sixty_o and_o although_o in_o this_o confirmation_n of_o judicial_a proceed_n usurp_v the_o late_a government_n declare_v to_o be_v usurp_v it_o be_v necessary_a to_o mention_v divers_a pretence_a act_n and_o ordinance_n by_o the_o name_n and_o style_n which_o those_o person_n then_o usurp_v who_o take_v upon_o they_o to_o pass_v the_o same_o namely_o some_o by_o the_o style_n and_o name_n of_o the_o keeper_n of_o the_o liberty_n of_o england_n by_o authority_n of_o parliament_n and_o other_o by_o the_o name_n and_o style_n of_o protector_n of_o the_o commonwealth_n of_o england_n scotland_n and_o ireland_n and_o the_o dominion_n and_o territory_n thereunto_o belong_v yet_o this_o present_a parliament_n do_v declare_v and_o it_o be_v further_o enact_v by_o authority_n of_o the_o same_o that_o the_o name_n and_o style_v aforesaid_a and_o every_o of_o they_o be_v most_o rebellious_a wicked_a traitorous_a and_o abominable_a usurpation_n detest_a by_o this_o present_a parliament_n offend_v to_o gaol_n till_o the_o next_o session_n there_o to_o be_v indict_v and_o proceed_v against_o for_o the_o same_o and_o that_o the_o officer_n and_o inhabitant_n of_o the_o village_n or_o parish_n where_o such_o offence_n shall_v happen_v shall_v be_v assistant_n therein_o and_o moreover_o the_o party_n grieve_v shall_v have_v his_o action_n or_o action_n against_o such_o offender_n or_o offender_n and_o therein_o recover_v his_o treble_a damage_n and_o treble_a cost_n in_o which_o action_n no_o essoin_fw-fr wager_n of_o law_n aid-prayer_n privilege_n protection_n imparlance_n injunction_n or_o order_n of_o restraint_n depend_v no_o action_n upon_o this_o statute_n to_o be_v stay_v but_o by_o order_n of_o the_o court_n where_o such_o action_n depend_v shall_v be_v grant_v or_o allow_v and_o if_o any_o person_n or_o person_n shall_v after_o notice_n give_v that_o the_o action_n depend_v be_v ground_v upon_o this_o statute_n cause_n or_o procure_v any_o action_n at_o the_o common_a law_n ground_v on_o this_o statute_n to_o be_v delay_v or_o stay_v before_o judgement_n by_o colour_n or_o mean_n of_o any_o order_n power_n warrant_v or_o authority_n save_v only_o of_o the_o court_n where_o such_o action_n shall_v be_v bring_v and_o depend_v or_o after_o judgement_n have_v upon_o such_o action_n shall_v cause_v or_o procure_v execution_n of_o such_o judgement_n that_o this_o act_n extend_v not_o to_o prejudice_v any_o of_o his_o majesty_n right_n title_n or_o duty_n of_o in_o or_o to_o or_o out_o of_o any_o tin_n in_o the_o stannary_n of_o devon_n and_o recompense_n to_o his_o majesty_n for_o the_o court_n of_o ward_n and_o purveyance_n and_o now_o to_o the_o intent_n and_o purpose_n that_o his_o majesty_n his_o heir_n and_o successor_n may_v receive_v a_o full_a and_o ample_a recompense_n and_o satisfaction_n as_o well_o for_o the_o profit_n of_o the_o say_a court_n of_o ward_n and_o the_o tenor_n wardship_n livery_n primer-seizins_a by_o the_o common_a brewer_n or_o by_o such_o other_o person_n or_o person_n respective_o and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n one_o shilling_n three_o penny_n xv._o by_o the_o retayler_n thereof_o and_o so_o proportionable_o for_o a_o great_a or_o lesser_a measure_n one_o shilling_n three_o penny_n xv._o d._n for_o all_o metheglin_n or_o mead_n sell_v whether_o by_o retail_n or_o otherwise_o to_o be_v pay_v by_o the_o maker_n thereof_o upon_o every_o gallon_n one_o halfpenny_n ob._n for_o every_o barrel_n of_o beer_n common_o call_v vinegar-beer_n brew_v of_o wine_n or_o cider_n import_v two_o penny_n ij_o d._n for_o every_o gallon_n of_o strong-water_n perfect_o make_v import_v from_o beyond_o the_o sea_n four_o penny_n iiij_o d._n for_o every_o gallon_n of_o coffee_n make_v and_o sell_v to_o be_v pay_v by_o the_o maker_n four_o penny_n iiij_o d._n for_o every_o gallon_n of_o chocolatte_n sherbet_n and_o tea_n make_v and_o sell_v to_o be_v pay_v by_o the_o maker_n thereof_o eight_o penny_n viij_o d._n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o several_a rate_n land_v rate_n of_o excise_n upon_o foreign_a liquor_n import_v to_o be_v pay_v in_o money_n before_o land_v duty_n and_o charge_n of_o excise_n or_o new_a impost_n above_o mention_v hereby_o set_v or_o impose_v upon_o all_o and_o every_o the_o say_v foreign_a liquor_n which_o shall_v be_v import_v or_o bring_v into_o all_o or_o any_o the_o port_n of_o this_o kingdom_n and_o dominion_n thereof_o aforesaid_a from_o and_o after_o the_o five_o and_o twenty_o day_n of_o december_n next_o shall_v be_v from_o time_n to_o time_n satisfy_v and_o pay_v by_o the_o merchant_n or_o merchant_n importer_n or_o importer_n of_o the_o same_o in_o ready_a money_n upon_o his_o or_o their_o entry_n or_o entry_n make_v and_o before_o the_o land_n thereof_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a etc._n entry_n to_o be_v make_v at_o the_o office_n of_o excise_n by_o common_a brewer_n innkeeper_n etc._n etc._n that_o all_o common_a brewer_n of_o béer_n and_o ale_n shall_v once_o in_o every_o wéek_v and_o all_o inn-kéepers_a alehouse-kéepers_a victualler_n and_o other_o retayler_n of_o béer_n ale_n cider_n perry_n metheglin_n or_o strong-water_n brew_v make_v or_o retail_v the_o same_o shall_v once_o in_o every_o month_n make_v true_a and_o particular_a entry_n at_o the_o office_n of_o excise_n within_o the_o limit_n of_o which_o the_o say_a commodity_n and_o manufacture_n be_v make_v of_o all_o béer_n ale_n perry_n cider_n metheglin_n strong-water_n or_o other_o the_o liquor_n aforesaid_a which_o they_o or_o any_o of_o they_o shall_v brew_n make_v or_o retail_n in_o that_o wéek_v and_o month_n respective_o as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o common_a brewer_n entry_n the_o penalty_n for_o not_o make_v entry_n who_o do_v not_o once_o a_o wéek_v make_v due_a and_o particular_a entry_n shall_v forfeit_v ten_o pound_n and_o that_o every_o such_o inn-kéepe_a who_o do_v not_o make_v true_a and_o particular_a entry_n once_o a_o month_n shall_v forfeit_v five_o pound_n and_o that_o every_o alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o do_v not_o once_o a_o month_n make_v due_a and_o particular_a entry_n shall_v forfeit_v twenty_o shilling_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o common_a brewer_n pay_v the_o penalty_n for_o not_o pay_v who_o shall_v not_o pay_v and_o clear_v off_o
shall_v cause_v to_o be_v proclaim_v in_o the_o market_n town_n next_o to_o such_o place_n etc._n penalty_n for_o take_v more_o than_o limit_v for_o lodging_n etc._n etc._n and_o in_o such_o of_o the_o neighbour_a town_n and_o village_n as_o to_o they_o shall_v seem_v meet_a to_o the_o end_n that_o notice_n may_v be_v take_v of_o such_o rate_n and_o price_n and_o if_o any_o person_n shall_v take_v any_o other_o sum_n then_o what_o be_v or_o shall_v be_v so_o limit_v either_o for_o lodging_n horse-meat_n stable-room_n or_o other_o such_o accommodation_n and_o be_v thereof_o convict_v by_o confession_n of_o the_o party_n or_o by_o the_o oath_n of_o one_o credible_a witness_n before_o any_o one_o justice_n of_o the_o peace_n which_o oath_n the_o say_a justice_n of_o the_o peace_n be_v hereby_o authorize_v to_o administer_v that_o then_o in_o such_o case_n every_o person_n so_o offend_v shall_v forfeit_v and_o pay_v to_o the_o party_n grieve_v the_o sum_n of_o forty_o shilling_n
