2._o a_o distress_n take_v for_o the_o knight_n fee_n of_o the_o parliament_n be_v sell_v therefore_o now_o let_v we_o see_v and_o examine_v well_o by_o what_o authority_n our_o officer_n of_o sewer_n may_v sell_v the_o distress_n take_v the_o word_n in_o our_o statute_n which_o be_v most_o powerful_a in_o this_o point_n be_v these_o viz._n to_o depute_v and_o assign_v diligent_a faithful_a and_o true_a keeper_n bailiff_n surveyor_n collector_n expenditor_n and_o other_o officer_n for_o the_o safety_n conservation_n reparation_n and_o make_v repair_a reform_v and_o amend_v of_o the_o premise_n replevin_n which_o our_o statute_n aim_v to_o give_v way_n to_o be_v intend_v to_o be_v take_v out_o of_o the_o king_n court_n which_o in_o law_n and_o justice_n ought_v to_o be_v obey_v and_o not_o from_o the_o sheriff_n or_o his_o officer_n by_o virtue_n of_o their_o office_n only_o but_o in_o my_o case_n the_o commissioner_n make_v a_o law_n that_o the_o good_n of_o a._n shall_v be_v sell_v therefore_o now_o to_o proceed_v to_o the_o six_o point_n which_o concern_v charge_n and_o sale_n of_o land_n to_o be_v make_v by_o the_o commissioner_n of_o sewer_n by_o the_o power_n and_o authority_n of_o this_o law_n and_o first_o i_o suppose_v the_o question_n may_v be_v extend_v to_o this_o that_o be_v whether_o the_o commissioner_n of_o sewer_n can_v impose_v a_o perpetual_a by_o the_o colour_n of_o the_o general_a power_n of_o this_o court_n if_o a._n b._n have_v a_o several_a pischary_n in_o the_o river_n of_o witham_n which_o be_v a_o river_n within_o the_o commission_n of_o sewer_n and_o the_o say_v pischary_a by_o these_o law_n be_v chargeable_a to_o the_o repair_v thereof_o if_o c._n d._n disseiz_v he_o thereof_o or_o commit_v a_o trespass_n by_o
