take_v the_o information_n of_o the_o say_a person_n in_o writing_n and_o every_o justice_n of_o the_o peace_n who_o shall_v have_v any_o knowledge_n of_o any_o such_o offence_n commit_v either_o by_o his_o own_o hear_n or_o view_n or_o by_o any_o such_o testimony_n or_o by_o confession_n of_o the_o party_n be_v hereby_o authorize_v and_o require_v to_o cause_v the_o say_a offender_n to_o become_v bind_v to_o appear_v and_o answer_v for_o the_o same_o at_o the_o next_o general_a gaol-delivery_n or_o oyer_n and_o terminer_n to_o be_v hold_v for_o that_o county_n and_o to_o be_v of_o good_a behaviour_n in_o in_o the_o mean_a time_n and_o likewise_o to_o cause_v the_o say_a witness_n and_o witness_n to_o be_v bind_v over_o to_o prosecute_v and_o give_v evidence_n against_o the_o say_a offender_n who_o at_o the_o say_v next_o gaol-delivery_n or_o oyer_n and_o terminer_n if_o it_o may_v be_v or_o otherwise_o as_o soon_o as_o may_v be_v shall_v be_v indict_v for_o his_o say_a offence_n and_o upon_o the_o trial_n be_v find_v guilty_a shall_v forfeit_v the_o sum_n of_o one_o moiety_n thereof_o to_o the_o king_n and_o queen_n their_o heir_n and_o successor_n and_o the_o other_o moiety_n thereof_o to_o the_o prosecutor_n and_o shall_v by_o the_o judge_n before_o who_o such_o trial_n shall_v be_v have_v be_v commit_v to_o the_o gaol_n there_o to_o remain_v till_o he_o or_o she_o shall_v have_v pay_v the_o say_a sum_n and_o shall_v become_v bind_v with_o two_o good_a surety_n to_o the_o good_a behaviour_n for_o the_o space_n of_o seven_o year_n than_o next_o ensue_v in_o case_n it_o be_v the_o party_n first_o offence_n of_o that_o kind_n but_o if_o it_o be_v the_o second_o offence_n of_o which_o he_o be_v so_o convict_v then_o to_o be_v of_o the_o good_a behaviour_n during_o life_n and_o if_o it_o be_v a_o three_o offence_n and_o conviction_n than_o the_o offender_n shall_v be_v commit_v to_o the_o gaol_n there_o to_o remain_v till_o he_o or_o she_o shall_v abjure_v the_o realm_n and_o be_v it_o likewise_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o person_n and_o person_n who_o shall_v hereafter_o offend_v by_o profane_a swear_v or_o curse_v shall_v forfeit_v and_o pay_v for_o every_o such_o offence_n to_o the_o use_n of_o the_o poor_a of_o the_o parish_n where_o the_o same_o shall_v be_v commit_v or_o if_o it_o be_v out_o of_o any_o parish_n to_o the_o use_n of_o the_o poor_a of_o such_o next_o adjoin_v parish_n as_o the_o justice_n or_o justice_n hereafter_o mention_v shall_v appoint_v according_a to_o the_o degree_n and_o quality_n of_o the_o person_n offend_v in_o manner_n and_o form_n follow_v that_o be_v to_o say_v every_o peer_n and_o baron_n of_o this_o realm_n or_o other_o the_o king_n dominion_n reside_v here_o and_o every_o person_n hold_v and_o enjoy_v any_o barony_n the_o sum_n of_o twenty_o shilling_n every_o baronet_n and_o knight_n the_o sum_n of_o thirteen_o shilling_n and_o four_o penny_n every_o esquire_n and_o every_o person_n have_v and_o enjoy_v any_o office_n place_n dignity_n promotion_n or_o employment_n ecclesiastical_a or_o civil_a of_o the_o value_n of_o one_o hundred_o pound_n per_fw-la annum_fw-la or_o more_o the_o sum_n of_o ten_o shilling_n and_o every_o gentleman_n and_o person_n in_o holy_a order_n every_o graduate_n in_o either_o university_n and_o every_o person_n have_v and_o enjoy_v any_o office_n place_n dignity_n promotion_n or_o employment_n ecclesiastical_a or_o civil_a under_o one_o hundred_o pound_n per_fw-la annum_fw-la the_o sum_n of_o six_o shilling_n and_o eight_o penny_n and_o every_o person_n keep_v any_o public_a house_n of_o entertainment_n and_o every_o other_o person_n under_o the_o degree_n of_o a_o gentleman_n except_o labourer_n and_o poor_a people_n the_o sum_n of_o five_o shilling_n and_o every_o labourer_n and_o other_o poor_a person_n the_o sum_n of_o two_o shilling_n and_o sixpence_n and_o every_o marry_a woman_n or_o widow_n according_a to_o the_o degree_n and_o quality_n of_o her_o present_a or_o last_o husband_n and_o in_o case_n she_o be_v never_o marry_v according_a to_o the_o degree_n and_o quality_n of_o a_o young_a son_n of_o her_o father_n all_o which_o sum_n and_o forfeiture_n all_o and_o every_o person_n and_o person_n in_o who_o presence_n or_o hear_v any_o such_o offence_n shall_v be_v commit_v be_v hereby_o authorize_v and_o require_v to_o demand_v for_o the_o use_n of_o the_o poor_a of_o the_o say_a parish_n and_o in_o case_n the_o same_o shall_v be_v pay_v to_o pay_v it_o over_o immediate_o to_o the_o overseer_n of_o the_o poor_a for_o the_o use_n aforesaid_a and_o in_o case_n the_o person_n so_o offend_v shall_v upon_o such_o demand_n refuse_v to_o pay_v the_o sum_n by_o he_o so_o forfeit_v than_o the_o say_a person_n in_o who_o presence_n or_o hear_v the_o say_a offence_n shall_v be_v commit_v shall_v and_o be_v hereby_o require_v present_o thereupon_o to_o put_v the_o word_n express_v the_o offence_n into_o write_v under_o his_o and_o their_o hand_n and_o to_o give_v notice_n of_o the_o say_a offence_n demand_n and_o refusal_n and_o to_o testify_v he_o or_o their_o knowledge_n thereof_o upon_o oath_n within_o the_o space_n of_o ten_o day_n unto_o some_o justice_n of_o the_o peace_n of_o the_o county_n or_o place_n where_o the_o same_o offence_n shall_v be_v commit_v who_o be_v hereby_o authorize_v and_o require_v to_o administer_v the_o say_a oath_n and_o thereupon_o unless_o the_o offender_n be_v a_o peer_n or_o such_o other_o great_a man_n of_o this_o realm_n as_o in_o this_o act_n hereafter_o be_v mention_v to_o direct_v and_o send_v his_o warrant_n to_o the_o constable_n tythingman_n churchwarden_n and_o overseer_n of_o the_o poor_a of_o such_o parish_n as_o aforesaid_a or_o of_o the_o parish_n where_o the_o offender_n shall_v inhabit_v thereby_o command_v they_o or_o some_o one_o or_o more_o of_o they_o to_o levy_v the_o sum_n and_o sum_n so_o forfeit_v for_o the_o use_n of_o the_o poor_a of_o such_o parish_n as_o aforesaid_a and_o likewise_o the_o like_a sum_n to_o be_v pay_v to_o such_o witness_n and_o witness_n for_o his_o and_o their_o time_n travel_n and_o pain_n employ_v about_o any_o such_o information_n by_o distress_n and_o sale_n of_o the_o good_n of_o such_o offender_n render_v unto_o he_o or_o her_o the_o overplus_n and_o in_o case_n no_o such_o distress_n can_v be_v have_v to_o apprehend_v the_o say_a offender_n and_o he_o or_o she_o to_o bring_v before_o the_o say_a justice_n or_o some_o other_o justice_n of_o the_o peace_n of_o the_o say_a county_n or_o place_n who_o be_v hereby_o require_v to_o commit_v the_o say_a offender_n to_o the_o common_a gaol_n there_o to_o remain_v until_o the_o say_a offender_n shall_v have_v pay_v the_o several_a sum_n aforesaid_a and_o full_o cost_v and_o charge_n to_o be_v tax_v by_o the_o say_a justice_n for_o apprehend_v and_o convey_v of_o such_o offender_n to_o the_o gaol_n if_o it_o be_v the_o first_o conviction_n for_o such_o offence_n but_o if_o the_o say_a offender_n shall_v have_v be_v before_o convict_v as_o aforesaid_a of_o the_o like_a offence_n and_o obstinate_a refusal_n then_o to_o remain_v there_o until_o the_o say_a offender_n shall_v moreover_o become_v bind_v before_o the_o justice_n of_o the_o peace_n at_o their_o general_n quarter_n session_n or_o the_o judge_n of_o assize_n general_n gaol_n delivery_n or_o oyer_n and_o terminer_n to_o be_v of_o the_o good_a behaviour_n for_o the_o space_n of_o then_o next_o ensue_v but_o in_o case_n it_o shall_v appear_v to_o the_o say_a justice_n by_o confession_n of_o the_o party_n or_o otherwise_o that_o the_o offender_n so_o convict_v be_v not_o able_a to_o pay_v the_o say_v several_a sum_n than_o the_o say_a offender_n shall_v be_v set_v in_o the_o stock_n for_o three_o whole_a hour_n for_o his_o first_o offence_n and_o shall_v be_v so_o set_v in_o the_o stock_n and_o moreover_o be_v public_o whip_v not_o exceed_v ten_o lash_n for_o the_o second_o and_o every_o other_o offence_n afterward_o and_o because_o it_o be_v find_v by_o common_a experience_n that_o excess_n in_o drink_v do_v beside_o other_o inconvenience_n very_o much_o dispose_v people_n to_o profane_v swear_v and_o that_o such_o excess_n be_v usual_o promote_v by_o drink_v health_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n who_o shall_v begin_v or_o pledge_v any_o health_n shall_v forfeit_v and_o pay_v as_o be_v before_o enact_v for_o profane_a swear_v to_o be_v levy_v in_o like_a manner_n and_o for_o the_o same_o use_v and_o all_o person_n present_v require_v to_o demand_v the_o forfeiture_n and_o give_v information_n of_o the_o refusal_n if_o any_o be_v as_o in_o the_o say_a case_n be_v appoint_v and_o the_o justice_n thereupon_o to_o proceed_v according_o provide_v and_o
suit_n of_o such_o person_n as_o will_v prosecute_v for_o the_o same_o to_z and_z for_o he_o or_o their_o own_o use_n in_o which_o no_o essoyn_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v and_o in_o default_n of_o such_o prosecution_n within_o six_o month_n after_o each_o several_a offence_n shall_v forfeit_v the_o like_a sum_n and_o sum_n be_v thereof_o convict_v by_o presentment_n or_o indictment_n before_o the_o justice_n of_o the_o peace_n at_o the_o quarter_n session_n to_o be_v hold_v for_o such_o county_n division_n or_o place_v where_o any_o such_o offence_n shall_v happen_v to_o be_v commit_v as_o aforesaid_a one_o moiâ—ty_n to_o the_o king_n and_o the_o other_o to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n shall_v be_v commit_v and_o moreover_o for_o such_o second_o offence_n shall_v be_v set_v in_o the_o pillory_n in_o the_o next_o market-town_n or_o open_a place_n and_o for_o the_o three_o offence_n upon_o conviction_n shall_v abjure_v the_o realm_n and_o be_v it_o further_o enact_v for_o the_o end_n and_o purpose_n aforesaid_a that_o no_o person_n whatsoever_o keep_v or_o that_o keep_v any_o public_a tavern_n alehouse_n tippling-house_n or_o other_o house_n of_o common_a entertainment_n within_o the_o city_n of_o london_n or_o westminster_n or_o burrough_n of_o southwark_n or_o place_n adjacent_a shall_v keep_v any_o organ_n or_o other_o instrument_n or_o instrument_n of_o music_n for_o the_o entertainment_n of_o guest_n on_o pain_n of_o forfeit_v the_o sum_n of_o 20_o l._n be_v thereof_o lawful_o convict_v upon_o presentment_n or_o indictment_n at_o the_o quarter-session_n of_o the_o peace_n and_o upon_o the_o further_a penalty_n of_o be_v disable_v to_o sell_v ale_n wine_n or_o other_o liquor_n by_o retail_n for_o the_o space_n of_o a_o twelve_o month_n after_o such_o conviction_n and_o every_o person_n so_o convict_v and_o yet_o sell_v any_o such_o liquor_n contrary_a to_o this_o act_n shall_v be_v punish_v as_o sell_v the_o same_o without_o licence_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o woman_n or_o woman_n shall_v at_o any_o time_n after_o sunset_n and_o before_o sunrising_n be_v entertain_v or_o receive_v into_o any_o tavern_n alehouse_n or_o other_o public_a house_n of_o entertainment_n as_o guest_n or_o guest_n except_o in_o case_n of_o traveller_n receive_v into_o their_o inn_n than_o the_o master_n mistress_n or_o dame_n of_o such_o tavern_n or_o house_n upon_o proof_n thereof_o make_v before_o one_o or_o more_o justice_n or_o justice_n of_o the_o peace_n shall_v forfeit_v 40_o s._n unless_o the_o say_a master_n mistress_n or_o dame_n shall_v prove_v by_o good_a and_o sufficient_a testimony_n that_o such_o woman_n and_o woman_n be_v of_o good_a behaviour_n and_o reputation_n and_o if_o afterward_o the_o say_a master_n mistress_z or_o dame_n shall_v permit_v the_o like_a offence_n the_o say_a tavern_n or_o house_n shall_v be_v take_v and_o deem_v a_o bawdy-house_n and_o the_o say_a master_n mistress_n and_o dame_n shall_v be_v punish_v as_o keeper_n thereof_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o offender_n within_o this_o act_n shall_v not_o be_v convict_v and_o punish_v by_o the_o justice_n of_o peace_n nor_o prosecute_v at_o the_o suit_n of_o any_o party_n as_o be_v by_o this_o act_n direct_v within_o the_o space_n of_o month_n after_o the_o offence_n commit_v that_o then_o the_o say_a offender_n shall_v and_o may_v be_v prosecute_v at_o the_o quarter-session_n of_o the_o peace_n or_o at_o the_o assize_n hold_v for_o the_o county_n where_o the_o offence_n be_v commit_v by_o indictment_n or_o information_n within_o one_o year_n after_o the_o offence_n commit_v and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o when_o and_o as_o often_o as_o any_o person_n shall_v be_v convict_v upon_o indictment_n for_o any_o offence_n contrary_a to_o this_o act_n the_o judge_n justice_n and_o justice_n before_o who_o the_o conviction_n shall_v be_v shall_v immediate_o thereupon_o signify_v the_o same_o to_o the_o bishop_n of_o the_o diocese_n where_o the_o offence_n shall_v be_v commit_v to_o the_o end_n that_o he_o may_v thereupon_o proceed_v to_o excommunication_n of_o the_o offender_n who_o shall_v not_o be_v absolve_v but_o by_o special_a order_n of_o the_o bishop_n upon_o certificate_n by_o the_o parson_n or_o vicar_n and_o churchwarden_n of_o the_o parish_n where_o the_o offender_n shall_v inhabit_v that_o the_o say_a offender_n shall_v on_o some_o lordsday_n in_o the_o morning_n immediate_o after_o the_o creed_n appoint_v for_o the_o communion_n service_n in_o the_o body_n or_o great_a isle_n of_o the_o say_a parish_n church_n have_v public_o confess_v his_o or_o her_o offence_n and_o solemn_o declare_v his_o or_o her_o unfeigned_a sorrow_n and_o repentance_n for_o the_o same_o and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n excommunicate_v or_o bind_v to_o be_v of_o good_a behaviour_n or_o convict_v of_o any_o crime_n or_o offence_n by_o virtue_n or_o in_o pursuance_n of_o this_o act_n shall_v be_v admit_v to_o vote_n or_o sit_v in_o parliament_n or_o be_v capable_a to_o be_v elect_v to_o serve_v in_o parliament_n or_o to_o act_n as_o judge_n justice_n of_o the_o peace_n or_o minister_n of_o justice_n or_o to_o perform_v any_o public_a ecclesiastical_a office_n within_o the_o kingdom_n of_o england_n or_o dominion_n of_o wales_n or_o to_o maintain_v any_o action_n of_o the_o case_n for_o scandalous_a word_n or_o upon_o the_o statute_n de_fw-fr scandalis_n magnatum_fw-la until_o he_o shall_v be_v due_o discharge_v of_o his_o scourity_n for_o the_o good_a behaviour_n and_o be_v absolve_v from_o his_o excommunication_n as_o aforesaid_a and_o shall_v have_v pay_v and_o perform_v all_o forfeiture_n pain_n penalty_n cost_v and_o charge_n incur_v forfeit_v tax_v or_o impose_v by_o virtue_n of_o this_o act_n any_o privilege_n of_o parliament_n or_o other_o whatever_o in_o any_o wise_n notwithstanding_o provide_v that_o no_o person_n excommunicate_v by_o virtue_n or_o in_o pursuance_n of_o this_o act_n shall_v by_o reason_n of_o any_o such_o excommunication_n incur_v or_o suffer_v any_o other_o temporal_a punishment_n disability_n or_o incommodity_n than_o be_v by_o this_o act_n appoint_v or_o ordain_v any_o law_n statute_n canon_n usage_n or_o custom_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o because_o the_o effect_n of_o all_o law_n and_o the_o honour_n of_o the_o government_n in_o that_o respect_n do_v depend_v upon_o the_o due_a execution_n thereof_o to_o the_o end_n that_o this_o act_n may_v be_v the_o more_o effectual_o put_v in_o execution_n be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o same_o shall_v be_v public_o read_v in_o all_o cathedral_n collegiate_n and_o parish_n church_n and_o in_o all_o chapel_n where_o the_o common_a prayer_n usual_o be_v or_o aught_o to_o be_v read_v immediate_o after_o the_o creed_n appoint_v for_o the_o communion_n service_n on_o some_o lordsday_n before_o the_o 24_o day_n of_o june_n next_o and_o afterward_o once_o every_o year_n upon_o the_o second_o lordsday_n in_o march_n and_o that_o for_o that_o purpose_n it_o shall_v be_v provide_v by_o the_o churchwarden_n of_o every_o parish_n at_o the_o charge_n of_o their_o respective_a parish_n and_o that_o all_o constable_n tything-man_n headborough_n and_o churchwarden_n shall_v at_o the_o time_n of_o their_o entrance_n upon_o their_o respective_a office_n be_v swear_v to_o put_v this_o act_n in_o due_a execution_n and_o to_o give_v information_n of_o all_o offence_n commit_v in_o their_o respective_a parish_n or_o by_o any_o person_n of_o the_o same_o parish_n contrary_a to_o this_o act_n or_o to_o the_o statute_n against_o drunkenness_n unto_o some_o justice_n of_o the_o peace_n of_o the_o same_o county_n or_o place_n within_o ten_o day_n after_o the_o same_o shall_v come_v to_o their_o knowledge_n according_a to_o their_o best_a skill_n and_o understanding_n and_o also_o that_o this_o act_n shall_v be_v give_v in_o charge_n to_o the_o grand_a jury_n by_o the_o judge_n and_o justice_n at_o their_o several_a assize_n and_o quarter-session_n to_o inquire_v and_o present_v the_o several_a offence_n aforesaid_a and_o all_o neglect_v of_o justice_n constables_z churchwarden_n and_o other_o officer_n and_o person_n in_o the_o due_a execution_n thereof_o and_o be_v it_o also_o enact_v that_o the_o judge_n justice_n and_o justice_n before_o who_o any_o person_n shall_v be_v convict_v of_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v order_n and_o cause_n to_o be_v pay_v unto_o such_o prosecutor_n and_o prosecutor_n as_o shall_v otherwise_o receive_v no_o benefit_n by_o this_o act_n and_o to_o the_o several_a witness_n such_o reasonable_a cost_v and_o charge_n and_o in_o such_o manner_n as_o he_o or_o they_o shall_v think_v fit_a and_o that_o in_o any_o action_n bring_v against_o any_o justice_n constable_n or_o other_o officer_n or_o person_n for_o any_o thing_n do_v by_o virtue_n or_o in_o pursuance_n of_o this_o act_n the_o defendant_n may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n and_o upon_o verdict_n for_o he_o or_o nonsuit_n of_o the_o plaintiff_n shall_v recover_v his_o treble_n cost_v the_o end_n
it_o be_v hereby_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o peer_n of_o the_o realm_n prelate_n or_o other_o person_n express_v in_o the_o statute_n of_o 2_o ri._n 2._o entitle_v the_o penalty_n for_o tell_v of_o slanderous_a lie_n of_o the_o great_a man_n of_o the_o realm_n or_o any_o baron_n of_o the_o exchequer_n upon_o commit_v any_o such_o offence_n of_o profane_a swear_v or_o curse_v as_o aforesaid_a shall_v refuse_v to_o pay_v the_o penalty_n thereby_o forfeit_v be_v demand_v as_o aforesaid_a the_o justice_n of_o the_o peace_n before_o who_o such_o information_n shall_v be_v give_v shall_v cause_v a_o copy_n of_o the_o say_a information_n to_o be_v deliver_v to_o the_o say_a offender_n his_o lady_n or_o steward_n and_o shall_v bind_v over_o the_o witness_n and_o witness_n to_o prosecute_v and_o give_v evidence_n of_o the_o say_a offence_n demand_v and_o refusal_n at_o the_o next_o gaol-delivery_n or_o oyer_n and_o terminer_n to_o be_v hold_v for_o the_o county_n or_o division_n where_o such_o offender_n have_v notice_n as_o aforesaid_a shall_v be_v oblige_v to_o appear_v and_o travers_n his_o endictment_n and_o in_o case_n he_o shall_v not_o appear_v or_o upon_o his_o appearance_n and_o travers_n shall_v be_v find_v guilty_a he_o shall_v incur_v the_o several_a disability_n hereafter_o mention_v and_o forfeit_v the_o sum_n of_o twenty_o pound_n one_o moiety_n to_o the_o king_n and_o queen_n and_o the_o other_o to_o the_o prosecutor_n or_o prosecutor_n and_o because_o it_o may_v be_v fear_v that_o perjury_n be_v often_o commit_v in_o this_o nation_n by_o the_o neglect_n of_o officer_n and_o person_n swear_v to_o the_o due_a performance_n of_o their_o office_n place_n and_o employment_n or_o duty_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a for_o the_o prevent_v the_o like_a for_o the_o future_a that_o every_o wilful_a neglect_n after_o the_o 24_o day_n of_o june_n next_o of_o any_o officer_n or_o other_o person_n due_o swear_v to_o the_o performance_n of_o any_o office_n place_n employment_n or_o duty_n in_o the_o due_a performance_n thereof_o shall_v be_v deem_v and_o adjudge_v perjury_n and_o be_v prosecute_v and_o punish_v as_o other_o perjury_n by_o the_o law_n of_o this_o land_n and_o for_o the_o more_o effectual_a execution_n of_o the_o statute_n heretofore_o make_v for_o the_o reformation_n of_o sundry_a abuse_n and_o better_a observation_n of_o the_o lord_n day_n commanly_a call_v sunday_n 7._o 3_o car._n 1_o c._n 2_o 29_o car._n 2._o c_o 7._o be_v it_o likewise_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o constable_n tythingman_n headborough_n church_n warden_n and_o overseer_n of_o the_o poor_a and_o other_o officer_n in_o their_o respective_a parish_n may_v and_o be_v hereby_o authorize_v and_o require_v upon_o notice_n of_o any_o offence_n contrary_a to_o the_o say_a statute_n or_o either_o of_o they_o
