whereupon_o it_o follow_v that_o the_o ecclesiastical_a judge_n here_o in_o england_n who_o have_v authority_n to_o hear_v cause_n of_o matrimony_n be_v the_o competent_a judge_n and_o have_v power_n to_o hear_v and_o determine_v this_o matter_n of_o the_o lawfullness_n or_o unlawfulness_n of_o the_o lady_n marriage_n and_o the_o rather_o for_o that_o the_o lady_n marriage_n which_o be_v the_o principal_a matter_n in_o question_n be_v make_v and_o solemnize_v here_o in_o england_n if_o it_o be_v object_v that_o because_o that_o point_n whereupon_o the_o validity_n or_o invalidity_n of_o the_o lady_n kennedy_n marriage_n depend_v viz._n the_o marriage_n between_o sir_n john_n and_o isabel_n kennedy_n be_v already_o adjudge_v by_o a_o definitive_a sentence_n long_o since_o from_o which_o there_o have_v be_v no_o appeal_n or_o provocation_n and_o therefore_o it_o must_v bar_n the_o lady_n we_o answer_v that_o although_o in_o cause_n of_o other_o nature_n where_o no_o danger_n of_o sin_n may_v ensue_v though_o the_o sentence_n be_v against_o the_o truth_n if_o a_o sentence_n be_v once_o lawful_o give_v and_o not_o appeal_v from_o in_o due_a time_n the_o matter_n can_v be_v cause_n where_o no_o fear_n be_v of_o sin_n or_o peril_n of_o soul_n to_o ensue_v the_o party_n may_v by_o their_o agreement_n make_v what_o end_n of_o the_o business_n they_o list_v by_o composition_n or_o otherwise_o and_o therefore_o if_o they_o do_v not_o appeal_v from_o the_o sentence_n give_v against_o they_o they_o be_v think_v by_o their_o consent_n to_o confirm_v the_o same_o but_o because_o a_o marriage_n by_o god_n law_n can_v be_v dissolve_v by_o the_o agreement_n or_o consent_n of_o the_o party_n no_o sentence_n therein_o give_v against_o a_o marriage_n contrary_a to_o the_o truth_n by_o error_n can_v by_o the_o party_n agreement_n be_v confirm_v lest_o if_o it_o shall_v be_v otherwise_o thereby_o they_o may_v by_o colour_n of_o the_o erroneous_a sentence_n marry_v other_o person_n and_o live_v in_o adultery_n nay_o more_o if_o the_o party_n themselves_o thus_o erroneous_o divorce_v contrary_a to_o the_o truth_n will_v hold_v themselves_o content_v with_o the_o sentence_n if_o either_o of_o they_o marry_v any_o other_o person_n or_o they_o both_o live_v incontinent_o with_o other_o person_n the_o judge_n of_o that_o place_n where_o they_o inhabit_v may_v and_o aught_o of_o his_o own_o office_n to_o enforce_v the_o party_n so_o by_o error_n divorce_v to_o live_v together_o again_o

for_o the_o truth_n of_o this_o we_o have_v a_o evident_a and_o authentic_a instance_n it_o be_v most_o certain_a that_o god_n almighty_n be_v a_o absolute_a king_n of_o all_o the_o world_n yet_o for_o the_o comfort_n of_o his_o people_n he_o have_v limit_v himself_o by_o oath_n and_o promise_n so_o the_o apostle_n tell_v we_o that_o by_o two_o immutable_a thing_n 18._o in_o which_o it_o be_v impossible_a for_o god_n to_o lie_v we_o may_v have_v strong_a consolation_n these_o thing_n premise_v concern_v the_o great_a power_n of_o our_o king_n that_o it_o be_v monarchical_a supreme_a and_o absolute_a the_o query_n be_v whether_o they_o can_v and_o lawful_o may_v either_o 1._o reprieve_n 2._o or_o pardon_v a_o person_n condemn_v for_o murder_n now_o it_o be_v a_o certain_a rule_n in_o law_n and_o reason_n that_o omne_fw-la illicitum_fw-la est_fw-la ex_fw-la lege_fw-la aliqua_fw-la illicitum_fw-la sin_n be_v the_o transgression_n of_o a_o law_n 4_o and_o where_o there_o be_v no_o law_n 15._o there_o be_v no_o transgression_n if_o then_o such_o reprieve_n or_o pardon_v be_v unlawful_a and_o may_v not_o be_v grant_v by_o the_o king_n of_o england_n than_o it_o must_v be_v so_o or_o present_a business_n to_o determine_v the_o case_n by_o humane_a law_n that_o which_o be_v desire_v of_o i_o be_v this_o whether_o the_o reprieve_n or_o pardon_n of_o a_o person_n legal_o
