notwithstanding_o and_o in_o regard_n a_o certain_a sect_n call_v quaker_n and_o other_o sectary_n 1._o person_n serve_v with_o process_n refuse_v to_o take_v a_o oath_n 14_o car._n 2._o cap._n 1._o person_n be_v due_o and_o legal_o serve_v with_o process_n or_o other_o summons_n to_o appear_v in_o any_o court_n of_o record_n except_o courts-léet_a as_o a_o witness_n or_o return_v to_o serve_v of_o any_o jury_n or_o order_v to_o be_v examine_v upon_o interrogatory_n or_o be_v present_a in_o court_n shall_v refuse_v to_o take_v any_o judicial_a oath_n legal_o tender_v to_o he_o by_o the_o judge_n or_o judge_n of_o the_o same_o court_n have_v no_o legal_a plea_n to_o justify_v or_o excuse_v the_o refusal_n of_o the_o same_o oath_n or_o if_o any_o person_n or_o person_n be_v due_o to_o be_v unlawful_a nor_o refuse_v to_o take_v aâ—_n oath_n on_o that_o account_n which_o oath_n the_o respective_a court_n and_o court_n aforesaid_a be_v hereby_o authorize_v and_o require_v and_o if_o need_v require_v the_o make_n of_o a_o new_a haven_n may_v with_o god_n blessing_n be_v of_o great_a advantage_n and_o benefit_n not_o only_o to_o the_o say_a county_n but_o also_o to_o the_o public_a by_o import_n and_o export_n of_o commodity_n and_o increase_v of_o commerce_n and_o trade_n and_o of_o able_a seaman_n and_o waterman_n and_o most_o profitable_a and_o necessary_a for_o the_o say_a city_n of_o new-sarum_n for_o the_o conveyance_n thereby_o of_o fuel_n and_o other_o necessary_n to_o the_o say_a city_n whereof_o there_o be_v now_o great_a scarcity_n and_o far_o great_a be_v like_a to_o grow_v if_o some_o help_n therefore_o be_v not_o provide_v beside_o the_o extraordinary_a preservation_n of_o the_o highway_n in_o and_o near_o the_o say_a city_n and_o county_n navigable_a commissioner_n how_o to_o be_v appoint_v for_o make_v the_o river_n avon_n navigable_a be_v it_o therefore_o enact_v by_o the_o king_n majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o lord_n chancellor_n or_o lord_n keeper_n of_o the_o great_a seal_n of_o england_n for_o the_o time_n be_v at_o any_o time_n after_o the_o end_n of_o this_o present_a session_n of_o parliament_n shall_v and_o may_v nominate_v appoint_v and_o authorise_v by_o commission_n under_o the_o great_a seal_n of_o england_n such_o person_n or_o person_n body_n politic_a and_o corporate_a as_o to_o he_o shall_v seem_v fit_a and_o be_v willing_a to_o undertake_v the_o make_n navigable_a the_o say_a river_n of_o avon_n from_o the_o say_a town_n of_o christ-church_n to_o the_o say_a city_n of_o new-sarum_n and_o to_o make_v a_o new_a haven_n if_o need_v require_v for_o ship_n and_o vessel_n near_o the_o say_a town_n of_o christ-church_n which_o say_v undertaker_n so_o nominate_v and_o appoint_v as_o aforesaid_a be_v hereby_o authorize_v and_o shall_v have_v full_a power_n and_o authority_n by_o this_o present_a act_n to_o make_v navigable_a or_o passable_a by_o barge_n boat_n lighter_n or_o other_o vessel_n the_o say_a river_n of_o avon_n from_o the_o say_a town_n of_o christ-church_n to_o the_o city_n of_o new-sarum_n aforesaid_a and_o for_o that_o purpose_n to_o cleanse_v scour_v and_o open_v the_o same_o and_o to_o cut_v or_o dig_v the_o bank_n of_o the_o same_o and_o to_o take_v away_o or_o remove_v all_o wear_v or_o other_o impediment_n that_o may_v hinder_v navigation_n either_o in_o sail_v or_o hale_v of_o boat_n with_o horse_n man_n or_o otherwise_o to_o amend_v or_o alter_v such_o bridge_n and_o highway_n as_o may_v hinder_v the_o say_v passage_n and_o navigation_n and_o to_o open_v prepare_v and_o make_v all_o wear_v sass_n lock_n and_o turn-pike_n fit_a for_o the_o say_a passage_n and_o likewise_o to_o cleanse_v scour_v open_a or_o cut_v and_o dig_v the_o bank_n of_o any_o other_o stream_n brook_n ditch_n or_o watercourse_n that_o shall_v to_o they_o seem_v convenient_a for_o the_o better_a make_v the_o say_a river_n navigable_a and_o passable_a for_o boat_n barge_n lighter_n and_o other_o vessel_n and_o likewise_o to_o make_v and_o erect_v any_o wharf_n sass_n lock_n turnpike_n or_o pen_n for_o water_n in_o or_o near_o the_o say_a river_n or_o passage_n that_o shall_v be_v fit_a or_o necessary_a for_o the_o same_o and_o to_o bring_v lay_v and_o work_v all_o material_n requisite_a for_o the_o make_n erect_v and_o repair_v of_o the_o say_a lock_n or_o turnpike_n upon_o the_o say_a river_n or_o passage_n and_o to_o cut_v such_o and_o so_o many_o new_a channel_n and_o trench_n as_o to_o they_o shall_v seem_v convenient_a for_o alter_v the_o course_n of_o the_o say_a river_n of_o avon_n in_o bring_v the_o same_o to_o the_o city_n of_o new-sarum_n as_o aforesaid_a as_o also_o for_o the_o bring_n in_o any_o other_o river_n or_o watercourse_n into_o the_o say_a river_n and_o to_o do_v all_o other_o thing_n necessary_a and_o convenient_a for_o the_o say_a river_n and_o passage_n new_a channel_n wharf_n sass_n lock_n wear_v turnpike_n penn_n for_o water_n and_o the_o say_a bridge_n way_n and_o passage_n and_o for_o the_o alter_n repair_a keep_v use_v and_o amend_v of_o the_o same_o or_o any_o of_o they_o or_o any_o part_n of_o they_o from_o time_n to_o time_n hereafter_o as_o oft_o as_o need_v shall_v require_v and_o also_o if_o need_v require_v to_o make_v a_o commodious_a haven_n and_o port_n near_o the_o say_a town_n of_o christ-church_n for_o the_o entry_n
therefore_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o of_o the_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o justice_n of_o the_o court_n of_o king_n bench_n and_o common_a plea_n etc._n justice_n appoint_v to_o hear_v and_o determine_v difference_n between_o landlord_n and_o tenant_n etc._n etc._n and_o the_o baron_n of_o the_o coif_n of_o the_o exchequer_n for_o the_o time_n be_v or_o any_o three_o rent_n only_o due_a before_o the_o first_o day_n of_o september_n one_o thousand_o six_o hundred_o sixty_o and_o six_o or_o for_o or_o touch_v any_o covenant_n condition_n or_o penalty_n relate_v thereunto_o or_o for_o touch_v or_o concern_v the_o prefix_v or_o limit_v of_o any_o time_n for_o such_o repair_v or_o new_a building_n rebuilding_n or_o any_o rate_n or_o contribution_n to_o be_v order_n according_a to_o the_o tenor_n thereof_o shall_v be_v obey_v by_o all_o person_n concern_v therein_o respective_o and_o shall_v conclude_v and_o bind_v they_o their_o heir_n successor_n executor_n administrator_n and_o assign_v respective_o notwithstanding_o any_o disability_n in_o respect_n of_o coverture_n infancy_n nonsanity_n of_o memory_n estate_n tail_n or_o in_o right_n of_o the_o church_n or_o otherwise_o and_o that_o infant_n feme_v covert_a idiot_n person_n of_o non-sane_a memory_n or_o beyond_o the_o sea_n tenant_n in_o tail_n bishop_n dean_n and_o chapter_n and_o other_o ecclesiastical_a person_n and_o their_o successor_n corporation_n and_o all_o other_o person_n or_o person_n body_n natural_a and_o politic_a their_o heir_n and_o successor_n and_o their_o respective_a interest_n shall_v be_v bind_v and_o conclude_v by_o such_o respective_a order_n or_o order_n according_a to_o the_o tenor_n or_o purport_n thereof_o any_o law_n statute_n or_o custom_n or_o other_o matter_n or_o thing_n to_o the_o contrary_a notwithstanding_o and_o for_o the_o better_a enable_v the_o say_a justice_n and_o baron_n to_o procee_v with_o effect_n in_o the_o say_a cause_n complaint_n how_o to_o proceed_v upon_o complaint_n be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a justice_n and_o baron_n or_o any_o three_o or_o more_o of_o they_o as_o aforesaid_a upon_o the_o complaint_n or_o request_n of_o any_o person_n or_o person_n concern_v in_o any_o of_o the_o say_a house_n or_o building_n and_o other_o the_o premise_n shall_v issue_v out_o note_n or_o warrant_n under_o their_o hand_n or_o the_o hand_n of_o any_o such_o three_o of_o they_o thereby_o warn_v the_o person_n or_o person_n body_n politic_a and_o corporate_a therein_o name_v and_o concern_v in_o the_o say_v late_a house_n or_o building_n and_o other_o the_o premise_n in_o such_o complaint_n mention_v to_o appear_v before_o they_o at_o such_o time_n and_o by_o the_o authority_n aforesaid_a that_o the_o say_a justice_n and_o baron_n or_o any_o three_o of_o they_o for_o the_o matter_n and_o according_a to_o the_o power_n herein_o before_o mention_v shall_v be_v and_o shall_v be_v take_v to_o be_v a_o court_n of_o record_n and_o that_o the_o judgement_n and_o determination_n that_o shall_v be_v make_v betwixt_o party_n and_o party_n by_o authority_n of_o this_o act_n shall_v be_v record_v in_o a_o book_n or_o book_n of_o parchment_n to_o be_v provide_v for_o that_o purpose_n and_o that_o every_o such_o judgement_n and_o determination_n shall_v be_v sign_v by_o three_o or_o more_o of_o the_o say_a justice_n or_o baron_n which_o say_v book_n or_o book_n of_o record_n shall_v be_v place_v and_o entrust_v in_o the_o custody_n of_o the_o lord_n mayor_n and_o alderman_n of_o the_o city_n of_o london_n for_o the_o time_n be_v to_o be_v keep_v with_o the_o record_n of_o the_o say_a city_n and_o to_o remain_v as_o a_o any_o thing_n contrary_a to_o the_o purport_n true_a intent_n and_o meaning_n of_o this_o law_n then_o he_o or_o they_o shall_v for_o such_o offence_n forfeit_v the_o sum_n of_o five_o hundred_o pound_n of_o lawful_a money_n of_o england_n unto_o any_o party_n grieve_v his_o executor_n or_o administrator_n who_o shall_v real_o prosecute_v for_o the_o same_o and_o first_o obtain_v judgement_n thereupon_o to_o be_v recover_v in_o any_o court_n of_o record_n at_o westminster_n by_o action_n of_o debt_n bill_n plaint_n or_o information_n wherein_o no_o essoin_fw-fr protection_n wager_n of_o gift_n grant_v conveyance_n or_o other_o disposition_n of_o any_o of_o his_o land_n tenement_n hereditament_n good_n or_o chattel_n or_o to_o take_v any_o benefit_n of_o any_o gift_n conveyance_n or_o of_o his_o liberty_n or_o suffer_v imprisonment_n upon_o demand_n or_o motion_n make_v by_o his_o counsel_n or_o other_o employ_v by_o he_o for_o that_o purpose_n unto_o the_o judge_n of_o the_o court_n of_o king_n bench_n or_o common_a plea_n in_o open_a court_n shall_v without_o delay_n upon_o any_o pretence_n whatsoever_o for_o the_o ordinary_a fee_n usual_o pay_v for_o the_o same_o have_v be_v impanel_v in_o manner_n and_o form_n aforesaid_a to_o judge_n and_o assess_v upon_o the_o owner_n and_o occupier_n of_o such_o house_n such_o competent_a sum_n or_o sum_n of_o money_n or_o receive_v shall_v be_v expend_v upon_o the_o purchase_n or_o re-building_n house_n on_o the_o other_o side_n the_o street_n and_o upon_o pave_v and_o amend_v of_o the_o way_n and_o street_n aforesaid_a according_a to_o the_o purport_n of_o this_o act._n and_o the_o say_a verdict_n of_o the_o jury_n and_o judgement_n of_o the_o commissioner_n in_o the_o case_n aforesaid_a shall_v be_v sufficient_a and_o conclusive_a in_o law_n to_o all_o intent_n and_o purpose_n against_o the_o say_a owner_n and_o occupier_n their_o heir_n executor_n administrator_n and_o assign_v act._n every_o any_o seven_o or_o more_o of_o they_o shall_v have_v power_n to_o administer_v due_a execution_n of_o all_o every_o or_o any_o the_o power_n or_o authority_n hereby_o give_v they_o &_o for_o the_o sit_v the_o place_n where_o the_o commissioner_n shall_v sit_v and_o determine_v the_o matter_n to_o they_o refer_v by_o this_o act_n shall_v from_o the_o 29_o of_o september_n to_o the_o 26_o day_n of_o march_n in_o every_o year_n be_v at_o the_o town_n of_o huntingdon_n and_o from_o the_o 25_o day_n of_o march_n till_o the_o 30_o day_n of_o september_n in_o every_o year_n be_v at_o ely_n unless_o the_o say_a commissioner_n hereby_o constitute_v or_o hereafter_o to_o be_v constitute_v as_o aforesaid_a or_o any_o seven_o or_o more_o of_o they_o shall_v appoint_v some_o other_o place_n or_o place_n be_v a_o market_n town_n or_o town_n and_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o shall_v by_o warrant_n under_o their_o hand_n and_o seal_n declare_v the_o place_n and_o time_n of_o their_o after-méeting_n which_o warrant_n shall_v be_v publish_v in_o the_o open_a market_n of_o such_o respective_a place_n where_o they_o last_o sit_v between_o the_o which_o he_o belong_v or_o procure_v the_o same_o to_o be_v do_v he_o shall_v suffer_v death_n as_o a_o felon_n act._n the_o continuance_n of_o this_o act._n provide_v that_o this_o act_n shall_v
