or_o quarter_n session_n of_o the_o peace_n unless_o such_o certiorari_fw-la shall_v be_v grant_v upon_o motion_n of_o council_n and_o rule_n of_o court_n in_o open_a court_n and_o that_o the_o party_n indite_v prosecute_a such_o certiorari_fw-la shall_v find_v two_o manucaptor_n before_o one_o or_o two_o justice_n of_o the_o county_n in_o 20_o l._n to_o plead_v to_o the_o say_a indictment_n in_o the_o king_n bench_n and_o at_o their_o own_o charge_n to_o procure_v the_o issue_n that_o shall_v be_v join_v upon_o the_o say_a indictment_n to_o be_v try_v at_o the_o next_o assize_n hold_v for_o the_o county_n where_o the_o say_a indictment_n be_v find_v after_o such_o certiorari_fw-la shall_v be_v returnable_a if_o not_o in_o london_n westminster_n or_o middlesex_n and_o if_o in_o the_o say_a city_n or_o county_n then_o to_o cause_v it_o to_o be_v try_v the_o next_o term_n after_o such_o certiorari_fw-la shall_v be_v grant_v or_o at_o the_o sit_v after_o the_o say_a term_n if_o the_o king_n bench_n shall_v not_o appoint_v any_o other_o time_n and_o if_o any_o other_o time_n then_o notice_n to_o be_v give_v to_o the_o prosecutor_n and_o the_o say_a recognizance_n and_o certiorari_fw-la to_o be_v certify_v into_o the_o king_n bench_n and_o there_o file_v and_o the_o name_n of_o the_o prosecutor_n to_o be_v endorse_v and_o if_o the_o party_n prosecute_a such_o certiorari_fw-la be_v the_o defendant_n shall_v not_o before_o allowance_n thereof_o procure_v such_o manucaptor_n to_o be_v bind_v in_o a_o recognizance_n the_o justice_n of_o peace_n may_v try_v the_o say_a indictment_n at_o the_o say_a session_n notwithstanding_o such_o certiorari_fw-la so_o deliver_v ii_o certiorari_fw-la cost_v against_o prosecutor_n of_o a_o certiorari_fw-la and_o if_o the_o defendant_n prosecute_a such_o certiorari_fw-la be_v convict_v than_o the_o king_n bench_n shall_v give_v reasonable_a cost_v to_o the_o prosecutor_n to_o be_v tax_v according_a to_o the_o course_n of_o the_o say_a court_n and_o within_o ten_o day_n after_o demand_n upon_o oath_n and_o refusal_n thereof_o he_o shall_v have_v a_o attachment_n against_o the_o say_a defendant_n by_o the_o court_n for_o his_o contempt_n and_o the_o recognizance_n not_o to_o be_v discharge_v till_o the_o cost_v so_o tax_v shall_v be_v pay_v iii_o vacation_n certiorary_n grantable_a in_o vacation_n nevertheless_o in_o the_o vacation_n writ_n of_o certiorari_fw-la may_v be_v grant_v by_o any_o of_o the_o justice_n of_o the_o king_n bench_n who_o name_n shall_v be_v endorse_v and_o the_o name_n of_o the_o party_n at_o who_o instance_n it_o be_v grant_v and_o before_o the_o allowance_n of_o such_o writ_n the_o party_n indite_v prosecute_a such_o certiorari_fw-la shall_v find_v such_o surety_n as_o beforementioned_a in_o this_o act._n iu._n durham_n certiorary_n in_o cheshire_n lancaster_n and_o durham_n and_o also_o upon_o every_o certiorari_fw-la grant_v within_o chester_n lancaster_n and_o durham_n to_o remove_v indictment_n as_o aforesaid_a the_o party_n indite_v prosecute_a such_o certiorari_fw-la shall_v find_v surety_n to_o try_v the_o say_a indictment_n at_o the_o next_o assize_n or_o general_a gaol-delivery_n and_o if_o convict_a shall_v be_v liable_a to_o like_v cost_v to_o be_v tax_v as_o by_o this_o act_n provide_v where_o the_o same_o be_v grant_v out_o of_o the_o king_n bench._n v._o etc._n for_o repair_v highway_n etc._n etc._n provide_v if_o any_o indictment_n be_v against_o any_o person_n for_o not_o repair_v highway_n cawsy_n pavement_n or_o bridge_n and_o the_o title_n to_o repair_v the_o same_o may_v come_v in_o question_n upon_o such_o suggestion_n and_o a_o affidavit_fw-la make_v thereof_o a_o certiorari_fw-la may_v be_v grant_v to_o remove_v the_o same_o into_o the_o king_n bench_n any_o law_n to_o the_o contrary_a notwithstanding_o vi_o surety_n surety_n provide_v that_o the_o party_n prosecute_a such_o certiorari_fw-la shall_v find_v two_o manucaptor_n to_o be_v bind_v in_o a_o recognizance_n with_o condition_n as_o aforesaid_a lease_n i._o cornwall_n lease_n of_o land_n part_v of_o the_o duchy_n of_o cornwall_n stat._n 5_o hereditament_n parcel_n of_o the_o say_a duchy_n of_o cornwall_n or_o annex_v to_o the_o same_o other_o than_o of_o honour_n lordship_n or_o manor_n shall_v be_v effectual_a in_o law_n according_a to_o the_o purport_n of_o the_o same_o copy_n lease_n and_o grant_n against_o the_o present_a king_n and_o queen_n their_o heir_n and_o successor_n and_o against_o every_o person_n that_o shall_v one_o year_n not_o dispunishable_a of_o waste_n
