this_o nature_n but_o only_o upon_o such_o as_o shall_v there_o sue_v upon_o contract_n make_v at_o land_n of_o or_o concern_v thing_n do_v or_o to_o be_v do_v or_o perform_v at_o land_n and_o hereof_o you_o shall_v have_v further_a confirmation_n by_o consulation_n grant_v at_o the_o common_a law_n upon_o prohibition_n from_o thence_o upon_o false_a suggestion_n issue_v chap._n ix_o that_o by_o consultation_n grant_v from_o the_o court_n of_o common-law_n at_o westminster_n after_o prohibition_n former_o from_o thence_o obtain_v contract_v make_v at_o land_n of_o and_o concern_v maritime_a business_n to_o be_v agitate_a and_o transact_v at_o sea_n beyond_o the_o sea_n or_o upon_o the_o port_n and_o havens_n or_o of_o or_o concern_v the_o same_o be_v acknowledge_v to_o be_v cognizable_a in_o the_o admiralty_n and_o have_v be_v thereunto_o by_o the_o same_o remit_v i_o shall_v here_o proceed_v to_o show_v that_o the_o maritime_a contract_n whereof_o i_o have_v hitherto_o treat_v in_o this_o three_o book_n of_o this_o treatise_n and_o particular_o express_v in_o the_o title_n of_o this_o chapter_n have_v be_v by_o consultation_n out_o of_o the_o court_n of_o common-law_n at_o westminster_n after_o prohibition_n from_o thence_o obtain_v determine_v and_o adjudge_v to_o belong_v unto_o the_o admiralty_n one_o robert_n baker_n of_o the_o city_n of_o london_n vintner_n sue_v one_o john_n maynard_n in_o the_o admiralty_n court_n upon_o a_o contract_n make_v at_o land_n of_o and_o concern_v a_o thing_n do_v upon_o the_o sea_n as_o by_o the_o consultation_n itself_o do_v appear_v but_o one_o john_n gilbert_n esquire_n be_v bail_n for_o the_o say_v maynard_n endeavour_v to_o decline_v the_o cognizance_n of_o that_o
for_o certain_a judgement_n thereof_o be_v give_v for_o the_o mariner_n berry_n chief_a justice_n of_o the_o common-plea_n the_o king_n will_v that_o the_o peace_n be_v as_o well_o keep_v on_o the_o sea_n as_o on_o the_o land_n and_o we_o find_v that_o you_o be_v come_v hither_o by_o due-process_n and_o therefore_o rule_v he_o to_o answer_v out_o of_o which_o the_o author_n observe_v four_o thing_n 1._o that_o it_o be_v call_v the_o sea_n which_o be_v not_o within_o any_o county_n from_o whence_o a_o jury_n may_v come_v 2._o that_o the_o sea_n be_v not_o within_o any_o county_n be_v not_o within_o the_o jurisdiction_n of_o the_o court_n of_o common-plea_n but_o belong_v to_o the_o admiral_n jurisdiction_n 3._o that_o when_o the_o ship_n come_v within_o the_o river_n than_o it_o be_v confess_v to_o be_v within_o the_o county_n of_o northumberland_n 4._o that_o when_o a_o take_n be_v partly_o on_o the_o sea_n and_o partly_o in_o a_o river_n the_o common_a law_n shall_v have_v jurisdiction_n for_o the_o first_o observation_n which_o be_v that_o that_o be_v call_v sea_n which_o be_v not_o in_o any_o county_n from_o whence_o a_o jury_n may_v come_v i_o may_v very_o well_o grant_v it_o and_o he_o yet_o never_o the_o near_o the_o proof_n of_o that_o he_o aim_v at_o viz._n that_o a_o port_n or_o haven_n be_v within_o any_o county_n out_o of_o which_o a_o jury_n may_v come_v which_o be_v absolute_o deny_v the_o reason_n whereof_o as_o 2._o before_z so_o shall_v be_v hereafter_o show_v for_o his_o second_o observation_n that_o the_o sea_n not_o be_v in_o any_o the_o jurisdiction_n of_o the_o common_a law_n as_o any_o that_o he_o have_v use_v to_o prove_v the_o port_n and_o havens_n to_o be_v within_o the_o body_n of_o county_n and_o out_o of_o the_o jurisdiction_n of_o the_o admiralty_n for_o his_o three_o observation_n which_o be_v that_o when_o the_o ship_n come_v within_o the_o river_n it_o be_v confess_v to_o be_v within_o the_o county_n of_o northumberland_n i_o conceive_v if_o mutford_n may_v at_o the_o common_a law_n have_v plead_v two_o plea_n which_o in_o many_o case_n be_v necessary_a and_o allowable_a by_o the_o civil_a law_n he_o will_v as_o well_o have_v deny_v that_o ever_o he_o carry_v the_o ship_n into_o the_o county_n of_o northumberland_n as_o he_o do_v aver_v that_o he_o take_v she_o upon_o the_o sea_n and_o silence_n be_v not_o a_o consent_n or_o confession_n where_o a_o man_n be_v tie_v to_o one_o plea_n and_o have_v divers_a to_o plead_v this_o therefore_o be_v neither_o confess_v by_o mutford_n or_o any_o else_o but_o by_o the_o author_n himself_o and_o such_o as_o be_v of_o his_o party_n for_o berry_n neither_o affirm_v nor_o determine_v any_o such_o thing_n or_o cause_v he_o to_o answer_v upon_o any_o such_o ground_n but_o upon_o this_o ground_n that_o the_o king_n will_v the_o peace_n to_o be_v keep_v as_o well_o on_o the_o sea_n as_o on_o the_o land_n and_o indeed_o the_o ground_n be_v both_o keep_v alike_o to_o sound_v the_o cognizance_n of_o this_o cause_n in_o the_o court_n of_o common-plea_n whereas_o the_o king_n that_o will_v the_o peace_n to_o be_v keep_v as_o well_o on_o the_o sea_n as_o on_o the_o land_n have_v provide_v institute_v and_o appoint_v from_o ancient_a and_o far_o pass_v time_n distinct_a judge_n justice_n and_o officer_n for_o the_o keep_n thereof_o on_o the_o one_o hand_n and_o on_o the_o other_o the_o admiral_n his_o deputy_n and_o other_o justice_n with_o he_o appoint_a for_o the_o keep_n thereof_o upon_o the_o sea_n and_o the_o judge_n of_o the_o land_n and_o other_o justice_n with_o they_o appoint_v for_o the_o keep_n thereof_o upon_o the_o land_n and_o neither_o have_v to_o do_v with_o the_o other_o jurisdiction_n so_o that_o i_o can_v conceive_v nor_o can_v i_o grant_v chief_a justice_n berry_v ground_n whereon_o he_o found_v this_o replevin_n and_o the_o take_v this_o cause_n into_o cognizance_n to_o be_v terra_fw-la firma_fw-la and_o as_o for_o that_o which_o sir_n edward_n coke_n will_v have_v to_o be_v the_o ground_n of_o this_o replevin_n and_o cognition_n of_o this_o cause_n namely_o because_o after_o she_o be_v take_v at_o sea_n she_o be_v carry_v into_o a_o port_n or_o haven_n which_o he_o account_v to_o be_v within_o the_o body_n of_o a_o county_n if_o this_o shall_v be_v allow_v for_o a_o good_a ground_n then_o must_v all_o reprizal_n take_v at_o sea_n by_o letter_n of_o marque_n and_o bring_v into_o the_o port_n and_o haven_n be_v exempt_v from_o their_o condemnation_n in_o the_o admiralty_n court_n for_o lawful_a prize_n and_o may_v be_v set_v free_a by_o a_o replevin_n grant_v from_o the_o common_a law_n and_o whatsoever_o fact_n do_v upon_o the_o sea_n either_o by_o ship_n or_o man_n the_o ship_n or_o man_n repair_v to_o port_n or_o haven_n justice_n must_v be_v have_v against_o they_o from_o the_o common_a law_n so_o that_o by_o this_o construction_n the_o admiral_n shall_v have_v no_o cognizance_n of_o piracy_n robbery_n etc._n etc._n commit_v at_o sea_n either_o by_o the_o course_n of_o the_o civil_a law_n or_o by_o the_o course_n of_o the_o law_n of_o the_o land_n upon_o the_o before_o mention_v statute_n of_o hen._n 8._o but_o if_o the_o pirate_n or_o robber_n etc._n etc._n shall_v escape_v and_o bring_v that_o which_o they_o have_v steal_v or_o by_o violence_n take_v away_o etc._n etc._n into_o any_o port_n or_o haven_n or_o to_o land_n this_o piracy_n robbery_n etc._n etc._n shall_v be_v try_v at_o the_o common_a law_n and_o as_o well_o may_v it_o be_v say_v that_o if_o they_o shall_v be_v take_v upon_o the_o sea_n and_o afterward_o be_v bring_v into_o any_o port_n or_o haven_n or_o to_o land_n that_o then_o the_o admiral_n jurisdiction_n cease_v and_o the_o trial_n belong_v to_o the_o common_a law_n so_o that_o the_o admiral_n must_v go_v set_v up_o his_o tribunal_n upon_o the_o high_a sea_n as_o sir_n ed._n coke_n distinguish_v they_o if_o he_o will_v have_v any_o jurisdiction_n at_o all_o and_o whatsoever_o injury_n shall_v happen_v to_o be_v do_v at_o sea_n by_o one_o ship_n unto_o another_o the_o ship_n which_o do_v the_o injury_n by_o repair_v to_o her_o port_n or_o haven_n shall_v free_v herself_o from_o the_o judgement_n of_o the_o admiralty_n court_n etc._n etc._n and_o the_o common_a law_n shall_v free_v the_o judge_n of_o the_o admiralty_n and_o all_o the_o officer_n belong_v to_o that_o court_n from_o any_o further_a attendance_n there_o which_o doubtless_o be_v the_o aim_n of_o the_o author_n as_o will_v plain_o appear_v when_o i_o shall_v come_v to_o sum_n up_o all_o he_o will_v have_v and_o i_o wish_v it_o be_v not_o the_o aim_n of_o a_o great_a many_o still_o who_o aim_n for_o their_o own_o end_n must_v necessary_o be_v destructive_a to_o a_o general_a good_a as_o shall_v be_v likewise_o hereafter_o show_v for_o the_o four_o observation_n which_o be_v that_o when_o a_o take_n be_v partly_o on_o the_o sea_n and_o partly_o in_o a_o river_n the_o common_a law_n shall_v have_v the_o jurisdiction_n for_o this_o partly_o take_v on_o the_o sea_n and_o partly_o on_o the_o river_n i_o must_v confess_v i_o know_v not_o how_o it_o can_v be_v for_o a_o ship_n be_v either_o take_v or_o not_o take_v when_o she_o be_v take_v at_o sea_n or_o take_v or_o not_o take_v when_o she_o be_v take_v upon_o the_o river_n unless_o we_o can_v say_v that_o one_o part_n of_o the_o ship_n be_v upon_o the_o sea_n and_o the_o other_o part_n of_o she_o upon_o the_o river_n at_o the_o very_a instant_a time_n of_o her_o take_n but_o if_o the_o jurisdiction_n of_o the_o admiralty_n may_v have_v its_o right_a we_o shall_v have_v no_o need_n of_o a_o mathematitian_n to_o strike_v a_o line_n between_o the_o sea_n and_o the_o river_n to_o make_v the_o distinction_n for_o indeed_o this_o distinction_n will_v be_v altogether_o needless_a but_o this_o observation_n have_v relation_n to_o the_o matter_n of_o fact_n from_o whence_o it_o be_v draw_v this_o meaning_n of_o take_v partly_o on_o the_o sea_n and_o partly_o on_o the_o river_n must_v be_v that_o a_o ship_n be_v so_o take_v when_o she_o be_v first_o take_v at_o sea_n and_o
